8:02 pm
of the city's commitment to address housing afor the recordability crisis, support production of new housing and create a housing action and neighborhood stabilization plan and ensure financial support of public housing for the new york 4, 2014 election. >> okay. we have heard the amendments last thursday from supervisor kim and she was wondering if she needed to be here and i said no. so is there any public comment for this item? please approach the microphone. >> subject-matter is about public housing. to my point for me as the japan center, chinatown and does not pay. every one of us have to have jobs to support our mission. we have to wash dishes or
8:03 pm
windows -- for me, to perform my holy mission, the art of making love of international friendship isn't easy. we find more strings than you would ever believe, because the japanese, chinese, taiwanese people, et cetera, the best place would be north china -- japan center. japan center. for today, after this meeting i will go to japan center to my lunch counter -- not from benihana today, but instead we'll probably grab a lunch combo and cream soda and spend two hours in front [speaker not understood] to perform my holy friendship
8:04 pm
missionary work for the people. >> are there any other public comments on this item? seeing none, public comment is now closed. can we have a motion to forward this committee report to the full board with recommendations? >> so moved. >> with no objection, motion passes, madame clerk is there anything else on the agenda? >> no, that concludes our business >> meeting adjourned.

8:06 pm
the. >> can i have a motion to excuse supervisor cohen. >> madam clerk one item. this is for the business sign in the planning code >> thank you. i'm the author of item one my co-sponsor is supervisor chiu. day today those zoning controls amend did business sign intended to identify signage to the business in which it's connected and the products in the business those serve to dish a particular business between a general sign
8:07 pm
sloops as a billboard this is hat notice been updated since 1965 since then the practices are challenge we have seen links like loopholes that have been identified businesses turn business signs in effect the billboards that will close the loophole the voters have over and over again voted in large majorities stating they don't want billboards in san francisco this is inconsistent with the preferences dedicated by the voters at the election time. so those controls will close that loophole to make sure the
8:08 pm
business sign is connected to the products being sold in the business as opposed to a billboard. so we have dan here from the planning department and mr. cannabis dispensary i want to give you the opportunities to make racks >> he's here to respond to questions. >> supervisor kim has a question. >> thank you, mr. cider good to see you i want to say i'm completely in support of the interim controls before us today and glad we're going to look at cleaning up the lack around business signs it's been over thirty years since. >> 50. >> 50? 62 in his. i had some questions around even kind of the origin i'm looking
8:09 pm
at this from a narrow precipitation but in the tenderloin i think one aspect it's a been critically frustrating is the amount of tobacco and liquor advisement on stores that face into the neighborhoods some of out inclines but secondly, it make me think about why do we put this into place why allow the advertising for a loophole >> at least a number of the members of the board we all postdate 1965 when the definition was crafted our working assumes thas has been that everyday when we walk by a store in the tenderloin and see
8:10 pm
dan's liquor store and a or whatever and ofrnlts see a somewhat sign for coca-cola our understanding the amenity has been induced and helping the business afford business opportunities and the branding it might not otherwise get supervisor wiener suggested there are shifts but in our estimation we allow a by sign to allow the business to present itself to its business and gain the attraction and support the business. >> in the time that sorry i realize it's confusing us with the ordinance sign it's much
8:11 pm
older than that. in the interim period can we talk about the business signage we want to allow if it's true it snbz are getting a benefit you you know, i want to be able to consider the impact it has on the neighborhood and the advertising for tobacco and liquor and things we're trying to curtail i feel like it impacts the health a neighborhood in the tinder tenderloin we have 72 liquor store i ask that not for the interim controls i'm in support of that but insert that >> we'll welcome it conversation. >> and the second piece this
8:12 pm
conversation i've not had the planning department we'll have advocates in the tenderloin what is the capacity for enforcement on signage. >> i'll go to scott sanchez he runs the enforcement. >> thank you, mr. considered. >> thank you scott sanchez planning department. so code enforcement has been historically been understaffed it is the lowest staffing one of the staff members is here doing the work in the tenderloins looking the transparency requirement because many of the issues are not the signage issues but what the store front appears can you see inside or boarded you up because of the machines or registers blocking
