12:03 am
may 27th and item 13 to march 13, 2014. >> second. >> commissioner sugaya. >> yeah. sorry i have a followup up to that and workforce development. i looked at the website for that sf plaza and there's a statement in there that says only city property over 27 feet and outside of the rec and park department jurisdiction is needing some clarification as far as next week as part of the continuance >> yeah. >> thank you. >> on that motion. >> commissioner moore. >> are before you take roll the expansion meeting will continue prior to its regular calendar to

12:08 am
up the good news is first of which is not a planning issue i'm happy to hear there's a dress code no sprukt superior court most people know what the dress is but some area of confusion but it's certainly a step towards a more better appearance in our public facilities. the other thing along those same lines i read in the chronicle that the school district is going to implement discipline after two hundred years the article in the chronicle idea they have behavioral things to
12:09 am
implement in the classroom that weren't been done before marrying this is a step that's long overdue they're making it more complicated than it has to be by giving it acronyms that's a good start they may attract more families to move and keep their students in public schools. i have a question on proposed state legislation with the ellis act this is targeted for one jurisdiction which is odd if you're passing legislation for the whole state of california it seems to not make sensea
12:10 am
the same issues could exist in other parts of the state. the other thing there's no means test, no, you know, those who would be tenants wyoming be subject to this legislation would be elderly or disabled and my fear is most people if you paint are a with a broad brush there's many people who take advantage of the low rents outside of san francisco and theoretically don't spend 50 percent of their time there you have to differentiate between the people's whose lives are disrupted and can't afford to move or people who are benefiting from the system.
12:11 am
i hope as this legislation moves forward those things are tuxedo. some days the things we do have unintended consequences and the rising rents keep the unit off the market. so rather than have to put up with the rules they find other ways to pass them into ownership status and waiting until all the tenant move out it's hard to say. but i found that interesting i'll try to do more research on my own to find out >> commissioner sugaya. >> yes. yes morning i attended the ribbon cutting and the opening of the center for youth well in-laws out in the bayview
12:12 am
at the 3450 thirds street the mayor was there and the attorney general was in attendance and supervisor cowen it was a well attended event and as you remember we had a little bit of controversy over it from some neighborhood people but it seems like an excellent facility. >> commissioner moore. >> i read an article yesterday, i want to bring to the commissions attention we all know post street particularly in the upper floors you have art galleries and other speciality services and apparently on 77 gary which had at least five or
12:13 am
six art galleries all have been tempted for offices. many of those galleries have been there between thirty and 15 years. so they're part of this network of culture and maine arts in the city that's being displaced. art galleries among others sponsor local artistry inhabits that's the only way to see the larger opinions and sculptures so i'm very concerned this is just the beginning and i hope we'll find a way to address that more constructively >> if there's nothing further commissioners item 10 directors
12:14 am
announcements. >> thank you. good afternoon, commissioners. just wanted to keep you, you updated on the mayor's office of housing task force. president one way or another went to that there was 75 people in the room. there was a broad discussion more specifically the mayor's staff is asked to break down the group into 3 topic areas for the next 3 months. one will be process improvements that the city development level including the planning department and the legislation and third financing and revenue considerations. again with the goal of improving funding for middle and low income housing human resources those will meet over the next
12:15 am
few months and by midsummer announce the changes in the categories. so the department will be involved in at least 2 of the committees and we'll keep you informed that concludes my report >> may i say i appreciated those quick updates and moving of the changes but i appreciate the snippets. >> commissioners item 11 review of past events from supervisors and boyle's they didn't meet this week. >> good afternoon. i'm with the planning staff to give you, your weekly report. on monday at the land use committee they heard will the property that is located in the
12:16 am
tenderloin. it is changing the zoning to enable the existing landmark building to be eligible for landmark rights and both the commissions recommended approval this week they made the same recommendation to the board. also at the land use committee they allow certain structures to be rebuilt and on february 6th it was at that hearing the commission voted to recommend approval. as there were not 4 affirmative vote it was not recommend. it expired so without any action the de facto recommendation was disapproval. so at the boards meeting on monday there were no speakers in opposition but a handful in
12:17 am
support of the ordinance. supervisor kim moved to amend the ordinance so the specific change said it will apply for the lot number. and that's the block and lot number where the proposed apple store will be proposed. on tuesday at the full board the landmark designation for 660 california street was approved on first reading arrest also the technical amendment for the impact fee was approved and lastly the waterfront ballet high limit right to vote to several city departments for
12:18 am
analysis it includes the port and our department and the controllerer and the office of economic enforcement and all of those agencies under the proposed resolution will report on the impacts if it were to the passed and the future for affordable housing infrastructure and transportation and a open space as well as a tax base so timing was a factor in this resolution would have required that report to be done open march 6 it was sent to the full board without a hearing in advance so items such as this that are sent to the full board need a name vote and will receive comment at the
12:19 am
board also resolutions that are sent to the full board first, they need another vote and 8 votes would be needed at the second meeting. so at this week's meeting supervisor wiener asked it to be sent to the land use. the city attorney advised the other equally committee would be the rules committee and stated a march committee would be arranged and supervisor wiener and 1ek9d by supervisor breed approved it and asked it to be sent to the rules committee. so it's pending before a rules committee. i have several introductions from the board members none of
12:20 am
those are the planning code so we'll not be hearing about those arrest supervisor farrell talked about homelessness and they were separate for hearing specifically focusing on lgbt and age use and veterans and seniors and the housing lard and the on cost effective strategy for addressing homelessness. supervisor avalos and 7 accountability supervisors introduced the city local hiring ordinance about applied to all properties around san francisco and supervisor avalos and the same 7 supervisors introduced at the ordinance that would require first source hiring requirements
12:21 am
for commercial projects to disclose to the city the principal positions for those projects. also, they would need to disclose the anticipated wages and the apprentices levels. lastly the supervisor talked about a funding source for housing in california that concludes my report unless there's questions >> commissioner antonini. >> yes. ms. rogers thank you. i want to get a clarification for the procure you said if there's no committee meeting referred directly to the whole all the supervisors that it required a unanimous vote for the measure to pass >> on first reading.
