4:30 am
kind of dates put out there for so long and so be sure about that and get back to them. >> right. >> and good luck with that. >> thank you. >> okay. >> okay. >> yeah. >> thank you very much. >> okay. item 7 d, update on major projects? >> good morning, commissioners. tom hewe y director of months w
4:31 am
off and we will deal with other projects. >> and the types are major and larger. >> yeah, especially in the housing project in town, a number of cranes, you know, right now it looks like 47 and right now. >> and so a lot of these projects and the hunter's point would be a lot of those projects are getting funding now and they are starting to see which were approved almost a couple of years ago and starting to see the movement. >> yeah. >> that is good. >> all right. >> it is good to see. >> okay. >> any other questions? >> i have a quick question. if there is so much building going on and i know that one of the things that we wanted to do was make sure that we staffed up and the money is there in the public. and so i know that we had to slow down a little bit because of the office space, but could you give us a break down of
4:32 am
where if there is a particular department or division that is short right now? or how, or where are the open positions unfilled in the department. >> there are some, plan and checked that we can see, but i don't want to feel it too much there, because, i expect them to legal, you know, maybe approve, and then, also, the inspection i'm concerned, when is the illegal and the pace and then i need to hire a few more housing, electrical, plumbing and building. and at that time, i, you know, i will see all of them or not. but, the building boom, right now, asking too many but for the retiree that we can see right now. >> well, one of the goals because we had the open positions and because they were
4:33 am
approved and that we would try to get rid of some of the prop f position and they were kind of a stopgap i think that we used to fill in 2012. and also because human resources was a little behind on their lists and so if those things have been taken care of, you know, if the human resources, especially on the you know, the clerical lift and things like that and they are up to date from the testing and you have a list to work from, i don't see why we should not hire the permanent positions, because, what we heard, from the budget director was also that, we are not filling some positions for the office space problems, but prop f people take the office space too, so if we have the approval for the permanence, and we have, and it is in the budget, why would we not try to fill those positions? >> yeah, actually...
4:34 am
>> you know, get rid of the prop f positions. >> yeah, the electrical and the inspector and we get some work done in the phase in the hour and after the training. and some work for prop f. and is there the only way that the time that we are sure in their office too to, you know, us and over all it is not that many prop f, eventually we will, you know, remove it and then we will have the permanent position, there. >> okay. >> yeah. >> and i think that should be the goal, you know, if we have the permanent positions if they are opened, and if they are, and if we are able to fill them, we should fill those. >> yeah. >> okay. >> and once again, you know, please make sure that we are going forward with the improving our space there so that we have room for these people coming aboard here. you know? >> yeah, that is my goal. >> yeah, i know that it is kind of out.
4:35 am
>> but it looks like we are going to be staffing up because of for example, the illegal units and i think that the general con census is that we will have enough work for everybody here for the next couple of years minimum and so, whoever is dealing with the human resources side of things that our list is current and we are not kind of chasing our list that we have the ability to go straight to those list and take from them and bring the people in for their examination and interviews that we are not and that is current, and we are in good shape there what really happened in the past is that we have to and it is actually the turn around time in your estimation and getting someone hired if you do choose? i know that it was almost a year when we started this journey a couple of years ago. >> it depends on the composition and some time, some robot. >> yeah. >> some what of the position that i had. >> has that improved? >> it has improved, like we get
4:36 am
the lease of the inspector, and engineer always, have released and then, also, the housing inspector also. >> all right, okay. >> let's see and make sure that that can be as efficient as possible for you. >> okay. >> next item? >> item 7 e, update on code enforcement? >> good morning commissioners, code enforcement and dbi dump the update. and if we are building inspections performed and there was 4491 inspections for the month, and complaints received, from building, there was 260. and complaints responsible for 24 to 72 hours, 235.