8:13 pm
windows looking more beyond the signage but transparency requirements for the code we've been pro-active in the tenderloin >> i've noticed a difference in the stores walking by they've increased the number of signages on their windows but in terms of you have 7 full time code enforcement officers. >> what's the plan. >> more than 13 hundred codes and packages of regulations from thought clubs and massage enforcement and affordable housing we deal with the general building requirements working with the legal construction activities things that may or may not included like the affordable housing that is just some things. >> i see it's complaint driven. >> correct we have placement
8:14 pm
driven enforcement you'll see the work from john and working on the store front efforts he headed up the citywide survey with the removal of signs and we're doing practice enforcement incorporation with supervisor chiu's office so we're trying to do pro-active enforcement with you we get seven hundred plus complaints a year and right now, we're in closing out more seven hundred and making what you think our backlog but try to publicize how to make complaints on our website or, of course, 311 make a complaint we've got to it. >> you have seven hundred complaints today is that a rough
8:15 pm
average per year and it's increasing people that have complaints they can direct them and making people aware of the planning code violations it has counted for the amount of complaints. >> on per staff member they manage a hundred complaints over the course of a year. >> yes. and straightforward the step back praying and more complex like affordable housing. some cases a litigation over the years. >> it seems like not have had staffing but thank you for your service in the tenderloin i notice a difference i want to continue this conversation how we can support the resources of
8:16 pm
the code enforcement team. >> thank you supervisor kim fair to say that the passage of codes enforcement they're all needing their heads we'll fix that sometime soon with that, open this up for public comment. i have that public comment cards (calling names) >> thank you. good afternoon committee members i'm tom. attorney with the law firm of roads we represent the promotion
8:17 pm
i want to present this letter to the committee and make it a part of the records >> we'll receive that by e-mail. we oppose is sign controls bra the committee today. for the simple reason the controls circuit a settlement agreement between contest pro tem's and it was approved by the full board of supervisors on july 8th. under the agreement the city in contest accomodation will agree to settle their differences they were required to meet in an existing lawsuit but those sign controls were to prevent the city and the state requirements to proceed under the agreement
8:18 pm
we oppose is signage controls. i'm valuable for questions or additional questions thank you for your consideration >> thank you very much. next speaker. >> kirston executive director with san francisco beautiful thank you, supervisor wiener and supervisor kim. on behalf of our board and members i'd like to and staff like to thank you, supervisor wiener and last h also supervisor chiu for introducing this legislation it begins a new process for business participation and space with regards to signage. it has not been updated since san francisco beautiful was introduced opportunities to regulate that and continually san francisco voters have voiced
8:19 pm
their opinions about billboards and public spaces and somehow corporate interests you've heard from find a way to interpret that code to their favor and in stark craft the code was written. so in the last year i had conversations with the mayor's office about their interest in signs from president chiu and our own interests in preventing the preponderance of the legal signs thank you for the controls that gives us a definition moving forward and an opportunity to work with the planning department and to reshape those and if the language in the policies conforms to the guidelines >> thank you very much. next speaker. . hello supervisor i'm here to
8:20 pm
voice my support for the in kind controls it is for the conflict of the controls that closes a will that that's been bus by the billboard operators far too long and in addition to preventing the appearance of san francisco in general it helps to safeguard and helps to protect public investment and the integrity of public buildings and provides the development and promotion of businesses in the city and linking to competition where aren't to the finances and promote public health those are necessary and overdue on behalf
8:21 pm
of the san francisco beautiful i'd like to ask the city to support those controls >> thank you any public comment on that item on item one seeing none, public comment is closed thank you to everyone that came down i'll say we received the letter from the running ruben and julius law firm on behalf of the controls i have respect for the law firm but i disagree on this one the settlement we approved specifically indicated that contest accomodation and other companies i i understand that have exploited this will that people are living in the neighborhoods and one day a new billboard goes up and there's a raffle for this in the corner store or whatever the product is
