12:30 pm
the applicant has satisfied all of the requirements necessary. so i think that this could be a quick one, i am hoping. >> great. >> do you want to say anything mr. ward? or you are good? >> all right, any commissioner comments or questions? >> seeing none, oh, yeah. we are going to take the public comment. but commissioner ak akers do you have something? >> is there any public comment on the application? >> good evening, commissioners, there is an old saying that is better to be safe than sorry and i think that having that discussion out loud and going to the city's attorney office to get the assessment of it, i think that we got it right and it is better to get it right than to have it come out and then later be appealed. and then you go through all of that. and so it is just one of those things where, i think that the
12:31 pm
process worked. and i am really happy for the applicant. >> thank you. >> any other public comment? >> all right, seeing none, public comment is closed. i am happy to take a motion on this. >> or, if you have any other questions? >> were there police conditions on this application? i don't see them, i can't remember. >> yes, they are here. wait, were there... okay, so, the applicant shall be responsible for compliance with the periodically checking for audible noise from the venue to insure compliance with article 29 of the police code, to assume the complaints are received and delivered to the san francisco police department and the applicant will agree to turn down the sound levels for the duration of the performance agreed upon by the police department.
12:32 pm
responsible for maintaining the event staffing and orderly events and minimize impact and sfpd resources and four, compliance with abc laws. i know that we heard this last week. >> i will move to approve. >> great. >> is there a second? >> i will second. >> i am sorry. >> with the conditions. >> with the conditions. >> so the motion for approval with the conditions and the second? >> i will second. >> okay. >> on the motion, commissioner akers? >> aye. >> commissioner hyde? >> aye. >> commissioner joseph. >> aye. >> lee. >> yes. >> campagnoli. >> aye. >> kim. >> aye. >> congratulations. we are going to move on to the next permit application, it is toan pham doing business as four seasons at 721 larkin street and it is for a place of entertainment permit.
12:33 pm
>> yes, so this is mr. pham, if you could come on up. and he opened up this restaurant the four seasons not to be confused with the hotel just up the street from here where he serves vietnamese food but would like to offer karaoke and there is housing across the street and also apartment buildings, across the street and also in the adjacent alley just to let you know. and northern station has no objection to this permit. >> great. >> mr. pham do you want to say about why you want a permit? >> we just opened the vietnamese restaurant about four months ago and me and my family were thinking about specifically slow and we would like to increase the business and for we would want to on the weekend or we would like to do a separate birthday party and the people that would like to sit together and would like to
12:34 pm
sing a few songs? and it is not going to be to (inaudible) and it is to do and then on the weekend and it is not going to be like very (inaudible) and things and hopefully this idea will increase the business for us. >> great, thank you. >> commissioners do you have any questions? >> i do. >> go ahead, commissioner joseph. >> i want to make sure that you understand that this is a place for entertainment. and so, is one of the questions it says, it requires that you secure the perimeter 50 feet in all directions, the restaurant staff will clear the area. how will the restaurant staff do that while being the staff inside of the restaurant? >> how can they be both places outside and inside? i don't understand. >> well, it could the restaurant with like 46 feet and it is a small capacity and
12:35 pm
the business is i mean we have to have the security, you know, to do it hopefully that... and (inaudible) and we are going to have the security to (inaudible) and inside of the restaurant if it is buzz y you know? and then, if you recommend, and as a staff, (inaudible) you know, the customer inside of the restaurant. >> okay. very small space. >> you said that the manager will handle the security and the manager will do the searching and checking and he will also be the manager as well? >> we have to hire another assistant to help him or myself to come down and help him. >> okay. >> so one time, how many staff do you have working? >> we have like two waitress and one manager with me and i am there all of the time and two cook there, very small restaurant. hopefully if it is busy we will
12:36 pm
