6:00 am
strike the right balance i believe it does and woemd h oewd supports this something that was mentioned this proposal is an increase in the formula retail regulation in the city just to summarize some it adds 6 categories including the professional and business services and it makes permanent the controls in central market and includes the national and entitled sites it includes the threshold to 20 those who suggested that number should have been higher by the proposal by the department is the right one. and the reason is because of who it helps it helps the small businesses like sales and coffee and imply bottled and books inc. and others since 2009 less than 3 percent of formula retail were
6:01 am
from businesses in the 12 to 19 range and the commission approved both the question is do we want to provide our small but growing biz businesses a little bit more runway before the cruz kick in with the uncertainty and the cost that the that brings. so in closing when you add everything up in the proposal 6 new categories and the change to 20 the departments proposal will net add more than one hundred and 50 unique businesses that fall under the new unique businesses planning ran a good process that included the stakeholders open both sides of the issues this is a balance and we're strongly in support of it >> thank you.
6:02 am
>> commissioner. i know we're all president to here the public comment but this is one more speaker so notification and the upper market and the threshold number i believe the threshold number has been discussed but let's talk about the other 3 for the economic impact study and thanks to commissioner mar we appreciate working together. the items that remain we feel like they lack the acknowledges a acknowledgement and we think it's important to stick with our proposal one thought is supervisor mar's is bumper when the vial impact report is not
6:03 am
needs that is clear that any store over 3 thousand square feet but stores smaller than 3 thousand square feet but that the outlets totally 10 thousand square feet need and then environmental impact report their unlike to have a quantifiable impact. so the fact that such small stores is being proposed combined with the fact there's a refresh my memory requirement of 2.5 miles makes it enlikely that the impact report will uncover anything and there's other things on page 8 i'll spare you those details let's move on to
6:04 am
number 3 the notification the public notification informs the public with the consistence unfortunately san francisco's requirement are not consistent the supervisors proposal adds to the complexity and the irregularity and difficult proumgsz mostly recently when the department looked our items you identified more than 40 identification types there are 5 notice for the permit holder and it requires a 45 day notice requirement this is more than any other requirement and more than twice as long as the
6:05 am
current requirement. that could create scheduling details especially a 90s and negotiablely even formula retail studies are welcome to the lengthy and costly details the notification process is comprehensive and effective and we'll have one way online for people to do a research of the projects in the city and get a complete list meantime they desire and lastly we recommend you don't codify the upper market street district if we have more than 20 percent of concentration for retail. as mentioned earlier effective there is no change in the way i review the proposals you have the policy in that area that has
6:06 am
staff decide approval we're not recommending you change that. currently, the community has been pretty satisfied with the specialize but we've heard the community talk about this and currently engaged in their own study. the castro cv d and the castro merchant and supervisor wiener's office and building developers are doing this comprehensive study therefrom we should not codify something unless we get the benefit of this address work combined we don't think this is the right way to go >> director ram do you want to add a comment.
6:07 am
first of all, thank you to ann marie and supervisor mar and actually, the other supervisors that have been involved supervisor breed and supervisor kim have rooegd weighed in payrolling there's a lot of discussion will be the balance whether it's less resdrief there are a number of ways we're making this more restrictive and we're concerned about the stores being considered changes the interesting thing almost everyone in the room agrees on 99 percent the basic system has worked as a result of the study you can look at the formula retail stores and test them out and consider whether or not their appropriate that's the right approach and we're
6:08 am
expanding that approach we're talking about here in our proposal and the supervisors proposal is to tweak the system based on the analysis and this is done at our request because of the multiple proposals on the table a year ago and we felt we were going to look at the controls and take recommendation on changes. the bottom line we believe the system works and what we're recommending are tweaks to the system so we look forward to hearing our comments >> thank you. okay. let's open this up for public comment please line up on the screen side of the room so we don't block the doors. (calling names). >> first speaker approach the
6:09 am
podium. >> hello, again. >> that side please and i'm ion or not. i'm joan wood i live in north beach i've lived there 52 years before that other parts the city where i live in north beach it attracted the attention of many city departments and all kinds of changes going on and diego up one street or another this seems like it's part of it it seems like a plan where you have two conflicting proposals here and i hope you'll approving approve supervisor mar's because the other one talks about the
6:10 am
changes that's obstruct active it's opening the door to places like starbucks which they have much more capital they can compete against our small businesses. i don't understand what director ram said that 899 percent of the people in the room are agreeing and going to the right direction this is an effort to reverse it i hope you'll see it and turn down the broadening the definition of chain stores making it easier to come in and hope you'll approve supervisor mar's proposal. thank you >> commissioners i'm richard i urge your commission to light
6:11 am
even the restriction on the chain store in our city. we only have one walgreens and one subway. and those are happy doughnut located in chinatown not other happy doughnut shops in chinatown the reason i say that is san francisco a tour city and many many tourists come to town we want to have more convenience store and more reasonable priced stores to attract our tourists. generally, the chain store the space is wider and they carry more goods.
