entertainment commission. we have one person, cathy peck, could we give her three minutes? could we have a microphone? >> is it on >> not on. >> test it. could you test it. >> no it is not working. >> hold on. >> we have got the professionals here and it will be on in a minute. >> try it now. >> hello. now we are hear. >> i am here, i am cathy peck, executive director of the hear foundation and hearing education awareness for rockers and it is an old name. and i am here to talk about the san francisco ear plug ordinance that was passed a decade ago and here worked with the mayor's office, and the board of supervisors, and the coalition on that early one. but we are very interested in

seeing how that is done. and we want to find out if the club's have had any luck being, you know, compliant with it. and we think that that could be really beneficial to find out and maybe help them. in some way. >> and this is elans. and he is a researcher at smith, kettle and we worked in the past and actually before the ear plug ordinance was passed, we had done a research study with smith, on musicians and folks coming and going into the clubs, and over our ten-year period we reported that about 86 percent of the people going into the clubs they were actually having ringing in their ears and so we were really excited about the ear plug ordinance like ten years ago. and now, we feel that there is a really great opportunity to show how great san francisco is, and you know how we are the kind of the first in doing hearing conservation and seeing

what it is that we are doing and how to help our citizens enjoy the night life. and they like to boogie, sorry. i am sorry. and any way, but also to help other cities get their heads wrapped around how this could happen and be a real positive thing, for people. you know, it is like a good thing. and we have this, actually here we have the initiative that we have done for, a couple of decades now, called plugs in clubs and we like to do this again with, and in our hearing initiative and plugs and clubs and do a research study with smith keller well and involve you guys with it and i talked

to cammy about this and we are old friends and it looks like the, and she had me talk to the public health department and they seemed to have, and it has tied into the fresh drinking water and so just coming here today to say hello and introduce ourselves and that is something that we would love to see. and we would like to see, you now, how it worked out and how we can make it better. and so thanks. >> great. we have a question. >> so, i know that you are not alicia bridges, i love the night life. >> yeah. >> and i myself have a custom pair of ear plugs that i had made. and after the ordinance came about, i know that my club was still open at the time, we bought a case of ear plugs, the spoungy ones and kept them there and the patrons have to ask for them and people are not just handing them out, as far as i know, i can tell you that much for a lot of the clubs

have them and they just, the patrons have to request them, just as they have to request water. >> right. >> and, also, you know, sometimes it is good for the people to know, you know, that they can request that, and you know, we want to help make that an easy thing, and we want to go out to, you know, for years, it has been in the clubs and always available to help in any way. >> commissioner lee? >> so, too late for me, my ears are ringing already. you know, we do have ear plugs in our coat check waiting for people to ask for them. are you going to go out and possibly have promos with sample ear plugs that can go out to the clubs and encourage people because i think that a lot of people don't know we have ear plugs available. >> well it is a two-fold approach, we would like to do

kind of a stea lth thing and then we would like to promote the plugs in the clubs again and get more people behind it and show, you know, and be more pro-active. in the clubs, a lot of the clubs, bartenders and staff they come to the hearing office and we do the free screens for them, always, for 20 years. >> you know, if you can come, very soon, actually, our staff wears ear plugs, our bartenders, but if you need to start with the signs that will be great. we will take your signs. >> all right. >> the main purpose of grading these plugs in the club initiative is really getting out the information that this ordinance even existed because i feel like most people are not aware of it and so we really do want to work with the clubs of

increasing signage and contribute our own signs in order for the patrons to be more aware of the clubs and i feel like most of the clubs do actually have ear plugs and me going to a lot of shows and just a lot of the patrons are not even aware. >> since this the public comment, we cannot have this dialogue, back with you and, we would love to see you come back with a presentation once the results are done of your study and once you have the findings of what you are finding in the field and i think that you have our support. thank you. >> are there any other public comment on items that are not agendaized today? >> all right, seeing none, public comment is closed. we will move to item two which is review and approval of the minutes from april 15th. >> i move to approve. >> second. >> second. >> any discussions? >> no. >> if not, let's take a vote.

>> commissioner lee? >> yes. >> joseph. >> aye. >> ayed. >> aye. >> akers. >> aye. >> tan. >> aye. >> and well, we are going to move on to item 3. which is the report from our executive director. >> good evening, commissioners, i handed out a package separate from the binder, so if you all have all of my memo. and lots of stuff going on these days, it is really busy. which is a good thing. and with the things outside of the realm of collective action which is even better. and i am excited to report that the board of supervisors passed a resolution on april 29th, resolving to create an integrated late night transit plan. and i attached the resolution behind the memo, and i report back to the board within 6 month's time and our working group will be co-chair by myself and then ben of oewd,

