safety trainings for taxi drivers and munis operators for 2013. in terms of expanding bicycle safety for bike riders, we have launched a number of initiatives. we have a new bike safety initiation guide which is a much easier to read format printed in languages in english, spanish and chinese and we have bike safety information, bike lights and promote safe lighting through our various social media channels. point no. 1, the civil grand jury recommends materials be placed in parking renewal paktd. it's the we recommend not implementing this. at the time we send out renewels for the permit.

we are seeking funds to ensure this message. it's something we are working on and these could buy a combination of billboards and munis ads and other messages. these message could include to get people to go riding and assessment -- safety. the jury recommends biking lessons to private businesses wechl a program in place, the commute by bike. our first year goal for this pilot program is to engage companies which encompasses 7500 employees and we are making progress to identify who those companies will be. we'll be reporting back on how that program is working. finally the

>> our courses as we understand are held in every district in san francisco. we have had courses in district 11 and 10. the outreach, the bicycle coalition utilizes their media and supervisors office to help promote that. these bike lanes are very knew and we'll be thinking about how to get these in the hands of people that need it across the city. >> these courses that are held in every district are they fully funded? >> it is a contract that is fully funded, correct. it's a 2-year contract that i believe will end next year. >> thank you. >> commander alley? >> good morning, i'm alley with the bureau assigned to the

administration transportation agency. i had the pleasure of escorting members and i'm very connected someway to this report. the police department regarding recommendation 2.2 to establish bicycle safety training program for new recruits as well as on going training in the continued education program for police officers, we agree with this. with that said, our current recruit officers receive approximately 16 hours of traffic enforcement training in our basic academy. as part of that 16 hours there is a full 1 hour of training to bicycle enforcement. i understand it's not enough. those same recruit officers receive 40 hours of

traffic and collision training. this is something that is new. now every single police officers coming out of our police academy is coming out of our training. this certified training component, certified by post. one of three components. you have your basic, you are and immediate and advanced collision. so they are well on their way to having a grasp of properly investigating collision. case in point issues such as taking the lanes. these are things that are discussed within this training component and that is specific to bicycle enforcement. within that 40 hours, there are a number of issues that are specific to bicycles that are addressed. from 2001-present. approximately 320 members of the department have been certified in bicycle operations. this is a 3-day

in-house rigorous training that i myself have been a part of in addition to the initial training there is a recertification that takes place. so we have additional 260 members who have been recertified in that course. in regards to recommendation 2.2, whereas the sfpd should create a bicycle safety video and models traffic enforcement and bicycle safety in california vehicle code and traffic codes related to bicycles, we are also in agreement. the department has reviewed the bicycle training program currently used by the city of chicago. it's a series of videos that addresses certain topics and we've been asked to produce similar videos to employ all applicable laws.

there are so many laws that are local and state than to have them in a single video might be a bit overwhelming. the goal is to create a series of issues as appropriate. we are hoping to have that completed by january 2014. in regards to recommendation 3.1, sfpd should update the citation form to include a categories of bicycle infractions. i'm happy to say that too has been implemented as of january 2014. the electronic process citation as well as the handwritten citation. regarding recommendation 4.2 which is a request for the police department to collaborate with the bicycle va c in the sfmta in the city should build an

enforcement safety campaign around the goals in 4.1 and alert the public in the plans that will follow. in many instances this is also implemented. the sfpd has already implemented numerous traffic safety campaigns. for example, recent efforts were aimed at reducing traffic driving and dui infractions and back to school enforcement with the 15 miles an hour speed limit around the school. it was an incredible success for kids going back to school. through discussions with the bicycle safety steering committee, sfpd would determine if additional enforcement campaigns are important. as these develop we definitely take great efforts to inform the public and to have a very collaborative approach in both education and

enforcement as the educational issues develop. thank you. >> i have a quick question. who developed the training course that you are implementing for your officers? >> the 16 hours or the 40 hours? in both case, the both training courses, the curriculum have been developed based upon the efforts of our own neighbors in collaboration with the existing best practice. for instance the 40-hour course is a standard investigative course offered throughout the state by other agencies in the topics of curriculum are the same. they are regulate in terms of the certification through the california commission on peace officer and standards. they approve the curriculum.

