not reilly how long your other items would take along with the transportation authority to make this a reality. we know this occurs the traffic facilities occur throughout our city and we also know it happens that over 60 percent of our facilities happen on 6 percent of our corridors. if we even invested one of percent of our corridors over the next few years we'll be able to reduce our entries and fatalities by over half. our office is working with supervisor yee and supervisor avalos on putting some elements of vision zero into our quoted codes so we'll be bringing in an ordnance particularly around our police codes as well. and i'm sorry and we look forward to working with sfmta that has passed a resolution supervisor kim to resolution as well. i want to give up any time to
6:01 am
supervisor avalos >> supervisor avalos. >> thank you president chiu i wanted to say thank you to supervisor kim and supervisor yee for bringing those issues forward. the board of supervisors and the transportation authority have really taken leadership on a current crisis we're having. it's clear we can pass resolutions but the effort we've made and the hearings we've have brought u brought the agencies together. this leadership we've taken at the board is significant and we have to stay on our departments to make sure we're moving forward with clear plans around our 3 e's here so i look forward to working with you colleagues we've created a special committee on the transportation authority that will be meeting especially on our 24 project in
6:02 am
24 months that will enable us to make a difference rapid in the city for the bicyclists. supervisor wiener >> thank you, mr. president. i'm excel supportive of this i want to thank the authors. i know that the education and enforcement pieces will fall into place and i've seen an increase in enforcement it's terrific. and some of the activity in this board chambers has been some of the impetus in getting this done and the advocates in the community. i just want to and i know i so you do like a broken record but the engineering aspect is so important no matter how much education or enforcement being human beings we're not all tentative all the time we're
6:03 am
imperfect per we're not going to have police officers every where and fundamentally we have to redesign our streets to maxim maximumize safety for all. it takes money but i think we're seeing nor resources being dedicated to those redesigns both from our budget and also through development impact fees but the prop k problem is we continue to see bureaucratic bottle necks that water down and sometimes kill very important pedestrian and transit safety projects. unfortunate there are some departments that continue to make objections that negatively impact the prongs. i and others have been involved with the fire department in particular that has strong views. i have great respect for the
6:04 am
fire department but i respectfully san diego we saw a few weeks good in supervisor breed district extending a platform to accommodate two trains this fire department opposed that it that looks like it will be shoernd so whoever is stepping off the car is going into traffic. whatever resolutions we pass we have to follow up working and being really involved if the process so those departments know this is a priority. and had that those decisions really effect real people and have pronounced effects. so i look forward to working with you will have you those
6:05 am
projects matter and supervisor yee >> thank you president chiu. i also want to thank my colleagues supervisor kim and supervisor avalos for pushing in piece of levengs forward. i also appreciate supervisor wiener's comment about the engineering piece. i won of the things i've seen in the last few weeks is the enthusiasm of not only the public and the organizations and the people in this chamber but also in the departments coming together and, you know, trying to get ahead of the curbing i curve to move past those things. i deeply appreciate that. and i think if any city is going to be to accomplish this it's san francisco. one of the things i want to
6:06 am
remind ourselves whether it's two years from now we're enthusiastic about this issue we need to keep on being enthusiastic because it could easily disappear. so thank you very much >> thank you colleagues i wanted to audio i want to thank everyone for they're working on this and show our dedication and that being said any final commen comments? >> supervisor breed. supervisor campos. commissioner chiu. supervisor cowen. supervisor farrell. supervisor kim. supervisor mar. supervisor tang.
6:07 am
supervisor wiener. supervisor yee. supervisor avalos. there are 11 i's. the resolution is adapted. item 22. item 22 is an ordinance amending the health care on sale and use of electronic cigarettes >> supervisor mar. >> colleagues i'm joined by our health officer who is from the public health department and our tobacco free coalition who has led to pass a responsible policy on regulating electronic or e cigarettes today. this measure if we pass it today will be the strongly e cigarette legislation on any city in the united states. i wanted to thank the youth institute tobacco reduce like malaysia centers and the commissioners and many others from the b y d c and the
6:08 am
grassroots for helping to educate me. last december i introduced this legislation to strike it in san francisco it will amended the current health care and prohibit the electronic cigarettes where smoking is prohibited. i'm going to do a demonstration so i can see the simulation like at about electronic devices side when you inhale it a little light goes on and it emits a substance that has nicotine and other harm fill toxins in the room. it's important i had a banana flafrd one but other flavors from bubble gum and gummy bears and other flavors are not targeted at elders their
6:09 am
targeted at the teens and youth. different billboards that are in our coalition have put up over the year the e cigarettes are being sold in american people wild west lewd. alongside candy bars and they're in different types of flavors from the range of them i mentioned are really targeted at young people. right now nights to the regulated and this ordinance will help us understand the impacts it would prohibit the use of the electronic cigarettes it will require a tobacco permit for the sale of electronic cigarettes and prohibit the sale of tobacco produce.
