within the commissioner's jurisdiction that are not part of the agenda. is there any public comment? seeing none, director's report, update on dbi's finances. >> good morning, and in your packet you have your september 2014, year to date, financial performance report. and that is basically a year to date report for the first quarter of fiscal year, 4015, which includes, the months of january, august and september. and i will take a few minutes to go over a couple of highlights of the first quarter. and so on page 1, you will see, we will have a summary there and we will see that both the revenue and expenditure and so on the ren new side, the revenues this year are at 15.2

dollars which is less than at the same time last year and primarily, and that is due to the reduction in we had the fee study that took effect in september, but also, if you look on page 2, you will see that actually, you will see that actually, permit valuation is also down, and so, last time that this year, we were at about 1.1 billion dollars in permit, and now that we are at 929 million, and so that has an impact on the revenue as well. and we are permanent activity is up and so you will see that we have issued more permits with the valuation that is down and you can see the slight impact on the revenues. and so, over all, we are projecting a 3 million dollar shortfall in revenues for this physical year and that is very preliminary because first of all it is only based on july, august and september and so just the first three months of the physical year and it also includes year to date, but also the 7 percent fee reduction and

we have actually taken that reduction, instead of getting rid of it in march when it is supposed to go away, we just straight lined it into the physical year, becauses you are aware we are working on a fee study, and so when that comes in, there is a visual fees then and at this time, we are protecting by a 3 million dollar shortfall in revenue, but once again it is very preliminary and so on the expenditure side and you will noise that you will see that the year to date, expenditures are less than last fiscal year and that is about 1.3 billion dollars less than last fiscal year and it is important to note that over all our spending is actually up, on salaries our spending is up and reflecting the hiring and professional service and reflectleing some contracts and the major reason is that there is reduction is because of the book orders you will see that the service of the other departments and the

funds that we will give to the other departments to provide the services to us, only been build, 17,000 and last year we build, 2 million and that is what impacting it, and so if you take that out, we are actually spending more this year than we spend before and that could be for a variety of things and a lot of departments, probably we thought that it would be this year and allowed the department to provide it in the first quarter billings to us and we expect that number to go up. >> and i think over all, we are on the right track with our spending, and particularly in the salary and so for instance, this year, salaries, expenditures are about 1,000 more than last year and that is good and we keep talking about this and we are filling positions and so that is reflected in our salaries and as we get more list that we are developing and more recruitment and we expect salary to go up more, and at this point, we are at a good point, based on the 3

million revenue projection as well as the expenditures projecting about a 730,000 surplus but i want to say that is preliminary and we will have better estimates at the end of the second quaut and her we will have had six full months and we will have had at least five full months and four full months of the 7 percent revenue being reflected and we expect to have more billings from the work orders and just more billings in general and more training and billings and more contract billings etc., and i am happy to answer any more questions. >> commissioner walker, please? >> can you remind us again when the fee study is coming back so that we can look at that. >> right. >> so we, we hoped that the fee study will be back, this month. and but we had a little hiccup there and the consultant and we were supposed to meet it in september and we were not able to do that because he had a conflict and so we met with him just recently and in the

controller's office and dbi we both have a variety of questions and because there are only some methodology and so we are working with them on that and he is schedule in the controller's office and so we are hoping that with and this will be run by next meeting and i don't want to keep saying that and so i am not going to guarantee that that will actually happen and just because there are some questions that we both departments have about the data that we are using and so working with them and so we do expect us to get done by the end of the year because we need to start working on it if there are any changes, because the hope is that once the 7 fee legislation is no longer in effect we will go into the new fee structure. >> okay. >> thank you. >> sure. >> and are there any other questions? >> i have to the same question. >> okay. >> thank you. >> thank you very much. for your update. >> item 4 b, update on proposed

legislation. >> good morning, commissioners bill strong, legislative and public affairs. i think given the president's discussion on chapter 38, we have a clear understanding of what needs to happen there next. and working group is with the fire department, and our mechanical plan engineers, and possibly a third party we will work closely with fire marshal wong and move that forward as quickly as possible. i don't need to add anything more to short term rentals as you know that does come up for its second and final vote at the board next week. and there was no board meeting yesterday. because of the holiday. and therefore, the enactment date is schedule for february first on that legislation.

