item. city clerk: item 15, ordinance retruax actively appropriating $677, 587 to over time and deappropriating $677 ks 587 in salaries in the fire department's operating budget in order to support the department's projected increases in over time. >> mr.. corso. >> thank you mr. chairman, i apologize for the delay. the next item is an over time supplement for the fire indemnity. department. there are two aspects to it. one is

the general fund supplement reallocation from salaries and in addition there is an airport component of it as well. the department is now requesting any additional fund for salaries but rather a reallocation of existing budget due to administrative code. for general fund operation, the main driver of this over time reallocation is at the department saw this last year retirements and separation then what was anticipated in its budget. the department projected approximately 30 retirements and saw 43 retirements and separation over the course of the year. while the department -- had additional academies

that came into the budget there's not additional personnel to offset the additional retirements. the department's request in this legislation amount to less than one 1/2 percent of it's total over time budget and in addition, the department will close the fiscal year approximately $2.1 million below budget of the previous fiscal year with regards to over time. for the airport, the departments requests approximately $140,000 to reallocate. back in april, the department came before you to request approximately $1.7 million department reallocation. sense that time, the department has seen additional separation from retirements and promotion throughout the department leaving the airport and leading to allocation. the airport funds are paid for by

directly across the street from the operation called butter on 11th street and i have been there for 15 years and over 25 years of experience in the entertainment industry in the local bay area and san francisco from night clubs, and ownership and operations and promotions and production for special events and music festivals. the buzz works project really started off as an opportunity to create a more safe and conducive atmosphere within the 11th street area and the inception behind the plan was to integrate a business into the center of the block that will tie all of the rest of the businesses toegtd. it is a buzz works is going to be a neighborhood craft brew and sports bar, and it will also have a food program that will support all of the other restaurants in the area by serving everybody else's menus.

and not compete with anybody, but basically compliment everybody else's businesses. i have gotten quite a lot of support from the existing area and i have been doing out reach since january when we started. and knocked on a lot of doors and a lot of open house meetings. and one of the more... after the first open house, and trying to get the people to come out, seemed to be like, a little bit of a challenge. and everybody seems to like to say something after the fact but we want to make sure that we had everybody and getting the opportunity to give the feedback before the fact and since april, we decided to utilize the space, and instead of trying to go out and find the people to get them to come to us and so i have been having a neighborhood garage sale and it is allowed pretty much an open house and it is kind of a casual environment and the people come in from around the neighborhood and see the signs and show up and i want to ask

the questions about what is going on about the business and we asked if they live in the area and we take the opportunity to tell them about the project and we have gotten a tremendous amount of support and in fact, this saturday, will be our last saturday. and so, it has been ongoing, and i think that i have pretty much talked to every person who lives in the 3-block area over the hast four months, easily. and if not seeing them more than, you know, more than many times. and as far as the project we have had to go through a long process of a change of use. and with several of the determinations by the zoning administrators to make sure that we comply with the plans and revisions for 2014 and we have been assigned the permit which is the first place of entertainment that is assigned to any establishment south of the market for the 32 years since the 1982 moratorium and it is quite a, you know, a wonderful thing to be able to have, the ability to do this.

and to help to support the entertainment commission. and the building permits are in the final stages of approval and we are waiting for the fire department to give us the blessing and if everything goes well we will start the construction at the end of the month and we will be opened in january for the play offs and catch the super bowl as the first grand hurrah and as far as the convenience and the necessary of this bar we found that a sports bar will be the ideal type of, you know, entertainment platform that all of the neighbors and residents are looking for because nothing such as what we are doing exists anywhere in the western soma and will keep the economy in the western soma rather than having it go to where the other sports bar are outside of our district. so, if there is any questions, i am happy to answer those. and thank you i appreciate that and just for the record we have been joined by supervisor norman yee and his night,