have to hire more, security to the place. >> and so in the house it usually has three. >> at least. >> i wanted to make sure that you understood. >> yes. >> the questions that you were... i wanted to be clear that you understood. >> yes, >> your responsibility with this permit. >> yes. >> okay, thank you. >> commissioner hyde? >> yeah, i am unclear a little bit about your neighborhood contacts and i was just wondering if you could go over what you have done and who you have talked to in the neighborhood? >> i have talked to the neighbor next door and to the dry cleaner and with the gentleman on the left side of us and they are okay with this, and make sure that it is not too crowded or too loud. to make the music too loud and going to turn it down and i already spoke to them and i even go to talk to the office of david chiu and let him know, the supervisor for that area. and i will come down and talk to him and let him know what is going on and have the permit
12:37 pm
today and the business okay? (inaudible). >> and did you attend any neighborhood, organizations meetings in that area at all to just kind of make the neighborhood aware that you would be adding... and i mean that i understand that it is a very small operation. >> right. >> but part of one of the things that we ask you to do is to go out and engage the neighborhood. and people who live there. like i am sure that the dry cleaner who is probably closed when you are going to be having karaoke is fine with it. but the reason that we ask for out reach is really, for you to become more integrated into the neighborhood. and so that the neighbors not only know that it is happening, so that it does not take them by surprise, but also so that you have connections and contacts with them, so that you are more part of the fabric. >> yes. >> so that they can help you and you can help them and there can be better communication. >> yes, we will do that, and we will do that. >> okay, and so there are
12:38 pm
several organizations in that area, and i think that you are going to be okay. but i really am strongly suggesting that you go out there and meet with these organizations. because it will help you as well. >> yes, yes, i will do that. >> thank you. >> thank you. sir. >> and any other questions or comments from the commissioners? >> yeah. i have so, your manager, as of what is the manager, a part owner? >> no. >> this is the employee, yeah. >> and so, no training at all as far as security? i mean,... >> yeah, we have two more and hopefully approve in the future, and we have to send him to go and do the security class. >> and you are going to send at least one? >> yes. >> one employee to security training. >> yes, we will do that. >> yes. >> okay, great. >> commissioner campagnoli? or anyone else? no. and you can have a seat. >> and is there any police here
12:39 pm
to speak to this application? >> good evening, commissioners i am the permit officer in the station. and the station has no objection to the place of permit place of entertainment for the four seasons and i spoke with him and i went out there and it is a traditional restaurant just one room, and want to put a karaoke machine in the center of it and in the application he is going to do the sound proofing in a stand alone building. he did attempt the lower polk meeting and which the captain was supposed to attend and he was unable to find it i don't think that he made it, but he tried. >> great, do you have any conditions that you have placed? >> just the sound proofing that he is supposed to be doing.
12:40 pm
and so, just noise complaints, and his hours of operations are from tuesday to sunday, ten a.m. to 9 p.m. and friday to saturday p ten a.m. to 11 p.m. >> and one karaoke machine with one, 100 wat amplifier. >> that is it. >> thank you. >> thank you. >> is there any public comment on four seasons? >> looks like there is one. >> can i have the overhead? back in... >> sure. >> my name is michael nolty and i am the executive director of alliance for a better district six, and back in june, or july of 2012, the applicant had applied for a type of 41 off sale liquor license and at the
12:41 pm
time the conditions that we wanted on the license were no after hours allowed, no live entertainment or dj. and i am not sure what happened to all of that. but, you know the thing is that he did not do any community out reach and we would probably request that he do for a continuance until he has done a community out reach, and there are actually it is in the jurisdiction of the business and so the alliance and our next community meeting on tuesday, november the 12th, at 6:00. and he is more than welcome to attend. that. and if you wants to be at agenda, and i think that the thing is that the committee has to come to him and tell him which meetings to go to, and that should be the other way around that he tries to come to them. and tries to be on the agendas. and i came for this one item
12:42 pm
because, it would have been clear to me that he has not reached out. and i don't know where the disconnect was, but you know a lot of people don't know where to start and i am happy to hear that you did go to david chiu's office but that is not the community that is just an elected official, he needs to talk to the community groups that are in and around his business. and i am sure that he will be a good added addition to a little saigon business district, thanks. >> thank you. any other public comment? >> seeing none, public comment is closed. commissioners, do you have any more thoughts or happy to take a motion. >> i just, he has conditions on the beer and wine? >> yes, you have conditions of the beer and wine? >> no. and the fan are there a special conditions on your beer and
