july. a stand alone museum and in 2008 and a new proposal came forward to have millennium build a tower and encorporate the cultural space and in the building and so it has been around a long time and it is seen, fortunately, or unfortunately the passing of the redevelopment agency and the expiration of the plan itself and thus, the actions that you are left with were the merely the conveyance of the parcels to millennium. and historically, or typically this would not have been a big deal, fairly straight forward transaction, except along the way, the redevelopment agency was dissolved and the state put into place a number of procedures that actually required former redevelopment agency to dispose of property but more significantly require

scrutiny by the state to be sure that it fulfills the purposes of the dissolution law, and so when you approved the purchase and sale agreement, to the millennium in july, you also approved a parcel property management plan which was sort of the governing document to the state that authorized and indicated that the transfer, or the conveyance was consistent with dissolution law. and subsequently in september, the department of finance approved the purchase and sale agreement, as well as the property management plan after, of course, the oversight board had also approved that. within a month of the commission's action and approving the purchase and sale agreement, there were two lawsuits filed, both of which relied on the, or on the sequa

the california governmental quality action to challenge the actions of the city and the agency, and because the agency's role in approving this project. the purchase and sale agreement. was much constrained from what it had been before, and the agency was a responsible agency, under sequa and it was not the lead agency has it might have been when the redevelopment plan was in effect and so in essence, the agency was relying upon the city's actions in certifying an neir and adopting litigation measures in approving the purchase and sale agreement, and so as it is a narrower, scope of responsibility. and this lawsuit, essentially, alleged that the eir did not adequately address pedestrian impacts, although there were broader claims, that was really the essence of the lawsuit and indeed, during, the discussions

with the petitioners that it came clear that this was the main focus of their concern was trying to mitigate the impact upon the pedestrian traffic that would be caused by this project as well as the cumulative effects of the projects in the area. and there was, a series of meetings and negotiations and the result was a settlement that proposes that the city and not the agency takes the certain actions that will hopefully improve pedestrian traffic. the settlement does not impose liability on the agency and results in the release of all claims, related to this lawsuit, and also, results in the dismissal of the lawsuit.

in short, the settlement agreement, and provides that the city will install signs in and around the project area prohibiting the bicycle and skateboard riding, and it will widen the northwest corner of fourth and mission street, so that it will be a greater amount of sidewalk for the pedestrians to walk on. hopefully we will have the fundings and the efforts of the city official to make it happen

and there will also be a sidewalk management work group that consists of the city agencies and the community stake holders that will continue to review, what other actions might be taken to improve pedestrian safety and the flow of the pedestrian traffic and make recommendations to the appropriate city departments. and finally, the settlement agreement requires that notice be given to the petitioners of any sidewalk table permit applications, so that the petitioners can comment on whether those sidewalk activities obstruct the pedestrian traffic or otherwise cause problems for the pedestrians. and the developer mill len um will donate $200,000 to the city to help to implement this and it is not the entirety of the budget, that is required,

to implement all of these actions. but, that will be the subject of the city approvals, and, i might add that all of the parties, have approved this settlement agreement, with the exception of the board of supervisors. and which typically does not approve agreements, settle agreements until all other parties have weighed in and approved it, but you are the next to last step to that process. all of the others, have indeed signed off on this and so based on the fact that this settlement will resolve an outstanding lawsuit that it will provide the benefits to the community in the area that will impose no financial liability on this success or agency i recommend that you approve this agreement. >> thank you very much. >> thank you. >> thank you very much. and i would like to take public

and again, i want to state right clearly because the hispanics have played an important role in california, as is the name of this city, san francisco, and as is the name of other cities san jose, and is the name of other cities, santa rosa, and we need to have a museum. we should have had a museum a long time ago and i participated in the deliberations with the first museum was supported to be built here with a lot of confrontation and came to the podium and stated to everybody how my family in the 16th century preserved the torra for over 300 years and the matriarch from the family came to me and paid her respects to me and so we need to do the right thing when it comes to

respecting and honoring our people as we have the..., you know, the museum of the african (inaudible) and i participated in the initial discussions and i was the first person to write an article on that museum and so the bottom line is this, the people, that contributed to this city, and rather they be hispanic or black, or they be the native americans we need to pay our reports and do the right thing and what is important is and with the success agency with the process, and it is the process, process, and the process is not very clear. and so, only if you have money you can go to them and you can deliberate and come to ajuddation and no one is going to come and speak after me, and

