supervision date. >> same house, same call? this resolution is adapted item 12 >> item 12 is an ordinance to amended the public parks code to ban the graffiti folks tools on municipal transportation city vehicles additional remedies to the offices committed on property and have the superfluous go avenue them. >> supervisor breed. >> i'm happy we're here today to review this legislation and hopefully, i, commit you to sport it as well the graffiti costs the city over $89 million a year last december he asked for graffiti to be addressed not only to impose hasher penalties
2:12 pm
but better for the folks are impacted by the crimes. my office conducted a nationwide search and with collaboration from other folks the artists i introduced a package of elective and procedural changes and fubl the locomotion helps us to process the graffiti and allows us to use that evidence to file it against defenders. we no longer than have to depend upon the court instead we can sue the offends for community and others services. other california cities concluding ante los angeles saw it's graffiti areas decrease by 55 percent.
2:13 pm
if happens in san francisco a decrease of 50 percent is $11 million in fund we have the controls on muni vehicles and our parks to amend the damage there we do this by collaboration by city resources like 311 and our city attorney's office i'm not asking for more money. i want to thank supervisor yee and supervisor cowen and supervisor chiu for co-sponsors this legislation it's also introverted by mayor ed lee the san francisco examiner the chamber of commerce and last month it was amazing endorsed by the graffiti advisory board and the arts commission. i thank you all for your support

is homeowners and the parks and every san franciscan who's tired of pavnt over graffiti i hope that makes a difference and colleagues, i ask for your support >> supervisor kim. >> thank you and first of all, i want to acknowledge the tremendous amateur of work that's gone into this and following up with supervisor breed's the point of addressing graffiti and vandalism and other strategies to reduce that. i want to make some minor all the times my apologies i'm waiting for copies graffiti can be a form of art and permitted so denying it as graffiti vandalism i'm clarifying that in the finding. so i'll have copies of the
2:15 pm
amendments the second it two is two comments under our fair chance ordinances we limit the background checks and the validated off the streets is seven years someone who's been convicted of graffiti going back ten years on page 7 line 2. is there any reason it is set at 10 years or can we bring that to seven years. i'm not sure if this is a question for dpw if the 10 years is something within their code but if possible i want to make it consistent >> the third comment i know this is alluded to an page 6 on line 15 and 16 the remedies are
2:16 pm
in addition to the other equalities but it's important to all the outcomes their something that the city encouraged the way of restitution is not only money the offered may or may not have but restoration work cleaning up parks and really outlining those outcomes are the ones for the city as well is oftentimes we're able to make greater change for the offenders in the city not just get a fine or a site from the city. supervisor kim are you directing our questions to anyone >> i was directing it for dpw behind the rational.
2:17 pm
i want to amend that >> i know we've all received these but have you had a change to a look at those and no, but from what i've heard they don't seem to be that significant but until i'm able to review the changes and be comfortable i'm not able to support them at this point there are a number of surprises in terms of the changes to the legislation. >> okay. let me me suggest to advance and do pass, consent or kick this to later in the meeting. >> i'm fine if we want to go over each amendment amendment by amendment and make a decision in this regard. >> i apologize. i did go over the first 3 amendments with supervisor breed's office amendment 4 we alluded to we
2:18 pm
didn't have time but amendments one through 3 are for the finding to clarify what i said graffiti clarifies the graffiti vandalism constitutes litter or in works code which constitutes blight and litter. >> can we go one by one and make a decision on each one. >> i'll make a motion to amend on the first. >> i think there's concerns around the definition of the public works code this is mandated under 0 state code i don't want the codes in conflict i'm okay with the graffiti vandalism inserted after diversity the fritter and in the
2:19 pm
second sentence the graffiti and vandalism insert but in terms of the definition of public works code that's a longer conversation i'm not prepared to support. >> so it was either or i'll make the amendment for vandalism. >> the amendment that we add the word graffiti on page 1 and is interest a second by supervisor yee. if we can without objection we'll take that without objection. why not amendment 3 >> number 2 was again graffiti vandalism and by the way, we gotten as defined by public works from dpw but we're happy with graffiti vandalism. >> okay. >> i think actually, i already called the amendments for amendments one and two so 3.
2:20 pm
>> on page 2 line one the graffiti offenders delete the advantageism offenders. >> second by supervisor breed that's without objection the case and. >> on page 6 line 16 in addition to other amenities not limited to outcome like service repair of a property under the code of equality we want to see this as outline it within the legislation. >> i'll second that president chiu but i would prefer it says effected properties in plural. >> i'm happy with that. >> a friendly amendment. >> add the language included
2:21 pm
and repair even if properties seconded by supervisor breed without objection that should be included. >> the final amendment i apologize that's a surprise amendment a question of whether or not to make f this consistent with other legislation on page 6 line 2 within the last 10 years to in the last seven years. >> i understand supervisor breed you have questions to this. >> i wanted to have classification as to whether or not there's a question around consistency as it relates to graffiti officers. >> can we direct that to the city attorney. >> john gibner, deputy city attorney frankly, i haven't seen this until now so the
2:22 pm
legislation supervisor kim addresses didn't address this particular circumstance it deals primary with employment related inquires. i would be happy to look over the course of the meeting if you push that back further to see if there's legal problems are the change >> i don't have problem with the change i wanted to make sure there's no issues around the legality. colleagues why don't i suggest we can ask dpw to come over the next half hour >> this is our last amendment. >> it is but unless your prepared for us to sport this may be to kick this a half hour
2:23 pm
to give john gibner, deputy city attorney a chance to look at this. >> i'm anxiously anticipating approval. >> i'll call this before your slew of special orders so we don't keep supervisor chiu waiting. >> i wanted to put this in line felt other policies but certainly not president it to have negative consequences. >> i'll probably call this back up or thirty minutes. >> item 13 is to address various divisions of repair zoning r zoning for small enterprise work places affirming the planning department requisite findings.
2:24 pm
>> okay role. >> supervisor tang. supervisor wiener. supervisor yee. supervisor avalos. supervisor breed. supervisor campos. supervisor chiu. supervisor cowen. supervisor farrell. supervisor kim. supervisor mar. there are 11 i's this year ordinance a passed >> item 14 to add the word rescue row in recognition of the animal services organizations. >> colleagues, same house, same call? ? without objection this resolution is adapted so sclaegz we have 5 special order items at the 3:00 p.m. at least two or three of those will be continued
2:25 pm
