difference as to its not the club it's not a question of what goes on in the club but when they leave we've been down this road before they there was other things when denton's come onto the statute street and someone was talking about other restaurant that is no bearing on strut street but it wouldn't have anything to do with stuart street. i'm not opposed to customers but on that street you have all restaurants that are closed by 10 o'clock and i do believe this is going to be a much later
12:31 am
crowd on the streets and i do believe the noise is significantly increased and the issues about the bottles and everything like that i oppose this and >> thank you. next speaker, please. >> my name is ashby jones i'm a remain the republican con and have been there since june of 1989 i want to speak of the st. patrick's day fended. my apartment faces stuart street i could hear the dj and the racket and there was alcohol and fueled behavior in the street i have to get up at 1 o'clock a.m.
12:32 am
so long as i follow their rules i have the right to quiet enjoyment of my space i cannot put trash down 0 trash shoot after 9:00 a.m. arrest this st. patrick's day day was a good neighbor policy event i'm telling you it wasn't. thank you. >> thank you. next speaker, please. >>. i'm in this case i'm a resident of the reconvene towers and i do a lot of business where i use regents for client entertainment. i feel like they have a good overall atmosphere is good and compared to other restaurants they provide a similar type of
12:33 am
atmosphere and a atmosphere for myself to expand my current business. worked for a technology 0 company based out of florida. so overall i think that i'm here to basically support of the overall regents and they've been a great entertainment venue for myself to utilize >> thank you. next speaker, please. >> i'm arthur i face regents and work early sunday morning not particularly a light sleeper but i can't hear any noise on saturday night so i support it >> thank you. next speaker, please. >> hi i'm bryan done i'm the
12:34 am
building security for the whole building where regent is at. i'm basically here to support regents for their entertainment licensee want to state on the record i've not had issues or complaints from other tenants and inside the building we have - to be honest, i hear noise a lot coming down from perrys it's at the combined people outside it's not one restaurant regents is being singled out there are cars up and down the street and hoover cars and taxis, you know, it's a busy area anothers certain times i wanted to
12:35 am
that. thank you >> thank you. next speaker, please. >> good evening. i'm charles times. i live in the east bay and visit san francisco every tuesday and thursday and i stop by every other tuesday and thursday to visit keith who happens to be a friend of mine. on one occasion i saw the poster for the informing me that i was accused and not there 83 and he they told me what it was for >> >> thank you. next speaker, please. >> hello, i'm cameron baily live in oakland and work in san francisco. i've been working in the audit
12:36 am
visible industry for 10 years. a couple months ago i received a request from the owner of the restaurant to take some sound pressure level >> sir, you were hired to do this work so if you want to speak you need to speak under the time allocated for the owner so you can speak with mr. twong he has 3 minutes of rebuttal coupling. all right. >> thank you. next speaker, please. >> so i'm ken gun i've been in the building for almost 2 years and was mrs. also a former employee of the residental part of the building. really when i lived there nothing but rave reviews that
12:37 am
regents has brought to the neighborhood. so far as my opinion i face regents and that honestly any noisy hear and concerns i have is more so from the starts a mile away when the giants were playing and people were coming through the neighborhood don't care and those people are not stopping another regents but going home. i have two dogs i walk them every night before i go to bed. there's never been a time when i've walked up and down when people came at me or have witnessed it going on in this neighborhood. i think it's safe to say that a lot of the noise complaints i
12:38 am
actually have with the building those people getting dropped off by a cab. so ultimately because i face the restaurant and when i worked there i spent 8 hours plus a day in the building and pretty sure was home all the time and had no complaints. other than i support regents. thank you >> thank you. next speaker, please. >> hi i'm mr. thomas i have nothing else to add i live on the 21st floor and haven't heard any noisy live and work a block away and so i've been there with clients and friends. i'm in support of regents >> is there any public comment
12:39 am
and those who haven't filled out the card it will help us w with the minutes. >> i'm the manager i have two concerns primarily about this is at notifications process with the entertainment commission went through i didn't see the notification i don't frequent regent is so going there to entry doors is not customary for me to the visible was not made aware of this i was made aware by the reconvene tenants association that surprised me. the second comment i share a common wall it's not a separate this go but there's a common wall i have serious concerns about effecting my business operation.
