mr. welch this building was bought in 1976 it was converted legally from a single-family home to commercial when the department cleaned up the act of the owner who had been using it as commercial all the time there's now a proposal to have two commercial uses this commercial use here this is the restaurant that doesn't have a kitchen and the garage and this is the stairs going up to the upper level another use the other use had the backyard and had a lot of parties that caused ruckus we're - upper being asked to create a bone fide recipient where there's no one on the plan after the dr was filed and the

planning department became aware that the garage was not being used as a garage but used as a laundry extension they cleaned up the garage what are the used you're being asked to approve you're being asked to approve a rear yard that's closed off but coming back and a rear yard is it is able to be eye from single-family home to commercial uses. you have an obligation to face realty. the planning code didn't allow this project. with a red bar and food preparation for bar food to be called a bone fide restaurant the abc didn't allow it and the planning code didn't allow it and there's another office use
