that it is i understand that if good for one it should be good for all, but also think that this commission in its early days had a discussion about not putting undo stress on applicants for permits and that is why we grant conditionally and we don't make them come back after all of their sign-off and stuff like that. and so, although, i see your point, and in most cases i would agree with you in this particular case, i do not. >> on my time during the commission, i know that we have added a condition that says that we approve, and allowed our staff to make that judgment whether they felt like the neighborhood out reach has been sufficient. so we can approve it with that amend that motion, though, and so i don't know if that is something that you feel like could work. >> one of the things that i am going to say about that is that it is okay to generally approve that, but as we get more into

the idea of the neighborhood out reach is a needed thing and it is something that we as a commission have worked on togethers and i think that things change and maybe it is not how the commission started out but this is where we are now. and i think that to say that this is a high end steakhouse is my first red flag i am not saying that it is bad but just because it is high end does not mean that they have to do or that she should not do the community out reach and i am saying that if we do that and as part of this permit i want to make sure that we start getting notified that the out reach is done and that we get and we can see it. or you know, what i mean? because before it is just like we say it and then we don't see it and i think that as we move forward we have to be a little more careful with how this is

handled. >> i agree, and i do see, the point here and that it is an established business and that we as a commission should not be over burdening, businesses, and at the same time i think that we should balance and having some consistency and since i have been on the motion a short while it has been about 18 months i have seen the inconsistentcies and you know, i am not clear on the nuances but sometimes it seems like discrimination, and i think that we want to be cautious about saying that if one business is up scale that they are exempt from the same rig ors of community out reach i am not saying that is what you are saying but that the tenants also to be mindful that if there are residents that are in

an sro situation, that they, or their comforts and rights and dignity in their residents is not discounted because they are in something of you know, in an sro situation. and they may not be given the same rights that someone who owns a condo who participates in a neighborhood group is given. so, but i am also open to voting in favor of the permit with the requests of staff to feel that the out reach has been satisfied and i think that it is something that we as a commission need to look at where are we falling on the neighborhood out reach and where we are holding to the standards and to be consistent about them. >> point taken, commissioner campagnoli, right before that, it looks like our staff has.

and we immediately contacted phra, pacific heights association and they were kind enough to have me at their meeting and i went through and addressed their concerns and one of the things that i talked about was that for five years i had a live entertainment permit at the plaza which is two blocks north and in that five years, we did not have a single complaint or a police issue or anything of that kind, and the board seemed that they did not issue a letter to me directly, they seemed very satisfied and there was not any concern raised beyond that. and i also, wrote a letter immediately to the fillmore merchant's association to let them know what we are planning to do even though you think that everyone will agree on something that is good for the street and people don't and i have got nothing but the support from that as well. >> great. >> commissioner joseph? >> so, the night of some of my

secret? i mean how did you... >> i think that the big thing is that both of the plaza and what we are planning to do at the elite is not to make the music the focus of what we are doing and it is something to augment what we are currently doing and so the worst thing that we could do from the elite from the business standpoint that will interrupt our dinner and brunch service because at the end of the day that is our bread and butt and her that is just a nice addition. and so i think that when if changing the personality of what we are doing, and where the goal and then i could really foresee the problems and so then you can see the sound levels and here it is very much just giving an extra component to our guests to enjoy while they are having a conversation it is not as if, we are going to change, the table configurations and have it is people focusing on the music.

regulation that may be overly regulating, regulations or unnecessary regulations or harmful regulation and so i would like my commissioners to keep their eyes and ears opened for upcoming legislation that may impact our street fares and other event likes the new prevailing wage legislation and so on and so forth and keep yourself mindful and you know, informed on what is happening. because i think that we will be having the discussions on that. and you know, maybe more about the bottled water and so on and so forth as we go on to the next year. >> thank you. >> i think that it is ask you during your report, but, from the hearing yesterday, i did not get to watch the whole thing on-line, but what are the next steps? i think that supervisor weiner said that he might be introducing some sort of resolution?

>> yeah. so that is the plan right now. is we present it a set of problems and a set of possible ideas for solutions, and suggested that the city come up with a integrated transportation plan and so with that in mind, he is going to basically, yeah, introduce a resolution to create a task force. and i mean, and i have not seen the wording yet, but i think that is will be in the groups. >> a working group, okay, a working group that reports back to the board in a period of time on progress, and then hopefully at the end of that it will produce a plan that in my mind we will push towards integrating into the larger transportation of the mayors may be putting forward that there may be resources for it and that kind of thing. assuming that he is going to ask you or someone from the
