universal like any industry it depends on the people behind the operation and who interacts with the community. whether the approval process would benefit the public and safety and well fair and what procures will help with the community input. there are many ways for the community to enact with the process they have the opportunity to give testimony before the planning commission and call the planners and there's a pickup i publicly noticed hearing and they can appeal to the board yet you have to know how the system works and in addition to knowing how it works when a permit t is filed. the hearings could help to
10:01 pm
mitigate that. the fifth tactic it the projected areas in which they locate. the department said there is to permit the cd in more residential districts south of market district this option has potential they're too few mc d in the western area they need more research and outreach so should we expand to all district or no one and would it be more pressure open the space. the second way to reduce the
10:02 pm
buffer from 6 thousand to 3 thousand the buffer the federal government will most likely target the mc d near the schools but the rule is a blunt instrument it didn't take into account the densities the biggest pen about it expand the green zone throughout the city and the significant expansion that lacks mc d in particular the western areas, however, this options will meet with the "x" potential to kids. the final way to expand the
10:03 pm
green zone. mc d are trial court the ground floor their concerns over the loss of dwelling unit, however, they're required to be ada assessable it will help address some of the impacts that the mc d these have on pedestrians. so take into account all of those to the maximum and we're not recommending all of the options this is what the green zone looks like the dark erroneously is the current green zone and the yellow is where it's expanded. you can see the large area in the south eastern portion of the city basically included more
10:04 pm
zoning districts into the green zone are the expansion on the west side of the city is more with slinking the buffer from 6 thousand feet to 3 hundred. the final area the acquire is best operational practices that should be take into account including the level of security and the hours of operation and location. in short the best operational practices are those who reinforce the rule of nonprofit the hours i have a security of operation i'll cover first. the hours of operation are regulate by the health code and planning and considered as a separate item at this or a future hearing. code and restrict accident you hours from 10:00 to 3:00 p.m.
10:05 pm
while at least one neighborhood wants to shorn it this would an issue of concern from the people interviewed it allows each mc d to set their own hours. the health code say they submit a security code but not reviewed by the police department. regardless all mc d have guards and strong doors. the inherent operation is to protect the business with proper security systems is sufficient the low robberies and crime is low. the location like any retail
10:06 pm
operation mc ds want to locate where we serve the most patient like areas where are less linkage to make them a target of justice they are not be clustered and from a public policy prospective they should be located with the metro medical act but the city is wanting them to be in close prompt to transit evenly distributed thought the city and at the end of the day it's the commission that's in charge of the balancing the interests with the best overall open policies. on site consumption when mc ds
10:07 pm
provide a place for patient to medicate they know that the smoking will be within the general area of the mc d. they provide a place for patients to a smoke not within their home and finally on site accomodation helped to provide a safe environment. staff. sort of goes without saying it's important to hire people are professional and friendly that helps to maintain good relationships with the community. transparency many mc ded obscure their windows >> am i out of time.
10:08 pm
hiding the candidates only helps to show that it is better integrating the services. the com patient role helps to take care of the sick and they have urged cities to have care programs. mc d that council with the early application process and continue to have the engagement after the process they can help to have he commitment by joining the organizations starting with financial investments in the community >> mr. star you've run out of time maybe we can go over them
10:09 pm
with a high-level and people can ask questions. >> the first is to have the dr process for the mc d applications. the second one is to expand the green zone and consider the 3 options reducing this buffer from 6 thousand feet and allowing the mc d and prohibiting permitting the use on the second floor. the third is to remove the thousand foot buffer around recreation facilities. the fourth is in the event that the existing green zone is expanding it would be appropriate to have a buffer in the commercial districts.
10:10 pm
the fifth is to require new playgrounds for new mc d the sixth is to clarify the distinction so that mc d on the ground floor are subject to the transparency codes the 7th is to monitor the code and the 8 is to 0 provide a dedicated platform question for the process in san francisco. and that concludes my report i'll, you know, you're open up >> a number of cards for comment please line up.