12:43 pm
wine license? >> and come up to the microphone so that you can answer. >> >> and you note a copy of all. and you note, and okay. that is fine. and what is that? >> okay, no,? okay. good enough. >> and commissioner? >> and then i was going to make a motion if that is all right? >> please do. okay, i would like to move to approve this, with two small conditions, and i think that it would be beneficial that they take a lead training that the people who work there take a lead training and now that i know that you can do it for free, that will be very helpful to them and i also think that they should notify that they did the community out reach, to
12:44 pm
a group. and i think that will also be beneficial to them. but i move to approve with the two conditions, or stimulations. >> just one clarification, he says in the application that you would like to go to 11 and i think that the 9:00 p.m. was for the food service and i want to make sure that that is clear. >> so he is asking for karaoke to continue after the food service between 9 and 11. >> yes. >> and the limited live goes to eleven. correct? >> yeah that is a poe. >> and it goes to eleven >> yes. and so it is poe. so it technically can go until two. >> not if we condition it. >> unless we condition it. >> i am sorry, did anyone else
12:45 pm
have... >> yes, what does the station recommend? what are the hours again? >> i heard something on thursday. and sorry, commissioners i was reading off the application that is what his times and days are, so the application... >> and you are fine with that. >> yes. >> okay. >> and are you saying that your condition is that it does the sound proofing? >> yes, has he has listed in the application which he says that he is doing, correct? >> yeah. >> so let's clarify this motion, and so there are two conditions, one is meet with community organizations, and whether that is alliance for the better district six or another one and then also, what is the second condition? >> lead training. >> oh, yeah, lead training and do we want to put the hours restrictions otherwise they will go or be allowed to go
12:46 pm
until 2:00 >> yeah, it is a poe. >> and is there a second for that? >> you know what, i want to... >> maybe i want to second it so we can discuss it. >> i will second that motion. >> commissioner lee? >> well, can we put in there that, i mean, some kind of security training >> we just did. >> the lead. >> the lead and guard card is kind of. nso correct me if i am wrong, isn't it true that if you have a poe, and you have a security guard, he has to be guard carded, and if it is in house, that you have to register that the venue has to register with the department of consumer affairs? >> so, it is required without having special conditions, and just by and mr. fan, you don't have to come up and i am just telling you this. your security guard has to not
12:47 pm
only go for lead training, but has to go for guard, card training, and you have to apply with the state department of consumer affairs, so that you are regulating your employee. >> otherwise, you have to hire from the outside service. okay? >> so that is automatically required. >> we want to make sure that he understands, it was kind of like, i am going to send him to class, kind of thing. >> okay. i think that it is clear now. >> any other thoughts about this? otherwise, we can take a vote. all right. let's bring it to a vote. >> could i get a clarification on the motion? yeah. >> the motion is to approve and did you approve ahours? >> we are going to keep no restriction on hours. >> okay. >> so the motion then, would be to approve on the condition that the applicant completes the lead training and has the staff complete the lead
12:48 pm
training and the he shows the notification of out reach. >> on that motion, commissioner campagnoli? >> aye. >> lee. >> aye. >> joseph. >> aye. >> hyde. >> aye. >> akers. >> aye. >> and president tan. >> aye. >> so moved. >> thank you. congratulations, we will move on to the next permit, and that is kim kyung doing business as town music studio and for extended hours. >> no, my name is kim. kyung. >> just one minute. >> okay, so she has been running the studio for 20 years and as you probably remember, they came to us and got a permit for a place of entertainment about a year ago. and they are now applying for the extended hours permit and northern station has been pleased so far with the venue's operation against coming into compliance and support of the extended hours with the same conditions that you have in
12:49 pm
your packet. >> go ahead, miss kyung. >> i own the town music studio. >> okay. >> why don't you have a seat. and unless you have questions for miss kim? >> no. >> all right. and are there any police comments or questions on this? >> the northern station, hello again. and we have no objection to the extended hours permit on this, the town music studios. all of the existing conditions will still apply and i have copies on the ones from the last permit. and i have been checked for the last six months and it has not been one incident filed about the music studio and we have no