12:22 am
>> first reading? >> that's correct. >> and it would take two reinforcing. >> if they're not heard by committee they need two hearings the first would have to be unanimous and the 8 vote would be a vote for the committee hearing. >> and unanimous is that all in attendance or the 11. >> i'll have to talk about that. >> as we've seen there are many times that committee can lock legislation or change it. also on the final items the feral homelessness and the hiring legislation might be further reports by the way, we have issues about, you know, itself hiring practices and even though it's not dribble a planning issue it's part of what we're considering and knowing be
12:23 am
a little bit more about the legislation and whether it applies to just within the city and county it sounds like it's 25shg9d at private sectors >> one will target the city and their local hiring practice and the second would look at the first source hiring that applies to private developers. fittings if that's okay. we can work with the president and vice president and making a recommendation on that >> also the homelessness issue. >> those are not ordinances hearing requests. >> hearing requests. anyway it's important to hear because it's an issue before us frequently >> thank you. >> thank you. >> and the board of appeals he
12:24 am
met with two items of terrorized their tha they held their officers elections the second is the 1050 valencia street under consideration view was passed and in december the board of appeals sought to remove the fifth store from the building and had findings to be adapted at a later date that was considered last time. prior to the hearing they convened 2, 3, 4 closed session to talk about the threats that were made by the project sponsor and changes that were made by the board and after that the board reconvened and held a hearing on the adaptation of finding they modified a few
12:25 am
finding the,of course in regard to the fifth floor to reestablish the fifth floor but have setbacks of 10 to 12 feet at the front and rear. the number of units should not change 12 should remain and also that the ground floor use must be occupied by a use and it was adapted unanimously. there's a 10 day rest period before it becomes final that's it >> we can move on that to the any public comment? members of the public may address the commission on
12:26 am
matters that are within the commission's jurisdiction and are not on today's agenda each member of the public may address the commission up to 3 minutes >> open this up for public comment. >> good afternoon, commissioners. my name is julian i represent the coalition of park merced. i have a appeal before the board of appeals i have had several appeals in regards to tree removals along the park merced area. we believe that those trees should remain there and we also building that the trees that have been removed along brotherhood way and this body approved back in 2010 we've
12:27 am
asked for clarification from one of our planners mr. cooper in regards to what the response is of the city in terms of the removal of those trees and the defines of the draft dir. if i may i do have the draft dir here will i'd like to show the commissioners what we're talking about. what part of san francisco we're talking about so i want to put it on the overhead here. commissioner we're talking about this section along brotherhood way this is the southern slope of park merced. those trees along this slope are supposed to be preserved under the draft eir and those
12:28 am
condominiums are being built by come stock holmes those trees are already removed and park merced has taken the dirty task of removing the trees along brotherhood way. it estates here open roman numeral months of the trees on the project site including those - including those along the southern slope will be removed or relocated. we've tried to get a response from the planning department from mr. cooper and we've been stone walls and would like your body here to take up this question as to why those trees
12:29 am
are being removed in defiance of the draft eir. thank you >> linda chapman i'm bringing you the report if coalition for san francisco land use committee that was distributed and perhaps he knows afterward you may get a change to read it is about 1601 larkin and the concerns that are important. and the way that neighborhood association are allowed to work and normally work at ethics and set forth e so forth arrest the gentleman said we've been to two hearings two different projects that was called mitigation was cash money being given to some group or another saying we represent the community and
12:30 am
that's not mitigation mitigation is related to the sequa or planning code. steve has written an ethics thing we'll be describing later and now the gentleman is prepping for the city attorney to be transmitted about the loop as a church sacrificing we ought to be able to evade the planning code or sequa because we're a church but once you begin allowing that they go into court and sue and submit
