>> matters appearing or not appearing on the, i am sorry, yeah, items for the meetings? >> you have your public comment on the executive director's report. >> david pilpal and two items under item three, the campaign finance discloser program, and the last sentence and the first paragraph there, the next filing deadline, i guess was march 24th and so, i guess this report is not capturing who was or was not timely on that. and maybe it will get an update next month? >> and, it also occurs to me that i believe that this thursday, is the oral argument in the alan grossman case, and i don't know that we are going to know anything further after thursday, and as to the disposition of the matter and that will probably take up to 90 days and if there is anything, interesting that happens at the hearing it might
8:31 am
be worth discussing briefly at next month's commission meeting. >> we should be so luck y >> i mean, seriously, there may be implications depending on how that goes, as to the sunshine ordinance and how business is transacted here in the city otherwise. and so, it is an important matter, i do take it seriously, thanks. >> and items for future meetings? >> i think that mr. chair, that mr. pilpal was reading my mind because i was going to interest at our next meeting for those of us who were not around in 2012, that we take up and get a report on the status of the, the case that is before the court of appeals, on for the oral argument and relating to our challenging, various, matters in the sunshine, san

francisco sunshine ordinance. and if we could have a report from staff on the history of that? >> and also, get into the way that it looks at this point and there were a couple of questions that i would like to raise, at that time and so if we could just discuss the case, that could go, on and get some preliminary report beforehand, from staff. >> i think that a discussion of pending litigation would have be to in closed session, right? >> that is fine. >> i just want to... >> and i just brought it up. >> that i think is great. >> you should add it. >> any other items for future meetings? >> is public comment? >> last one for tonight, david pilpal and i am not sure that it actually needs to be before you as an item but i think that given the lengthy discussion
8:33 am
that we had earlier that we should have a sit down of the minds about how referrals are handled from the task force that all of that procedural stuff we all ought to do better at and i take responsibility for my share of that. and i think that we should talk about that. and perhaps, at a staff level, we find a way to do that. >> specifically, i mean not... >> not specifically... >> not... and but i mean, what... so for example, in the case that we had today, is there some ambiguity when it comes to the information that you think needs to be transmitted back and forth to make this... >> i think that the task force could do a better job and understand the due process issues which, and i think that we need to carefully with the language of the ordinance because when we handle the request for the determinations as to whether a record is public, under 21 e. and that is a determination, whether there is a violation,
8:34 am
that is transmitted under 67.30 c. or 67.34 if there is a willful violation found and that has other implications and we sort of tagged one on to the other without detaching and considering carefully who is the main party and the respondent and i am not sure how much of that burden should be placed on the complainant and how much is the task force and what you can do to perfect a matter and whether you need to, and we need to sit down and think about this stuff. and frankly we should all try to get it right and not waste your time any more than we waste our time. but some amount of that is going to happen. and it is just democracy thing that we are doing, and you know we are working on that. >> thank you. >> thank you. >> commissioners ray hartz, director of san francisco open government, and i would like to point at something that i think that should be on an open for discussion, the letter that was sent to regarding the complaint
8:35 am
tonight states, however, if any party fails to appear and the commission did not grant a continuance or reschedule under 1.eand then the commission may make a decision in the party's absence. >> i watched you go through this derm on strong about the, and is it fair to mr. ginsburg, did he get sufficient notice, whatever happens to be, and yet, i don't see you having any problem at all, if the city shows up, and the complainant does not show up, and having a hearing, in their absence. you did it tonight, and you did it to me, last week. and it was done intentionally. i let the sunshine ordinance know that i would be out of the state from the fifth to the 25th months ago. they reschedule a lot of my
8:36 am
sunshine ordinance complaints because of that. and i will be honest with you i think that it is really bizarre that this was sent to me and to you on march the third, and i was not sent a copy of the referral and then on march the 5 thing, the evening of the day of the day that i left, you put in an announcement out saying that there is a hearing on the 24th which is the day before i returned. do you really think that any party, to a hearing is going to consider you to be a fair body, if you simply go and have a hearing in their absence? would you think that it was a fair hearing, if you had some sort of a hearing and they did it and you didn't know anything about it and only came back to find out what happened after the fact? especially when it was so blatant and announcing it on the day that i leave and holding the hearing on the day before i get back, what kind of
8:37 am
chicken... is that it is nothing but co-ward ess, it is because you have someone that always comes to the meeting and that is what makes it more aagree gus in my mind and i was here in the month before and he made the comment that mr. hartz you have spoken more than anybody tonight and when i do come to these meetings i always do speak. and the idea that i would intentionally and knowingly miss that meeting is just bizarre, and mr. st. croix, made no effort at all to contact me, or to determine why i was not here just as he did with the complainant tonight and i would not be at all surprised if this gentleman did not find out tomorrow that he had a hearing on his case tonight. and you are going to sit before the citizens of san francisco, on television, and tell them that you are a fair body? and i will read you the section of the good government guide that talks about that. >> mr. st. croix, could you reiterate for the record what
8:39 am
>> is there a motion to adjourn the meeting? >> so moved. >> second. >> yeah. we need the public comment on that. >> public comment on the motion to adjourn. >> no. >> okay. all in favor? >> aye. >> opposed? >> none, the meeting is adjourned. >> so what brought you out here for the bike ride today? >> i grew up in san francisco but i have been living in new
8:40 am
york. i wanted to see what san francisco is doing with infrastructure. >> cities are where people are living these days. the bay area is doing a lot with construction and the way to change the world starts here. >> we are about to take a bike ride. we have 30 cyclist. i'm really excited to hit the road and see what the city has in store.

man that gets the job done he bring his skills and commitment to making keeping san francisco a city of families in order to do that we have to have affordable housing. i associate that with his remarks of all the people he's acknowledged this morning and especially to the residents. this is all about you. and >> yeah. >> all right. and it was not that long ago person here for the groundbreaking and asked for your suggestions and we were generous with them mostly to be able to stay if you worried about through the tradition of groundbreaking to what we're celebrating today. i'm proud of the federal proclamation i want to acknowledge secretary for the 50 millions for the city and county
8:53 am
of san francisco and more to come and the $100 million in tax credits that the federal government's has enabled the private sector to loan in the tax credits that's a collaboration we were early with early money to pressure this initiative and what was really important at the federal level we're excited about affordable housing and market value rate housing here that weather we did didn't diminish the public housing sector of that that's an important priority for optd as we go forward with his reenlightening and through there's something part of the public housing authority and hud the rental demonstration program that that's a demonstration
8:54 am
program the more success we have here demonstrates this can be done and serves the model to the nation so we take pride if what this means to our residents and individual families those who have lived no public housing will continue to do so and the fact we have affordable housing is part of it and we have the market rate by none of the units were distributed that way it was very shall we say democratic's if i can say that. so congratulate everyone that has anything to do with it ali is a champion so thank you effective from the start supervisor cowen and to mechanic thank you for your allowing us here and joaquin i'm happy to

for the best resident in the city and county of san francisco (clapping) where the delipidated and uninhabitable temporary housing once stood we see beautiful brand new structural sound housing where families will have is peace of mind knowing their children will play in stave green spaces in their neighborhood. the mayor said we're delivering a promise not only to rebuild the housing we're delivering on but it's a promise to rebuild a community that's what is most important. a promise to instill dignity in a neighborhood and more importantly in the people.
