laguna honda that will be discharged from the program how will that relate to the affordable care act especially since we have a january 1 deadline for applying? >> most of the people vast majority are medical eligible so most enrolled in medical so they will be able to select the h.m.o. that they will participate in and they get the same notification that anyone living in the community gets to decide which way they want to go. so that's accessible regardless of whether you have medical or not. so it's a service as needed. >> is there some support because everything we hear in the press it's still very challenging to apply for these services online but certainly there's other programs by the

state but is it helping people bridge this? >> laguna honda has an eligibility unit so currently there's an eligibility unit that can actually help make sure somebody gets access to their entitlements while they are there. within the city as a whole the department has certified eligibility workers that have been designated to assist in doing applications for folks so the people that aren't connected can be hooked up with an enrollment person. >> thank you. >> councilmember zarda? >> thank you and thank you for your presentation it's very very important to the community. just to follow up

on something you had mentioned rising rents that we're all experiencing in san francisco the ability to provide someone housing most likely will be decreasing in reference to how that relates to the 500 units originally demanded in that lawsuit how do you feel the number leftover will be impacted by the rising rents. >> i think it's going to be a matter of the pace of the demand for the scattered cite and it's possible that if the demand is not suddenly going to spike that we will probably be able to accommodate despite the fact that the rents are increasing. the a arra y of selection is going to shrink as

and all this i know most of this program is more focussed on the san francisco county. with the county consider maybe going out of the county? i know it's probably difficult but rents in san mateo, east bay may be lower but i know it's very difficult to transition a resident of san francisco over there but maybe have to explore the possibility so that people can be discharged or at least be able to live in the community. >> it's a very good point and i don't think we would not entertain that as a possibility , no resident exiting laguna has requested to leave the county the majority are the reverse they would much prefer

to stay. >> all right. we'll move onto public comment on this item. mr. shaw? >> thank you as you may know i used to work at laguna honda hospital secretary for a decade and when the justice department proposed this program i opposed it and i attended many long-term care counsel meetings excessing my frustrations with it they were ordered to cut 420 beds from laguna honda and now we're hearing that there's only 98 placements what happened to the patients and they can't get

skilled nursing care anywhere between eureka and bakersfield because there's no skilled nursing for long-term care. when i was the secret secret ary at laguna honda wrote a proposal when we wrote that proposal, short-term rehab was defined as ninety days. why was it cut to 30? could that explain why my friend was stuck in that for months? needing too much rehab because his rehab care went over 30-days? and he could have maybe been rehabbed to ninety and stayed in town and not be dumped out

of county to antioc h. if thereof there have only been so many people taking advantage of this program in a 5 year period that means it's had a miserable rate of success. to these voucher programs? i have repeat ly tried to get daas the long-term care coordinating counsel to admit where are they being diverted to? is it to board and care in town board and care out of town? i strenuous ly object to roland,

wong's creative suggestion to save rent money by dumping people out of county when you do that you diss enfranchise san franciscans from their native city why aren't you asking how many people have been dumped out of county? they won't give me the data, will they give it to you? i need to go to supervisor campos and have him hold another hearing to find out what's happening to the seniors that can't get into laguna honda. don't you care whether we're being dumped out of county? >> thank you mr. shaw any other public comment on this item. okay public comment items not on today's agenda we will limit

i'm the president of friends of mclaren park. it is one of the oldest neighborhood community park groups in san francisco. i give a lot of tours through the park. during those tours, a lot of the folks in the group will think of the park as very scary.

it has a lot of hills, there's a lot of dense groves. once you get towards the center of the park you really lose your orientation. you are very much in a remote area. there are a lot of trees that shield your view from the urban setting. you would simply see different groves that gives you a sense of freedom, of being outdoors, not being burdened by the worries of city life. john mclaren had said that golden gate park was too far away. he proposed that we have a park in the south end of the city. the campaign slogan was, people need this open space. one of the things that had to open is there were a lot of people who did a homestead here, about 25 different families. their property had to be bought up. so it took from 1928 to 1957 to buy up all the parcels of land that ended up in this 317 acres.

the park, as a general rule, is heavily used in the mornings and the evenings. one of the favorite places is up by the upper reservoir because dogs get to go swim. it's extremely popular. many fights in the city, as you know, about dogs in parks. we have 317 acres and god knows there's plenty of room for both of us. man and his best friend. early in the morning people before they go to work will walk their dogs or go on a jog themselves with their dogs. joggers love the park, there's 7 miles of hiking trails and there's off trail paths that hikers can take. all the recreational areas are heavily used on weekends. we have the group picnic area which should accommodate 200 people, tennis courts are full. it also has 3 playground areas.

