4:00 am
we need a certain amount of notice we receive the questions and give us adequate notice to respond both to the plaintiff's and appellants so if it's cancelled it's cancelled we can do better than that in terms of making you know the rules of the road clearer. the other question i had i know this is going to come up given this was not a simple fix but a simple issue the assessment of costs was it because we had to send an inspector out there 2 thousands is not a lot but could have been spent better than the question why did we come up with that because we had to come up there so many times and talk to
4:01 am
the tenant >> i'm going to be as diplomatic as i can but historically he didn't respond very quickly as i said we've had to send another case to the city attorney he didn't traditionally respond to the tenants quickly are in this situation he's tried to make the rapes and have not been mandatory what's needed to abate the situation on the issue of the situation the officer can grant one day extension we need a one-day notice and those are generally at least a one-time continuous unless there's a hazard unless there's other evidence to the contrary where you have a situation that is
4:02 am
going to impact someone severely. that's why staff if do anything left lanes unless we have something to be concerned but or about >> we include that this is the point that's what i'm interested in. >> i apologize for that. >> i'm glad we have clarification. >> now public comment. >> i'm denise the tenants sister. >> go ahead. >> i didn't hear what he had to say. >> what was your public comment? >> my condominium is i'm a little bit concerned the owner first of all, he said that he didn't have access we're there all the time he mangles
4:03 am
appointments and a lot of times he didn't show up and he brought two plumbers and they wanted to fix is and he said no. i talked to the plumber and he said the pipes are old and he was going to charge him that thousands and mr. fong said no so mr. wong still said no. we brought a second please state your full name and he also said no. we brought a third one and he also said no. i don't think he's been honest about trying to fix it my sister and i talked to the third one they didn't speak english and i said what did mr. wong is to you and i guess i had an inkling he
4:04 am
didn't want to fix it did he say not to fix the neighborhoods and not outdoors they said, yes. i'm not confident he's honest and he said he wants a key. he didn't need a key. we're there all the time he didn't follow-up or glow so i'm concerned because 2008 he went to the rent board and agreed to do a lot of things and 6 years later things have not been done. i'm concerned my sister is diabetic and she needs a shower she comes to my house to shower and the stove everything else i can't name everything i'm concerned about my sister she's been getting sick because of all
4:05 am
of this and ended up in the hospital too. so i don't know what to say. they've agreed mr. board restrict would they're to work on this and he's he probably i'm sure he's honest and going to work hard i trust him by not sure mr. wong will come through and the excise he used he had another hearing we had another hearing but we showed up in the morning. he showed up in the morning and we showed up for the afternoon small claims he took my sister to which my sister prevailed.
4:06 am
that's why i'm here to speak >> denise gonzales i'm the tenants sister. yes >> thank you. >> okay. >> thank you very much. any other public comment? >> steve. on behalf of mr. wong her we've been to that residence >> move up to the mike. >> we've made several appointments the first one was on 3, 13 of this year i'm sorry. sorry about that the first one was 11, 18. one of our guys dave was skeleton to go there but the actual customer cancelled at the 9:00 a.m. because the tenant wasn't there and we went out on
4:07 am
the 20th of 2013 and the tenant cancelled the appointment and the last time was 1129, 13 and the tenant cancelled once again. we've been working with that mr. wong for 10 years as the plumber and he's been trying to fix the situation to have two bath tubes together and we have to open up the wall and replace the piping. we need to gain access to the tenants place to open the wall to get even though piping done >> i have a question of clarification who you meant by the tenant the tenant underneath the tube.
4:08 am
>> the tenant with the tube. >> commissioner walker. >> what do you stimulate the time period. >> i can't stimulate until i open the wall. >> the worst-case scenario. >> a day. >> we'll be in and out in one die. >> okay. thanks. >> thank you. >> any public comment? >> i'm the tenant that has the bath tube stuffed up tube. >> your name. >> ilene. they have not made any appointments with me. i don't know what they're talking about. anyway.
4:09 am
that's all i have it is stuffed up the little plug that removes doesn't remove its stopped the water is stuck. you have to take that off and the handles don't work. anyway, the first plumber he brought charges $3,000 and he offered to do it for half the price and he refused. that was 5 months ago that he brought 5 plumbers and none have done the job. i've been waiting 5 months since november 2013 for that to be cleaned up and fixed. and he still hadn't done it.
