inspector also. >> all right, okay. >> let's see and make sure that that can be as efficient as possible for you. >> okay. >> next item? >> item 7 e, update on code enforcement? >> good morning commissioners, code enforcement and dbi dump the update. and if we are building inspections performed and there was 4491 inspections for the month, and complaints received, from building, there was 260. and complaints responsible for 24 to 72 hours, 235. complaints for the first notice of violation sent with 64. complaints received and abaited was 163.

and abaited and the complaints of notice of violations was 51 and the second notice of violations was code of enforcement was 17. i will have rose mary speak on behalf of the housing and the code enforcement. >> thank you. >> good morning, commissioners. as you can see from the chart that we or the housing division we keep monthly statistics that include what we have performed, 908 inspections and 338 new complaints coming in. and we have responded to just about almost all of those with the exception of 12 within in three days and some of these are anonymous complaints that require us to try to gain access and we can't get access to some of those, units and accounts for some of the ones that and sometimes, there is delayed entry. and as you can see, that we have got the numbers there, we

continued to work on our open cases, to try to get them closed. and later on, this morning, when you have some of the bigger cases in front of you, you will see our efforts trying to get the cases closed and we are still, doing that, between, now, and the last commission meeting, we actually gave detailed presentation to land use committee or the board of supervisors, on the department's code enforcement efforts. and so that, i think went well, and so we all got up there and gave a presentation as to what we do to try to manifest the presence and get the cases closed. and that also includes, heat complaints where i was before you a couple of years ago, where we actually tightened the time frames on how much time we give, for a notice of violation, depending on the type of heat. and those have shrunk down to some instances two days and if a property owner does not respond in that period of time, we are out there posting the building for a notice for a

hearing and doing the title research etc.. so the other report that i want to make is that the new inspectors have jumped in and carrying the full district and some are in the districts that are complicated and doing a fairly good job with that and so even though it does take amount, a year or two to get them completely trained, i think that we are very satisfied with the efforts that they are making. >> okay. >> thank you for that update. >> good morning, commissioners. and john for the code enforcement division. and for the month of january, we took 69 building electrical and plumbing cases to the director's hearing and of those 27, have already have abatement issued and 11 are under advisement and then, for the month, we abaited a total of 144 cases. that concludes our report.

have had a duplicate novs, for example, where more than, you know, twice, or even three times, the same nov was issued for the same problem, so sometimes those are taken off the books, when we recognize that they were duplicate, so i was wondering if there was a process, either the complaining neighbors, or whoever is following the novs would know that. why they have been abaited. why they have been taken off of our books. either they have moved up or they have been abaited. is there some kind of a book keeping for that? i don't know. do you want to speak to that? >> good morning, commissioners. under notice of violations if they are abaited if there is a permit taken and the work is completed to abait the notice

of violation, this is for building, the second notice was issued it goes up to code enforcement and even as a second notice of violation, if a permit is taken out and it is performed and a notice of violation is abaited if no work is being performed it moves up to a director's hearing and eventually it made. we have taken some of the cases as complaints and close them. because we don't want to say abaited on the case because there was no action taken. sometimes there will be a complaint for noise or dust and when we investigate it, we find nothing and we close the case just so that we don't have open, active complaints. , the grand jury said that we have so many open complaints that we went through the backlog and we tried to abait the ones that we could and closed the ones that had no

>> commissioner mccarthy? >> aye. >> commissioner mar? >> yes. >> commissioner clinch? >> yes. >> commissioner lee. >> commissioner mccray. >> yes. >> and commissioner melgar. >> yes. >> the motion carries unanimously. >> okay. we are to agenda item 8, discussion regarding 125 crown terrace and before we begin, i have a statement from commissioner walker, who unfortunately could not be here today. this statement is commissioner walker, i appreciate the time and attention given to the issue of the building collapse on crown terrace by the department and by the gsa, the project sponsor and the structural engineer on this project both have strong ties to our department. and in fact they both have served as president of this commission. this commission over sees the

department. the report issued by the department and the report issued by the gsa both layout that there were protocols and procedures of our department not followed by employees. they also spell out a very serious obligation that the building was not done according to approved plan and so i understand that there is a peer panel responsible for approving the plans for this project and i also understanding that the tower and footing were signed off by the special inspection and i requested a copy and i have not seen them, were there special inspections of the footing and of the towers? were there reports submitted? i have questions as to who is responsible for inspecting the tower and the footing is no one responsible to see if things this intraindicate are being implemented are they making sure that the towers are at least in the position as proved?