point shipyard phase two provides for a variety of public benefits and the commission is considered previously, benefits related to the public housing, and alice, and the parks, and certainly, one of the key public benefits in what you are seeing before you, frankly before any home is sold, either on hunter's point or candle stick is the advancement for the studio space for the artists who have had a presence at the shipyard for many, many decades. and we are very pleased to bring forward the scematic design for that replacement space and this is a companion item to what you heard a month ago, related to the commercial kitchen and now there are two separate buildings that will accommodate these use and so with that, i would like to ask, the assistant manager to present this item. >> thank you, executive director, and president johnson and commissioners. and today in requesting for the commissioner to make the

findings and to conditionally approve the designs for the huntsman shipyard and as part of the presentation, after that contest and the replacement of the buildings and as well as the location and requirements and the obligations to the existing tenants and subsequently, (inaudible) will present this design package for the replacement studios and i will conclude with an overview with the next steps, as the executive director pointed out it is for the kitchen which happened on april 15th, and that replacement kitchen stems from the same location obligation as today's replacement studios. >> as you know the shipyard is in the process of being redeveloped and will deliver over 12,000 homes and 350 acres of parks and with the office space and the development

program and also envisions the district of the center and referred to the shipyard and the village center for the guidelines the existing building houses 150 artists and additional artist buildings will be developed around the building 101 and you can see on the slide, the location of the art district in red where the circles will replacement of the facilities are shown. and in order to initiate the transformation of the shipyard, nearly all of the buildings will be demolished and all of the buildings are vacant, and some are currently occupied by 300 artists and the commercial and you see all of the numbers on the slide, and this is the building that will be retained and all of the other buildings will be demolished and this will be required to relocate and the building 103 has already been vacated to the

necessary work, but the artists out of that building have the right to return to the shipyard and so they are part of this location obligation. maintaining the role of the artist and the future of the shipyard with a clear mandate of the variety of stake holders and could be found in many of the documents of the shipyard development and for example, the redevelopment plans, and states just one general principal and to maintain the large committee of artists and on the shipyard for provide for the needs of the low cost space, and the conceptual framework calls for the work of the space, and so the prop g which was late. provide the guidelines for the

building that will be a replacement for the artist studios that will be the most as part of the redevelopment. and in the residents and this will be placed and to the intended acquisition and by the public entity and it has relocation rights, and from the relocation assistance and the property and they must receive, no less than 90-day notice before they actually are being displace and there are no residents on the shipyard for the residential do not apply and so some of the arists apply for the businesses and they are entitled for the business reestablishment in the businesses and in addition to the general benefits for the moving expenses. >> and in most relocation situations there is an actual displacement from the site occurrence. and this has to find, the new suitable facilities and at this shipyard, however, we don't

have that kind of displacement because they have agreed to make sure that relocating the tenants off the site but they will be accommodated to the new replacement buildings at the shipyard and this building that includes, the replacement studios as well as the kitchen will be constructed and closed to the city and the building to make sure that we create this vibrant art district. and this commitment to provide for the replacement facilities is captured in the face and the plan and which is part of the dua. they have required a consultant to advise the agency on all relocation matters and check the wake field with the opc is here today and ask him to stand up for a second over there. thank you. opc for the past and perfecting the condition of the artist studios and the design process

and the replacement facility and making sure that all relocation work is fulfilled including preparing a relocation plan and in summer and fall of 2011, opc conducted a survey of the existing artist buildings, and the interviewed artists in order to understand the current work environment and the studios to determine the next square foot replacement requirements. in cases where they could not get access, to the landlord, they submitted a summary of the survey results and these were shared with lanar and used as a basis for designing the replacement studios. in 2012, presented the first to the artists and you can see how the comments were tracked during these conversations and many of the artists and suggestions were implemented in

2012 and 13 and continued to refine the building designs with the impute from artists in late of 2013, presented the final draft design. the work on the building design, they worked with the partner and opc consultant with extensive and real estate and expertise to estimate the future rents based on the operating costs, the tour of partners is here today. and ask her to stand up as well. and what she did, is she used the design and the drafts of the building to create a performer, that estimated all anticipated costs associated with running the building and so the costs include the expenses for the operation and the maintenance and repairs and the utilities and in texas as well as the capitol reserve that will be necessary to maintain the building over

time, the partners current estimated $111 per square foot per month and which is consistent with the range of $1.00 to $1.20 that she estimated early on in the process and that range has been communicated to the artists since 2012. the rent number of $1.11 is considerably below any rents in the artist studios that are available and advanced from $1.50 to over four dollars per month per square foot. the closest space is in bay view hunter's part and it is yosimite and they go for $1.50 and there are no current vacantcy and we don't know if the rent will increase there as well. the current rents for the existing studios range very widely from less than $.40 to over $1.50 with the median rent being $1.87.