4:10 am
this business about 19 i know he goes into everyone's apartment he has keys. i have a letter saying i don't have to give him a key and there's no law that says he has to have a key. i'm lessons there he only has to call me up and make an appointment we're there all the emit. i'm handicapped i can't work. >> so they say this plumber asking is going to do the job i give them my number he only has to make an appointment. mr. wong changes his number so i can't leaf him a question that's
4:11 am
why it's been 5 months he changed his phone number so you can't call him. >> commissioner walker. so you're saying i didn't have an appointment that you cancelled did you have an appointment with that plumber >> no. he said he had 5 appointments >> or something like that. not with me >> okay. >> not with me. that's the first time i've seen him >> today every call him. >> no. >> thank you. >> thank you. any public comment? questions by the commissioners commissioner walker >> i just think that ultimately we are interested in having the work done. i think it sounds like there's
4:12 am
different scenarios and the issue someone assumed there was going to be a continuous i feel the evidence establishes there are code violations and the notice of violation and the subsequent action is appropriate. i feel like it's been long-range this process that the tenant has had to live in those conditions so i would ask - i would move that we uphold the order of abatement and that we give them it's been discussed by the preliminaryer it only takes a day we give them a week to do this work and hold the abatement in awe bins for a week allowing them time to do it and assess
4:13 am
fees. before we entertain that may i ask could we have the landlord and tenant agree they can do the repairs within the timeframe of one week >> i thought you that's what rosemary said, yes. >> i just a question for the department. duo do we know if the plumbing permit has been applied for >> i was asking my staff i don't know if that's the case i suspect it's not been perhaps the property owner can attest it that. >> on the same day that's
4:14 am
normal. >> i would think that p&g could take care of the inspections. >> i think if there's an agreed timeframe it would be pulled a day before they go in that's normal and a twenty-four hours notice. >> yeah.. >> so moved. >> second. >> i'm a little bit i'm just obviously i echo commissioner walker's points here. i believe there was good faith by the owner to have the hearing continued. i'm trying to find out what's the overall value of the permit if he is granted that continuous >> are we speaking the statement? >> yes. >> i'd be happy to look at the costs with respect to that.
4:15 am
and see what we can do but he's accrued it beyond the violation notice the notice was in november even if it was a thirty days notification so we're way beyond that so the accrues beyond that. so from that standpoint he has accrued that amount of time. i'd be more than happy to look at it in the context he asking for the abstinence he's not gone or golden the work done so i'll look at that >> if i can finish. there's also the issue conflicting stories of whether or not he was trying to get the job done and wasn't. so in the e kwaks he was given
4:16 am
no consideration and the pier officer didn't know those are issues we need to look at. this would have been resolved if people were communicating directly. i'm not trying to point fingers but we are part of this as well because we didn't do our job with the hearing officer >> i was telling you that went to a hearing at least 60 days it wasn't immediate because we'll have exposure with this property owner in the past. >> i want to talk about what's in front of of us now. >> understand, i understand you
4:17 am
want to have the assessment costs waved. >> in this particular case. >> there's another motion on the floor though. >> there is a motion on the floor i understand i want to make a second motion but i think this is a case we could consider removing the costs as commissioner lee said to agree on a dead certain date to fix this and hopefully not have this situation again. i don't know if there's a motion >> there's a motion on the floor you can't make a motion before the other one is dealt with. >> i'd like the commissioners to hear my motion and they can vote it up and down in order. >> you can amend hers but not
4:18 am
make a motion on top of hers. >> and i think we all understand we can anticipate after this motion there will be a second motion i'm not sure about the motion to the question. >> i was wondering if i could jump in for the sake of communications i was going to propose if commissioner walker would accept a friendly amendment to her original motion before we jump into the acceptance which is not to assess the total costs but to modify the assessment of cost i want feedback on that from the staff if it's acceptable. >> okay. a couple of things. there have been plumbers out there that have looked at this
4:19 am
project two or three prior to this gentleman coming. so i feel like there has been adequate access and time to do this work. whether or not whatever those two say about this particular plumber coming out. it's been a long time that this person has had hocking to live with those conditions so i think that allowing time to complete this work with an end date is more than generous. i will for the same thing of moving forward something entertain a reduction but i will not amend my motion to delete the assessment completely. >> rosemary is there a way for