10:11 pm
(calling names) >> good afternoon, commissioners i'm chris i'm here on behalf of my superintendant. we're here to oppose the the reduction of the one thousand foot around the schools it's the my administrations position that our focus on the health and safety and we feel our our students in 2012, the district issued the youth risk behavioral survey 10 percent of the middle students had tried marijuana and mailer nearly a third. our relax is our school department has a health
10:12 pm
education to understand marijuana and to essentially try to decrease the number of students who use marijuana and increase the healthy behaviors we want to point out the drug free zone enacted by congress while some things about a we feel the boundary is consistent with the spirit of what the district feels is appropriate. maintaining a safe distance between the mc d and school is appropriate. i want to point out that in mr. stars presentation when he showed the map the greatest increase is in the southeast
10:13 pm
part of the city we're promoting access for a all areas we feel this is unfair we see the high concentration of our students those suffering under social concerns and struggling the most in our schools. thank you very much for your time >> a to supervisor avalos is here and wants to make a comment. >> good afternoon john so to speak at the convention he wanted to first of all, thank the staff for the excellent piece of work and mr. star b did a great job it's a fascinating read the supervisor avalos is in support of the recommendations he wants me to thiflts the
10:14 pm
critical piece is making sure that mc d are held to a high standard and a good way to prioritize mc d that are providing compassionate care and services and to promote the mc d into neighborhood it's great for accessibility for that disabled patient and a transportation issue that helps to reduce the issues. conversely we want to make sure that the mc d are held account if they're not helpful in a neighborhood perhaps the neighborhood can rate them and there should be a way to reevaluated their permits.
10:15 pm
we're supportive of recommendation one of keeling e keeping the dr approval and adding finding we can work on that but the suggestion from the staff with good. expanding the green zone that's the trick it at first blush we're for the resurrects of 6 thousand feet it's great to see the districts concerns. i think the staff recommended limiting mc d along major travel routes i'm not sure how workable that is, i think another possibility we can restrict the hours that the young are leaving the schools. as far as yeah. i think on the recommendation of keep that in mind the zoning districts i'm not sure that's helpful as
10:16 pm
reducing the school buffer. i think seeing the large pvrd areas i'm going how much many easy the access it's less begin about the acre ridge and as far as the recommendations of allowing mc d on the second floor we're alleyway u allowing that in the excelsior district. and then as far as recommendation 3 removing the thousand foot buffer we want to see more information the staff report mentioned that wouldn't result in much of an expansion of the green zone we need to look at those facilities and what the change is to the green zoning and recommendations about
10:17 pm
the buffer i think supervisor avalos is in support of that in the outer mission district requiring the permits for outside the area there should be a chufrt of the green zone and the recommendations seem like strong ideas as far as the preapplication meeting, etc. etc. and lastly i think is the sort of political reality as the report acknowledged it's questionable whether there's a will for the city to take on the issue but supervisor avalos will encourage you to take a lead and love to see the planning department to draft this and take to the board of supervisors i think we should look for the
10:18 pm
2016 and the mc d will pass and this will change the landscape. i look forward to the discussion today mississippi's >> thank you next public speaker. >> good afternoon. i'm kathy smith. i ran a mc d called hope nest we were on ethnic street and part of the federal closer a private man run commerce school moved in after we were there for 8 years and shut us down well, the government shut us down. it seems like the planning department i'm sorry but you guys let that happen.