6:10 am
i want to thank mayor ed lee in their office for the continued support and my co-sponsor supervisor chiu and supervisor avalos and kneeing for their sponsorships as well and other colleagues. in the past several months my office has worked with the hardworking public health department staff and the lead leadership and the uscf researches and the vietnam niece and folks to educate ourselves on this new industry. march 6 we held the rules committee that passed with unanimous support this ordinance and yesterday it received unanimous support under the youth commission and it was supported by other committees. with the growing popular the it
6:11 am
was total legal what i do in the room but with they're growing popularity it's time to regulate them to protect businesses and individuals. despite air - the number of types of businesses that are selling it there is a doubling of the sekdz teens and i did not know people have been an incredible growing users but we have no regulation in place for sekdz this will help the industry to not allow the sale
6:12 am
but only regulated like sects. the youth using sekdz have doubled and nothing it more important than protecting the health of young people if we do nothing we will have a whole new generation of people hooked on harmony nicotine devices. nicotine is a highly addict active chemical. we're joining a number of cities we're not the first but we would be the first big city with a strong regulation but we're joining richmond and boston and seattle and many states as well
6:13 am
in regulating e cigarettes. those device are abandon in hospitals and most airports. i hope the urgency will give you some sense of how the industry is expanding and we need to act rapidly if this is passed today, we will be cooperating with chicago and new york to make sure we're working with the national orchestras is from the american cancer society and the america heart association and the smokers rights at the national level. i thank the tobacco coalition and karen and bob who are here and many others for their leadership but especially the young people are that are
6:14 am
organizing to raise their voices to pass those important policies. with that would the doctor like to give the public prospective >> good afternoon. i want to thank the board of supervisors for role the leadership they've stone shown over the decades on this issue of tobacco produces. 195040 percent of people smoked sects and by 1990 down to 40 powers we now have 12.9 percent in san francisco that have been smoking that's a terrific accomplishment and we want to preserve that accomplishment and that's the social norms around making smoking unacceptable.
6:15 am
smoking e cigarettes is a safe alternative to smoking cigarettes this is the harm reduction argument. another argument smoking e cigarettes may help people to stop smoking cigarettes here's what they're saying therefore we should continue to allow anyone to smoke cigarettes anywhere and we don't want to do that. right now people can go ahead and smoke cigarettes anywhere that will reduce the smoking norms we've achieved. we don't know wyoming want to provide free e cigarette attorneys to our children and obviously not promote nicotine addiction. everyone is behind feel and
6:16 am
thank you for your continued leadership in this area >> thank you very much. colleagues, i strongly urge your support and i and ask you to think about the explosion of a new industry that's trying to hook a new generation of smokers on a harmful product as well. i want to thank my staff victor and derrick smith and gary from the public health department thank you for your work. with that i'll urge our strong support for this measure >> supervisor mar i want to mention it is not legal to smoke a city in city hall and supervisor mar was smoking an e cigarette and within a few minutes we'll also not be allowed morgan anyone to make it
6:17 am
clear. if there's no additional discussion - excuse me. supervisor avalos >> i note we have law enforcement in this room (laughter). >> i was just asked by our clerk to make that clear. with that, colleagues, can we take this item same house, same call? . without objection this ordinance is passed on first reading >> item 23 an ordinance to dissolve the enforcement of marijuana offenses. same house, same call? this ordinance is passed reading from and item 26 and 27 were considered by land use committee on a regular meeting on monday and sent to the board item 26 to amend the third street alcoholic district to allow alcoholic
6:18 am
control and type of two winegrowers license >> same house, same call? this ordinance is pass on the first reading. >> this is declaring the intent of the board to order the portion of certain streets along with the elicits that are in the shipyard and the confidentiality redevelopment plan area and order the additional vacational for various purposes and reserve and setting a hearing date on this motivator of april 14th arrest same house, same call? this resolution is adapted. >> can we have a role call vote on the last one. >> motion to resend the vote and without objection this last vote is resend roll call vote.
