10:01 pm
>> thank you. >> good afternoon, commissioners my name is patrick i'm a 40 year valley residents and carpenter and one of the co-founder of the market. i've known vince for decades and despite the birthing of being irish he's a good bloke and he's run his business great (laughter) >> i remember the neighborhood projects that got started in the bar and on like stained napkins. i met my wife in the nova valley
10:02 pm
residence we had our reception in the bar in the backyard area in 2001 it was a wonderful event in case you're interested i do have some pictures of the wedding i'm happy to give you to look at (laughter) otherwise i'll be divorced if i don't get the pictures back. there are so few places in the neighborhood that do a continuous history. this is an important thing for the nova valley per we lost josh apple who was one of our san franciscans we can't for the record to lose much more of our neighborhoods and community. i would strongly support that
10:03 pm
and i hope you agree with it and whatever restrictions you place on vince he'll squirm but he'll be happy to obligate >> i'll pass around the pictures. >> i think you should keep them in the interest of your marriage. >> thank you for allowing me to speak. i'm michael i've been a resident in nova valley for seven years i want to say on behalf of vince i've known him and went to 80 his taven and he's a great stand up person he building in his community and frairp that's why i continue to go to that bar it's a neighborhood bar and like the gentleman before me we're
10:04 pm
losing so much of this neighborhood in san francisco this bar here in noah valley you feel you have great neighbors and a really good worker class family to have a beer after work. i hope you agree and noah valley needs to stay the way it is and pass that for san francisco as a whole interest thank you >> thank you. >> hi, thank you for the opportunity to speak in support of this noah valley. the valley taven is my favorite bar and i've been a loyal
10:05 pm
customer. the noah valley taven is a place where the neighborhood meets. the bar draws a difference crowd spanning generations and backgrounds and it's a place i've formed a ton of friendships. valley taven many of us know each other and we share and unwind after working or on the weekends. we can have interesting conversations with an old friend or someone you meet because the atmosphere s is respected. that's fairly well maintained and cleaned. the backyard is a truly good
10:06 pm
amenity. the backyard has been quiet and that's why it's special it allows a quote outdoor space for us to relax and sit and enjoy a beer or read a book. so with that, it's my sincere hope you'll consider lettuce have our neighborhood patio for the people >> thank you. >> good afternoon, commissioners my name is is todd affidavit and for identification purposes only i'm the president of the friends of noah valley the neighborhood association. i'm in full support of the valley tavenz conditional permit. i think you can kind of get a
10:07 pm
feeling for noah valley we know each the neighbors and vince have been in the neighborhood for thirty years and they contribute to the local school and went to city attorney phillip's and they work at the bar and vince with one of the few people i actually buy him a drink every now and then. i often joke around and say all of noah's problems are handled at the bar. the outdoor patio one of the things that needs to be enthused there were meetings that were held and those issues got worked out. it speaks to the community
10:08 pm
s.p.c.a. of noah valley and how vince and noah valley fits into the fabric of what makes our neighborhoods special. thank you very much >> thank you. >> my name is adams all i want to say is the patio was when it was opened was a great part of the neighborhood i would basically go through on a lazy sunday afternoon and i read a very long book 2 thousand pages of material i read back there
10:09 pm
. i hope you approve this for conditional use >> hi, i'm matt i've lived through for 32 years that garden has been opened. i have friends from all over the country and people love how european it is it's part of the image of san francisco how lovely it is you should come out driver's license after you approve this conditional use permit >> good afternoon. i'm greg i'm retired after 2 seven years at wells fargo you've been
10:10 pm
around noah valley for many, many years now. i think when we're talking about the opposition it's a beer garden there have been neighborhood who have complained about noise but i have lived near the bar at the 541 elizabeth street i didn't hear noise. i heard a lot of owners saying in the backyard was open it might effect their property values but in terms of noise there was no noise. i think the conditional use this could be resolved in a very opportunity ethnic way.