and this was an the hearing of the land use committee on the same topic. and this is going to be a hard effort, but one that i think that going to resolve into something really interesting, and we are putting together the test for the stuff right now and i will just continue to update the commissioner, as we go along and obviously i want to include you guys as commissioners. and as it is possible to do without, violating the brown act. but, yeah, this is going to be hard, but it is going to be fun. and the plaza legislation that you guys heard in february, was heard at the planning commission, because it contains changes to the planning and the zoning of the police code and on thursday, may first and to the full board and it will be heard at land use next month may 12th and i testified on behalf of this commission based on those comments that you made after the presentation that was made to us, and so it was

short, but obviously very supportive. >> and another exciting thing that started recently is the controller's office is doing the second phase of the economic impact study and look at the economic impact of the fares at festivals and so happily, we were able to push this forward before this, and they are in the festival season started, for the festivals and a certain number of them with charge attendants from people who don't live in san francisco. and to survey their own patrons. and find out, sort of how much spending is going on, and it is a simple survey and instrument that can be done on-line with

survey monkey or on paper. we expect the results and analysis to be done by early next year, based on the fact that we want to capture all of them that go into october, including outside lands and so that gives us time for the controller's view analysis and hopefully that number will be large as we expect it to be and will help us with some other things that we have been discussing including 10 b, which i will get to. right now, in addition to that memo, there is a letter in the package from the police commission. and it was in response to the letter we sent in april 17th regarding the 10 b program issues identified at our hearing. and the police commission

response dated may first is attached and short and indicates that the commission president believes that these issues fall outside of the parameters of the commission to modify the program. and from this point, the staff will just await any further instructions from the commission. today in addition, was a really good day because the mayor's office and supervisor weiner jointly announced the launch of night life sf and i have attached the press lease as well and so you can take a look at it and this is the website for the current night life entrepreneurs and patrons and musicians and anyone interested in the night life, and it is really dense and it has a ton of information on it and takes the time to look at it and congratulate ben who worked on it and took the time to get it pushed out into the world and now, if you guys would share,

on your social media, and then, i am sure that ben would be appreciative of the feedback, where i think that it is really great. under the heading of the office update, the place of entertainment permit for region located at 130 george street was appealed on april 16th and the board voted to sustain the entertainment commissions actions. and we remain undefeated at the board of appeals. the 1842 is the list for the expect or position that i have working on getting, so when i can hire an additional inspector was adopted by hr yesterday, and which it is really a big deal. ten people on that list that have gone through the process,

and second interviews are being schedule for the final hiring to the done, cross your fingers by the end of may or early june, which will make it the fastest first time ever. >> on tuesday, april 22nd, and we will keep the commission informed and unless, commissioner hyde wants to add anything to that. and i got, i thought that today, that the heritage foundation legacy bar project continues to roll on and june second, i think, is correct, they are going to add another one to the list of legacy bars. and that is going really well and which i think is really exciting and that should be at

>> and if you survey. >> patrons, >> if you give it to pride, which is huge, you got to do it like now. >> much time did they give the neighbors? >> a couple of months, they are trying to figure out if they need a permit to do the work and they are not allowed to touch the vent on the roof because the landlord is not giving them the permission and so they are trying to do what they can using what little funds they have and i believe that commissioner hyde also

recommended that they speak with the small business office, to see if there is any short of low interest loan or any sort of thing to do with the city, to accomplish that. >> what happened just curious, what happens if they do all of this work and spend all of this money and it is not good enough because of the vent? >> i mean that i guess there is nothing really more that we can do. >> okay. all right. and just for the corrective action goes, can you tell us what happened at 550 bonneville? >> there were two incidents over, i don't know if it was even two-week period or a three-week period, on saturday nights. related to one particular party that is a repetitive party. and there was some violence outside of the club, but considering there is not a whole lot around there, it was attributable and fairly clear nexus to that event.

so again, the security protocol was reviewed and did not rise to any formal at this time and everyone agreed to that, but, there is some serious change and since then, we have not seen or heard anything come from there and so hopefully the changes that they made will work. >> thank you. >> just out of curiosity, is the night life, how do they refer back to the entertainment commission site? or is there... >> it does over in the sections that are related to the permitting, obviously there is a lot related to this commission. but, by and large i think that it is not really about, it is not primarily, in that permit it is a big part if you want to start a business in this industry, you got to know about the zoning and all of that stuff. but, we are and ben is here, i guess, if it is inappropriate to ask him to answer that. would i say to take a look at it because it will be, and i

don't know if you are, it is on your phone it is teeny, but it is really an interesting website and i think that it is really flexible and easy to update as well. >> great. >> all right. so do you want to take it away? >> good evening commissioners and related in relation to it, i just want to staff off with that andvy been by every weekend and friday and saturday, and my normal patrols and my big focus is making sure that they are using pat down at thes door and enforcing the dress code and i have gone as far as to check for the new security that i have yet to meet that they are guard crowded and since these incidents in our meeting and at bay view station, there was only one instance where i had a guard that was uncarded and a new card that they called in last minute. and it was the 6th guard on