>> and he mike? can you make sure that we and the code at vicery committee looks at the amendment that have been forwarded? i would like those on the agenda. i think that you will know that the file was divided and two amendments were sent at the advice of the city attorney, and back to both the planning commission and to the code advisory committee for further review. >> okay. >> so, those amendments will presumably be finalized and count as a trailing piece of legislation if i understand supervisor chui's plan on this correctly, but in short, yes, of course we will get a full set of all of the amen mendments in the final legislation and that can go

back to the code advisory for a subsequent recommendation, back to the commission. >> that would be great. if everything could be packaged together, so that we could see if some of the concerns are being addressed by those. >> of course. yes. we can. >> we can certainly do that. >> and i will just say, with respect to the soft story ordinance, item, i am sure that most of you have seen some of the media coverage, director hui was actually part of an nbc national story that will run on friday on the actual anniversary october the 17th of (inaudible) and as part of the brian williams evening newscast. tr is a lot of interest around the country in 25 years, since preetta and what has san francisco done to try and reduce the damage and the buildings and the possible injuries to populations? and so, we are getting a lot of attention to that and a lot

that have is tied in with the fact that 95 percent of those who were in suspected soft story building and needed retrofits have now complied and we are down to now 350 buildings, and that have actually been posted with these red and white earthquake safety warnings and we started posting our inspectors started to post, actually just, last week. as a consequence of both, those postings and some of the additional media coverage, that we have had from that, and 75 as of yesterday, had to come in and submit it, and now, the late, screening forms. and i think that the director has pointed to all of you that if people do respond within the first 30 days of these

postings, and that includes a notice of violation, we are not going to penalize the owner, we will accept the submitted screening form from the engineer or the architect and move forward with getting that assigned to one of the four tiers. and most of the tiers that have come in when you look at the weekly chart that the staff has been keeping show those in tier three, and four, and we have actually a small number that are in tier one, and was actually already issued close to 100 permits for people to start doing the work so that we know retrofit work on these buildings is already under way. and over all sense i think that there is first phase has worked reasonably well, even though we do have this roughly five percent that have not yet complied. and i think that the final thing that i would... >> sorry, while you are on that

point, so to the commissioner, or to supervisor weiner's point there, this morning on some and similar to do the out reach and regard to the policy, and his ordinance, and is there a way that we can help them out there on that and with the true? >> yeah. absolutely, i think that we can certainly be more proactive and as the director mentioned have our counter staff, make reference to the fact that this additional legislation and has been introduced and it is very likely to pass and there is an opportunity if you are doing a retrofit, to at least look at adding another unit. and to see whether that would work. and you know, we can do another mailing and we do have that list as you probably know, we have done ad least three mailings, and the mayor's office of earthquake safety has done, monthly post card reminders, and again, to try to get the compliance rate up.

and dbi, did a fairly active media bi in all of the local papers and as well as the major publications to try to increase owner awareness of the original september 15th date, and that date as you know was extended by the director to first part of october and october third and we had moved it to, to give the people some additional time in order to comply. and all of those factors that i think that were affected in making people aware that there is opportunity here. so, what we are certainly very pleased to try and leverage the supervisor's effort to address this ongoing affordable housing issue. >> yes, and give me a call for the ordinance legislation and yeah, that would be good and maybe if we could try to organize a meeting with maybe the supervisor staff and talk

about the out reach on that and maybe you can update us on how that went and that falls into the getting out ahead of the scenarios rather than on the doorstep. >> and yes, and i will say that we will redouble our effort and we do make every effort to work closely with the supervisors and the staffs. and as an illustration of that on the one final thing that i will mention on the legislative calendar is supervisor kim will hold a meeting and a land use meeting on monday, the 20th. to look at the issue of noise permits and our process for issuing those and as you know, this week six is probably ground zero for a lot of the construction that is under way, right now. and increasingly, of course we have a community of people living in those neighborhoods, where this construction is going on. so, while most of the process

does put the responsibility on the contractors to establish 24-7 hot lines, and to hold the community meetings, and to have regular newsletters and distributions so that the people living in the area, where the construction is under way, are at least, informed of the kinds of jobs that might require them to come to us when they can't complete the work, during normal construction hours. and i think that many of you know that some parts of construction especially in the early stages of building, these high-rises and keep in mind, that most of these are adding to our housing stock and there is, i think, over all, uniform support around the city to build more housing, as quickly as we can. that does often mean that some of these construction projects, can't do the work during the normal 7 a.m. to 8:00 p.m.

construction hours and so they come to us and make us a request because they have got to do, let's say, a mat pour for a large foundation and it did happen to the end of september and the contractor wanted us to let them start work at 3:00 a.m.. and our inspection staff that reviews these said no that is too early and you will disturb too many people and ultimately, it was recommended to do a 5 a.m., start, in order to get what aamounted to 25, or 30 concrete trucks in and doing what had to be done, you know, in a time sensitive way. and i would say, that based on my knowledge right now, over all, the inspection staff is very stingy with these kinds of permits. we do not hand them out like candy, we never have. but we are working with supervisor kim's staff and there is a meeting today that i