6:12 am
and prices is more reasonable. and the manufactures up to date and fresh. and other they follow our labor law and the store especially in chinatown that is why i know they are not paying the minimum wage. i encourage you to have more chain store in the city i okay >> next speaker. >> i'm lee of lee delhi. just is a background i was born and raised and educated in san
6:13 am
francisco and my son lives in san francisco and my daughter graduated in usf i'm a native of san francisco. there are currently 13 locates we have and so we hit that magic number but we're not a big box. we are definitely not a stabs we're not any of the changes mentioned. but in reviewing the egging on report i think there recent components of egging on report i don't think truly reflect what really happens for example, in the egging on report it specifics that formula retail will use local sources for accounting and resources and
6:14 am
include employment. evidences that formula retail will use corporate offices we're headquarter in san francisco. the egging on report saying about regarding employment that i think he says that because small businesses are generally less efficient they hire foremost small retailers we have the at the end i is to do more ourselves so where instead for ourselves we would hire internal auditors and general managers therefore increase the employment as opposed to a decrease in employment.
6:15 am
the other question regarding small retailers vs. ourselves we have a tendency to provide for benefits for our employees the threshold for sick leave and accident told her for family friendly work ordinance we have to comply with the small operator doesn't. i support some points of supervisor mar's proposal but i'll request if in our decision to consider the locally born and raised and operated small business although a chain not really the big box chains received to in this section >> thank you. >> hi, i'm david i'll just say
6:16 am
some measures up there i would actually have a one step up there there's much safety go through the stores at this point it's dangerous at night but it would get much more chipper in their store and you have more cord to buy and thanks. >> thank you. >> hi my name is richard i live in chinatown. i shop a lot with my parents i shop with my parents by there is
6:17 am
not more store so i suppose that the chain store in our logo i support it. >> my name is ann i'm a senior citizens living in chinatown chinatown is no car. so you this is proposed for us to stop to travel around to something i would like to shop in my summer one store and long that will make me feel safe and
6:18 am
save time and money and they have more item. we can pick currently an area so but i will i want to go to my neighborhood store taking over completely by the train store he wish that some people will get more business in our local business here. thank you.
6:19 am
>> thank you. i'll call a few more names (calling names). >> i retire already but i do anything i feel have manage in chinatown so the stores will be for many senior citizens their, their safety. >> hello, i'm isaac richard the director of the san francisco center we work with the university of the california and all our funding comes from small businesses and individuals i'm concerned about the proposal and appreciate the assessment that
6:20 am
we're 99 percent agreement and all we have to do is tweak but it misses a larger picture the small businesses in san francisco are closings down we're losing our small business community i know i tall call them up and ask for money they say their closing down this is not something i'm imagineing you've got the increased vacancy and i disagree with the assessment that expanding the formula retail basis is going to not have an impact on the small business and rent. there's a demographic that's changing that's also increasing the residential rent the city is changing so many of the small
6:21 am
businesses that have long term customers those customers are moving out and they have to appeal to a different customer base they have so market to the basin everyone knows what i'm talking about there's a new demographic into san francisco our original businesses that have not created a vehicle to reach an impact on their sales and ability to survive there's new competition on line we get cars from shops that do window repair and a group that advertising on tv they're taking the businesses away from our repair shops and the insurance copies are being the first call
6:22 am
to get the discounts on small businesses this is not happening in a volume but in a large environment you need to look at that. when you look at considering the proposal i don't agree go with expanding the formula retail base to 19. >> i'm opposed to increasing the formula retail limit from 11 to 19 or 20. i'm also opposed to allowing the subsidies to be considered new and independent businesses the rigs recognize that locally operated businesses contribute to the base in which the formula retail don't.