100-person night and so as far as being able to control crowd and having the proper security numbers for the number of people in the room, i think that they were good to go. club malibu is part of the patrol and i always try to be sure that there is a presence out front, and one disappointing situation on this last saturday was on saturdays they have there is a change over late in the night and i noticed when i was driving by that they had a band out front, not playing at full volume, sort of warming up instrument and so i talked to them and the band directly and i went in and talked to the management and and a change, if you need to in the front, they have been very responsive, when i am there and

regarding the construction projects and i had about a 45-minute visit with the saturday night dj this past week end and trying to figure out the ways to lower the over all volume and he has a meter on the phone that he is checking out and we went over the things together and so i am going to continue to work with them and bring the over all volume down in the meantime while the construction project is happening. and maze is also a place on polk. that i have, and i will stop in on the weekend and i have made the visits due to a comment by a neighbor. i think that the main issue with the maze on polk is a side door and a double door on the fern alley that a lot of sound leaks through and i have been in touch with two owners and we have addressed with getting a

quote for additional sound proofing and i feel that we are making progress there and a couple of other complaints that have come across the desk in the last three weeks, and one at the chapel on 777 valencia and one on 582 washington, and very good communication between the complainants and the owners of the establishments and i think that they are looking for some third party input. >> that was lovely. >> yes. and maybe my voice is too deep. but, there is very good communication, between the management and complainants and i think that the next step is to go in and do some dwelling inspections and insure that the complaints are valid and see what we can do to take other steps inside of the venues.

and it has been an ongoing establishment that we get the frequent complaints from and i don't do a ton of shows there and i have been working with a resident across the street for some time and was unable to get into the dwelling, and over the course of about a half hour, i was able to establish, a new limit for the night manager of the venue. we were able to set a high limit for the sound for the events and the tenant is happy to have someone in the office that she can communicate with and has the phone number for the event manager and myself any time there is an issue, and this is one thing that i will have to be by for every event and take a listen and they don't have a built in sound system and so there is no levels that we can set with the

equipment. golden gate tap room is plays in the union square, 449 powell and they are out of compliance as far as the permits. and so, they are after a visit on saturday, they were already been in touch with the entertainment commission about coming into compliance, and then at the request of officer chan at the station, i visited park 77, and park merced and they had a couple of incidents and i have yet to look at the reports and i think that there were a couple of fights in a short span of time and since then, they have instituted a cover charge or using wands and id scanners and said that that is helped out quite a bit with their crowds. and i think that about wraps it up. >> any questions? >> one quick question, so the

incidents at 550, that prompted just the meetings about the security plan, what were they? >> there was some knife, one instance and a fist fight and they are not properly patting people down and that is why. >> not even in the clubs. >> got it. >> so it was from what i have seen, every time that i have gone, they were patting down out front and have many more security than they need based on the security plan and dress code as well. >> right. >> okay. commissioner hyde? >> yeah, i just wanted to ask about club malibu we just had that meeting and they were warming the band outside, it was terrible. >> it was disappointing to see. >> i wanted to know if there was anywhere around that space that was creating noise or having any entertainment like in a garage or anything like that? >> not that i have seen.

i do patrol the general area there is a restaurant next dao by the name of william that we are trying to bring in compliance now for a limited live and i do walk up the alley next door there is a place that caught my eye called melody cafe that has a garage across the alley and they do have a piano, butvy never seen any activity and i only thing that i have seen in there is a car parked. >> okay. and then have we limited, what i have learned from joseph, is that if we limit the bass or the music at 80 dba? yeah? db? because, the biggest problem is the bass going up the hill, and vibrating through. so have we limited the bass at malibu.,?

>> the only discussions thus far have been over all decibel levels, the bass is a huge contributing factor to that in the situation and i have yet to go in and try to set corrective bass levels with them and maybe that is a good next step. >> yeah. >> so it is not the dbs, it is megahertz, it is frequency and done on the equalizer and so it is not done on the limiters and it is nothing to do with the compressor, and it is done on the equalizer and so, if you will see it, it is the low end, and so anything below 60 megahertz or 80 megahertz and you take that out and you are limiting the vibration, not necessarily sound. >> i have heard it, many different levels on many different nights, i think that they have a different guy on friday and a different guy on saturday, that they have sometimes two different acts and one dj on one given night

and so... >> you can ask them to start the equalizer and move it out of the dj booth. and put it in a closet and lock it up. >> really, that is the main thing and i don't think that they are able to comprehend that and do it themselves. >> right. >> when we visited them, we asked them to do that and that was almost a year? >> 6 months ago. >> okay. >> and so they should have been doing that. >> okay. >> i will pay, and i will set up a face-to-face prior to the event night. and some time early in the evening, and this friday, hopefully, and we will see if we can go over some levels. >> thank you. >> commissioner lee? >> i never have been there and so just referring to you guys, when you, and is the duct insulated on the inside? >> no. and i mean there is no inside, it goes from the wall up >> up the shaft? >> yeah. >> there is quite a bit of sound coming from this. >> yeah. >> and quite a bit of sound
