this is a partnership. i believe in maximizing the potential but i welcome the facelift by adding manipulative needed housing to the land therefore i support 24 project and urge the planning commission to do so as well >> thank you. >> next speaker >> good afternoon, commissioners i live on the hill as well and go by those places endless i hike peninsula in all directions everything else that's been said i agree with but there are many ways to get to pioneer park. and you can go up greenwich and there's filbert steps and any
11:31 pm
constricts will cause temporary problems, however, so much construction is going on this the city anyone can complaint i support this we needed something there especially nice housing. thank you, thank you >> thank you. next speaker. >> good afternoon. i'm bill rick's i own the property east of the subject property and strongly support 24 project. more importantly i'd like to read a short letter from a neighborhood of mine. this is from mary kay q shields immediately west of the property she asked me to read the letter. dear commissioners i've living e lived on filbert street my home is immediately next door to the

proposed this on telegraph hill i believe the project deserves our support the property has been vacant wrapped with a chain link fence. the owner and sheert has been supportive to my suggestions about the design which will be an appropriate scale for this location i look forward to the property being cleaned up and thank you several mary kay i have another letter from john fitzgerald a similar sentiment i won't read but pass that along to you >> thank you. some more names. (calling names) >> hello, i'm calvin i own a

tic i've taken an interest in the architect of our city i've been born and raised outing outside of san francisco but will hear. i'm impressed with the design the fact he's been linking to our feedback and is having a beautiful project i'm impressed and think this should be approved and urge the committee to do so. thank you. >> hi, i'm greg? my wife jennifer we live two houses from the project. we pretty much support what the other supporters have said we agree with all the folks we're a
11:34 pm
pursuant of the projects we think the site has been empty and want to commend the project sponsor we felt they've kept in touch and just as greg and i were married about year and a half guarantee going ago i've new but i've been to the hearing i'm actually a real estate agent and this site needs something. and it is really does not do a service to telegraph hill to have this site where they're graffiti and broken glass and again, just as a new be to the neighborhood the design the project is complimenting the neighborhood and we're in support of it thank you. thank you. next speake
11:35 pm
thank you. next speaker. >> good afternoon commissioners i'm duts tin a local resident i've moved here if colorado my wife to pursue a opposition here and coming from colorado we were shocked at the housing shortage in san francisco we've been looking over a year now i will venture to say that the housing shortage in san francisco is a crisis i see coit tower and i'm stunned to see this vacant lot. i reviewed the proposed plans for the townhomes on telegraph hill and support the project it's a shame that the process to build some such beautiful homes has taken this long coming from
11:36 pm
someone that wants to purchase a home i urge you to joet vote yes. i wish to see this on the market today >> thank you. next speaker. yeah. let me call the last kartdz and if you wanted to speak please line up on the screen side of the room. >> thank you, commissioners. my name is kevin i'm a resident in the neighborhood arena near the embarcadero public voices are critical when talking about a public view and public landmark a landmark is one of the most recognized in the country definitely one of the 3 recognized in the city. you each were appointed your
11:37 pm
positions with the public interest in mind and on a yearly basis we're stanley trying to generate revenue and preserve the and i athletics of the neighborhood we've not laud this this one a los angeles or new york and we love our city i question whether this is in the public interest to have the wall night not in the public interest this is a beautiful park the top part of the city okay twin peaks maybe by but thought the top highest part of the city please remember that and like entered for the record over 40 letters to deny the conditional use
11:38 pm
approval and instead two urge the project sponsor to look at alternative options and there are we ask this commission to tell me the project sponsor to cocoa to the negotiating table with the neighborhood there's not a come mitigation over the height that could not be reached >> thank you. next speaker. >> good afternoon, commissioners i'm mary i'm the ancestor of the telegraph hill dwellers planning and zoning economy i live on mothering street i met with the project sponsor and he presented various options preparing flexibility so that the neighborhood would be
11:39 pm
fine with the project how have what's been presented is not at all what we discuss i'm disappointed what's before you is a mother and father out of every inch of what is allowed in the massing and not prepared to us with the different options early on the west wall is a solid wall facing the west that the public right-of-way will see and people with walking up there this project was rushed and needs to go back and i encourage you to have the neighborhood work with the project sponsor to resubmit the project with the variances that will meet the needs of the neighborhood. thank you very much for your consideration >> thank you. next speaker.
