futile and administrative agency was clearly declared on a particular case and that's in the city of dana point case where the outcome of this is clear. we cannot apply for an excavation permit and if we do we will be denied because we haven't got the smf approval so i would argue this is ripe for the commission to review it right now. >> understand what at&t is suggesting, however, within an order of denial we have always been consistently stating and informing the at&t that the reason for the denial was we request at&t to identify internal facilities from all indications based upon review

from staff. this is the only location for all three permits. these are solo locations so the suggestion from at&t is in these kinda cases you're required to approve it, there's no alternative, regardless whether it's public comment, objections or not, unlike what has happened previously that was appealed at this board on 22nd avenue where alternative location was identified working with the community. >> in these kind of cases the department suggests that in order for it to be fully effective that the process needs to be followed that there should be this approval of an excavation permit in this case, a denial excavation permit to effectuate this similar process as we did to the previous matter that came in front of this board for surface

decisions regarding permits, the issuance or denial of permits and i understand the frustration that's been expressed on the other side, but until we know what the permit is, then -- and until the permit has been denied, then i don't think it's here yet so there should be an application for a permit. it wouldn't necessarily -- if dpw makes it impossible for at&t to file a formal application for permit then i think at&t should send a letter to dpw that satisfies the requirements for an application for permit requesting that the permit be granted so that we know what the permit at issue truly is that at&t has satisfied all conditions of the permit and dpw has a chance to say we are denying the permit for reasons one, two and three in this letter or this

and today we're going to be talking with a residential building owner about what residential building owners and tenants can and should do before earthquakes and after earthquakes. ♪ ♪ >> we're here at this wonderful spur exhibit on mission street in san francisco and i have with me today my good friend george. thanks for joining me, george. and george has for a long time owned residential property here in san francisco. and we want to talk about apartment buildings and what the owner's responsibilities might be and what they expect their tenants to do. and let's start by talking a little bit about what owners can do before an earthquake and then maybe after an earthquake. >> well, the first thing,

lawrence, would be to get together with your tenants and see if they have earthquake insurance or any renters insurance in place because that's going to be key to protecting them in the event of a quake. >> and renters insurance, there are two kinds of insurance. renters insurance coffers damage to goods and content and so forth. earthquake insurance is a separate policy you get after you get renters insurance through the california earthquake authority, very inexpensive. and it helps owners and it helps tenants because it gives relocation costs and it pays their rent. this is a huge impact on building owners. >> it's huge, it really is. you know, a lot of owners don't realize that, you know, when there is an earthquake, their money flow is going to stop. how are they going to pay their mortgages, how are they going to pay their other bills, how are they going to live? >> what else can property owners do in residential rental housing before an earthquake? >> well, the first thing you want to do is get your property assessed. find out what the geology is at

your site. get an expert in to look at structural and nonstructural losses. the structural losses, a lot of times, aren't going to be that bad if you prepare. an ounce of prevention is worth a pound of cure. get in there and get your property assessed and figure it out. >> so, what is a nonstructural issue that might cause losses? >> well, you know, pipes, for instance. pipes will whip around during an earthquake. and if they're anchored in more numerous locations, that whipping won't cause a breakage that will cause a flood. >> i've heard water damage is a major, major problem after earthquakes actually. >> it is. that's one of the big things. a lot of things falling over, ceilings collapsing. but all of this can be prevented by an expert coming in and assessing where those problem areas and often the fixes are really, really cheap. >> who do you call when you want to have that kind of

assessment or evaluation done? >> the structural engineering community is great. we have the structural engineers association of northern california right here in san francisco. they're a wealth of information and resources. >> what kinds of things might you encourage tenants to do besides simply get tenants renters insurance and earthquake insurance, what else do you think tenants should do? >> i think it's really important to know if they happen to be in the building where is the safest place for them to go when the shaking starts. if they're out of the building, whats' their continuity plan for connecting with family? they should give their emergency contact information to their resident manager so that the resident manager knows how to get in touch. and have emergency supplies on hand. the tenants should be responsible to have their extra water and flashlights and bandages and know how to use a toilet when there's no sewage and water flows down.

neighborhood. i was born and raised four blocks from where we stand today. i came and played in this park, on the equipment, in the you know what i mean you know jim gym and structure today. >> to make this a park that everybody can enjoy, a diversity that would show the city that this is what san francisco is all about. >> what we got here is 3,000 new square feet of places for people to be healthy and be active and the community to gather. >> if you see /kaelly's mural in the building, there cannot be an imagery that's more related to this place. what people told us about what the importance of the windmills and the green houses and the flowers that used to be grown here and the wind, let's not

forget the wind. >> we have to continue to invest in our city's infrastructure and creating new. this is a recreation center for the 21st century and for the 21st century communities. >> we finally made something after somebody that everybody needs and this is the park. >> when the new california academy of sciences opened in 2008, it quickly became one of the top tourist magnets in the city. part of the cal academies' astronomical success is the weekly nightlife party. >> i am joined by helen, who is here to school me on all the nocturnal activities that are getting ready to take place here. tell us a little about what we can expect to see at nightlife.

>> we open up the doors every thursday night at the california academy of sciences. there are certain things you can see every week you can go to the museum, visit the planetarium, and we bring in bars and a deejay or band. it is a different feel from during the day, something different every week. tonight , we have beer and music. -- tonight we have great beer and music. it is beer week. we have a dozen local brewers in african hall. we have a deejays to set up throughout the museum and a live performance at 9:00 p.m. tonight. >> what has been your favorite part as a participant or as an observer? >> my favorite part is to walk around the aquarium in to see people with a drink in their hands, getting to know maybe somebody new, may be looking for a day, or chatting with friends. there jellyfish. i mean, they are beautiful.

>> the culmination of the animals. >> it is very impressive. we do not have this at home. >> tell us a little about some of the spider's we see here on display. >> at the california academy of sciences, there is a very large collection of preserved and live specimens, which are the evidence about evolution. we have the assassin spiders, which are spiders that exclusively kill and eat other spiders. they are under the microscope here. research done and the california academy's i rhinology lab suggests that the assassin spiders have been doing this for over 150 million years. this glassed in room is a real scientific laboratory, and the people in that room are