8:22 pm
it is not being sold there to people wonder why this billboard n is in my neighborhood the settlement we approved i'll read it for each sign within the city the contest promotions shall apply with all applicable pro tem's for the administrative regulations, in fact, at the time the permit for the sign is issued with applicable recreations and electrical code and the puc codes i was not involved but the city attorney's office. >> i don't know what the how the process went but in the end you could have had a supplement that said the law standards to be applied would be the ones in
8:23 pm
effective it says whatever codes are ♪ place at the time of the permit. so this changes are important and i think we need to post them so supervisor kim if increase no additional questions i'll taken a motion to move item one to the full board with positive recommendation as a committee report >> so moved. >> when i come home to you, san francisco >> madam clerk item two. >> this the for the police codes and arcades. supervisor breed is the sponsor and i'm a co-sponsor so here we are from supervisor breed's
8:24 pm
office is connecticut nor >> thank you supervisor wiener supervisor breed had a conflict i wanted to make a few comments as the sponsor of the legislation it was playing arcades at a party of supervisor chiu p that effectively this the code not enforced that was a bit of a surprise so in district 5 in the upper hate bumped into the regulations and first-degree i will watch has a pinball leads that has a lot of people there and i had a stalk of letters of support self-the members of the pinball legacy that was part of the record you'll hear from many
8:25 pm
of them. in 1982 pinball games were popular and they were corrupting our children and overrunning our neighborhoods so the board of supervisors passed extensive regulations i emphasize excessive there were controlling when and where the arcades can be in the places in san francisco not a single game in 3 hundred feet of a school or many any implication in a commercial district i'm not e i'm not sure what the concern was. if you knowingly are in violation of the arcades the chief of police b will impound our games as supervisor breed
8:26 pm
mentioned chief suhr is a great cop but hard to imagine him breaking out a dolly and not happened. so times have changed 'tis since this alleviation was passed they're more of a notify of people my age that grew up in the 80s is if kids want to play video games they can do that or in this is your cell phones we want to maintain the oesht and extremely the permit process to bring it in line with the commission practices and strengthen the controls against illegal gambling so i want to mention a couple of things with respect to illegal gamgz we
8:27 pm
knew on page 2 we adams mechanical awe amazement so a gambling devices future on payment 12 any video game a that's been modified to become a gaimg devices any mechanic amazement devices being using maybe i am pounded by itself chief of police and a or the use or operation thereof vicinities any rules and regulations and sub mechanism devices shall be confiscated our legislation today is about arcade games
8:28 pm
anything it constitutes this would not be qualified to be controlled under california law and is patently illegal this is not a regulation process for our gambling devices i know we are asking where entertainment is concerned but in short supervisor breed wanted to be responsive to the entertainment commission concerns about the good neighbor policy so a distinction between that i want to thank supervisor wiener for covering the alleviation he has one business in his business and others from the entertainment commission and commanders from the police department and
8:29 pm
especially deputy city attorney jason man for putting up with us and in crafting that the first one the legislation is not about passing new laws but taking the wanted to fix the old ones, and, secondly, they buildings the government shouldn't be standing in our way based on outdated laws i'm happy to answer any questions >> thank you very much supervisor kim. >> i just had one question and my other question for the entertainment commission. i was looking for this but a part of the code i talked about the machines where you get a value out of the machine equal to the within one you put in are you talking about vendor machines >> the temporary to the are sticker it's a purchase as opposed to a game.
8:30 pm
>> thank you. >> great any other skewing supervisor. i wanted to thank ms. johnson and supervisor breed and the commission for working on this. we had a situation with a well-thought-out bar opening up a second bar with an arcade theme that ran up against the wall we provided temporary relieve and moving forward with fix with thatwith that - >> i'm sorry, i do have questions for the entertainment commission. >> my apologies ms. black stone. >> why even have entertainment commission give permits to bars that have 10