4:37 am
complaints for the first notice of violation sent with 64. complaints received and abaited was 163. and abaited and the complaints of notice of violations was 51 and the second notice of violations was code of enforcement was 17. i will have rose mary speak on behalf of the housing and the code enforcement. >> thank you. >> good morning, commissioners. as you can see from the chart that we or the housing division we keep monthly statistics that include what we have performed, 908 inspections and 338 new complaints coming in. and we have responded to just about almost all of those with the exception of 12 within in three days and some of these are anonymous complaints that require us to try to gain access and we can't get access
4:38 am
to some of those, units and accounts for some of the ones that and sometimes, there is delayed entry. and as you can see, that we have got the numbers there, we continued to work on our open cases, to try to get them closed. and later on, this morning, when you have some of the bigger cases in front of you, you will see our efforts trying to get the cases closed and we are still, doing that, between, now, and the last commission meeting, we actually gave detailed presentation to land use committee or the board of supervisors, on the department's code enforcement efforts. and so that, i think went well, and so we all got up there and gave a presentation as to what we do to try to manifest the presence and get the cases closed. and that also includes, heat complaints where i was before you a couple of years ago, where we actually tightened the time frames on how much time we give, for a notice of violation, depending on the type of heat.
4:39 am
and those have shrunk down to some instances two days and if a property owner does not respond in that period of time, we are out there posting the building for a notice for a hearing and doing the title research etc.. so the other report that i want to make is that the new inspectors have jumped in and carrying the full district and some are in the districts that are complicated and doing a fairly good job with that and so even though it does take amount, a year or two to get them completely trained, i think that we are very satisfied with the efforts that they are making. >> okay. >> thank you for that update. >> good morning, commissioners. and john for the code enforcement division. and for the month of january, we took 69 building electrical and plumbing cases to the director's hearing and of those 27, have already have abatement issued and 11 are under
4:40 am
advisement and then, for the month, we abaited a total of 144 cases. that concludes our report. thank you. >> okay. >> is there any public comment on the director's report items 7, a through e? >> good morning, robert davis again, and i was wondering if you would consider opening a satellite office in the bay view, you are looking for space and you are trying to hire people and we have office space and the south east is where all of the buildings are going to be for the next two years, thank you. >> thank you. >> which item do we need to go to next? >> just a question. >> ross mary indicated that there has been a presentation on enforcement to the board of
4:41 am
supervisors. mr. davis, asked that we set up a satellite, i am wondering if there is a place in between that there might be a time for bic to go out, to the south east, and make a presentation, in these critical areas, about what is going on, with reinforcement or enforcement to talk about the neighbors about our plan. >> and this seems like a good idea, i think. because we have done some presentations with mostly what working with the supervisors, and in the respectful districts. so maybe, if the supervisor cohen out there might want to host a meeting, i am sure that the department staff and other folks would be happy to go out there. >> yeah, commissioner mar. >> actually, in the background, i am working with the supervisor cohen, and trying to
4:42 am
for the out reach, you know, in the bay view area around march and you know we did not set up the time yet and maybe that is set up for kd and then my goal is slowly go to each district to wish them for the different ordinance, like the soft story, or the illegal unit or other stuff. when you do that make it a part of the agenda with a regard to a satellite office and that district can be very popular. >> i don't know how deliverable it will be, but i would definitely be interested in it. >> i would like to have a question, >> yes, sir. >> for the staff? you know, whoever wants to take it, regarding this code enforcement and novs. because it was raised earlier that sometimes novs are taken off the books, but it should be clear, either they are abaited
4:43 am
or if there is also a, i don't know if there is a data point, where i know in the past we have had a duplicate novs, for example, where more than, you know, twice, or even three times, the same nov was issued for the same problem, so sometimes those are taken off the books, when we recognize that they were duplicate, so i was wondering if there was a process, either the complaining neighbors, or whoever is following the novs would know that. why they have been abaited. why they have been taken off of our books. either they have moved up or they have been abaited. is there some kind of a book keeping for that? i don't know. do you want to speak to that? >> good morning, commissioners.
4:44 am
under notice of violations if they are abaited if there is a permit taken and the work is completed to abait the notice of violation, this is for building, the second notice was issued it goes up to code enforcement and even as a second notice of violation, if a permit is taken out and it is performed and a notice of violation is abaited if no work is being performed it moves up to a director's hearing and eventually it made. we have taken some of the cases as complaints and close them. because we don't want to say abaited on the case because there was no action taken. sometimes there will be a complaint for noise or dust and when we investigate it, we find nothing and we close the case just so that we don't have open, active complaints.