6:19 am
>> supervisor breed. supervisor campos. no. commissioner chiu. supervisor cowen. supervisor farrell. supervisor kim. supervisor mar. supervisor tang. supervisor wiener. supervisor yee. supervisor avalos. no. there are 89 eyes and two nos are the resolution is adapted now about go to really call. supervisor breed is the first to introduce new items >> okay. that was quick roll call. today, i'm introducing a comprehensive over hall of the san francisco policies on graffiti. this is a product of months of calculation including the city attorney's office dennis herrera
6:20 am
and the directors of mta director reiskin and the director of dpw director mohammed and 311 center as well as the police department the graffiti advisory board and the san francisco arts commission and san francisco beautiful and local artists. they all joined me at a press convention. i want to thank them all for coming and helping us to craft this legislation. accordingly to the budget and elective analysts it costs the city nearly $20,000 a year not only by property owners. i see the human costs that graffiti considers and i hear from property owners who faithfully paint over graffiti i
6:21 am
see that muni riders because the busses are at the yard being cleaned of vandalism. i've seen the entire budget be spent simply on removing graffiti from the public art. it's important for us as a city to do something about it is a serious problem. instead in developing this legislation i didn't want to follow a path by those who view every crime as a opportunity for yet a harsher punishment but instead we've researched the jurisdiction including new york and san diego to develop a plan that will provide better outcomes for graffiti offenders that there are many pieces of
6:22 am
the puzzle. two parts includes administrator fixes and elective fix or so we estimate over 90 percent of the graffiti in san francisco are from serial offenders. pursueing a criminal tag is really an effective you use of resources but the criminal courts have approved the inappropriate approval for the same tag they've over taxed and the burden of beyond a rose bowl double is hard. civil courts require a preponderance of evidence and recognition that a unique tag is the signature of a specific
6:23 am
offender. so our task is to collect and occur rat and employ the preponderance of the evidence ambassador swelling we'll have the employees particularly at the mta photograph them with the smart phone and submit those to the police department and 311 ledger city resources. customize 311s trespasser to streamline the defense and give the police department with the took him of material, etc. all identified. create a defined cost structure for abatement so reporting employees don't have to make specific estimates for the damage this will be integrated into our 311 system that makes
6:24 am
the process way more fiscal. chief suhr has agreed to add analysis and additional staff in order to comical and appear in court when those operator offenses are bothering brought forgot. we'll work with the city attorney's office against the offenders those can be for community service. all this work is administration not elective and all of it is underway. several jurisdictions in southern california are you're going on enforcement system similar to this one. in fact, in east los angeles they saw over the past 4 years their graffiti abatement drop by
6:25 am
55 percent in the first 5 years. if this happens in san francisco we're talking about $11 million and that's definitely work out focusing on attention on this motivator. secondly, introducing legislation to tile graffiti controls and codify the new procures the legislation i'm introducing today will 99 revise the cities existing graffiti ordinances under the public works code section 13 to be experienced against the perpetrators of the graffiti not just the victim. codify the second thing is codifying the city attorney to pry graffiti on both public and private authority this will give the city attorney's office authority to go after the
6:26 am
offendersers. the third thing to ban the spray paint and tagging in any city park. the fourth thing is to revise the police code to prohibit anyone from casing spray paint on muni vehicles and lastly my legislation will add a general policy that city departments are collaborate on graffiti reports and seek the avenues. this will only happen if the departments who have been impacted. i want to thank the departments for working hard to get to this point their excited as you all know this is a major problem a $20 million problem.
6:27 am
so in short i'm confident the city will be better off as a result of moving forward on this and i landmark to having a discussion and supervisor farrell has said count me in but i want to mention as a former art director the most frult thing is when their murals get painted over or their criminalized because of people that are tagging buses not all artists are criminals but all artists shouldn't be penalized and they too want to so reform so we're addressing those issues appropriate. i look forward to come back in a year and looking at the
6:28 am
hopefully, the huge amount of savings as we save on graffiti abatement. the second item i have is about the drought. i know we're tired of hearing conversation about the drought but it's an important conversation. i was just in d.c. and had a great opportunity to meet with senator dianne feinstein who talked about what we needed to do on a local level in regards for planning for the future that includes developing new areas for reserve so we're collecting as much water as we can so when we're experiencing a drought we're not nerve about what the future holds for our state. so governor jerry brown issued a state of emergency and hetch
6:29 am
hetchy watershed that provides water was at the 40 percent of its normal level and the snow backing pack was at the 32 percent we've asked customers to involuntarily reduce their water by 10 percent and particularly in san francisco have exceeded dispensations. earlier this month i urged the california legislator to fund 3 projects for san francisco and that resolution passed the board on particular case 11 on one month prior; isn't that right dianne feinstein introduced the california emergency drought act. the act directs the epa to prioritize projects that can
6:30 am
immediately provide water to the public 40 with health care problems and for a range of water supply projects including ground water wells and others conservation technology are the act funds reduce the impact of the drought and could provide funding for the 3 projects so today, i'm interrogating a resolution to pass dianne feinstein act of 2013 and lastly i know this is a bit of a technical thing i'm introducing. it's a resolution to extend a lease with o e w d our one stop job location in