12:50 pm
objection. and again, we as mr. hyde said earlier we would like to soften the clothing a little bit and i think that the problems start at 2:00 when everyone comes out at 4:00, if they could filter out it would have less impact on public safety. >> thank you >> is there any public comment about town music studio, seeing none, public comment is closed. any motion, or thoughts, commissioners? >> and i would like to move to approve however, in the conditions, the last one says that the san francisco police department shall have unrestricted access to the system for auditing and kind reporting purposes and i would like to strike that as part of the permit. and that last bit of the sentence >> so your motion is to approve the permit with all of the police conditions except for... >> the san francisco police department shall have unrestricted access to the
12:51 pm
system for auditing and crime reporting services. >> that i think means that they want access to the footage, without... yeah. >> and is there a second? >> i second. >> and all right. and any other discussion? >> all right, let's go to a vote. >> the same house same call? >> yeah. >> and okay. >> congratulations, so moved. >> awesome. >> all right, that means that it has been approved. >> so we will move on to the next it looks like dis being asked to be continued do we have to move to continue that? >> yes. >> okay. can i take a motion to move d? the gathering? >> >> motion to continue. >> to our next meeting. >> two weeks from now. >> to be continued to the next meeting. >> i will second.
12:52 pm
>> and do we have a motion and a second. >> on the motion to continue to november 19th, the same house and same call. >> yeah. and all right, and okay. it is like, we are going to move on to our last permit this evening, which is carly mcnary and commissioner joseph. and i will have to recuse myself on this permit. >> see you later. >> sorry. >> the marketing works at 830 market street. this is one of the situations for a loud speaker permit we would do this in the office, but because they are asking to have the sound until one a.m. we are bringing it to the commission and this is for a video game system launch event at game stop on market street and i believe that the game will be released at midnight and leave us to kind of entertain the gamers that are waiting to pick up the machines and all kinds of stuff. but, and andy is here to give you more information. >> hi. >> hi. >> and please provide us more
12:53 pm
information. >> as andy mentioned i am here representing carly mcnary who is with working out of character, and to expedite the permitting process, police station four is doing a coast to coast midnight launch and they are doing it in new york as well as here. and they are looking to and they have a list of customers prepared and eager to purchase the item, and they know that there is going to be sxliens they are going to provide a little bit of entertainment for them in regards to that. and there is going to be a dj in the game stop building itself and there will be amplified sounds outside while they are waiting in line getting their opportunity to purchase and pick up their games. >> great. >> and the questions, for the applicant? >> i have one, hi there. what kind of amplified sound will be outside? >> we are going to have a host
12:54 pm
with a microphone, and 80, pretty, sm 58 and a standard mic and it is going to be a host to talk to the people and kind of interact and get the feedback and get the people excite and also there is going to be a dj playing the music. >> outside, or the dj will be inside and there will be speakers inside of the building and two speakers on the stands outside of the building. and to, again, help entertain while they wait on the machine itself and goes on sale at midnight, this event starts at 6:00. so, there will be and it is a little bit like kids lining up at nike world for the latest greatest shoes, there will be, you know, some people out there, >> so the event starts at 6:00 and not three. >> no. not... the loading time, and there is logical loading time and things that we need to
12:55 pm
prepare for things that marketing works needs to prepare and they can't just open at 6:00. and instantly. >> and so you... >> the music and the loud speaker begins at 6:00. >> oh, not three. >> not three. >> it is that you are applying for it to start at three. >> it is the way that we looked at this permit is the entirety of the event itself. but, the performance, but the interaction, that the dj with the host, and that begins at 6:00. >> and does that end at 1:00, or are you... >> that is from, well, it is, on my security plant, that i received from play station themselves, and the events end at eleven, and then, they will be able to pick up their games starting at midnight, and they literally have to wait until midnight to pick the game up and so it is...
