8:00 pm
a long time. some of you might remember the red vick movie house and it slowly lost business and we needed to close and because we really we owned the building really tried to think of what would be the best thing to do in the neighborhood. we have a hand out for you, and because we are part owners of a restaurant also, the restaurant will expand into the old red vic lobby and we are having a small market place with five tenants who are confirmed with the small food businesses and 49 seat event space, which we are hoping to really kind of revitalize and bring back people into the neighborhood. we have a tremendous amount of good will, we plan to show, you know, documentary movies with programs. and rent it out for private events and we have interest in
8:01 pm
live entertainment, meaning music, and comedy, and related things. we don't think that noise will be an issue. there is nobody above us, we are a one story building and we have restaurant on either side and a big backyard and alicia winterstein amount of good will in the neighborhood and support for this. >> thank you. >> and if you don't mind, just taking a seat and we can hear from any police comments on this? >> no. >> okay. >> that is fine. >> they submitted a letter of support in your packet. >> great. >> any questions for the applicants from the commissioners? >> or comments about what you think about it? >> no. >> okay. >> seeing... >> i do, i commend you for being so innovative. >> any other comments? >> all right we will go ahead and take the public comment on this, is there any public comment on second act? >> seeing none, public comment
8:02 pm
is closed. happy to take a motion. >> i move to approve. >> i second. >> okay. on the motion to approve the limited live performance permit. akers? >> aye. >> hyde. >> aye. >> lee. >> aye. >> campagnoli. >> aye. >> and president tan? >> aye. >> you have your permit. congratulations. >> good luck with that. it sounds great. >> so our next applicant, is actually human video game, which i think that we would like to continue? >> yes. >> so, if i could just entertain a motion to continue this until the next meeting? >> so moved. >> second? >> on the motion. >> a second first? >> second. >> got it. >> anxious. >> akers. >> aye. >> hyde. >> aye. >> joseph. ae. aye. >> lee. >> aye. >> tan. >> aye. >> campagnoli. >> aye.
8:03 pm
>> and third up is ronnie lau doing business as horizon and 498 broad way and i believe that they are asking for a bill ard permit and a mechanical device. >> i got to go. >> i am taking a break on this one. >> steve is stepping out. >> all right. >> go ahead. >> and so they have been out there on broad way for about 6 years. and no problems and they are asking to have the additional and want to add the pool table and three mechanical amusement devices. >> ronnie would you like to come up and say hello to us? >> good evening commissioners i am here today to apply and hopefully get approved for a billards as well as mechanical device and what we are looking to install are a few video game units like a miss pack man. >> mr. and police pacman. >> and obl the tais up and we
8:04 pm
have done the research on those and so we also want to install a few billard table to hold some local billard tournaments and so nothing too extreme and so you will hop to approve that. >> do you feel like you leave at this commission? >> i do. >> just checking. >> any commissioner comments or questions? >> no. >> all right, are there any police that would like to speak to this permit? >> officer methias? >> central station and just to voice our support for the applicant. and it is the things that we have been meeting with them and also, just talking about the diversity on broad way and not having the same business plan for every single business all along the broad way and so we are looking forward to this. and the only thing that we
8:05 pm
asked and we talked to ronnie lau about it, was as far as the amusement games and the video games that there not be any poke and her gambling machines and he was in complete agreement on that. and so we are at central station is recommending approval. >> great, thank you. >> any public comment about this permit application? >> seeing none, public comment is closed. commissioners? >> i move to approve. >> second. >> all right. >> on the motion to approve. >> commissioner akers? >> aye. >> commissioner hyde. >> aye. >> commissioner joseph. >> aye. >> commissioner campagnoli. >> aye. >> and tan. >> aye. >> could you signal steve, someone? >> and i think that someone will do it. >> let's just move on. and so, for the next applicant
8:06 pm
is sycamore tim ryan who would like to amend his limited live performance permit. >> as you may know, the limited live performance permit changed slightly in july and now it covers outdoor spaces when it came last year to get the limited live permit it did not include outdoor, it did have neighbors that had concerns and specifically asked that music not be outdoors. now, that the limited live does allow for outdoor use, he would like to see if that could be applied. so, the staff would do with it but because it expressly said on his permit not to have outdoor music that is why we are bringing it to you this time. >> great. >> thank you. >> is mr. ryan here? >> or someone representing mr. ryan? >> no.