>> you say the curriculum was certified by post. what does it stand for? >> post stands for california commission peace officers and training. >> thank you. supervisor tang? >> question for sfmta. the findings was that both agencies would launch an education diverse program. i'm wondering if you would be willing to give more details on that. >> that was part of the discussion? >> the training? okay. >> the discussion is between sfpd, in courts in terms of developing a model that many instances in other counties that we can implement here. there have been some challenges typically the financial

encouragement for bicyclist to participate in a diversion type program. for instance for cars, for operators of motor vehicles there is a series of financial incentives by state law. if you are operating a vehicle and given a citation, that violation is going to appear on your driving record. there is also substantial fine in many instances in the tune of $300-400 depending on the violation and your insurance rates is going up. there is a serious incentive for you to go to traffic school within an 18-month period. for a bicyclist. any infraction, any citation you receive, there are no further consequence in terms of insurance. there is a fine, however. for instance a bicyclist going through a stop sign, they are looking at a fine that is just below $200.

there is a cost associated which is a projected cost associated with the diversion plan. the big issue is how much wiggle room in many cases do courts have in reducing the fine in many instances that the state is mandated and there is certain elements to the fine that simply cannot be waved. there are some challenges there. we are continuing the discussion and we are hoping to come up with an innovative approach to deal specifically with the bicyclist. part of that discussion also is potential legislation changes , state level in order to allow the courts to fully wave some elements of the fine. >> thank you. >> i have a question about responsibility. i'm driving a car and i hit someone either in a car or a pedestrian. i'm liable and i carry insurance

and my insurance, i make the claim and the insurance pays out. when you are in a bicycle, and we've had several collisions in the past and that has resulted in fatalities particularly for bicyclist. what kind of legal remedy exist? >> the only legal remedy that appears is one civil process between the person injured and the person responsible for that. obviously in the event of a death, you have a criminal proceeding potentially as well. anytime you have the loss of life coupled with a violation of traffic laws, you are looking at a potential at a minimum of -- the only remedy

is a civil between the two parties. >> thank you. any other questions? seeing none, thank you commander. i believe the next presentation is the bicycle advisory committee. mr. hill. good to see you. >> good morning, supervisors, cohen, katie tang and david campos. great to be here and appreciate the opportunity to be here this morning. i chair the bicycle committee as well as the current one. looking at this finding ahead i will review them quickly. finding no. 1, i won't repeat it again, but the bicycle safety committee grease with the finding on paragraph two and say that we have met with sfmta and sfpd and the representative

of the bicycle coalition members and members of the superior court from 2011-2013. at this time there is little prospect for the same reasons the commander said that we have two particular problems with the citation diversion. the first of all is the amount of fines are defined by the state and i had asked at that time if we can look for relief through our representative to perhaps move for modification in the law that actually deals and the reason for this is when we first started, every county in the state has their own system for bicycle citation diversion. this is only in a few states and counties had it. these days most counties have some forms for dealing with this and this time we should add a process. this is somewhere where it's justified with the vast

increased associated with them. the other authentic -- thing is the process of the sworn officers. which is the administrative handling is extremely bulky and that's what they can do something in providing the funding to fund that part of the process. we encourage something the board would be active and supportive with it. in 1.1, we are unaware of any expansion program for beyond munis operators and taxi programs. the munis operators were commented and the 1 hour training sessions that bicycle incidents after this meeting. 1.2, we recommended further analysis, the bac unaware of

any plans. there is a relative consensus on that. recommendation 1.3, the vac is unaware of any incentives to provide bicyclist who committee a workshop. currently those who complete a course receive a certify icate: i'm not sure we need to do a lot more in that area but we need to do a lot more in certainly promoting. 1.4 was publicized classes roadway behavior recommendation requires further analysis. i would comment because i teach those classes on the 4-hour ride that attendance has dropped off recently. the city has done a 1 hour course which is pretty good. it doesn't get

into the detail handling in the road as well as getting the right type of bicycle and detail and that sort of authentic. -- thing. the 1 hour course is a great program. but the 4-hour is probably needed to build confidence as well as the ability to know how to handle yourself in traffic. recommended 1.5. certainly we need to offer businesses that is being implemented as i understand it in the mta and bicycle coalition. finally no. 2 bicycle training should be by utility bicycle operators and what style of doing it. it should be more by the league and bicyclist program and working together on that rather than having it on the confines

