members of the housing coalition the per diems came and making made a presentation they've reviewed it in daily and our members loved the project in particular with what was noteworthy more than the parking and all the tributes of the project this design really gets it in terms of which an viewing neighborhood it gits fits in, well a backdoor balanced neighborhood we love the affordable and remarkably parked in the a great communicated outreach and i hope you'll approve it. >> thank you. good afternoon, everyone. commissioners i'm a business and local 2 61. on behalf of the brothers and sisters of local 261 i want to
9:31 pm

9:32 pm
true mark approached us to talk about the playground that is look with supervisor cohen and director reiskin this saturday they've been active participants in fundraising and they've been angle engaging organization we as a neighborhood support both engagement the design and the plan for this area. my address is 1099, third street i'm about two blocks from the site. thank you. thank you. >> thank you. >> good afternoon, commissioners i'm making allen on minnesota which is about 2 1/2 blocks from the project site i'm here to talk about the fact in the city of san francisco there's a housing crisis and it's not (inaudible).
9:33 pm
>> the crisis is the average person working in the city of can't afford to live here. part of it is to say yes to the projects that engage the community that meditates the affordable housing on site i that includes the straight this project is all those things please support it >> thank you. next speaker. >> hi, i'm here to support in project. i live in dog patch and am a member of dna i think in project will be a great addition to 9 area those projects have been present at our meetings they added a retail space and on street units that will add activities to the area and the escalating is well designed.
9:34 pm
this neighborhood is an exciting area more and more people are interested in moving here therefore i think it's important to support this. texas will integrate into the neighborhood. and i hope you choose to support this project as well >> thank you. as the next speaker come on up i'll call more names (calling names) >> good afternoon, commissioners i'm r j local plumbers and pipers in san francisco an opportunity on behalf of the brothers and sisters of local 38 i want to voice our support for the residential project we truly appreciate the outreach from true mark we're excited to see this create direct and indirect local jobs we support in
9:35 pm
proposed development on texas street and urges you to support this development in order to create local jobs thank you for your time. >> thank you. and good afternoon commissioner. i'm riding i didn't corpus i'm with the preservation program that is in san francisco residents for the last 20 years called united players i'm here to speak on behalf of true mark it's a wonderful relationship in our community our headquarters is on howard street the south of market which has not been easy last week, we buried two kids one 18 and one 23 and another one died a couple of days ago but true mark helps people to give them opportunity to better
9:36 pm
themselves when you have a relationship that's in a neighborhood that creates relationships it makes a different i support those guys they care about the people in the community and looking out for us in our center; right? sorry that's obama he's going to have to hold this is important (laughter) so i wanted to say in my conclusion please i encourage you to support them those guys are amazing in our neighborhood and helping out united states hood we're really i mean in from the bottom of my heart to build more rimz with developers like true mark >> thank you. is there any additional public comment? >> good morning. i'm john
9:37 pm
morris i live immediately across the street kitty corner i've recently found outful about this information an environmental report mailed to my house. my years maybe tainted i stand in opposition is monthly because this building is way two large they're asking for exemptions and those exemptions are being asked for because the building is way too large it's about two to thirty percent from any calculation longer than the area is zoned for. so it's just incongruous reimburse with the nature of the neighborhood mostly
9:38 pm
single-family homes i know my sunlight is going to be blocked i've experienced this on the other side of the street particularly during the winter i lost light its way too large and high. the other concern is the parking issue whether looking for exemptions for off-street parking. according to the calculations in this planning statement here it is about 50 percent shortfall of the off-street parking it mentioned 30 off-street parking and they're providing 55 to 66 parking spaces we're short on parking it's a fight i have many people parking in my derivative
9:39 pm
i'm late to work because i'm calling someone so there's already a big problem with street parking. so if this gets cemented look at that issue and make them provide more off-street parking. and the noise and pollution that a lot of noise from the others units partying and dropping trash if not the self-same of single-family home neighborhood but they're on the edge of single-family homes and it's not the nature of the neighborhood thank you. >> thank you. >> sue hester. i have i hope a
9:40 pm