8:07 pm
>> interesting. >> was he here earlier? >> i don't know. >> i know that he posted for ten days, so i guess that i will let him know to come back next time. >> it sounds like we need to take a motion to continue. >> i move to continue. >> i second that. >> and okay, commissioner akers on the motion? >> aye. >> commissioner ayed. >> aye. >> joseph. >> aye. >> hao*i. >> aye. >> campagnoli. >> aye. >> and president tan. >> aye. >> great. so, moving right along, we have martha banuelos doing business as ayutla on 2778, 24th street and we heard that you were at the last meeting and i think that we have the background and there are things that we need to clarify. >> there was clarifications that the commission requested to have evidence of a lease agreement and we have that and it should be in your packet and documents from the abc and i believe that they have those with them. and it looks like a lot of this
8:08 pm
has been cleared up. and so, i just wanted you to know that with the limited live performance permit and of all of the permits as of july 6th we are able to have bridge permits so when one business closes, and another one is in the process of applying, for a permit, we now can issue temporary permits and we did issue one after the last commission meeting just to get them to this meeting and during that time, i believe that they were to serve no alcohol, but they were allowed to have entertainment. >> great. thank you. >> martha, would you like to come up? >> thank you. >> hi. >> sorry. >> welcome back. >> if you want to just, make your case again or just summarize what you are here for? >> well, as you know from the last time, some of the allegations turned out to not
8:09 pm
be here and so we were able to clarify, and make sure that we are doing everything that the way that we are supposed to do it and we have not had any violation and we have never had a single incident of drunkenness and no incident of under aged drinking and no violence and nothing, and we enlded the shows at the time that we were supposed to and we only have the complaints from one person and so other than that, we had hundreds of signatures from our petition, and dozen and dozens of letters of support from supervisors and everyone. >> great, thank you for coming back. >> do we have any questions for them. and i know that our staff clarified the lease agreements but they are here. >> have you been working with anyone else just trying to get everything together? >> yeah, we worked with the merchant association and we worked with supervisor campos
8:10 pm
and we worked with all of the departments and the building department and the health department and we have been working with all of them. >> any other questions? >> all right. >> seeing none, why don't you just have a seat and we can have the police come up. >> i would like to make a motion that avry parker does not go last on every agenda. >> second. [ laughter ] >> i am serious. >> officer, avry parker from the mission police station, i have already submitted my requested conditions, previously, i also like just to update the commission, that on september 10th, there was a joint task force that did not
8:11 pm
really have anything to do with the entertainment nor alcohol issue its was an illegal unit within the business. an illegal apartment unit. martha had not denied that there was one there she had vacanted the tenants and the building inspection went through. and that as far as i am aware of is resolved. i would like to also to just kindly suggest to her that disstilled spirits regardless of the alcohol content is not within her permits. and that she avoid serving them. because i was not at her place of business on the tenth to do enforcement action, i was there
8:12 pm
merely as inspector of the security, and however, i did observe the makings of the margaritas again. and so just again, to her to operate within her all of her permits. and licenses. and that is all. >> great, thank you. >> officer parker. >> thank you. >> thanks for waiting to the end. >> last but not least. >> definitely not least. >> do you or have you seen the police conditions? >> you should have, because... okay, and you are okay with them. >> all right, and nodding is a yes. okay. >> is there any public comment on this please come up. and one at a time.
8:13 pm
>> >> my name is frank and i leave adjacent to the property. the noise is exceedingly loud at times, whenever they are there. they play their back patio is right next to my property. it is extremely loud and they presumably play something, but they have a birthday skit that they play. and presumably doing it inside, but the door is wide open and the guy is outside announcing, and you can hear him announcing the to play these birthday songs. and this has been going on for many, many years. we lived at the property, and i have lived at the property for probably almost as long as
8:14 pm
their business has been in, about 50 years. and no, about 75 years. sorry. my age is getting me. they continually play this music and, they just leave that door open, if they played inside and shut the door, we probably would not notice and you could barely hear it. i have a neighbor that plays the piano that you can't hear, his house is adjacent to my backyard. you could hear a pin drop and just barely hear his piano playing. he sound proofed his entire building and the sanchez building is not sound proof at all. if they shut the door it might help. but, they don't. thank you. edid i give me name, frank duart. >> thank you. >> and could i ask a point of reference please? >> i am just wondering what hours you are most disturbed?