10:19 pm
the private schools doesn't get the same scrutiny as the public schools do. we're were not invited they were coming. it seems like there's a lot of oversight rex on the cannabis dispenses we would like to is it reciprocated and see the same rules apply to us. we're paying huge amounts of money and seems like ooip i've got no protection because somebody let a school move in too close to me. we were serving our neighborhood and helping people find housing we were one of the model dispensaries in this town i'd
10:20 pm
hate to see other dispensaries go down the road if you change it to one thousand foot the government will shut them down too. it's obvious you don't scrutinize there's noting another school going in there are leathern shops and a bicycle lane what are they going to do during the folsom street fair did anybody think about that maybe the planning department needs to think more carefully not only about the mc ds but what's going on around us. i've heard this rumor that the planning department was going to help the dispensaries that were
10:21 pm
closed down i put in a application in july about a letter of determination i haven't heard back. i know the planning is understaffed i again that is not my problem >> thank you. next speaker, please. >> hello, i'm eugene patterson i'm a disabled veteran i'm suffering from 4 terminal conditions i've lived lessor i'm a cannabis patient and i'd like
10:22 pm
to thank kathy i was a patient of hers at health net and she was very helpful and the community has lost a great ally. now i'm - i'm sorry >> please continue. >> now i'm involved with actions of love in their veteran program. they're also providing very needed service for the community. there are not nearly enough dispensaries or advocates people who even care about the disabled veterans and are beinglogies their access to the cannabis
10:23 pm
that's helping them and i always thought that patients medication and stuff should be between the patient and doctor not something turned over to a government process to be buried in red tape and have the patient that desperately need this lost in the shuffle this report addresses the concerns i can think of and has been some of the most intelligent in depth study and $0.35 that's my hope that the suggestions are taken seriously and hopefully, we, find a way to make that work for
10:24 pm
our entire community >> while the next speaker comes up i'll call a few names (calling names). >> hello good afternoon my name is steven crane i'm a member of access love and live in district 6. our district in district six-hundred has really been just i don't know how to explain it all the dispensaries are closed it's one of the highest crime areas in our cities shootings almost every week and no medical marijuana relief whatsoever in our district i've talked to supervisor kim about that. i can go down i used to go to hope net it was a great places
10:25 pm
it's closed i don't go to certain dispensaries i have to go 3 miles to get the type of help you need. i worry about i'm a gardener and try to grow some of my own medicine i'm worried about that the green zones and why is it being k357b9d like also into the poor neighborhoods where a lot of the service is really needed that my concerns are no help in the district 6 in the poor neighborhood i want to see it changed >> thank you. next speaker, please. >> good afternoon, commissioners i'm a director of assess love
10:26 pm
and i'm fascinating a working group that president chiu is hosting. i want to thank aaron star it was great to work with him. our working group agreed we would like to see this amended and adapted to send this to the house commission as our lead agency in also to review the issues in the report that indicate they're under the per view of the health department such the definition that 9 patient make a mc d and we all know 9 patient don't do that. we need to look at diversions and look at the transfer of ownership for not only the patient but also the neighbors
10:27 pm
of the mc ds we have acquit a situation on ocean street right now. the only thing to strike from the report is striking the conditional use the press application process it the redundant and we like the support our historic compassionate provider that were removed by the federal government that's the vapor room and sanctuary we have no services in our tenderloin area or hunters view area and have large concentrations of people living with sdrabldz in those areas as well as nothing in the west side of our city. i support this and have partnered with the health commission so we can look at
10:28 pm
implementing compassionate care programs across the city as well. thank you for your time and consideration >> thank you. next speaker, please. >> good afternoon, commissioners i'm part of the city hall work group sponsored by president chiu and the acts of love. i want to talk about my medical history i suffer from constant psalms whether i'm walking or sleeping i'm in pain i'm in pain right now i can go take over the counter medication approved by the fda we sooth from lengthy
10:29 pm
and sleepiness and unable to work and socialize. there are certain sprairnz strains of medical cannabis that are helping spasms. as a transparency and change of ownership i'd like to braushg the captain chief is not aware of the transparency of the ownerships and i want to close on the note mind you and everything here san francisco is visiting to many districts each have no peefrpt but for the access for you patients medication it currently dispensaries are located dishe
10:30 pm
proportionly to the portion of this city and have full complete access to patients needs. thank you. >> thank you while the next speaker can you please i mean, i'll call a few names. >> the world has to get used to cannabis is the medication of the future you can make a baggage of so many things medications don't even come close to that. i do believe we all want safer streets so add for cannabis dispensaries because it's the needs of future. there's no safe access my neighborhood is the tenderloin and diversity needed
