exceptional. the addition matches the neighbors rear building wall and that has resolved the issue. i think pictures say a thousand words, so i'll display this picture. two-doors down at this house, this is a new addition that went up and that is massive. it's nowhere near what i'm trying to build. it's 18 percent larger of mine in terms of their addition. so in summary, the requestor has failed to prove that the addition is considered extraordinary and circumstances. i have acted in good faith and i respectfully ask that the commission takes the planning recommendation and approve the plan and deny the dr. >> the public hearing portion
1:31 am
is closed. >> commissioner moore. >> i would like to give my comments to the building and ask mr. washington a couple of questions. mr. washington, my understanding is that single family residential over three stories does not require a secondary means of [inaudible] in the forms of stairs as we see on the plan. i want to restrict my comments to discussing the stairs which are in the rear of the building and added massiveness, which i think indeed makes it difficult to look at the expansion as the reason of expansion. i want to look at the buildings. if there is a need for the stair, it can be a circular staring because from the fire department's point of
1:32 am
view, the stair that is currently shown is not a requirement. am i correct for saying that? >> i don't know the answer because i am not a building inspector, but i do believe this is a single family resident that a spiral staircase could be an option. we could clarify that. i try not to make -- >> again, the fire department has its own way and dbi as well, but i like a reading of the amended code. the reason why i'm saying that because i think unfortunately i think everything about the addition itself as far as the building is concerned is fine. it shows that stair and what comes with a stair is a bulging out the deck on the different level where it occurs. what grants them a stair over the bedroom on top of the roof. i
1:33 am
would suggest that stair is resolved internally by doing -- by placing the stair in the same place as the stair from the second -- from the first to the second, from the second to the third, and then to the roof deck. that you'll have a hatch or a small penthouse which indeed would very much minimize the impact of the building on the backyard and how it interferes with the side line on the rear of the building and that is the objection of the other property owners. by doing so, you could also pull the -- you look at the side line, the first page of our submittal, you can pull the deck back by three fleets and the east face -- it interferes with looking into the other neighbor's rooms would be
1:34 am
eliminated. so you shrink -- without shrinking the building, you start to pull back the stairs, internalize the access and form the bedroom to the roof deck, but put the roof deck on top of the bedroom, but keep it like a small penthouse in a less obstructing way in the rear yard and the ability to look into other people's properties. imagine yourself. you have your living room or whatever facing to the back and you see this massive stairway interfering with your side line. this is not a secondary unit. it is a building expansion, but i ask that we consider making alternate suggestions on how to deal with the stair. either the circular stair which holds back to the western edge of the main building or an internal
1:35 am
stair and an internal stair from the bedroom to the roof deck on top of the bedroom. >> thank you. commissioner hillis. >> yeah, i think the massing of the addition is fine. it seems like you were farther to the north and shrunk to the south. there's an abundance of decks and stairs that makes this seem like a larger addition than it actually is. >> commissioner antonini. >> agree with the commissioner. i think it's a good project. i don't think it has to be significantly changed but a visible staircase, you don't see it too often with residences. usually
1:36 am
it's interior, and if it's possible to do that without adding to the cost of the project, even if the bulk became -- the end result is going to be the same, but you're not going to see this visible staircase there. >> commissioner moore. >> if we have a general agreement, then i make a motion to take dr and make modification to the rear stair with the option to add a circular stair or delete the entire stair but have an internal stair to the roof top on top of the bedroom and i can give mr. washington the sketch of what that can look like. >> commissioner sugaya. >> yeah, are we retaining the decks in the back or what?
1:37 am
>> if you are asking me, i retain the back, the decks in the back. i eliminate the eastern deck on the bedroom floor, have an internal stair coming up to the roof of the bedroom roof, pull this back by two or three feet so that it stays away from the level below. and then the stairs, either an additional circular stair coming from the bedroom going down or this stair goes away all together and the lower deck remains as it it. >> if you eliminate the circular stair, then there's no access between the floors, is that correct? >> the access and internal stair. there's an internal stair already. >> i mean on the outside, there's no connection between the decks.