bright yellow tie and i think that the main question is always the community out reach. and i appreciate very creative way of doing that and i hear that supervisor kim is supporting this item as well and so thank you very much unless there are any questions, supervisor mar? >> yeah, i wanted to thank you for the amazing out reach that you have done just documenting it easily and it is a great marketing concept that man cave on steroids as you call it and not competing with the existing businesses but integrating with the 11th street corridor, where the places are and you your use of the buzz kind of very creatively and visually as well, and i think that creation of a hang out, social tavern spot is needed on a street like that and i wanted to thank you especially for the hard work with all of the residents that you have contacted and even just outlining from january of this year for the 6 months that the work to reach out to people

and listen to their concerns, too, but thank you. >> thank you. >> thank you very much. >> thank you, very much, why don't we now hear from our abc liaison unit from lieutenant santos. >> good morning, sir. >> good morning. >> and my name is lieutenant santo and i work with the san francisco police department and alcohol licensing unit and i am here to provide you with a report on the buzz works. and at buzz works has filed an application with the california department of alcoholic beverage seeking a type 42, on sale public license, and for 365, 11th street, buzz works plans on the promotion of sales and the local amount of beer and in a unique atmosphere of a man cave, auto shop, repair shop and sports bar all rolled into one. although not required to do so,

he plans on the sales of food through the local restaurant in the immediate area to provide sustain able economy for the 11th street corridor and will provide daytime hours to attract a lunchtime crowd into the area, he hasself conditioned himself not to do off sale retail to not impede the off sale retailers, for the purposes of this hearing, the california department of alcohol beverage control, abc, seeks the determination from the board of supervisors as to the approval or the denial of this license. from january, 2012, to january, 2013, there have been zero calls for service from the police department. as well, from january, 2012 to january 2013, there are zero police reports. and the premise is located in plot, 242 and it has 176 police reports according for 2013.

and the applicant premises is located in a high crime area. and the premises is located on the census track, 0178 and 102, the population is 4516, and on sale, license authorized by the census track is 15, and the on sale licenses are 35. off sale licenses authorized by the census track is four. and active off sale licenses are ten. the applicant premises currently located in an undue concentrated area. and as far as letters of protest, there is one letter of conditional protest that was received by the california department of alcoholic beverage control. and the protester was given the option to request a hearing if necessary. and as far as letters of support, there are none recorded with the california department of alcoholic beverage control. and the police department at this point, along with the

know that you muddle through and i appreciate that and you muddle through the beginning of your committee starting this committee, through trying to figure out what will be the acceptable ways of doing out reach and going to the district supervisor ss one way and it comes down to filtering down to the community and the surrounding location. and so, i think that if one city department kind of has one set of guidelines, maybe, you know, this will help you with your set of guidelines, i don't know if you guys have seen it. which i think that this is always about sharing, i think that i am sharing with you because i get tired of coming to these meetings if everybody is on the same page, then possibly i could just count on my committee members here to you know, do what is necessary and any applicant as they come to make sure that they have done all of the necessary kind of check marks to prove their application, and then move it

forward to the full board. but, when they don't do the venting and communications with the community, and all of that, then, you know, you have to say, well and it has happened a couple of times already where you say that you have to check and do certain things and come back to the call of the chair which is a reasonable request. also, i want to congratulate our current topic person here on the letter street, the buzz works for actually doing the community out reach. he came to actually two of our meetings. and i was just kind of... i didn't expect to see when i looked at the executive summary to see my agendas in there which i thought was kind of fascinating. it looked like he did a book report and kind of like i said oh, my god, something is actually doing a book report which is actually making it easier for someone reading the summary to actually see what

was happening, and just listening to someone's take on what happened. and i think that he actually, like i said did kind of like a book report. and reviewed the steps that he took to do the adequate out reach and so i actually want to give him kutos. because, and also because also it has a second bar. and i think that he kind of then also understands the purpose of the neighborhood out reach so thank you. and we are in support by the way. for the 60 6. >> thank you. >> and if we could hear from jeffrey clay barcos? >> good morning, supervisors, and i just like to more or less, echo what michael said and i commend him on his out reach and i think that he has been a model that if others will use that same model to the community that it will aleave a lot of concerns.