12:56 pm
>> so your host is off the clock at 11 p.m. >> that is, yes. >> which means that you would turn the music off. >> i believe that they want to have the allowed use of music until one, just in case, but it is going to be a scaled back presence and activation at 11. it is going to start winding down and they are just going to machine the line as it stands and wait for people to pick their i had ems up and their games up and then leave. >> okay. >> other questions from the commissioners? >> in the market is where this is happening? >> yes. sorry. and so, is that like in the middle of the block? >> it is, it is towards, it is towards, it is towards fourth, and it is as you go down the block there is a diesel game on the corner and a new converse
12:57 pm
store and so that is the location and it is exactly across from the walgreens and the levis. >> i was trying to think of the possible residential in the area. >> no, there is a hotel. >> there is hotels. >> and these ends and the ritz. in the area. >> and that is, yes, and in regards to that, what we have made clear to the client and to our dj, that we are going to keep the bass out of the music because that is what tends to travel and we are going to monitor the upper frequency and we are going to actively monitor the content, of the dj. and the performance and so that way, if he decides to go off the menu, so to speak that we can reel it back in and bring those situations under a control, but. >> and have you contact with the hotels? >> the four seasons is actually hosting the pr portion of this.
12:58 pm
>> okay. >> they are well aware of it. >> all right. >> and have you guys done an event like this at game stop before? >> game stop has hosted events like this before. >> i am just curious for the staff or at least ma*ib because it is going to one? >> yes, formally we would do it in the office but anything that goes after ten p.m. and it is outdoor we bring it to you. >> great. >> any other questions? >> would you be opposed to at least have the communication with you know the head of security of the hotels, in case you do get a complaint that they can call you. >> absolutely. no complaint with that and no reservations with that. we do have them as part of this. >> so that they can call you directly rather than go through the police. >> and absolutely, and we can coordinate that with the four seasons and i can check in with the other hotel and we can
12:59 pm
coordinate through the area, with just a few others right there. >> but, the names escape me. >> commissioner campagnoli? >> thank you. and so you do have some ten bs? >> yes. >> you are hiring, could i ask how many? >> that is yet to be agreed upon is what it boils down to, the station itself is making the assessment and going to let us know what we are going to have on site. >> you have met with them? >> yes. i am here for the sound permit, for the after hours sound permit but there has been a variety of different portions of this, and the head of security for play station has been in contact with central. central, southern. >> southern. >> sorry. >> and what is your (inaudible) called? >> and how many? >> and so they did they are expecting, around 500 is what we are, is what we are
1:00 pm
enthusiastickly estimating. >> this is a game release? >> ps 4. >> the new system. >> yes. >> it is the play station four. and not my dem graphic, either, but i know a lot of people who get a lot out of the video games. and >> so this is a young crowd that you are expecting? >> the demographic is 14 to 35 when you look at video games as a whole. >> yeah. >> it leans towards males but it is a mixed crowd and it is 14 to 35. and so, because of the price of this item, i am thinking that it is going to be in talking with the play station people they are going to see a slightly more mature crowd and it will not be a bunch of 15-year-olds running aaround unattended because this is going to cost some money. >> right. >> all right. i think that we have heard as much as we would like to hear. so thank you.