4:45 am
, the grand jury said that we have so many open complaints that we went through the backlog and we tried to abait the ones that we could and closed the ones that had no action taken. if action was taken and it would be abaited, if there is no action, as far as there is no work that we could find, that had any violations we close the case. if we send it out, we put a comma on it. >> if we close it, we put the comma, why. >> there is a reason. >> okay. >> thank you. >> thank you, deputy. >> is there any more comments? >> seeing none. >> which item would you like to go to? >> what we will do is... >> do you want to take a vote? >> let's go back to where we started with the meeting number
4:46 am
three excuse me number four. >> we are on item four. election of the bic president and vice president. >> and so, as tradition, at this time of the year we are back to where we are or where we need to reelect our different seats and officers, and so, with that, i don't think that we have, >> i move the reelection of mr. mr. carthy and mr. mar. >> second. >> and we could look at the same time. >> call the question? >> do you want it? >> do you want the public comment first? >> okay. there is... >> okay. there is a motion to reelect our current president and vice president if there is a public comment on that motion? okay. seeing none, then, >> does it need to be seconded?
4:47 am
>> i second the motion. >> i think. >> i think that he did. >> commissioner clinch did. >> okay. >> owe will do a roll call vote on this motion. >> commissioner mccarthy? >> aye. >> commissioner mar? >> yes. >> commissioner clinch? >> yes. >> commissioner lee >> yes. >> commissioner mccray. >> yes. >> commissioner melgar >> yes. >> the motion carries unanimously. congratulations both of them. >> and thank you, fellow commissioners. >> so the discussion of a possible action to appoint the commissioners serve on the litigating subcommittee. >> if someone would call that one. >> actually, could we call both of them together five and 6? >> okay. >> 5 and 6. together. and just, open it up to see if there is any commissioners that
4:48 am
want to switch or want to be on any committee. >> absolutely. >> okay. so 5 and 6, and so to include a discussion of possible action to appoint commissioner to serve on the nomination subcommittee? is there any discussion? >> if there is no discussion, maybe i will just propose that we keep it the same, on both committees. >> second. >> okay. >> commissioner lee has made a motion and commissioner mar seconded to keep the remaining officers on the litigation subcommittee as well as the nomination of the subcommittee. >> maybe we should also mention who the commissioners are on which committee. >> on the litigation subcommittee is currently commissioner mccarthy, commissioner walker and clinch and on the nomination subcommittee, it is commissioner lee, commissioner mar and commissioner melgar. >> call the question. >> okay. >> is there any public comment
4:49 am
on this motion? >> okay. seeing none, roll call vote. >> commissioner mccarthy? >> aye. >> commissioner mar? >> yes. >> commissioner clinch? >> yes. >> commissioner lee. >> commissioner mccray. >> yes. >> and commissioner melgar. >> yes. >> the motion carries unanimously. >> okay. we are to agenda item 8, discussion regarding 125 crown terrace and before we begin, i have a statement from commissioner walker, who unfortunately could not be here today. this statement is commissioner walker, i appreciate the time and attention given to the issue of the building collapse on crown terrace by the department and by the gsa, the
4:50 am
project sponsor and the structural engineer on this project both have strong ties to our department. and in fact they both have served as president of this commission. this commission over sees the department. the report issued by the department and the report issued by the gsa both layout that there were protocols and procedures of our department not followed by employees. they also spell out a very serious obligation that the building was not done according to approved plan and so i understand that there is a peer panel responsible for approving the plans for this project and i also understanding that the tower and footing were signed off by the special inspection and i requested a copy and i have not seen them, were there special inspections of the footing and of the towers? were there reports submitted? i have questions as to who is responsible for inspecting the tower and the footing is no one responsible to see if things
4:51 am
this intraindicate are being implemented are they making sure that the towers are at least in the position as proved? who signed the special inspection report indicating that they were in position as approved? i also ask if there were any materials in the house, that may have affected the stability of the structure, and i have not received an answer. additionally, it is of concern to me that evaluation of work done on this project was one 12th of the actual cost, if that is normal, as indicated by project sponsor, communication, then we need to review what is normal. and our data needs to be real and it needs to be activate and it needs to be updated to our system in real time. allowing cost, estimates to go through our system in any fashions that are a fraction of real cost is unacceptable. again, i appreciate the time, taken in reviewing the history and investigating more details of what happened, but that is the late agenda document delivered to illustrate what is being said in these reports if
4:52 am
not given a clear picture of what happened. i have concerns that our protocol and policies would allow such a grave oversight. and in this case, one that resulted in the collapse that could have led to injuries. i would appreciate a response to my questions to preside more information as to how our special inspections process allowed this kind of failure and, our commission, and under the charter of the city and to serve the city of san francisco and the general public, by insuring the life and property within the city and county are save guard and to provide a public forum in that process, and so in that end we are obligated to provide answers and make sure that it does not happen again, and the end of the statement. >> okay. >> we will take the public comment and if i may, call you
4:53 am
to the mike, >> i know this letter came this morning and i would appreciate that she has asked a lot of questions that she feels is not answered in the report. and is there something and could you take so maybe the next commission meeting we can update her when she is here on that. >> absolutely, and i will go through the specifics and provide those answers too. >> if you may make sure that is given to bill and the director. so that they can have that. i guess that it is okay to spopd. >> it seems to me that we will respond to the entire commission. >> okay, all right. and if that, and what we can do, then is make sure that the next commissioner meeting and i would appreciate if she had the answers before the meeting. >> okay, appreciate it. >> thank you.