11:40 pm
>> hello, i'm the property owner along the east side of the property as well as the portion of the south side like no one spoke to us he wanted to drill from our property into his hillside so he can drive cars for parking i said no, i never received any plans and one of the neighbors had an attorney dhekt the statutes and the planning department said there was no permit preponderance of the evidence but there's a 2013 date on this permit small business is covering up my husband and i own the pathway out right open the east side of the pathway has been narrowed by
11:41 pm
3 feet by architect i've heard about this look how small those perspectives i had to take off the internet we're confronted with a state and local government number of issues i wrote a letter in regards to this proposal and wants me to reference a few items first, the most concerned issue is the cut they're putting into the sides of hill. and certainly the this puts all the adjacent properties at risk and this has brick foundation our foundations have been reinforced, however, the hillside goes through tour garage that helps with flooding so at what point doesn't this
11:42 pm
supercede to accurately talk about the risks who's looking this over as you know mr. carp has been retained and down a critique we've not seen this. i first heard about this on june 29th it's ridiculous to shadow there has to be some strategy of shutting the neighborhood out of the process i hope the commission will pause and consider whether theirs other benefits to benefit the community at large for the neighboring and not indicate eric garcetti to a need of a few everyone e even without public benefit please do know and just say no. thank you.
11:43 pm
>> thank you. next speaker. . i apologize for not having a card i've lived in neighborhoods for over 25 years from 995 to 98 i was in the houses that has been referred to everyday because the manager and i was working together i was there everyday and just came up to correct something with with all respect that was miss tom nolan spoken if there's a curb cut out i'm positive there was no curb cut out but i'm sure there wasn't a curb because i had a motorcycle and like the cottage without a fence in fact it of
11:44 pm
the green if he has for decades and that green fence prevent anybody from walking into the property even though equip the for terry we could walk through the tiny gate the exclamation of the curb printout tloofts no a derivative because immediately on the other side of the fence on the filbert staepz steps was a bush of the roses where i often stayed and worked would be where you could come in own the other side of the fence so i'm simply saying there's no curb cut out and access for cars and someone that knows the neighborhood the issues are how are we going to get cars in and
11:45 pm
out of the areas how are they going to go in and out on this 12 place and not to be dangers to another person i'm sure it was possible but not done in the past. thank you >> thank you. next speaker. >> good afternoon howard wong i'm an architect on the west side of telegraph hill unfortunately, this project has become bulkier and worse over time the initial projects are the potential success. the earlier destines were lower and nifld views over the buildings and views between the this are buildings unfortunately, the project got a little bit taller and bulkier
11:46 pm
and elevators and penalty houses commissioners, that places you under president reports and announcements added but if you look at telegraph hill from affair or close up it's a fine-grain mediterranean village when people look at that hill from surrounding areas they're looking at something special that's why visitors look at the view. a view a mediterranean village rivals almost anything not world to so a wall that large and the residential view corridors is not necessary. if you look at any hill town or fine-grain urban design building step downward with the slopes although it steps along the telegraph hill side it doesn't
11:47 pm
step in the south ward direction towards the downtown or other southern have you corridors and there is no reason why it shouldn't like any project there are many ways to design a building a stepping way to the south is just as much value as project that don't we see projects in marin county and dwreez and italy and are respectful adherence provides opportunity for decks and patios and terraces which are equally as valuable for a high-priced luxury real estate as a room. so that in this particular site there are many, many options that could be study. the impacts of the construction are very, very significant it's
11:48 pm
going to be like the historical grave brothers that tried electro demolish this hill and finding the vulnerability of rock and the geoallergy of risk this project needs to be looked at very, very serial thank you. >> next speaker. >> hello commissioners. i'm shootout i live on kearny which is the other end of telegraph hill boulevard at the top of lombardy i've attended three or four of the community meetings and this last project is huge. i sent you a letter i assume you've read it i'll outline some of my complaints why on earth is there not an eir required for this it's such american people
11:49 pm
impact if you see what has to be pulled out of the site the garage is 4 levels down how many feet is that and come out on telegraph hill boulevard there's no accountability street access. the bulk on filbert street steps i've asked the talent the architect why they can't have a different facade it relates better to the hill character rather than a large project which is it's correct that the whitney in the garden daily house is incredible but why have 3 clones coming down the staircase this project needs fine tuning thank you very much. do best for san francisco on this one this is a problem
11:50 pm
child. thank you. >> thank you. is there any additional public comment. oak seeing none, public comment is closed public comment is closed >> commissioner antonini. >> is julie i have a question for you in regards to our comments. you made a number of the suggestions obviously construction control is something we can workout and improvements of the steps on telegraph hill can be talked about by the way, you talked about the position of the view the break between the houses and are you saying i think it's between house one and two the the slot to allow people to access the wlfldz and congressional are you interested in putting in a different location or enlarging that
