there are limits as to what the commission as a body can actually do with regards to individual projects. in addition the commission wears two different hats so one of your hats as the san francisco building inspection you have the conduct of building inspection and the amendment of the code that the dbi is involved with but you also wear the hat as the abatement appeal board. so there are instances in that regard you act as an entirely different body and your acting more in the capacity similar to a judge. so there's different rules of conduct so oftentimes that issue

comes into play where the roll you may be take as the san francisco building inspection can come back to the abatement appeal board for enforcement type of acts is that trigger that process. i urge, you know, caution in that regard because you don't want to do anything as this san francisco building inspection that my undermine the abatement appeal board if a project comes before you >> commissioner walker i'd be interested in hearing hearing our comments. >> yes. it's a fine line but of most importance there are several investigations going on and until those are complete and we have the reports before us

i'm the structural engineer for the terrace. happy new year mr. president, in regards to this project. the entire team from the design team to the construction crew apologizes for the incident. we take full responsibility for it. the structural design perhaps commissioners you're not aware of this the design was reviewed by the structural advisory committee. this is a group of experts. we spent hundreds of man-hours coming up with a comprehensive set of structural drawings that

included every detail in regards to the complexity of that project. dbi attended those meetings. the committee made out of a soils engineer a going lost and she or he engineer and architect. dbi did everything right. all the proper steps were taken. just to put this into prospective the sack review lasted 7 weeks and it costs over $67,000. i'm delighted that the chair of the committee is here. we had the geolost and harvey

was the the architect and steven wall street was the structural engineer. this was our group it would be labeled the best group. the set of drawings were approved. the work started approximately 8 weeks ago. this was a failure of implementation. like all accidents could this action have been protested? unfortunately, the answer is yes. we were very fortunate that no one was injured. we were also very cautious about the system. in fact, we had a full review that included wrapping it with

everyone know that the people who were involved have been in the construction industry for many, many, many years. the company involved with the showing plan has been in business for 75 years with an unblemished record. gentlemen that was a cat tropic accident but it was an accident. and they do happen that doesn't make it acceptable or okay. which is why we make the statement we're responsible. the project sponsor is trying to put the situation right. whatever corrections as far as processes and stuff we'll do whatever we have to do. that was the message i wanted to convey to you this morning

and acknowledge his apology. but we need to understand fundamental although this is a landslide site and excavation has started and stopped we're about to go into the winter and it's going to rain sometime and i want to encourage and i've had discussions with him to get the fountains in now. let's not let this site for the entire winter. they've carved out the hill we need to get the foundations into this building but we need to get the fountains in to protect my clients property to address the remaining wall on top of the hill. i've had discussions with some better implementation of this

project. i believe the building department is capable of working that out but get even though fountains in now much >> thank you. >> thank you. next speaker, please. >> good morning. i'm frank. i'm a geotech engineer i was with the with the building inspectors. the design process that was implemented was very thorough and complete and compasses a complete review. we required that the owner retain technical consultants and

geefts as well as the structural jerry. the plan was checked on two cargos. my objections are that while the design was thorough and complete the implementation of the design failed. it didn't meet the intent of the design. my observations are that the requirement of the special inspection when were part of the permit process could have been performed more thoroughly. i would encourage this commission to allow the foundation and g.e. logic shoring to continue as the gentleman has pointed out. we have an open cut. it's important that the rock

bolts be installed around the south property line. it's important that the shoring get in. it's important that the home that's sitting there be better secured if it's to remain. furthermore, my recommendation to dbi is we mandate continuous observation during this process. that the owners design team submit frequent and if that means daily reports daily those reports include photographs so the members of the dbi can, in fact, look at the photograph to see if there are any issues of what's being implemented but the important thing is we need to

install a foundation and basically shore the site. and we need to do that in accordance with the permit that requires special inspection and we need to have the dbi have the confidence that it's a being done through the proper reporting and memorializing with photographs. thank you >> thank you. is there any more any public comment? before i close? >> good morning, commissioners steve williams i've been representing the adjacent neighbors for a number of years

they asked me to come down and what's been said and securing the site and the cut that's been made in the hillside it needs to be shored soaps. the neighborhood can hear pieces of the building crumbling and they want it handled. they want the removal of the structure whatever that takes. this has been a demolition we tried to make this point in front of board of appeals and the planning commission. no one would listen it's a demolition and there's no way that the existing site is safer