non-controversial proposal i ask am bringing this up last week. i asked on page 34 you add another condition and this is that the project shall not be counted as producing housing under the goal of the city to reduce thirty thousand new units of housing unless there's a cc&r imposed on the project guiding every condo ownership that prohibits the association rules and it also biennials the owner in terms of any rental a that's happened before condos are sold. there is an absolute approximate
9:41 pm
on rentals because unless you have a set right near a you countering station how attractive will that be to people using it as a short time rental. a lot of the plays that are initially occupied as condolence people move on and they decide they're to rent it out on an monthly basis the condition is that the planning commission you development a really binding condition and everyone who is coming in for a large project like this one last a condition that it can't be converted to short term rental that has to be remaining as a primary residence
9:42 pm
and housing for people in the city no tourists please incorporate that true mark should be happy to have a resolution like that a condition because their building housing aren't they and if their building housing they want to keep it as housing thank you very much >> thank you. is there any additional public comment seeing none, public comment is closed. commissioner moore. >> the communities voices in support of the project and varies or varying it hard to not repeat many of them. i think the project deals with the difficult side and the most exceptional way it is not just the trap sdold shape of tezoida
9:44 pm
motives to 3 bedroom units but maintaining oversight affordable we want to introduce a mixed neighborhood by the tone for the social intent of the transformation we want to see here. i'd like to take one second and comment on the mr. hester's comment of adding a condition i do not believe i think we need this city attorney's advise normally we're not allowed to condition projects with intents to a large stent but can't do that await guidance. i support it but we're in the
9:45 pm
mid of a project i would support it as an idea but in no position to incorporate it even into the discussion here today. the city attorney is stepping in and will probably remind me of what i can and can't say. going on i think the engagement with labor employment including the selma pathway project is remarkable it attracts as an attitude it reflects itself in locates that are far away from the selma project is actually located. i'm interested in the realization of the green trust i think it creates a remarkable
9:46 pm
project and i'm in full support of that. i have one suggestion. if the architect or true mark will come up to the podium i'll appreciate that. on your drawing this is this is an architecture question if i may. but it's also an owners question. (laughter) on your drawings 83 point zero under our materials suggestion item 15 there is a ambiguity i want to see not being interesting there are you're talking about aluminum until our exterior of all systems i'd like to ask that aluminum windows do
9:47 pm
not get cost into this when the rubber hits the numbers we'll be able to maintain aluminum windows rather than vanilla windows their inappropriate for this building type and ultimately don't deliver the quality while i support the project will be embedded by. is that something you'll be comfortable with >> i think we can but i'd like to take about 30 seconds to say the new energy codes we've found some of the energy folks say the windows don't meet the high standards but we can admit to do that. in addition some of the windows manufacturers we're not talking about the one we're thinking about but we find vanilla
9:48 pm
windows are steel wrapped in vanilla and manufacturers can't make them it's only achieving a design goal but we'll say yes to our aluminum windows >> there's a reason that village starts to change color and that completely alters the consistent of the building. i know your pal system s are using a high system i'll be concerned we're staying on target the best we can given the code, etc. >> thank you commissioner antonini >> yeah. i would agree with
9:49 pm
commissioner moore and certainly explore various options on windows. you know, i know there are some that are wood windows that have a high quality village quality on the outside but the main thing to weather properly a lot of times the aluminum have had problems >> i think this is a very good project and it's again, a large project to authorization. as was the case with two projects from true mark and we've continued one on 409 van ness those are come forward to the western neighborhoods and all the sorts of things we've
9:50 pm
asked them to side kwartsdz substituting for rear yard and other things are r that have no significant impacts on the neighborhood around them that part is very good and again, the oversight affordability this is tier one that is different from tier two. the legislation from eastern neighborhoods describes the amount of affordable that's required of a project and their, of course, completely conformity and as commissioner moore suggested especially with the change of elevation in the streets that's a tough thing to do this is as good as it gets
9:51 pm
i'll move to approve >> i'll second that motion. >> i want to clarify if the motion or ask staff to call out the roof-deck or removal of the roof-deck. >> if i may commissioner there are a number of references particularly to the roof-deck so as part of the motion take out and modify the motion according inevitable workman's comp windows. >> i don't have to add it to the motion i want to add to the record we're concerned about that. >> thank you.
