to you. thank you >> is there any additional public comment? i got faked out >> that was quite elegant. >> as a project sponsor we're given 10 minutes to describe the project. >> am i allowed to rebut. >> no unless the commissioners have questions. >> it's actually not correct. >> is there any additional comments. okay public comment is closed. >> yeah. you'll have some questions from me.
5:31 am
my first question is those are condo mapped or they are not going to be sold >> yes. sir. >> so we have 11 units means 8 parks spaces are. >> there's 9. >> oh, 9 parking spaces. >> and that leaves us would 2 spaces areas but there's going to be it is way it looks like 2 units without parking. >> yes, sir. >> so what would be the situation with the owners of those units? we would they be able to
5:32 am
purchase the parking from the garages or would it be a long-term rental >> it's a long-term rental. i've been associated with this problem the condominium association can have two spaces assigned to the condominium association and then the owners of the condominiums can rent from the condominium association the parking space that are in the remote lots >> so their assigned. >> in the lots - and so the hoa is the renter. >> okay. that's going to have a few more questions on say thing here. you said the windows are aluminum something around the aluminum i assume. in their not just bare aluminum >> no their colored aluminum.
5:33 am
their dual grazed and i actually have some - so their powder coded aluminum windows so their silver gray in color >> i assume the covering makes them impervious to saltwater climates. >> that's why their powder coded. >> then i i said there's going to be case windows. >> yes. >> the ones that are open will be case time and there are separation between the windows and the face of the building. >> face of the building.
5:34 am
>> yeah, that's okay. >> relatively speaking that's a deep recess so 4 inches. >> and then the materials on the outside of the believe is that masonry facade and is this stucco 0. >> around the with these is stuck could and the base is tile and then the upper believe is cedar. and i have an example >> so long as it has the appearance looking at it from a distance it appears like the typical marine a with the stucco base and yeah. the base and the
5:35 am
upper building is cedar and over a long pirate the cedar will go silver. >> i hope it continues to have that masonry appearances so it looks like it goes in the neighborhood. those were most of my comments and a questions for you. i had another comment by thank you very much >> thank you, sir. >> i know that it sounds like they've done a pretty good job in trying to figure out the parking lot situation because i give the young lady who parks the car open is street because one of my dental receptions has been broken into but not parking
5:36 am
out on lombard street. >> thank you wanted to comment on the parking issue. as you know under section 1 j 0 it was variable through a conditional use authorization it wasn't a variance but a few years ago the board of supervisors made a change to reduce the number of residential parking spaces is an administrative process. there's no variance hearing on this item and that said the commission should you so choose to make that one-on-one i would note any determination if you do agree with the reduction in parking that is not appealable on the decision you're hearing
5:37 am
today it would be to be part of another appeal >> just for the record the commission didn't request under item 7 to see the architects credentials because we can't ask about any personal information. the comment was made instead of they didn't indicate the name of originalor of the drawings and having said that my recommendation was to hire a professional architect to help with provide to provide a proper set of drawings. this applies that we ask that kind of questions which we didn't. the building has come a long way forward. it will be a background building
5:38 am
on lombard street. i would have preferred a different window material but that's neither here nor there but the department said it's okay. so i'm okay. i like to say that - what was i going to say this doesn't address your thing. i'm going to ask the zoning administrator i've never heard that zoning association which within the owners of condominiums h they have the right for additional parking spaces and this ups the ante >> the issue is the condominium association essentially renting
5:39 am
out parking spaces off-site and under the planning koetd code that's a right. let's say you have a 3 unit building you could rent that out within 3 hundred yards within the building and that's something that's been there's been more flexibility with co- changes over the years but this is something that's allowable to have parking provided, you know, for residents in the vicinity >> they're not allowed to make profit they can have dues that contribute towards the operation
5:40 am
of the building but not have density income. i appreciate your providing that information >> i want to thank the project sponsor for bringing this forward. it's a much better project and everybody acknowledges that. it needed some improvement and i also appreciate that you went through and took the comment of the commission and were responsive to that. and then finally i think again i don't find the parking under a problem i've live there 6 years and i went to see the america's cup and had no problem. so parking is not an issue. part of the approval it wouldn't be silent on the issues and we