12:40 am
mr. twhong has been a good neighbors all noise complaints in the past have been mitigated but there were 3 incidents in december with holiday parties going on not sure but we had noise complaints from guests and the complaints were miebd by the his staff. i have concerns about the process and the noise effecting my business and the pittsburgh properly addressed through sound proving and security to keep the issues that the association has brought up about street activities because that also will effect my business >> is there any public comment. you've spoken already ma'am. if there's no other new public
12:41 am
comment we'll start rebuttal with the appellant. you have 3 minutes >> hi david reconvene tenants a couple of things the police code doesn't allow denial it does allow denial for noise issues. put it on the screen. if the peaceful enjoyment of the neighborhood t is effected you can deny it. no one attended the hearing because no one economy about the hearing i'm surprised their bragging about this it's a complete disaster and this was not where the poster was put up
12:42 am
and that's grounds for denial they'll not say where it was posted on a parking meter. the march 16th event you saw the video and heard the loud music it was a disaster people were yelling and that was permitted and their ignoring the rules. there's been noise issues and the police were sent there in 2012, the year they opened why this system is a failure in making n this known i can't defend the entertainment commission system we filed a complaint about the st. patrick's day event and they
12:43 am
doesn't say anything about it believe me we've complained to the captain and the other restaurant don't make the noise that regents did. o sdoum is fine very professional obviously, the boulevard and china has not been a problem it's all regents and that's why that one busy stand by what i said earlier. i i would like to point out and please know f that the entertainment commission suggested to you on page 10 you add a clause in the first paragraph page textbook of their
12:44 am
brief mr. and mrs. please reduce the hours to more reasonable hours 10:30 or 11:30 is normal in the city if they're good we'll extend it help us out >> mr. osgood. >> yes. >> when i showed the video i have no idea where it is if you want to show it on the overhead then i can determine whether it was actually, the appropriate site. >> i am under oath and i take that serious. let me get it. i'm afraid this isn't going to
12:45 am
12:46 am
maybe i should pause it for you. okay. that's the regents sign. it's hard to read but - >> you had it the right way i think the first time it's sideways. there's their folding doors wide open. wide open. people yelling. car honking. >> okay. >> again. >> no, that's all right. thank you. >> thank you for asking. >> you can sit down we're done
12:47 am
asking questions and we'll hear in mr. twong again. >> i think the permit holder will go next. that's okay >> i just want to say that regents it the smallest restaurant on the street we're 69 in the dining room and thirty for the lodge area we have folding doors we post our notice on the front door the glass door it's also visible the other thing we share a common champions and exit that is twice the size of regent and most of the customers walk through this entrance and exit they might think it's regents customers
12:48 am
because they have a business on embarcadero and it's known for traffic vertigo traffic it is more foot traffic you get people you pulling up with the taxis and limos and there's 10 restaurants in the area. i have kevin who did the sound testing for me. i want to introduce him >> i'm cameron i work asia audit visible professional i received a formal request a couple of months ago to take some s p l sound pressure level measurement at his restaurant. and for what reason i didn't
12:49 am
know, you know, the details but i went in and turned the sound system up to, you know, approximately 90 decimals intoxicate a series of measurement throughout the restaurant and next door and across the street and based on the measurement that i got from that i mean, the sound was basically inaudible across the street no more than that foot traffic throughout the city and next 0 door was also inaudible. so i don't know what else to
12:50 am
tell you >> do you have any more questions and you saw the video is it in some of our previous comments you've indicated it could have been contributed to the traffic the traffic could have been contribute by other restaurant. >> that was during the st. patrick's day from the irish pubs and any sound we're only a small part of the street there's a lot of restaurant 20 capacity we're only 69 for dining we're open for dining and lunch and even though our hours close at the 10 months of the bars are not closed they stay avenue 12 i know that bartenders they come
12:51 am