the ampitheater was built in 1972. it was the home of the first blues festival. given the fact that jerry garcia used to play in this park, he was from this neighborhood, everybody knows his reputation. we thought what a great thing it would be to have an ampitheater named after jerry garcia. that is a name that has panache. it brings people from all over the bay area to the ampitheater. the calls that come in, we'd like to do a concert at the jerry garcia ampitheater and we do everything we can to accommodate them and help them because it gets people into the park. people like a lot of color and that's what they call a park. other people don't. you have to try to reconcile all those different points of view. what should a park look like and what should it have?

should it be manicured, should it be nice little cobblestones around all of the paths and like that. the biggest objective of course is getting people into the park to appreciate open space. whatever that's going to take to make them happy, to get them there, that's the main goal. if it takes a planter with flowers and stuff like that, fine. you know, so what? people need to get away from that urban rush and noise and this is a perfect place to do it. feedback is always amazement. they don't believe that it's in san francisco. we have visitors who will say, i never knew this was here and i'm a native san franciscoan. they wonder how long it's been here. when i tell them next year we'll get to celebrate the 80th anniversary of the park, equal

everybody and thank you for being here to witness and a celebrate the signing of dues process for all ordinance in san francisco. and first, i'd like to commend supervisor avalos for your work supervisor in bringing this important legislation to this body before the board and public. i want to thank all the other supervisors as a role wholly know they spent a lot of time on this to think about the changes we're macro and i especially want to give a particular things to tang and kim for oh, amendments it strengthened the ordinance itself. i also want to give a very strong thank you it the numerous agencies about public safety but

the cabinet rights ease the cabinet advocates many are in the room today including the groups that xhiepsz is rights committee i had the opportunity to hear the stories of victim who were getting tangled up with icing detainers for trying to cooperate with our police department. i'm also glad to have our police chief and he also is the first chief in the state of california to support assemblyman trust act which all of you has been signed by governor brown. thousands of our members of our limited english and immigrant community, in fact, all our commensurate's live in fear of

did he portion and they've mistrusted the system. so this is a message i want to send by the signing of this ordinance and i'm speaking to our immigrant communities that's it's safe absolutely save to call the police if you're a victim or witness to a crime. everyone knows we need to stand against s come we also retain some local flexibility to deal with violent felons and while we compromised on that aspect of it and understood how complicated that was that perhaps we had points of view on we never lost sight of getting rid of s came.

so we do what i think other government's should do we found the common ground and that's why i'm proud to be signing this ordinance. i'd like to take p the opportunity to invite supervisor avalos what it's meant to him but basing also to the rest of the city. thank you, mr. mayor. and i want to thank you for your work on this legislation. we met in early august to discuss this item and i was very impressed with how much you thought about the issue and what the city is facing and the immigrant in inform and around this country is facing with the s come system. your well, with our staff.

i want to thank law enforcement as well as for your input in contrast this legislation and thank you sheriff and the police departments who helped craft this legislation. i most of all, i didn't bring this legislation forward as the defense economy did interest i represent a district about 50 percent of usor foreign-born so some people on the street have experience with immigration that are really unfair to the contributions they're making in san francisco but the organizing that was good morning and the conversation was very, very strong and actually passing this legislation and doing the advocacy puts you tell u us at a higher level to protect immigrants. and the relationship we build

between government and community will strengthen our police efforts to make us safer. and most of all, i want to thank people like nellie who got entangled as a victim and later spent 8 months facing deportation procedures. no one should have to have fear of calling the police wondering if they're going to get deported. people should be able to come forward as witnesses or victims and this legislation helps that happen. as the mayor said no one here should have any fear again if you're immigrant call the police whether you're a victim or witness. i want to thank the colleagues. i do want to thank supervisor

kim for helping to bring forward amendments we worked all agree on to move forward this legislation. everyone are regardless of our citizenship status should have due process and it's a constitutional right and it's the fifth amendment of our constitution and we here in san francisco uphold that and we say that our values should drive our values. thank you, mr. mayor. look forward to your signing this legislation (clapping) there it is, done (clapping) i pledge allegiance