who signed the special inspection report indicating that they were in position as approved? i also ask if there were any materials in the house, that may have affected the stability of the structure, and i have not received an answer. additionally, it is of concern to me that evaluation of work done on this project was one 12th of the actual cost, if that is normal, as indicated by project sponsor, communication, then we need to review what is normal. and our data needs to be real and it needs to be activate and it needs to be updated to our system in real time. allowing cost, estimates to go through our system in any fashions that are a fraction of real cost is unacceptable. again, i appreciate the time, taken in reviewing the history and investigating more details of what happened, but that is the late agenda document delivered to illustrate what is being said in these reports if not given a clear picture of what happened. i have concerns that our protocol and policies would allow such a grave oversight. and in this case, one that

resulted in the collapse that could have led to injuries. i would appreciate a response to my questions to preside more information as to how our special inspections process allowed this kind of failure and, our commission, and under the charter of the city and to serve the city of san francisco and the general public, by insuring the life and property within the city and county are save guard and to provide a public forum in that process, and so in that end we are obligated to provide answers and make sure that it does not happen again, and the end of the statement. >> okay. >> we will take the public comment and if i may, call you to the mike,

the report. >> so with that, madam secretary? >> is there public comment on item eight, regarding 125 crown terrace? >> good morning, commissioners, good morning, director. and santos the instructeral engineer, and give you an update on where we are. and as you recall we had a meeting a few weeks ago, where we were urged to obtain soil, and foundation permit. and we developed a set of structural drawings that are compatible with the previously approved drawings by sac and we submitted the drawings to dbi and a permit was issued. and during that process, we also payed, penalty fees, for the deviation on the shoring permit and the fees between the original permit application fee and the ultimate valuation of

1.57 million dollars and so all of those things were paid by the project sponsor. and permit was obtained, and the permit was obtained for the thorough review of dbi in conjunction with supervision from sac, particularly mr. rolo and the structural engineers that are participate ant on that project. mr. tim matheson and steven lou. and the foundation, system is currently being implemented, and we have been asked by director tom hewey to provide a weekly report. weekly update, of what is going on in the project. and we have been doing so. including pictures and as we were instructed we are telling what we did yesterday and we we will do today and what we will do tomorrow and that has been

happening for the last two and a half weeks, the project is going extremely well. we have special inspections and the soil review, for the drilling as well as implementation of the shoring system. and we are working very closely with the neighbors in regards to the sections that may require shoring and under pinning and as far as the time frame to complete this foundation work, and we are anticipated an additional five weeks to complete this work. and again, thank you director for making dbi accessible and available to do all of the inspections. and we literally have weekly review from those reports as well as the procedures from dbi. and all of the special inspections have been implemented, and the soils and engineering and drilling, has been implemented. in terms of the next phase of

the project, as director hewey suggested at the last meeting, we have been sent back to planning. and so at this time, we are interacting with the zoning administrator, and mr. scott sanchez and let me just, emphasize that we have not changed the character of this project. we are treating it as an alteration. all of the pictures that have been sent to dbi, and the commission, are showing a section of the building that has been preserved, and this is an alteration permit. and we are in the process of getting an update to mr. scott sanchez in regard to the types of drawings that we need to submit. those drawings will require a new permit. and that permit will be or

usually exposed to a potential appeal, but we are going through the entire process and making this process, as transparent as possible because our desire is not only to regain the confidence of the commission, but also the public at large. and we are committed to making this project a successful project. and the entire team has remained a cohesive unit. no one has been fired, no one has been sued. and everyone is working together to make sure that this project is successfully completed. >> okay, thank you, commissioners. >> thank you. >> thank you. >> i get you a little bit of extra time there, because i think that it is important that your testimony, but please if you could keep your comments to 3 minutes i would appreciate it. >> going forward. >> next speaker please?

became available apparently monday of whatever week it came out, we did not get a copy of the report, we thought that the project sponsor would have received a copy of it since it was about him, but when it was put into the public domain, we actually could not find it, we have looked at it and we are disturbed by the findings of the report for obvious reasons and, we are devieted that the commission has given the impression that they want this matter reviewed and again, the comments made by the commissioner walker actually, i welcome it, because we would like to have our opportunity to address the report. and to point that out the

deficiencies in the report. there are deficiencies and the findings are not a picture of what actually happened and i have one advantage over you as a project manager and i know that this was not meant to happen. that this was an accident, and that you would not think that from the testimony of it after the accident, and i watched it again last night and if you go back and look at it and you ask yourself, fairly, was this a commissioner that is acted with comments like i will reserve comments and public opinions until i hear the facts. there were no facts issued within days of that. but this commission already seemed to have made the assumption that things were

meant to happen the way they did. and there were comments made that this looks to be a sight where the refewal to get around a demolition and we want let this happen because i am going to use it as an example going forward. so that the people as a guy that was nearly killed underneath that thing it was very upsetting to read that kind of thing, but we hope to have this on the agenda next month and we look forward to having our side of story out there which is going to be the truth. >> thank you. >> thank you, next speaker

staff, you know, supporting me and it was such a committee to help me quite a bit to get the history, and all of that is together to finding all of the facts, and i am finding the oversight by the staff and to make it right away and then with the help from the gst to help me to do an independent, you know, investigation, the investigation is also for me all the way down, and i am not exclude everybody yet in the investigated. and then to find, all of those facts out. and then, in the process, i also asked me staff to tell the truth and we present to you everything that we find out and for some reason i cannot disclose, you know in the

public i feel that the report does not reflect all of the findings and also we take proper action and you know, you remember right after the bic meeting at, you know the next day after and everybody get a copy of it and how we are going to deal with it and also, the follow up and additional action plan and spended time to read the report and that is about one inch and those who support, and the only first few pages is my summary. i spept the time and i watched the 49er game and i need to write my report, that is the sad part, over all i feel my staff do their job and then there is