8:15 pm
>> all hours of the day and night. we live there 24 hours a day. they start about 1:00 sometimes 10:30 in the morning, and they say that they have and they play only one day. but, this band... >> and this... >> well, we are there, all hours of the day and night. and it is going on at 2:30, 3:00 in the evening, and 3:00 in the morning, i have called the police. >> 3:00 a.m.. >> you are saying 3:00 a.m.. >> p.m. or a.m.? >> that is after midnight. a.m.. and i have had the police come out and >> okay. >> they can't do much. >> i think that it is clarified. >> thank you. >> go ahead and just speak into the mic. >> my name is kathleen duart and i live at the same property
8:16 pm
with my father. and so we are the neighbor that calls all of the time. and like my father said, the back patio is adjacent to our backyard and so we really get hit with the noise, last year, january 10, sanchez was issued a limited live performance permit and there were very specific conditions laid out in that permit. and you know, you could see it in the minutes. and in you know this past year, they have not always adhered to that, and quite a bit they have done things that are in direct violation of the permit. those things are and is it was specific that they needed to play the music inside with the back door shut because as my father mentioned the back door is often opened and i realize that it is nice on the patio
8:17 pm
but it is very difficult because i can't hang out in my backyard and can't have a normal conversation in my backyard.. i get tired of hearing the music, 6 to 8 hours at a time, when i am inside and my own home, with the doors and windows shut. and i have to live basically and sleep in the front of the house, by bedroom is in the back but i can't spend the time in the back because it is irritating to listen to that for five and six hours at a time. also, in the permit i believe that she said that she would work on communication with the neighbors she has never approached us and she knows that this is a situation and she knows that we are the folks who call and sometimes i call when there is music on the bad patio because she has gotten a one day permit and i have been notified and as far as i know she is operating outside of the conditions of her permit and so
8:18 pm
when there is a one day permit i am sure that she is irritated that we called the police but i would not know any difference. that is a huge irritation, the music is supposed to stop at ten p.m. and it was gone past ten p.m. on numerous occasions because of the neighborhood that we live in and i am not fond of calling the police. and i am not fond of calling the police and we were instructed by the police to do this every time they don't play past ten and every time that we play on the back patio and which is also not the condition of the permit call the police and so that is what i do. and so, and i am not saying that i don't want them to have a permit. what i would like is i would like better sound proofing inside of the building, i know that my time is up. >> i would like the back door remain closed and i would like the back door to be closed.
8:19 pm
sound proofing and the back door to be closed and i believe that the front door is also supposed to be closed. sometimes when the front door is opened, the music and there is some bands that are extremely loud and some punk rock bands. >> your time is up. >> sorry. >> and to notify me when they have one day outdoor permit. >> all right, thank you. >> any other public comment? >> department you can come back up? >> just from listening to her, i believe that she is unfamiliar with the new ordinance regarding outdoor space. >> right. >> and so we can clarify that. any other public comment before i close it? >> all right. >> public comment is now closed and the matter is now with the commission. >> the permit that is being applied for does allow for outdoor limited live. and so it is not just in door, and a matter of closing doors. so, i think that we have some
8:20 pm
things to mitigate in the commission, any thoughts? >> i am sorry. we can't take any more comments. >> i would like to approve this permit with the conditions, sorry, i am starting to get tired. with the conditions from the mission station as our accept and i think that it should at the bottom say, interior, sunday through thursday, and are admissible on the patio on friday and saturday and sunday and until, i would like to make that 8:00 p.m. to mitigate some of the complaints that you are having. >> so, there is a motion on the floor to approve it with the
8:21 pm
police conditions and the modifications to 8:00 p.m. for outdoor, is there a second? >> i would like to second it was an amendment that the sound outside not be more than 8 points, 8 db or the ambiane decibel levels in that neighborhood and in the city we use 68 as a mean number for the whole city and so 76 with the maximum decibel level outside. >> and i would accept that, that is fine. >> and so, 8 above ambient. and so 8 above 68. >> which is the code. i am just restating the code. >> so just one comment that i think, last time around, you know, i think that parker had suggested planting a right level that everyone could agree to and they don't have a
8:22 pm
decibel reader and how do we enforce that. and we would have the sound technician go and take the readings and we would set that up if someone contacts the office and we will be able to arrange to have the sound readings taken ambient in the neighborhood and when there was music on we would prefer to do it when they were having a party, something that is planned to have. >> which means that you have to invite us to a party for us to measure that. >> do you understand what this motion is >> that you have to be inside except on the weekends when you can be outside? >> okay. >> and commissioner campagnoli? >> i actually had a question. could we take questions? >> no. >> i don't think so. >> no. >> never mind. >> commissioner? >> i just really want to caution that this be followed
8:23 pm