and as you know i feel that there are too many bars in district six and so i am more or less opposed but when we have people such as vladamir and the young lady that will be coming up here they have alleviated a lot of our concerns and it is nice to see that rather than having a bar come in and muscle into the neighborhood and take it whether you like it or not. i have learned a lot in this process, that i really see that really the board of supervisors has little control of this. and has little control over this, and the police department has little control over this and even the mayor has little control and it really is an abc issue. and i think that is what really needs to be dealt with. possibly if you win an assembly position perhaps you could introduce a bill to maybe get a little bit of control back for the city because when the

community, the police department, and different things, speak out and voice against a bar in a neighborhood, and you have the abc says take it, you are going to have it in your neighborhood whether you like it or not. i just think that there is something very flawed with the law. so, but, in the case of these two people, i think that their out reach is wonderful and they have alleviated the neighbor's concerns and so i will not get off on topic there too much. >> thank you. >> thank you very much. >> and is there any other member of the public that would like to speak? >> seeing none, public comment is closed. you know, in terms of the... and i appreciate mr. nolty providing us a copy with what the entertainment committee recommends and from my perspective i think that there is an expectation that if an agency like the entertainment agency puts out a set of guidelines for what community process or involvement looks like, that those processes would be followed by the applicant.

so there is an expectation that that would be done. i also think though that it is important for this committee to have the leverage and the discretion to go beyond what is required depending on the individual case. so with that in mind, and i know that supervisor and mar and i were trying to figure out if there is a planning code definition of a man cave, i don't know that that exists. but i have been impressed with the out reach that has been done and very appreciative of the applicant. so if we could have a motion on this item? supervisor mar? >> if we could take that motion, to move this item forward, with a positive recommendation, as a committee report. >> so we could take that without objection. >> thank you very much. >> if we could call number two.

event fees and art sales, i am well suited to operating a small business in the city of san francisco and experience of machining and training a staff and ordering product and maintaining the bookkeeping. the staff will train for food safety and beverage experience and will be experienced in the hospitality industry, on average i expect to have three to four full time employees myself included, i expect to be there every day and working at least 50 hours a week and i have been aproefd by several locals looking for work and i will hire as many as possible. i have hired a payroll company and recently partnered with restaurant manager who adds the valuable knowledge and experience to this endeavor. i believe that tender will be a unique and welcome edition to the neighborhood and while there are several bars in the area there are few wine bars, we are occupying a retail space that has been vacant for decades. i believe that the vacant commercial space contributes to

the over all health and i am excited to be part of the recitalization of this beautiful building and i am focused on serving local goods and the tap, is a green, echo friendly to typical wine establishments the wine that i will be serving will not be found in stores or even other wine bars as all of my wines are produced for distribution on kegs, it is just starting to build in popularity, there is no waste and it is a green and way to enjoy wine and it is an excellent business model for a place for people to gather and enjoy a product not readily available elsewhere and the recycling of pick up of bottles takes place in the late hours of the night and early morning and can result in noise and sleep disruption for neighborhood residents, with wine on tap there are no bottles being recycled and they will be delivered during the business hours and will not disturb the residents of the building in order to secure the

quiet enjoyment of the residents in the neighborhood i have amended the application with abc and there will be no off sale, wine or beer, or live djs or music and i am committed to keeping the side walk free, and i will make sure that the patrons understand that we are operating beneath a apartment building and people being loud will not be tolerated and i will hire a door man to check ids and i have installed security cameras inside and out to serve as a deterrent to loiterers or disrupt the peace or persons attempting to engage in illegal activity and i will comply with any conditions on me by the abc or local law enforcement to secure that my business will not disrupt the residents's way of life and do everything in my power to make sure that it is not a debtment to the community but a safe and pleasant place for the people in the neighborhood to enjoy the fine products and i have

invested a considerable amount of time and money in improving the space and made improvements to the interior and the exterior, it is a commitment to the community in providing a high quality, echo friendly product, and i plan to feature a resolving art show every other month and have secured two tender loin galleries to help with the shows of local artists i commissioned two murals that were painted on the premises, the interior is 28 feet long and was painted by local artist andrew shultz and is the vocal point of the down stairs. and another one by ien and both are rising stars and have works in the permanent collections in many art museums their work at tender are there for the entire neighborhood to enjoy. i have lived and worked in san francisco for the last 24 years, i am a single mother of