4:20 am
the clock to start ticking to reduce the fees or approach it differently? the commission sitting as the abatement of board of appeals you're sitting in the shoes of the hearing officer i can ask that be reduced it is how to direct. i can definitely like i said, we haven't calculated it but we were at $2,000 if we have a ballpark we can come up with something you have in mind >> i would be willing to amend it by half. and then allow for a week to get the permit, do the work and have the inspection
4:21 am
>> i will second that modified motion. >> okay. >> there is a motion to uphold the order of abatement hold it in awe bins for one week and to apply the assessment of costs at half the amount. so i'll do a role call on that motion. commissioner clinch. sxhaern. commissioner melgar. commissioner lee. commissioner mccray. (laughter) commissioner walker. okay 9 motion carries unanimously. >> item f general public comment it there general public comment
4:22 am
4:23 am
>> we are here at the urban center on mission street in san francisco. we have 3 guest today. we have david constructional engineer and bill harvey. i want to talk about urban myths. what do you think about earthquakes, can you tell if they are coming in advance? >> he's sleeping during those earthquakes? >> have you noticed him take any special? >> no. he sleeps right through them. there is no truth that i'm aware of with harvey that dogs are aware of an impending earthquake. >> you hear the myth all the time. suppose the dog helps you get up, is it going to help you do something >> i hear they are aware of
4:24 am
small vibrations. but yes, i read extensively that dogs cannot realize earthquakes. >> today is a spectacular day in san francisco and sometimes people would say this is earthquake weather. is this earthquake weather? >> no. not that i have heard of. no such thing. >> there is no such thing. >> we are talking about the weather in a daily or weekly cycle. there is no relationship. i have heard it's hot or cold weather or rain. i'm not sure which is the myth. >> how about time of day? >> yes. it happens when it's least convenient. when it happens people say we were lucky and when they don't. it's
4:25 am
terrible timing. it's never a good time for an earthquake. >> but we are going to have one. >> how about the ground swallowing people into the ground? >> like the earth that collapsed? it's not like the tv shows. >> the earth does move and it bumps up and you get a ground fracture but it's not something that opens up and sucks you up into haddes. >> it's not going anywhere. we are going to have a lot of damage, but this myth that
4:26 am
california is going to the ocean is not real. >> southern california is moving north. it's coming up from the south to the north. >> you would have to invest the million year cycle, not weeks or years. maybe millions of years from now, part of los angeles will be in the bay area. >> for better or worse. >> yes. >> this is a tough question. >> those other ones weren't tough. >> this is a really easy challenge. are the smaller ones less stress? >> yes. the amount released in small earthquakes is that they are so small in you need many of those. >> i think would you probably have to have maybe hundreds of
4:27 am
magnitude earthquakes of 4.7. >> so small earthquakes are not making our lives better in the future? >> not anyway that you can count on. >> i have heard that buildings in san francisco are on rollers and isolated? >> it's not true. it's a conventional foundation like almost all the circumstances buildings in san francisco. >> the trans-america was built way before. it's a pretty conventional foundation design. >> i have heard about this thing called the triangle of life and up you are supposed to go to the edge of your bed to save yourself. is there anything of value to that ?
4:28 am
>> yes, if you are in your room. you should drop, cover and hold onto something. if you are in school, same thing, kitchen same thing. if you happen to be in your bed, and you rollover your bed, it's not a bad place to be. >> the reality is when we have a major earthquake the ground shaking so pronounced that you are not going to be able to get up and go anywhere. you are pretty much staying where you are when that earthquake hits. you are not going to be able to stand up and run with gravity. >> you want to get under the door frame but you are not moving to great distances. >> where can i buy a richter scale? >> mr. richter is selling it. we are going to put a plug in for cold hardware. they are not available. it's a rather
4:29 am
complex. >> in fact we don't even use the richter scale anymore. we use a moment magnitude. the richter scale was early technology. >> probably a myth that i hear most often is my building is just fine in the loma prieta earthquake so everything is fine. is that true ? >> loma prieta was different. the ground acceleration here was quite moderate and the duration was moderate. so anyone that believes they survived a big earthquake and their building has been tested is sadly mistaken. >> we are planning for the bigger earthquake closer to san francisco and a fault totally independent. >> much stronger than the loma
4:30 am
prieta earthquake. >> so people who were here in '89 they should say 3 times as strong and twice as long and that will give them more of an occasion of the earthquake we would have. 10 percent isn't really the threshold of damage. when you triple it you cross that line. it's much more damage in earthquake. >> i want to thank you, harvey, thanks pat for