10:11 pm
i've enjoyed the bar garden you can fwlaen information it's not just ordinary folks those are folks who have been contributing to the exultant. when i sit back there and listen to the tech folks you're almost on the cutting-edge of technology (laughter) and after awhile individually just by listening to people you can make relevant and significant decisions. i hope you look at those people those are fine folks they're not gangsters they've done some things with their lives and, of course, we're also going to be core dale to the neighborhood
10:12 pm
and mr. hogan has bent over backyards to talk to those folks and tried to alleviate problems. in the final analyze it would be a good decision to give him the trust and conversation he deserves. thank you very much and have a good day >> thank you. next speaker please. >> hi, thank you for your time i'm ricky live on elizabeth street behind the bar. the only noisy usually here is the usa and cutting as hours are being built in the neighborhood. on saturday mongers i get up earlier like at 4 i try to relax on saturday but don't get that
10:13 pm
relax but that's good for the neighborhood, too. i moved here recently from south carolina there was not a lot of bar activities and quickly adapted did bar as our neighborhood bar and as the young man mentioned getting married in the garden mile fiance are looking for the opportunity on labor day weekend so i encourage the support and voice also and hoping i'll be able to come back in several years and show you the pictures of my wedding >> hi, i'm another neighbor i've lived through 8 years i've noise sensitive and i've been
10:14 pm
going to the taven xrarsly for years now. i work from home and when the tech guys on the cutting-edge of technology i take my bar i love the back patio i'd bring breakfast and my friend was there at another place you can sit aside at the french place across the street. so it's sad it's closed i would love it if it were still opened but i like the bar too >> thanks next speaker. >> hello, i'm affidavit my wife and i moved to the noah valley and i joined the st. patrick's
10:15 pm
parish i used to hear the bells ringing i stopped hearing the church bells so one day after massey asked father tony is there a noise ordinance from stopping the bell ringing so i asked to ring the bell it happens ever nice and it feels good whatever you're in the neighborhood you hear the bells ringing and it's part of the fantastic pea the reason i bring that up is because vince a instrumental during the st. phillip's effectively he's helping out with the beverages and all that for making the
10:16 pm
effectively a success and going going back to the bell ringing thing now i've assembled a group of people and we have a number of people that ring the 0 bells and oftentimes we've had them at the valley taven and even in the back patio area. we liquor that on a saturday afternoon because it made the feeling even more special. i think the valley taven is an important fabric in noah valley it feels like a european country it feels like a pub where it's not like a bar scene it's more like a gathering place a place
10:17 pm
where things get down and old friends meet and visitor out of town take them there. hopefully, i'll be in the back patio once again thank you for your time >> thank you very much. >> good afternoon, commissioners. i'm nike live about a block and a half from alleviating taven and as someone that works for home it's a place to go to discuss with potential business partners all sort of things to work on. in this sense that's not just a place for local bar but i can generate more places for san francisco. to that end i think the back patio only series to move forward interests like that
10:18 pm
>> hi, i'm a long term resident of noah valley raising a large family there. i was going to speak to the character of vince but i think you've heard enough about vince 0 character we won't be able to live with him now. i want to say related to his participation in the neighborhood i don't know whether it's fortunate or unfortunate going through the local schools every time i'll been volunteered for something he's been standing next to me including make a lot of contributions out of his pockets to the activities that go in support of this school.
