12:44 pm

12:45 pm
planning area for 45 days just to note that is on final passage. >> thank you president chiu it's exciting to be able to introduce the first of many initiatives between my office and the mayor's office to memory lids prop k and build for affordable housing in san francisco ambassador beyond building more affordable housing and preserving and taking off the rent control buildings off the speak active market it addresses some of the gent indication concerns we're seeing a hot office real estate market the controls i'm introducing today with the mayor prohibited the building identified as distribution and repair in the selma area 2 henry adams street
12:46 pm
on the east and while the planning process is underway i'm sure you're aware of nights in the policy impact stage it the preservation of the stage and not have a loss of pdr south of market you've eertd harder is a rich neighborhood with a mix of uses and this is pdr is an important mix this is highlighted a couple of weeks ago when kilroy mandatory they'd be purchasing the flower mart and one of 5 wholesale markets in the nation it will prevent any presidio use in the selma plan as the city engages how to
12:47 pm
include all the variety of uses that our city would like to see in this neighborhood we know that pdr spaces and jobs you know that pdr spaces and johns provide an important vehicle particularly for our working class community because they provide the jobs for the city that may not have the higher education even a couple of weeks ago i met with a variety of associations i've heard from many members that have family members that worked at the flower mart and concerned about the flower mart moving to oakland their coming out of the housing balance and housing production compromise with the mayor's office and my office engaged in over the month of july we know that growth is a positive for the city bringing in more revenue for office and residential unit in the building
12:48 pm
we also know it is impacting our neighborhood and and what time to with the mayor's office with the stabilization plan to increase the affordable housing and stabilize our neighborhood in the things we love about san francisco in addition to helping to preserve the pdr space another reason we have the opportunity to take a careful look at the land use in the smentd and i'm excited about the mary's has committed to make sure we build 33 percent in the housing plan something we couldn't have done with the redevelopment tool to make sure we get that without redevelopment and we also want to make sure we're considering land use in the selma carefully and not want to be approving
12:49 pm
proemgz and there's a lot of pressure in the neighborhood as real estate it look at in the area to fast pace some of their projects so what does this moratorium do the ordinances prevents the planning department to issue an approval to replace pdr by a non-pdr in the selma area it exempts the zoning district and proposed projects that comprise one hundred percent of the housing 415.1 and properties containing any of the pdr uses gas stations mrartsz are self-storage and properties subject to a development code under chapter 6 and the
12:50 pm
california government code and projects that have submitted an environmental plan where pdr conversions is allowed or in or green before september it's a moratorium will only be in place for 45 days as required by law our intent so 0 reduce the controls and extend it until the plan is adapted i want to recognize the mayor and his office in his commitment to make that a reality awhile on recess the mayor committed $3 million to allow us to purchase the rent control unit and take them off the specific active market and thank you him for the interim controls and thank you to our co-sponsors supervisor avalos supervisor campos
12:51 pm
president chiu, supervisor mar and, of course, supervisor cohen who has introduced here own interim control 60 to protect the pdrs in her district we were spider by her work with the mayor's office and, of course, i want to recognize someone that i forget despite her intense amount of work april who rushed to the city attorney's office to show case our commitment and many others loss they're for their work in the neighborhoods how we stabilize san francisco and build more affordable housing so colleagues, i ask for your support thank you unless there's further decision colleagues, same house, same
12:52 pm
call? we'll take that without objection. this being an urgency ordinance this ordinance is finally passed. >> and with that, roll call. >> supervisor campos. >> thank you, very much mr. clerk i want to note that this coming monday at 10:00 a.m. there will be a federal trial here in federal district court concerning my relocation assistance ordinance which this board of supervisors passed with a super majority judge clarlz charles buyer will hear the case on golden gate avenue as you recall by a super majority of this board we enacted the ordinance in april of this year, the ordinance provides that when landlords make use of ellis act to
12:53 pm
withdraw the residential units from the market they may compensate the tenants between the tenants current rent and two years worth of are we talking about at a comparable rent in san francisco it yaets creates two administrative stiff appeal processes to protect the small businesses one at appeal for the ellis act to challenge the differential calculation and another process to allow the landlords to port commission petition for payments where they show payments of financial hardship the landlords can pursue both appeals this has been a part of the solution of san francisco affordability crisis we've heard reports the law has lout tenant to live in
12:54 pm
san francisco after being evicted despite the as not only rents in san francisco because of the importance of this law many of our middle-income residents are still here we know this lay is important to address the crisis i have a great deal of conditions in the city attorney's office and thank you to city attorney herrera and his entire staff for making the defense of this law a priority we believe building we'll prevail but we're confident at the end of the day this law will be protected by the courts this is a legal case that goes beyond the issue of relocation but to the question of whether or not
12:55 pm
working people middle-income people can live in san francisco it is a place for everyone to live and again, i think the city attorney's office and look forward to the trial on monday the rest i submit. >> thank you supervisor campos president chiu. >> thank you mr. clerk colleagues today, i'm excited to introduce our ordinance for predictable schedule for formula retail employees with which is the bill of rights introduced by supervisor mar the ordinance we're introducing is the first in the country to deal with the unbe predictabilityable schedule and unfair practices that effect our low income wage workers i proposed the family ordinance
12:56 pm
and thanks to you san francisco became the first to establish caregivers to request flexible work schedules and president obama expended the right to over 2 million workers and part of the rights we included provisions for predictable schedules but the topic was i suggested a separate label for employers to address this topic 0 for much of this year we've through the discussions learned and unpredictable schedules and last minute on call practices creates work family challenges and undermines workers well-being we've heard about the best practices how to manage the schedules as well as the fact that the largest chance stories
12:57 pm
typically known in our city as formula retail establishments have the ability to have a flexibility in schedules that can base this on schedules and customer demand our economy is doing well, for many we have too many people that struggle in jobs with unpredictable shifts and have barriers to a solid criteria lard we've heard from apartment workers who how much they will learn and struggle with two jobs over the past decades tennis 2003 workers have download our city as said this is not enough to lift the folks out of poverty
12:58 pm
but must be based on on fair schedules this ordinance will apply to employees that encompass 5 percent of the workforce it will require formula retail employers to post skweldz working days in advance and discourage the erratic consultations by providing predictability pay changes are made in the last 7 days where a worker is having their changes made similar to paid time required by the state it will discourage the on call shifts to allow the workers so have unpredictable pay and provided part time workers have equal
12:59 pm
protections with howell wages i want to thank the coalition the staff from the legal position and jobs for justice and many on that have been part of the coalition and colleagues i look forward to discussing this with you i want to mention supervisor wiener will be discussing one topic it will be trees and in particular, the trees that have not been kept up in our city in my district this past week a giant tree krachd and we know that our cities relinquishment policy with trees is not working earlier this year i asked the colleagues to include an expenditure in the budget for trees in the district i know that supervisor wiener has had
1:00 pm
serious challenges in his district we need to do better and because of that i call for the hearing he'll be describing in a few minutes. >> thank you president chiu supervisor cohen thank you, very much. i'm delighted to hear that supervisor wiener is going to be calling a hearing 0 on trees i'd like to add my name to that request it's a significant problem an ill conceived idea to transfer those sick trees to resident i'd like to close today's meeting in memory of a great man under johnson he was the only african-american elected to the sacramento board of supervisors and later appoint to the u.s. health and human services and