of the additional police training which is currently proposed. moving to recommends 2.1, a long support and advocated for sfpd bicycle training not only for better understanding the law and conditions bicyclist deal with but also bicyclist enforcing traffic on our streets. we believe police are not on bicycles, they can travel quite fast and thoroughly. we would like to see a program by sfpd to bring new bicycles into traffic enforcement now. it would be good for them too. recommendation 2.2, recommendations analysis on going training of all police officers especially those who raise outside of san francisco and have otherwise little connection to the transportation goals of san

francisco in developing events first city discouraging auto use and establishing a priority for slowing traffic for the benefit of children, seniors and bicycle and pedestrian users. we tend to feel that a good deal of society as a bicyclist has a connection of empathy for bicyclist everyday. recommendation 2.3, bicycle specific safety through munis operators with training goals. the bec has long supported the civil grand jury recommendation for the development of what's called a ready rate, something the highway patrol focuses on which is shorthand guide to officers as to which vehicle

codes apply to bicycles versus those intended for other purposes like vehicles and other traffic. at the same time we would like to see citation for motorist for -- which is dangerous for bicyclist. there have been at least two fatalities in the south of market where a vehicle makes a right turn. that is very dangerous and with trucks it's often fatal. we need to have this ready focus on motorist citation and things they do with honking the horns that is never cited these days. finding 3, no brainer. finding 4, which is extension of 4.1. i would

say it's part of it that what bicyclist that we found through our committees that bicyclist are looking for equity and equality and evaluation. the feedback is important. it's not particularly addressed well. not to criticize the grand jury report. i will get to that. recommendation 4.2. recommendation requires further analysis. the bac has made further attempts to reach the parties and requires bac meeting and specific agenda items regarding the response. the committee has not responded to this committee. i'm not going to the administrative codes that requires it. the ba c looks for the participation

in 2012, 2013 civil grand jury. we recommend the safety committee being recommended. i would like to bring your attention lastly to a document that you were given, you may see it, >> there are three sheets that i would like to illustrate for you. what this identifies is the kinds of causes that result in the fatalities. over the last 2007, we've had 26 fatalities in the city, 1997, excuse me. 26 fat alities. related to vehicles and as well

as two died by gunshot assassination and one with solo crash. and two unknown. what i want to bring with you is the swerve side-swipe. the reason i want to bring this to your attention is this entire document was produced without any help from the city or police or anyone else because the records on fatalities are not published. we have the fatality 2 weeks ago because it made so much public. with what is truly dangerous, we need to have access to the kind of statistics that are telling us what is causing these accidents. the police look at who is at fault. we are not

concerned with who is at fault. we want to see what the conditions are and work out the engineering and education to work out the conditions and causes. it's an interesting document. i also quickly is that we average in one place an average of 1.4 fatalities. we've had three. i hope this is not a trend. the other thing i would like to show you quickly from the mta collision report. as you look at the highlights, the no. 1 cause or factor is

driving in unsafe speed conditions. driving for the vast roads are probably not going over 15 miles an hour. talking off the record with officers this appears to be a default where officers tend to write when they don't want to take the time to figure out what the right cause with a. we would like them to focus on the cause. if you notice on the motor resist side, speed is only a factor. if you look at the ratio of 100. that says that approximately 1/3 is due to unsafe speed which i assume could be they are not going anywhere. the second thing i would like to bring your attention to is the fact that this is the classification. you can see here it side-swiped head on and classification for the federal highway

coalition flyers. our intend on that recommendation was to reach out to bicyclist and general public and be mindful of the city's budget constraints. we thought that was a creative option. being that that can't be implemented i would like to say on behalf of the jury that we really encourage the sfmta to come up with more creative ideas that are cost-effective to reach out to the greater population. with respect to recommendation 4.2, a number of the parties have responded. the idea behind that recommendation was to get everybody on the same page. so to gather groups of pedestrians and we have the existing

pedestrian task force, the sfmta, department of public health, to bring them together and as mr. hill indicated, it's not so much about fault, butts it's moving forward with this greater percentage of individuals on bicycles to have a cohesive policy around safety and fairness. so i don't know if specifically a task force around this issue would be appropriate, but we appreciate the efforts of all the departments, but some of it still appears to be done in a rather piece meal basis. perhaps the task force inviting all of these stake holders to come down and come up with a policy similar to the one implemented in portland would be a good idea. the other item is in developing your resolution today, we would just urge that in