5:41 am
don't want to set a precedent so people go in and out of the garages there. so i move to approve the changes >> one other thing on the parking mr. hood puc. i think we've discussed this but it is not true it would be expensive to add the additional. you talked about the loss of our retail unit >> nothing is impossible bits it's expensive. >> and that would be only for those two plays pariah appreciate neighborhood comments i understand from mr. sanchez of what's happened in the past and now because of the required parking they could request a
5:42 am
hearing so it's not final until the planning commission, you know, passes judgment on it. and on the motion commissioners that's on the floor and been second with conditions (calling names) so move commissioners that motion passes unanimously 7 to zero and places you on item 11 for 4850 gary boulevard request for authorization >> good morning president's fong sherry planning staff. this establishes the retail use in a vacant food mart space on gary boulevard within a existing
5:43 am
mobilize gas station dagz an establishment in the district. on october 14, 2010, the planning commission authorize the use under a motion under case no. 2010 to convert the service station to an all gas station affiliated with the location. to add a retail use and allow the retail use of selling beer and wine also required the conditions modified of the authorization. the formal use of the retail organization has been established and has more than 5

hundred floors and two hundred in north america. the posts 711 store will have a cashier area office and restrooms. they've received one phone call in opposition to the project. the permits representations is recommended to be approved and i'll be here to answer any questions. thank you >> project sponsor please. good afternoon. i'm with a n a engineering. as ms. young dated in 2010 we objected an approval from you to convert those service station and your client as established a
5:45 am
relationship where they've xherntd a couple of sites for this operation. and the reason they have established the relationship is to streamline their operation and all their operations for those facilities. as such they've decided to come before you and on your approval to a 7, 11. the construction is almost complete. and has been greatly improved than it was before. there's going to be a tremendous amount of landscaping that will be added and depending upon our approval we'll be opening in 8 weeks. if you have any questions our operator is here to answer any
5:46 am
questions you have. >> okay. thank you. opening it up to public comment. two cards. (calling names) >> i'm olivia i'm a homeowner on the bloke with the exit of 76 station exists. on the seven years i've been a resident is the safety of the buildings on that block and are actively walking that block because it expands 3 major bus stops. there's a lot of pedestrian traffic. my time there seven years and there's been multiple incidents where cars exiting the gas station have totaled our car and
5:47 am
there's been no liquor available and a.d. the liquor would further increase persons being at risk. we have a continuous problem with the greenspan and that's the homeless issue. invariably it's the liquor and drugs and making it even more assessable to them is again, a concern. there are an abundant number of children preschool children that use that bloke to go to and from school. i would favor the business being in this location i think the construction is looking very good but i would not favor the
5:48 am
addition of liquor being solid at that location >> thank you. >> any additional comments. oak public comment is closed >> i have a question the project applicant spoke will expensive landscaping in the drawings. i did not see such a drawing if you have one could you please put it on the screen >> i don't have it in front of me but it's going to be reflushed and i'll be more than happy to supply that to the committee if you wish. >> that's all i had to ask. >> commissioner antonini. >> thank you. i'm supportive of this but i also appreciate the comments by the neighbor.
5:49 am
i think the city doesn't do a very good job of taking care of the foliage around the area of park presidio boulevard the lawns are not mowed properly and all the fondle is never trimmed down. if that were done it would eliminate the homelessness is he they wouldn't be able to congregate in there. it's something i'd like to see done. it's actually highway one. i'm not sure if that's the state or the city of san francisco >> i know that's the patrols - >> as far as the maintenance? >> yeah, it's policing but maintenance for the foliage and
5:50 am
i think it's the city property along presidio but the ride way would be in inspiration with the city but in terms of the landscaping there are some photos that shows the existing landscaping in the packet. and in loose you terms called landscaping it's pretty over ground but as far as the liquor problem it's just beer and wine but in any case there's a lot of places close by where they can come and buy beer and wine so this may not change things. maybe the work done at this site and part of our security will be to keep an eye on there.
