helpful for people here to speak. while you are organizing yourself i'm going to ask > we of appeals meeting of december 11, 2013. we are discussing site plan approval: the applicant requests approval of a site plan approval for the property known by legal description as industrial park west, block a, tract 27-a1. item 5 -- abcd. the comments will not be included as evidence and will not appear in this record. >> sue hesser. i'm separate from the marsh. 246 rich street. cash you -- out. i was the attorney through the entire

period of the controversy from 1995-2001. increasingly as we went through process, planning commission figured out they had to impose conditions that bound the occupants to not complain. what mary read you were absolutely correct. the board of appeals requiring sales to be done that notice that people couldn't complain. why? because artist live in commercial developments. they went into zones and i represented them. they went into produce market, cites next

to the at another -- to the food bank and after all those considerations and many many more, the planning department realized and the planning commission realized after the first couple of cases they had to put these conditions on to keep the occupants from driving people out that the city wanted in this city. the zoning allowed for them. they were really protective of food banks and artist and industrial operations and those conditions were put in by the city. >> next speaker. please lineup

by mr. pacheco. >> commissioners my name is rick west. i want to start off. the developer mentioned several times 1043 valencia street that we did not show it in any of the pictures and that it was 4-5 stories big. i want to correct that. it is in the photographs that we represented. i'm part of the a liberty hills group. it was there and they didn't even notice it was there. it's a tall building. my main concern is i live on this building. this quarters of this building is not on this. it's on hill

street. it's with the historic district and the sound engineers said interesting sound bite that it would be a massive sound wall so it is a big wall. >> thank you for your time. i have been a resident of hill street since 1979. i'm referring to these pictures that we have. here is the building that we are discussing. if you will notice if there is a step down along valencia stroo it that we approve of is steps down as we go an along. that is what we
8:05 am
are asking for on hill street. i want to remind people. hill street is a 1 block street. it does not cut through guerrero. 1 block of historical houses. the majority of these buildings is on hill street. the address is hill street. all we are asking for is for this massive building which we keep seeing pictures of on valencia street but they don't show us purse along hill street. we would like it to be a step down like this building. >> hi, my name is sherrie steiner. i'm with the proposed valencia street building. i have lived there 10 years or more. i'm concerned about this building particularly because

of the parking. the situation is they are providing no parking but they are requesting that they have a parking permit, 3 parking permit per unit. in other words 36 parking permits can be granted to residents of this property despite the fact that they say they are diminishing their carbon foot print. they are not if they are putting 36 parking spaces on our streets. we can't afford that kind of allocation and we request that san francisco like other cities when they have no garage building, they have no residential parking permits either. it's consistent with the whole concept of the low carbon foot print.

>> hi. my name is steven. i have lived in glen park for the last 16 years. i have been a pat tron of the marsh for many performances. i see the noise complaints that have happened in the south of market area. i don't want the same thing to happen in this area. as the sound engineer explains it's not the noise from the streets outside. it's the noise from the complaining resident who may not appreciate any type of loud performances that maybe taking place. the noise performance, dramatic

pauses and any type of performances. you have all gone to movies where you have been in the silent part of the movie and been disrupted by the noises of a blockbuster theatre. that's very distracting and if you were from a bar you would have the noise from not only the constant base sound of music but voiceers. >> i just wanted to come and tell you how much the marsh has meant to me. i'm on a tight

budget and i have not been able to afford to attend the theatre. marsh has been a tremendous help to me. they did a great show on depression. i suffer from depression myself. i was in the service and was in iraq and i did not have the courage to speak. he did encourage me to go to the va and get help. he did change my life and my families life. i hope we can do what we can to keep the marsh running. thank you very much for your time and consideration. >> hello, i'm marty gomez and a neighbor of the marsh. i have
8:10 am
lived there since 1982. i love this part of the city. this street. i love the history of it and the aesthetic of it and i feel this building will be -- it won't fit in. i have been a performer at the marsh since the 90s and i know very well a what the gentleman spoke about before. we need silence, we need to be able to perform and we need silence in between the line. the noise from the streets is not anything we have not been able to deal with with the soundproof we have from the marsh, but the noise will be making it impossible -- also i