after work and lounge around and sometimes hotel guests cockamamy and we accommodate them as well. >> okay. >> thank you. >> thank you now, mr. black stone. >> thanks again so we again, i want to reiterate never once received a phone call through 367 are dribble go to the entertainment commission regarding any problems with regents as part of the processing we work closely with the police department i have officer chang he can speak about the incidents he's witnessed at regents. >> i'm representing the captain. back in 2012 i received two
12:52 am
phone complaints one from mr. those good and one from ms. hefrt emaciating from the regents. i had a street supervisor speak with mr. twong and subsequentially i went out and met with mr. twong he can't have any form of entertainment during the late hours he had to pull the appropriate entertainment permits. at which point in 2012 he pulled two one night permits. which ass so far as my knowledge there were no calls for service and no complaints. i did a commuter check important the last month's for the one 31
12:53 am
stuart street and there was one call for service. and that was in 2013 unrelated to it was an altercation involving an employee and patron i have no other records of disturbances and not received any calls or e-mails in regards to any form of complaints. >> nothing received march 15 the appellant indicates they've made a complaint on that date. >> in regards to march 15 i have a counterpart assisted
12:54 am
record. of an incident that occurred the actual address was stuart and mission. if you bear with me one second. the complainant was mr. those good. and this incidents where he apparently per the cad he respect to the premises anothers 31 stuart street there was an altercation involving security and the police were called out the report from mr. those good wanted a one of the security guards cited for being battery by one of the skukdz and the security guard mr. those good
12:55 am
sited for trespassing they had a private party so at one point the responding unit they rectified to medical and saying he was pushed. that's basically the information that i have >> thank you. i don't know i guess. >> i just wanted to mention that many of the concerns that the residents brought regarding smoking and noise outside by having a permit we're able to ask the applicant they will get a notice of violation if not in compliance with the good neighbor policy any garbage they
12:56 am
have to clean up. as part of the outreach regents submitted a number of letters one was from the hotel grich i was a little bit spriensz to see that. i was too excuse me. can you refresh some of the standards you'll hold no non-trofrns of the sounds >> the actual sound test measures the amount bins sound on the street and can't be 8 decimals above ambient so if outside the ambient sound was 65 anything over 73 is out of compliance. it can be as loud as you want
12:57 am
inside but not outside we're concerned with the residents and businesses are experiencing. >> i have one question in regards to the 2:00 a.m. permit is it standard practice to issue the 2:00 a.m. >> we rely open the police departments recommendations and a history of the what the applicant has, you know, shown so far. like i said as kit said mr. twong he has another location unicorn eave never harder of anything so there was no reason to deny it at this point >> okay commissioners the matter is submitted.
12:58 am
>> the - i guess that's one part of the city i don't go drinking i'm not aware of the situation contrary to any establishments when the last time the case on union street. >> not even harvey denton's. >> okay. the i guess, you know, after hearing a number of cases especially understanding the how stringent did sound is the permittee holder is going to be surprised what he has to do to stay within those standards. and i'm not exactly sure what
12:59 am
occurred on some of the nights that appears there's a difference of opinion as to what can and can't be heard. i'm a heavy sport that the sound has to be contained within the entertainment and i've spoken to it extremely on every case in front of us. i think that we won't know until this thing gets an opportunity to go through. it's a shakeout and we'll see what happened. i'm supportive of the holding the permit. >> i i guess i'll agree i guess to me what was persuade active there was no complaints other

than the appellant out of 4 hundred tenants in this building. and then on the streets, in fact, so that to me is significant as well as the fact that the video shows some noise but it's unclear whether it's patrons from other facilities as well as the permit holders facility that's unclear to me. it's also i guess i'll note it's speeding it's an exceptional situation all over the city in terms of noise. i didn't see any contrary report on the sound emissions presented by the appellant to dispute the report presented by permit