will be attending along with some of our inspection staff about trying to formalize this process a bit know so that it is very clear from the policy and procedures way, to exactly how this works, and whether or not someone has a legitimate reason to need this type of very limited duration, job specific type of permit or if in fact it could be done during normal construction hours, and therefore by, minimizing the impacts on the local communities already living in that neighborhood. >> thanks. >> commissioner mar? >> i just have a question and maybe a request, on the ab, 2188 and the united solar inspection and permitting? is that another one of those areas where i think we need to have a little bit more preplanning from the staff and director because it is going to

happen and so the question is i would not want our department to be the one holding up either in inspection of the solar panels because we want to encourage that installation, and those inspections to take place. >> yes, and i am sure that our electrical inspection group agrees with you as far as i know, that is and it has been a expedited permit processing process on time and the question with this one and the reason that (inaudible) the building departments across the state oppose this legislation, and not on the basis that it was not a good idea to have more solar, but on the basis that no matter what stage of review the building department might be in, this legislation now requires that you drop everything, and you do the solar permit, or item first, if it is ten mega watts or larger,

and there were concerns expressed internally by our electrical inspection, division as well and as well as by the electrical divisions around the state about this. and it has to passed and the governor has signed it and will certainly attempt to expedite our process father to make sure that it is implemented. >> right. >> that does not take effect, as you know until some time next year. >> right, and i think that it is particularly challenging for our department because we are one of the few counties that still have the separate inspectors, we don't have you know, uniform, you know, inspectors, that are certificated, and in mechanical, plumbing and electricity. >> >> it falls heavily on the electrical division. >> thank you. >> you finished aren't you? >> thank you. >> director? excuse me, sorry, forgive me. i got ahead of myself there, commissioner lee has one question and then the director wants to weigh in.

>> i understand that there is roughly now what in 275 property owners that have not submitted the form? >> the last number that i saw was yesterday, 350. it may have fallen. >> 75 have since submitted? >> come in, yes. >> so more my question really is, are we going to do anything special to try to reach these final 275 or 360 property owners? i mean, i know that we have done a lot of mailings of across the events to let the people know but it seems like 275, and 350 might be a little bit more manageable and i am going to say is there an alternative method to try to reach these people before we start to penalize them? >> well we do have the contact information and i know the soft story staff and they have been actually making phone calls to try to give a heads up to the people and we can certainly continue to do that.

and try to bring the people in in this next 30 days, and i think that we have made it very clear and i hope that over and over, that we are not trying to penalize people and we really want them to comply, and let us know through their engineer or architect's survey, are you in this, mandatory pool or not? and you have hrd done the work and therefore you don't need to be in it and so, yes, we can certainly redouble our efforts. >> what is the penalty? >> right now? >> well, right now, the way that the code enforcement process works, they would next go to a director's hearing. because of the numbers involved where we might have a larger type of hearing. so we might bring in 30 or 50 or whatever number to try and bring expedited attention to that. and at that point, there is the

following that second notice of violation, as you know there is normally this monitoring fee of $52 per month, that is charged but i would say that the opportunity of getting this on track, and minimizing any type of serious cost issue, is very good. and ultimately if people are not being responsive, we will have to refer the case to the city attorney, for litigation. and as you know, we had a very small number of such cases under the unb program which was the only other mandatory retrofit program that we have had to deal with in the department. >> director? >> yeah, first of all, regarding the solar, and that we already, you know, that i already, you know, (inaudible) and our chief building inspector. and before even they passed a

code by the state, the biggest issue is, you know, (inaudible) most of the time inspect and that is why we may be reading 90 percent but the other ten percent or whatever it is there is a (inaudible) and they are going to take the time and then work with the contractor to work out the major issues for the easier approval process and then, in the meanwhile we will hire a couple of more inspectors in the electrical box. and that is why, you know, one time that we are talking about it and object to the state and you know, all of the cold and somehow, that we think that we can manage it, because, you know, at the time, that we are

notice of violations 375 and the complaints in violation, and second owners of violation, and and for the housing inspection division, the performed were 945, and smraints received, for 445. and the complaints in 24, to 72 hours, and 389. complaints of violations notice of violations for 122, and complaints of violations are 310, and the number of cases sent to the director hearing is 26 and the routine inspections were 199 and there is a note there that statistics of the month of september, the monthly totals were diminished due to the number one training and number two, resources need for investigating the short term complaints and number three, the last and inspectors. the number of cases to the

we have spent, and i am almost frightened to be able to tell you how much time that it took to take the first five through and hearing to be able to get the notices of decision because, of how different it is to get the investigation, and especially if the complaint has come in, and has not given you a on-line hosting listing, and a lot of individuals who are advertising on various on-line platforms including craig's list and all sorts of those out there now. >> and but, it is that they are getting smarter about not putting the pictures of the front of the building on that listing and since there are no addresses, trying to make sure that you have identified the listing with the specific property, that currently follows under chapter 41, which is four units or more for us until this legislation actually, if and when it gets amended is very difficult. and sometimes we are