11:51 pm
location >> moving it commissioner there's a scale the little cottage the issue of the view coming up the hill from the west to the east so when our coming up the stair from kearny street because the number 3 the west facade is on the property line currently it can't have my any windows so you see this big blank wall we know what that looks like so we're moving it down the hill so the project sponsor the architects already planned i think there's a gap i don't know if their, their property or mary kay cottage but a small gap between the cottage and number 3 unit by rightthree: the architect what would happen if we move forward the three walkway and aggregate that with the space to
11:52 pm
the west of unit 3 and if they pulled the unit back just a few more feet they could introduce windows on that facade and better set back the top floor now this that golden gate bridge views you've got light and air it would make the unit nicer but my interest if you're seeing the view as you come up the boulevard you'll see the skyline you don't want the space after around the curb but if you aggregate all the possible openings that the project can tolerant and agree gate them too the cottage and the project you might open up a corridor and certainly open up light and air
11:53 pm
and make the facade nicer and give the cottage nor breathing room in the tape floor is sent people having the cottages would get more sunlight and there's a lot of advantages to amending the west side. >> when you talk about the cottage the existing. >> i'm talking about the 3 - >> on filbert what we call mary casing cottage. >> i now understand when i heard cottage i heard cottage was way in the background. >> mary casing cottage. that's very well taken and i'll ask the project sponsor. i have a few other comments i would be in favor of the possibility findings a way to make that larger as staff stated
11:54 pm
at the beginning of the presentation there's no view problem from up on top of the telegraph hill where the park actually is, in fact, the trees have grown so high you can't see around that's a different issue were you see a view as you're driving or walking up telegraph hill boulevard which my wife and i and i don't even at 10 feet high it will block the view the entire view, of course, you'll see the knows their at all in telegraph hill but whether it's thirty or 40 feet it dpoorptd but i agree with julie if i put the separation on the extreme west side that will open up space often the com on filbert and might open up a corridor
11:55 pm
which one is coming in towards the direction they'll not see the new demonstrates but beyond it to look down there it's not the most important view to preserve and as far as the comments about the cars traffic there's 4 cars maximum and it's doubtful they'll be coming out and because of the elevator those carcinoma can gage their entrance and they're not alone there are other houses further along the boulevard that have drivers into the filbert steps you're going to descend the filbert steps to the east this is not the first time cars have
11:56 pm
begun in there this is not an issue to me and the other thing it's tight i conforming the issues about the geotechnical or dbi issues will have to be worked out and we'll come up with a schedule. and someone else talked about the subpoena problems on filbert. i think if we open up that space within the filbert homes and the new project it will allow more but talking about the sun particularly in the winter months it comes from the setting this wouldn't have an impact because the sun comes from the south of those places. there was come traffic the complications of walking once the construction is underway the
11:57 pm
trucks will get into this site and the rest of the way the passageway will be clear i don't think that's a problem except when the trucks is existing or entering and the other thing i do often walk by there and wonder why the vacant lot it looks like a garbage dump and it is amazing people would rather leave it this a dummy state i can see the questions but the fact their moving forward and as jimbo bob stuart carefully summarized all the alternatives so other things were not financeable and private residence on here is probably the thing that makes sense
11:58 pm
particularly when the city gets property tax revenue and a lot nor aesthetic people coming from other cities and walk up the steps wonder why it's american people embarrassment to the city. i think it maybe a little bit of modification i'm prepared to support it but i want to see if we could move the positioning of the hours to allow for of the corridor that julie was talking about and also perhaps some set backs if possible. >> commissioner sugaya. >> yes. i have a question for the staff on the 3 points race on the procedural issue one we're being asked to take action on resending or whatever m that has to do with the cottage i don't believe that was noticed
11:59 pm
so i'm going to ask can we take action on that and the rest of the conditional use number one and inhibiting number 2 procedural comment made there were that 4 parking spaces and the notification says 3 and also a third point which i didn't write down i don't know if everyone got it. >> it has something to do with the corrections on the map but most interested in the issue on the cottage. >> so the issue on the cottage was to explained it was authorized to have a variance it was approved for a variance in the 4 or 5. in 997 a permit ways issued to allow the construction the construction happened they went through a series of inspections
12:00 am
and candid that's not the most unusual but noefrls nonetheless it is supposed to happen and on the conditions of the lot to move forward option one is to sort of propose a new variance have that reauthorized to close out the permit that requires additional novs we delay this project option two to go back and take back the variance and restore it after the discusses is with the zoning administrator we could move forward today >> i'm asking the city attorney whether or not that's legal. >> commissioner president wu kate and the city attorney's office if i understand what was explained to you the original variance may not