6:23 am
there are people who work and live here the businesses reflect the neighborhoods they service. on the other hand, their based on a corporate model and they have messenger and acquisitions and off shoring this is the process that is known and i version and american companies merge with a foreign company for tax purposes an american drug store chain with many stores in san francisco is currently doing that companies are not interested in the economic vitality of our neighborhood innovate interested in the economic vitality of our country we face it in a p and l statement we need to buffer our local neighborhood businesses
6:24 am
from those teechz corpse maneuvering we must have the law firm of formula retail to 11 this kraelts a level playing field so our local businesses can compete and thrive. thank you. >> my name is mark you live in north beach i support everything that was said by the prior speaker i'll hear to address how small businesses support small nonprofits and that even what was a small nonprofit like collide and another small nonprofit began by getting
6:25 am
support from small businesses and finding they're way in the community with the support of often sole proprietor businesses but are before i say that nobody has addressed the sole proprietor businesses they say we only have 13 stores and someone else said phils coffee is small but in the substantive word a small proprietor is small. and most of the businesses in north beach where i live are really small so when i go out now well, let me give you the history when i start the nonprofit i had a theatre project we took a show and took a second show to new york that was a successful company but successful ways of the small businesses in the country in
6:26 am
north beach they gave us money. i'm talking about someone that will put up 0 poster in their window by the way, safeway won't do that all the goodwill in the world won't allow them to be less than what they've been trained to be to conform to a formula that helps them make money so we need to walk in and talk to someone in the neighborhood. many years later currently, i work for passport and paul church who supports us again, the sole proprietor or pair people so two people together would own a businesslike park attentive well park attentive
6:27 am
has two recuperates but most places they have a single place and that's it that's what adds character to the neighborhood i don't know why you go to 20 neighborhoods because it's phillips i feel look the departmental proposal will help a single business i'm not for raising the threshold butlogically the thresholds for supporting the character in the neighborhood so thank you. >> good evening, commissioners i'm dee dee workman in the chamber of commerce we understand you're looking at the formula retail we're here to ask you to support of the departments legislation we
6:28 am
support our analysis of the community outreach that's something that the chamber of commerce urges your staff to do we recognize that is as a result of the facts and data derived in the community input we support the threshold in 20 in 11 it allows the homegrown businesses to grow before falling under the formula retail controls that recent bumper to bumper we support the idea you'll study the subsidy issue we think that's a pursuant move and glad to see that in there we also building that individual impact studies shouldn't have to be carried out but i railway with 3
6:29 am
thousand square feet that's a small retailer and unfairly burdensome this provides a balanced approach to retail in san francisco and gives of the consumers a choice where to shop. >> thank you. come on up and i'll call a few more names (calling names) >> hi, i'm rose for our 2 o'clock i'm southerner certain it's 707. i'd like i'd like to read into the record
6:30 am
instead of reading every whereas i'll pick out a few and the second point i want to make is a personal opinion on supervisor mar's legislation whereas the coalition for the san francisco coalition our neighborhood associations will promote and protect the retained neighborhood and whereas the neighborhoods represent fwi the neighbors of the coalition have look at the protection and the distinct blends of all the local businesses the real vibrant engaged community not the cook current created by the chance stores and whereas the 2004 ordinance according to the ordinance for the cu authorization and a rehabilitation of the