5:51 am
i move to approve >> i may add a comment and concern. there's another 711 two blocks away. is there that i affiliation and most importantly at the terms of the lease at the existing 711 >> there's no relationship right now. so far as the lease terminal i apologize i'll have that for you. so, you know, i'll bring up this has been a concern of ours as a whole. i'll speak about clustering. this is a case assuming this existing lease is active for a few more years we'd have 2711
5:52 am
two blocks away on the same side of the street. i think gsr boulevard is okay. but two and one block is disconcerting to me >> is there - can you talk about security. the neighbor mentioned obviously, the way people you pull out of the gas station do you have cameras or anything - >> the cypress one is a mandatory 16 - 11 and there's a manager who is going to be walking around the site. and you know the lighting has been improved under the canopy
5:53 am
and the lighting has been improved. but the last one when the construction is over we're going to tear this side out and it will be greatly improved. but closer to camera and their manned 24/7 and training that they go through as part of being a franchise and also the safety of our neighbors because their our greatest clients. you're only selling beer and wine >> and not singles. >> no, we restrict that. >> commissioner moore. >> i would actually share w your concerns about the two same franchise in one block from
5:54 am
another. i'm concerned that the community itself might not be very aware of that. park presidio funds the entire area it's a state residential neighborhood and this discussion is not as much about formula retail per say but the same factor of two of the same fall being the same franchise being on the same side of the street is a serious question >> yeah. on basis for recommendation it talks about the fact there's a close proximity 51 hundred gary it's 2 1/2 blocks bus it's close. that's a freestanding 711 and i but this is a gas station that has a 711 accessory but it's a
5:55 am
big improvement over what's there now. sometimes park presidio is a little bit of a barrier and crossing it is not pleasant so people may walk up there to get some grocery goods from the east are more alp to go there >> i don't know? not upper market we have a radius would that other 711 be included in that? i think this is a little bit different because we have to let corporate 711. >> it's two blocks away so i
5:56 am
don't have the exact dimensions but i'll assume it's outside of a 3 hundred foot radius across park presidio. >> we try to do on market street is formula retail not unlike formula retail. >> commissioner. >> yes. and commissioners morris comment about landscaping triggered some re-examination. is this the supposed proposal? >> yes. >> those those evacuations don't match our plan. >> i have pictures of the existing site. >> you have a west elevation you have no door but on the plan theirs an excess door - oh,
5:57 am
sorry i'm backwards i take that back. you have sclairp shown in the front of the building but there are no planters >> so far as the time when this was designed but the landscaping on the side front is the landscaping we're going to be refurbishing and this is the black or white version. >> okay. thank you. >> commissioners there's a motion and a second on say floor to proof with condition shall i call the question that is increase on that (calling names) commissioners that motion passes
5:58 am
5 to 2 with commissioners moore and fong voting against. commissioners that places you on items 5 a and b at 1433 bush street request for the variances. >> good afternoon. glen of department staff. the project before you is located at the 1433 bush street and also located in the r f c commercial high density district. the project is propose to demolish the single store rental
5:59 am
car building occupied currently by city rent a car. they're the project sponsor who wishes to develop a 10 story building containing 22 dwelling units and in the ground floor they want to reestablish their use as auto use in the community. at this time the department has received a letter from folks who wanted time to talk with the project sponsor. and i'll let them talk about that. i received a letter from the complaint and the department recommended approval. they would provide 32 additional units and continue the auto
6:00 am
business and protect a city owned operated business within the city and it also meets excuse me. meets applicable i requirements of the planning code and that the project is okay with the designing neighborhood. later on after the presentation if you want me to go over the height and bulk of the building was deprived in coordination i'm be happy to do that. project sponsor please. good afternoon president fong and commissioners i'm anthony. i'm one of the addition. what we have a new urban project it's a 10 story complex situated under 20 feetwe