to the letter because you know, if not, then i think that we should look at it much more closely and see it again. but i mean, this has to be followed to the letter, the licensing, everything, everything has to be done by the book. or you are going to come back here and we are going it create problems. >> all right. any other comments from the commissioners? commissioner lee? >> does the neighbors have phone numbers to each other? like if there is a problem, you can call them? >> you do? >> no. >> oh, okay. >> okay, so part of the good neighbor policy is that you share that number with your neighbors which you have two of them here, so whether it be a cell phone or a line that someone will pick up. any other comments? >> so the motion is to approve limiting the weekend performances, outdoor
8:24 pm
performances at 8:00. >> along with the police conditions from mission station. >> yeah. >> is there a second? >> second. >> and can we take a vote. >> yes we can take a vote. >> commissioner akers >> aye. >> hyde. >> aye. >> joseph. >> aye. >> lee. >> aye. >> campagnoli. >> aye. >> and president tan. >> aye. >> approved. >> thank you. >> good luck and please share your numbers with your neighbors. and we move right on long to the last couple of things on the agenda. and item 8, commissioner comments and questions. >> so anyone have any additional comments and questions? >> commissioner hyde? >> yeah,vy i have a few comments. i just want to announce that on the 23rd we are going to have the second neighborhood meeting with the neighbors who live at fulsom and 6th. and also, i just wanted to say that i took my tour of broad
8:25 pm
way and the strip clubs one night just to see how they work, and get a better kind of feel about what they have been doing on broad way, and i also had lunch with officer avry. to discuss just sort of permitting issues and how that went. and that was great. so i just wanted to tell you that. >> great. >> any other comments commissioner joseph? >> were you going to say something? >> no. >> okay, anyone else? >> all right. >> and any public comment on commissioner comments? >> no. >> seeing none. >> and moving on number nine, >> new business requests for future agenda items. >> commissioner hyde. >> you have this broad way corridor pack and i would like a future business item to be that we discuss the ideas that they have here and the other
8:26 pm
ideas around the party buses because i know something in here that they have a special section on the party bus and how to limit them on that street and since it is a state-wide licensing thing, i think that it would be really good for us to be able to maybe put some of those ideas into permits, and in areas that are having trouble with the party buses or just kind of to maybe curtail the issues that we are having with the community, and so if you would read the party bus thing and see if i would like to have a discussion about it. >> do you want it at the next meeting? >> sure. >> or a couple of meetings from now. >> sure as long as it happens in the next month or two. i appreciate that. >> okay. >> i also would like to look into the idea of having some sort of discussion publicly about cameras and their uses including the police department and whoever else staff would feel would be relevant. just because i know that there
8:27 pm
is a lot of discussion about it and i get a lot of complaints about having them here and there. and i would like an open forum if we could. also, i would like permission from the commission to co-host a meeting with jane kim's office in early october, it will be held at monarch around 5:30 the date is not set because i don't have the permission to do it. and this is to talk to night life about how they can contribute and what they need to contribute to public safety and health along the 6th street corridor as there is money going to be spent there and i thought that it would be helpful to make it an official meeting in case any other commissioners wanted to come. >> that is cool. >> that is great. >> and that is it. >> is it going to be for the public? >> yes. >> yes. >> and i think that.
8:28 pm
>> and i have another question. and i have just one other question about your future agenda item. >> just to make sure and we can discuss about the party buses but to the staff is it true that if the party buses are regulated state wide we could further regulate them we just can't regulate them less than the state law and we can do it more than the state law. >> we as the city of san francisco and as the entertainment commission have no regulatory authority on buses. >> great. >> so we can't do that. >> we can talk about their impact. >> however, can we do things like make... can we say that as part of their permit, we cannot we want them to notify the police station for any party buses they are taking during the week? >> you may condition permits, as you see fit, permits by permit >> that is kind of the discussion that i was hoping to
8:29 pm
have. >> >> we could also, could we have like a joint session with the mta, to talk about party buses? >> i don't know if they are appropriate local regulatory body. >> just the state. >> out of the hands of any local jurisdiction. >> no the police department does traffic enforcement and if it sees the vehicles on the street and in theory they go do something to the vehicles on the street. the chp handles buses, bay area, ride, and the puc which is the state puc regulates the physical bus itself and the mta can limit the size, and of the vehicles on the streets and which streets the vehicles particular sizes can move around on. >> and where they can stop. >> you used to work for mta. >> but whether or not a joint hearing is valuable, is something that you could
8:30 pm
discuss. >> just as a side note, i'm super unclear on commissioner hyde's monarch meeting as it relates to agenda and permission. >> i just would like it to be an official meeting from the commission as far as the notice so that more than like two of us could show up. is really my concern. i think that we have two industry reps that are fairly involved, you know, new, health and new police and i think that maybe they would want to come to the meeting and so i don't want to see that as an impedement to talk about it. >> so we could agendaize a special meeting outside of city hall of either a committee or the entertainment commission, as a whole, in light of brown act violations. if that