4:54 am
>> and so, if you, and if commissioners can hold their comments, we can wait until we can take the public comment and then, address our questions on the report. >> so with that, madam secretary? >> is there public comment on item eight, regarding 125 crown terrace? >> good morning, commissioners, good morning, director. and santos the instructeral engineer, and give you an update on where we are. and as you recall we had a meeting a few weeks ago, where we were urged to obtain soil, and foundation permit. and we developed a set of structural drawings that are compatible with the previously approved drawings by sac and we submitted the drawings to dbi and a permit was issued. and during that process, we also payed, penalty fees, for
4:55 am
the deviation on the shoring permit and the fees between the original permit application fee and the ultimate valuation of 1.57 million dollars and so all of those things were paid by the project sponsor. and permit was obtained, and the permit was obtained for the thorough review of dbi in conjunction with supervision from sac, particularly mr. rolo and the structural engineers that are participate ant on that project. mr. tim matheson and steven lou. and the foundation, system is currently being implemented, and we have been asked by director tom hewey to provide a weekly report. weekly update, of what is going on in the project. and we have been doing so. including pictures and as we
4:56 am
were instructed we are telling what we did yesterday and we we will do today and what we will do tomorrow and that has been happening for the last two and a half weeks, the project is going extremely well. we have special inspections and the soil review, for the drilling as well as implementation of the shoring system. and we are working very closely with the neighbors in regards to the sections that may require shoring and under pinning and as far as the time frame to complete this foundation work, and we are anticipated an additional five weeks to complete this work. and again, thank you director for making dbi accessible and available to do all of the inspections. and we literally have weekly review from those reports as well as the procedures from dbi. and all of the special
4:57 am
inspections have been implemented, and the soils and engineering and drilling, has been implemented. in terms of the next phase of the project, as director hewey suggested at the last meeting, we have been sent back to planning. and so at this time, we are interacting with the zoning administrator, and mr. scott sanchez and let me just, emphasize that we have not changed the character of this project. we are treating it as an alteration. all of the pictures that have been sent to dbi, and the commission, are showing a section of the building that has been preserved, and this is an alteration permit. and we are in the process of getting an update to mr. scott sanchez in regard to the types
4:58 am
of drawings that we need to submit. those drawings will require a new permit. and that permit will be or usually exposed to a potential appeal, but we are going through the entire process and making this process, as transparent as possible because our desire is not only to regain the confidence of the commission, but also the public at large. and we are committed to making this project a successful project. and the entire team has remained a cohesive unit. no one has been fired, no one has been sued. and everyone is working together to make sure that this project is successfully completed. >> okay, thank you, commissioners. >> thank you. >> thank you. >> i get you a little bit of extra time there, because i think that it is important that your testimony, but please if you could keep your comments to
4:59 am
3 minutes i would appreciate it. >> going forward. >> next speaker please? >> good morning, president and commissioners and director. and i'm john kilkan and further to my esteemed colleague, rodreguis briefing to you, on the current status, of 125 crown terrace, i respectfully ask you president, and commissioners, to put crown terrace as a formal action item on the agenda so that the team can present to you exactly how this accident or calamity occurred, we are in the process of putting all of that
5:00 am
information together. it was helpful that your advice of reason in the commentary by saying that you did not believe and that was not meant to happen and i thank you for those comments and i look forward to making a formal presentation to you in due course, thank you. >> thank you, next speaker? >> good morning, commissioners i was a manager on the project and i still am, and there is not much more to ad