don't feel it's a transit rich neighborhood anymore. once 26 valencia was taken away. the bus issen frequent and unreliable. it's not transit rich. it's transit adequate. thank you very much. >> commissioners. having been up there a few years ago, i believe in commissioners. it fun to be back visiting you and seeing commissioner fung. i'm here because i like this project. i have a bicycle and i like buildings that don't have parking, but i think there are real harms that this building did us to some of our existing
8:12 am
important resources in this city. i this i this liberty hill district, i don't think it belongs. i'm concerned about the impact on the marsh. i'm concerned that this building made it through process without being addressed. i don't think the fact that prior bodies failed to accurately address these problems should stop you on what you can do on this board to make this a better project. i want to urge you to grant these appeals and impose these conditions and make this a better project. >> good evening commissioners. my name is charlie. i want to
8:13 am
talk about time. i have been an artist and resident at the marsh for 2 years and playwright performer and teacher there. it's my home. they have brought tens of thousands of people and watched the marsh become a financial anchor in the mission. a stitch in time saves nine. we have made great progress. and i want to thank everyone who has helped us get all the items in the left column. that is a lot we have got n agreement on. the stitch in time that you can make is the stuff in the right column. i'm particularly concerned about standing on age
8:14 am
the at a moment of heightened drama and watching something that i have directed and hearing the loud noise of patrons of a bar or of amplified music next door. now is the time to put in these conditions so we are not facing the problems in the road. this is the time you have to make contribution to the neighborhood and the culture and the city. thank you. >> hi. i'm jeanie mcneil. a professional artist. i have not lived in the san francisco area for as long as everyone here. it's a privilege to be here actually an see this process and be part of it. i teach at the marsh. i moved here from new york 0 -- 10 years ago.
8:15 am
what san francisco seems to offer me in the community is what's different about it in its very specific flavor is that it's a city where there is great high quality art just as cosmopolitan of new york where a single artist can be heard and the marsh is a place where those voices can be developed and not only a place to work but things where we heard earlier and how a place can be impacted. the noise because intimate moments is how things transpire. i'm standing here to say, yes, the construction
8:16 am
limits. yes, these limits. it seems like everyone is trying to work together on this to maintain what it offering the community. it my pleasure to be here. >> commissioners. my name is shabay. i have lived in san francisco and have attended performances at the marsh. it's entertaining, personal and powerful and unforgettable. the neighbors know that it's a beloved and treasured theatre since 1989. you have seen the crowd behind you here and know that behind each person here there stands scores if not hundreds of people that share our sentiment. the marsh is a treasure. it's a cultural
8:17 am
institution that is known worldwide. we do would you allow a condominium next to a ballet or symphony? i this i not. it's threatening existence of the marsh to make a profit. you are making reasonable efforts to make sure it's a community that is chosen. the question is what kind of neighbor would 1050 be. you make the power to make sure it a positive edition to the thriving community.
8:18 am
>> hello. i moved to san francisco 10 years ago from london. i have learned to love the marsh. i don't know much about planning laws other than what i have heard here. i ask you to protect this little theatre. it's an ward winner and been a remarkable theatre. in the 10 years i have been living here things have changed a lot in that time especially in the mission and there are many family oriented places. they are just disappearing. please if you can make an issue of noise and protect it. >> would you like to mention
8:19 am
your name for the record? >> this is based on a false premise. everyone speaks about this is a transient rich neighborhood. in this particular development, it will have significant and unintended consequences. today, the valencia street has no public transport at all. 5 or 6 blocks away, there is a limited range. it transports 26,000 people at 6 miles an hour. this neighborhood was well served by public transparent up and to including when this project was
8:20 am
proposed. the buses on valencia street go have been eliminated. no required on-site parking is predicated on an area being and i quote well served by transit. this neighborhood has systematically stripped of it's public transit options. i want to bring your attention one other thing. anytime there is an automobile ownership. i'm referring to a study done at northeastern university of school of urban studies. what's going happen if people cannot get to where they need to be on public transit, they going to drive. they are going to be
8:21 am
more congestion. >> hi, i'm jean gore. i have lived here since 1991. i'm a solo performer at the marsh and very aware of how important it is to have silence when you need it. and i am distressed about the sound that will come from this new building. i also want to mention that to have the developer designation is like having the fox watch the hen house. i must say. and
8:22 am
parking is something that really bothers me because there is not enough parking on valencia as it is and they should not be allowed to have parking on valencia when they claim to be such a green facility. thank you. >> good evening, honorable members of the board, it's great to see you all again this evening. my name is jefferson mccarly, the advise president of the of the corridor agency and i was asked to share our concern to you. from this mission statement we endeavor to maintain the goal and unique identity and spirit of the neighborhood. that biggest concern is the opportunity for the marsh to thrive and survive. we would like to ask for you to support them in
8:23 am
their efforts to stay healthy and achieve their short-term and long-term goals. we appreciate the concessions the developers have already made and encouraged by their initiations to make this a transit first building. we would like to see the residents not be eligible for parking and we would also love to see two carshare spots in their garage. more residential units in the neighborhood in the corridor means more residents. it's good for business. we are not interest of that expense in the culture of the community of our neighborhood. thank you.
8:24 am
>> good evening, my name is ab bot. as an audience member at the marsh i have witnessed profound things at the theatre. bottom line the marsh makes the city a better place. to do anything to threaten the existence of the marsh would be a travesty. that this is a transit rich area, i ride the 14l and the 49. and i would be hard press today imagine an owner of a high end kond

>> next speaker please. >> that's a hard act to follow. i'm a 40-year resident of the mission. founding member of the pharaohs neighborhood. i have endorsed every statement made previously. i want to add, our organization has for decades supported the youth center in the m -- mission that helps children get after school tutoring and camping and arts and summer programs. some of them have attended drama

classes at the marsh. this is a resource that must be protect. i endorse all the recommendations that have been made and i beg you to see they are here. >> my name is john barbie. i'm with the neighborhood association. the chapter says that historic resources in the neighborhood would in my particular mission neighborhood would be rigorously respected. we thought we were extra safe. i heard the appellants describe very isolated old buildings and 12 units and those are in much

larger foot prints and larger lots. this was an entire different animal. it was on a tiny hill like a side street. it cuts through a mid-block and first they propose 16 understood for bicycles only and with a gigantic party at the top. and people are yelling and not talk. it was a righteous place. we didn't want that anywhere on valencia street. i hope the board is not buying that there is no noise coming from this now. i think it's a huge concern that no music club or bar be located in the sports side because this
8:30 am
would severely impact the marsh. we have so many of those and they are ill regulated and you can't have these two competing noise. that would do it. >> before the next speaker begins i want to invite anyone in the overflow that wants to speak invite them to join us if they want to speak. >> thank you. my familiarity with the marsh is through context through their theatre in berkeley. i was the deputy planning director in berkeley. this is a bid bit of a holiday for me. my first of all i think