10:19 pm
i really was confused about this because so long as i've known vince the thing about the garden that was unique to me was the fact whatever someone was in the bar and said it's noisy in the bar they go out to the garden and that garden is an oasis and not a noisy active place it's where people go to get away from the noise. thank you >> thank you. >> good afternoon, commissioners i'm randy knox i'm a patriot. it's intended to be a quote place and it usually is. if you go to the bar they
10:20 pm
consider it their backyard. i was there i was invited to a party and beer was there i know that's not going to reoccur vince a sensitive to the neighborhood. that's a marriage to go to that place to read books and so forth i hope you'll support the project >> any further comment. yes >> copies of information i think you might have already of the material. vince and i have met and this is the original report incorporated into that. commissioners good afternoon. i'm eric i live on elizabeth street although this is a new
10:21 pm
application this has been in use for many years in the backyard. i am a small business owner and not insympathetic to mr. hogan's deserve a expand his business i agree to the proposed conditions. in 1993 the prior owner was denied a liquor permit and mr. hogan was denied but he continued to operate. without a strong set of conditions vicinities the zoning regulations. expensive conditions are required in order to make the special finding in code 145.2 when read in addition to this
10:22 pm
the commission shall find the activity is comparable with surrounding used to the operation of the design area that doesn't effect the privacy of the activity in the activity area it doesn't disrupt the neighborhood. in the draft motion those are high standards to meet and they've not been met without significant conditions of approval i'm hopefully, if the conditions are implemented the patio will be able to operate without unduly disturbing the neighborhood >> thank you. next speaker please. good afternoon, commissioners i'm mark i'm on 24th street i'm directly effected by noise from the valley taven.
10:23 pm
i have filed an official notice i'm going to read that statement and asking the commission to deny this. my first group is are interferes my privacy and licensing such premises will violate my privacy and it is stated with anything that is indecent or an bankruptcy so effects the quiet enjoyment over and over or any, any number of persons is a public nuisance. we've gathered only 9 signatures but i'm a renter but i think the problem is the area is question is a small condenses small area
10:24 pm
and the sound revisibility considerably and the noise is are a dramatic and intrusive and in addition it creates a constant sense of tension by the way, you never know when it's coming. the area is just not supportive of a bar. i would say that the bar has been operating as everyone has testified on and off for the last ten years outside of the liquor license and against the directive issue by planning commission that this space can't be used for commercial purposes. i have outstanding recommendations and i still want to voice my opposition and i'm asking the commission to deny
10:25 pm
this. this is a must not with a lot of activity and during the daytime hours and quiet innocence in the evening hours. as we work during the wing quiet sunday afternoons an important and there's many children in the family that's compromised by this >> next speaker please. good afternoon, commissioners i'm sue i live on elizabeth street. and i work at the home and my office is actually the further backroom in the house so every time there's could motion going
10:26 pm
on i hear it because it's a valley and the sound reverberate off one side of the mountain to the other we're next to the bar. i understand it's a bar and i have no problem people going to a bar but to have it noisy all the time because there's a garden isn't convenient. i don't want to get into anybody's way having a business but having kids in the neighborhood people drink and get business treasures and speak in not polite language. people need to be considering that and paid attention to everyone in the community. thank you >> thank you. next speaker.
10:27 pm
>> hello, i'm ellen i live on elizabeth street. our backyard faces the back of the noah valley taven. we've lived there for 15 years and i have two daughters 8 and 13. the valley that taven has only become a problem in the loose few years the earlier years we were having and raising children and making the difficult decisions to stay in the city and stay in the lottery system all that's difficult this was when we committed to staying in the city. in recent years when the operation of the patio creates the most disturbance is on the weekend. unfortunately, that's when we
10:28 pm
especially my duties are most libel to be out in the yard and we need to have the windows open to cool down the house. a couple years ago my daughter started committed on what we were hearing my older daughter said i'm happy to go home expect for the bar she said the yelling sometimes made her afraid. she also said when she was in bed she couldn't read. in her bedroom the windows are not operable those are yells she could hear from the double pained glass windows. i was to mention one day both my
10:29 pm
daughters ran through the yard they heard the f word and others. i had my daughters birthday party in the yard and became concerned about the language. although the music and noise and yelling has been awe envying over the years those recent comments that make me feel concerned there about this application and the yard is a two-story concrete wall and the acoustics amplify the sound and it's inerratic and or obscene. i feel a daily noisy bar is inappropriate for the residential backyards because
10:30 pm
the children are monthly outside. i'm encouraged by the point and the work that's been done about adding - >> ma'am, i'm sorry your time is up. >> next speaker >> good afternoon. i'm daniel wen beggar i live in ethic street that's adjacent our backyard our backyard is several doors down and wherein there are people in the backyard taven we hear them unless it's calm i've been there when it's been calm the problem is on the device when there are a lot of people back there.