and some long term tenants at the shipyard for many, many years. 87 cents, yeah, thanks for the correction, thank you. >> so some of the tenants for a long time pay very low rates of less than $.50 in some instances for all of the buildings that don't have running water or heat, or in door, bathroom facility and these rents for the existing artists have not been incraoetion creased in many, mean yeaers and do not account for any reserves for the capitol investments that they were not slated for demolition, and however the vacantcies are occurring in the building and the new artists pay the higher rents, and closer to a dollar. the impact of the rent

increases and the oci and the earlier survey this year to confirm the tenants to move into the building and this is done in close collaboration with the non-profit organization that represents the shipyard artist and whose mission it is to maintain affordable space at the shipyard. and all artists respond that they wanted to move into a new building and many of the artists will be happy to sign a lease as soon as possible. and for some artists approximately a third the rent increased poses a problem and they requested smaller studio sizes as an order to be able to afford the rent and as a result. oci requested to provide more small studios in the new building and the ibi group that will replacement studios and the architect to adjust the plans for more spaces in order to address the artists of the affordability concerns and as part of the survey and the subsequent follow up

conversation with the artists a small group of less than ten, indicated that they would have the difficulties with the new, rent, but they were not interested in increasing the studio size and they cannot be addressed to the changes to the design and however in response to that, star decided to develop a fund to provide a financial assistance to a leg able artist. and oci and star will continue to reach out to artist and not respond with the survey and if not, it will be further advised as new information comes in and the changes to the elements of the studios can still be made throughout the early phase of the design development, and if there is no additional information, or objections from any of the remaining artists, by the time that the building interior has to be locked in which is approximately 6 weeks after the approval, those artists will be provided with the studio spaces that correspond to what they

currently have. >> the replacement studios for mostly parcel b artists will be built on the site where the currently building 110 is located and those tenants need to be relocated first which includes the commercial kitchen and the number of artists that are accommodated in the vacant spaces on a temporary basis and those artists have the right to move into the new building which that is available. and subsequently building 110 will be demolished and allow for the construction of the replacement studios and as soon as that completed, parcel b, artists and the building 110 artists will move into the new replacement studios. and on the parcel b is cleared, the demolition can start there. and so, to allow for the parcel b work to begin immediately, when the parcel transfers in 2006 and to be sure that the important public benefits that

includes the housing sites and the improvements and funds for workforce development and the housing assistance and the new parks, will be provided without any further delays, and we propose adjusting the order of approvals and proving ahead with the design, and in advance of a major phase approval, this is a lot by the dda and consistent with the approach that was presented for the replacement kitchen in april. and the replacement studios design has undergone the usual design review process by oci with the input from the planning department and the technical staff has determined that the design is conist ent with the design for the development guidelines, including the parking and requirements, and also, that it complies with the redevelopment plan and with the phase two, dda and i want to ask them to come up and walk you through the building designs and

related infrastructure work. >> so, i would like to thank both the staff and commission for having us here again today. i am not sure, there we go. and today, marks the exciting culmination of a long process, in which both lanar and star and the artist community worked closely together to arrive at an out come that i think that we all can applaud which is insuring the future of the artists in the new shipyard as we work to redevelop it. and i will not spend much time on this page, because the design team members are not paying for advertising here. but, ibi group is the lead architect and patty lock is here today who will also help out with some of the design

portion of the presentation, and the balance here is the rest of the design team. so, what you can probably see, much better in your packet, but unfortunately it is not showing very clearly here is the overview of the artist parcel site. and on the top portion, and i will, and i will not spend much time here because it is a little bit hard to read because the top center portion of the site is where galvez comes down and enters the artist parcel and in the lower left-hand corner, you have outlines for the future pedestrian plaza and the future art center, parcel. and the top portion of that rectangular shape is actually the commercial kitchen, which the commission heard a few weeks back. and the trapezoid shape at the

top is the artist building portion of the site. so this side, will help you get a bit more or a bit better sense of sort of where we are located out on the shipyard and you see the upper left-hand corner and it breaks into robinson street. and building 110 sits just below where robinson street is defined. and that building will actually be coming out and that was sort of a portion of the presentation with the commercial kitchen. and you can also see building 101, which currently houses approximately, 150 parts and that building will remain. these are some images of the site as it exists today. and i think that the most important one