1:38 am
>> no. based on the loose interpretation of the modified code and single residential three stories, you do not need a secondary [inaudible]. that was the revised code a few years ago. >> commissioner antonini. >> putting that staircase and internalize that bedroom, it doesn't utilize that bedroom. >> it comes from the second or third and goes up one more floor and has a hatch or a small penthouse. >> you're enclosing. >> correct. >> i'm fine seconding the motion. >> are we clear on a motion? >> do you have that? >> i'm not clear on the motion entirely. i got the part where taking dr and modifying the rear stair
1:39 am
and then or eliminating it to an interior -- >> at the exterior stair well, we're eliminating the stairway and allowing a circular stairway to go in that space. >> yes. >> if it's not allowed, then by fire or the building department, then those decks have no external connection is the way i understood. >> understood. >> on the roof deck, the access is internal, not exterior. >> i'm going to try to explain this and please feel free to try to make it commissioner moore. we're going to remove the rear stairway off the back portion of the house with the option of
1:40 am
possibly working with a circular stairway, then adjust the interior stay way to allow interior access to the roof deck over the existing stair well? >> correct. >> and then -- the planner and i will work with commissioner moore and the sponsor architect for the clarification in necessary. >> it's up to you. i think a small penthouse is fine but given this building is so far back, nobody will see that. >> i don't know building code to the point where if it can be allowed with a hatch or if they need a penthouse. >> did you say something about the east deck? >> the east deck off the bedroom would disappear. so that is a notch that leads the other building, the neighboring building more
1:41 am
free. >> we're going to eliminate the east deck off the bedroom. >> that's correct. >> it will be a real intrusion into the privacy of other people because you're looking right into their window. >> all right. commissioners. there is a motion and second to take the dr and modify the rear stair to a circular stair creating internal access to the roof deck and eliminating the east deck off the master bedroom. on that motion, commissioner antonini. >> aye. >> commissioner moore. >> aye. >> sugaya. >> aye. >> wu. >> fong. >> aye. >> commissioner wu. >> that motion passes 6-1 with commissioner wu voting against. >> commissioners, general public comment. i have no speaker cards. >> general public comment? >> why don't we close public
1:42 am
comment. [laughing]. >> commissioners, i just want to talk about ssmta and it sounds like a great name and it is and it rolls off your tongue, but the reality is it's [inaudible]. when you look at it in that context and it's analyzed further. we have a very strict set of guidelines of notification from the planning department and it works. when something major, or minor happens in the neighborhood, you're required to notify your neighbors and generally it is in writing. but unfortunately the same does not a lie to ssmta and other words muni. you have no order of notification. i understand the independent entity and they can do what they want until such time as they come before you and when they do for certification or in
1:43 am
secret, then you have the authority and the power to require anyone bringing such approach from any other department before you to adhere to the notification requirements that you have and your required. i remember telling suzanne, our notification is such if i blow my nose, i have to notify my neighbor. that's what we came down to and i'm not requiring that of muni but we're required to do that. tomorrow for instance, when they hold a hearing at 8:00 a.m. in the morning, out of all the activities in the 1960s, i've never seen a hearing begin at 8:00 a.m. following following an agenda item passed here today and they have no intention to have no respect for the public process, so what did we do today because after all, i was bond and bread in activity in this city and learn from the best, you
1:44 am
know, from the fights and all that. i don't condemn or criticize what you did, i went right down to the board of supervisors and i filed an appeal of your requestor approval that stops the hearing from happening. did i want to do that, no. was i forced to do it? yes. because you're preserving and forcing muni, sffmta to respect the neighbors. they did not notify one single person and we have pulled every one of them and they put it on a pole. i don't reach up on poles. that's what they did on notification. sometimes i read them when it's interesting and stuff like that and you're drawn to that, but they didn't do that. i wanted to inform you. the beat goes on. thank you very much.
1:45 am