9:52 pm
commissioner johnson oh, >> i was going to ask commissioner antonini if you want this as part ever our motion. >> it would be it's been removed so therefore my motion includes removal of the roof-deck. >> thank you very much. >> commissioner johnson. >> that's great i was going to ask about the roof-deck i want to echo commissioners who've spoken this is a project that is in the eastern neighborhood plan? something that i think personally do frequent dog patch in this areaer it fits well with the closed traffic and the types of people that not to live in the neighborhood and a great design. i have a few questions and comments. some of which may or may not end up in my motion. the first one is about the roof-deck i respect the ability
9:53 pm
of the project sponsors willingness to remove the roof-deck, however, unlike other roof-decks this is not one that is sort police said on top of the building with a roof-deck on top this is a i think an integral part of the plan. so i don't feel comfortable approving the project that had a roof-deck that that is a whole corner and not being there so if the project sponsors could speak to what is going to be there instead that might make me feel a little bit better. >> yes, thank you commissioner, i appreciate our comment and, you know, your intent was to be very responsive to the neighborhood they've expressed
9:54 pm
concerns about the privacy that's why we removed the roof terrace where it is now it will be a typical roof situation so it will be a roof without the dock active landscaping that's currently shown on our plan. >> thank you. i mean again, i feel like if it was just a roof-deck more on the building schematic but i--i don't know to have nothing or to be determined i guess. i mean, i understand the compromise is made pretty recently like today so, i mean i guess can you speak to what others option that might be considered what else date of birth considered even within the
9:55 pm
scope of the motion that it (inaudible) >> we have a i think you can see a green roof area that is remaining. >> okay. >> so we're going to take out the gathering area it will be beautiful for the people with the green roof view. so it will be a gathering area >> will there be any other area and the roof will be there we're not planning things now but certainly this is in the end. the green roof remains the furniture and the favors go away >> i know there was a rear yard variance i believe. >> increase an exception and i
9:56 pm
- and and i'm trying to get a sense of what we're doing today, the roof is on how does that impact the rear yard what's the small business now. >> previously in our current set of plans we have approximately 95 hundred square feet of small business now with the removal of the roof terrace we have one thousand small business when is still above we're meeting the small business requirements it doesn't change with respect to the rear yard. >> okay. okay i won't bet you. >> we're expanding the roof. >> i like grass the roof needs
9:57 pm
something on that it isn't a face of the building there need to be something there even if it's not a space of congregation it can't be nothing because people don't want to see a roof-deck. >> we've incorporated things into our project on the roof so definitely things we can do to utilize that saying that space number two, of the property line. >> next question this might also be for the project sponsor or is architect this guess a question i would have asked van ness to be continued they have the ground floor unit that would be commercial but their configured as residential and is that considered for your ground floor unit particularly the ones along 22nd streets because
9:58 pm
that's retail. >> if you're talking about the walk up units. >> yes. >> we've also looked at those as preschooler residential spaces. >> okay. all right. and then just last point. since others have made mention of the comment from the ms. hester about the cc&rs again, i agree with commissioner moore we need the city attorney empty i don't know when you guys consider that as part of your building one of the things we've agreed on in terms of the community short term rentals is the private contracts and the ability to supercede legislation so maybe you guys might consider that good for the marketing of our building bans the types of people you want to live there.
9:59 pm
i don't know that i would agree with having that in general thank you very much >> thank you commissioner. >> thank you. if i could ask for an opinion from the city attorney and sure deputy city attorney definitely under private contract the homeowners association can turn it into private agreement b that are more stringent but in terms of the commissions ability to commission any increased on short-term rentals we wouldn't advise there are the board has acted twice to prohibit short-term rentals both in the administrative code not within the purview the code this is something with the planning commission commented open but the board will future leg let
10:00 pm
and there's not discretion in the legislation for the planning commission to further look at the short term rentals. and we'll see you know how this develops but at this point there are two pieces of legislation and in effect that prohibit short-term rentals, and, secondly, there would be a condition, you know, it would behove the commission to find something different from other residential buildings that warrant a particular condition >> thank you commissioner sugaya. >> yes. on that point just to make clear ambassador short-term rentals less than thirty days are currently prohibited in the city unless someone comes and asks for a
