because of the numbers involved where we might have a larger type of hearing. so we might bring in 30 or 50 or whatever number to try and bring expedited attention to that. and at that point, there is the following that second notice of violation, as you know there is normally this monitoring fee of $52 per month, that is charged but i would say that the opportunity of getting this on track, and minimizing any type of serious cost issue, is very good. and ultimately if people are not being responsive, we will have to refer the case to the city attorney, for litigation. and as you know, we had a very small number of such cases under the unb program which was the only other mandatory retrofit program that we have had to deal with in the

department. >> director? >> yeah, first of all, regarding the solar, and that we already, you know, that i already, you know, (inaudible) and our chief building inspector. and before even they passed a code by the state, the biggest issue is, you know, (inaudible) most of the time inspect and that is why we may be reading 90 percent but the other ten percent or whatever it is there is a (inaudible) and they are going to take the time and then work with the contractor to work out the major issues for

the easier approval process and then, in the meanwhile we will hire a couple of more inspectors in the electrical box. and that is why, you know, one time that we are talking about it and object to the state and you know, all of the cold and somehow, that we think that we can manage it, because, you know, at the time, that we are and we are doing it that way. and to help out on the solar, and you know, it is not changing our process. thank you. >> and item 4 c, update on major projects. >> good morning, commissioners. did you see you know, the projects, and that is the... adding one... and (inaudible) 1.7 percent, increase. but, of course, the amount of

projects still coming in, but the number of permit and more projects that is, and also rising to from the valid that you can see that those are the things (inaudible) and then, if there will be a couple more bigger one coming in later and i mentioned before that they want to start the construction next year. and then, we will go to, you know, hopeful, and they will be proactively trying to help them and to run parallel with the planning on their project. >> any questions? >> no, thank you for that. >> item 4 d, update on code enforcement. >> good morning, commissioners, this is the code enforcement and dbi monthly update.

for the building inspection division, 5045, and complaints 316, and complaints response in 24 to 72 hours, and the 258. and smraints with the first notice of violations 375 and the complaints in violation, and second owners of violation, and and for the housing inspection division, the performed were 945, and smraints received, for 445. and the complaints in 24, to 72 hours, and 389. complaints of violations notice of violations for 122, and complaints of violations are 310, and the number of cases sent to the director hearing is 26 and the routine inspections

were 199 and there is a note there that statistics of the month of september, the monthly totals were diminished due to the number one training and number two, resources need for investigating the short term complaints and number three, the last and inspectors. the number of cases to the director's hearing 101, number of order of abasements were 30. number of cases under advisement were 20, and number of cases abaited 782, and the cases referred to the city planning is one and per your last request, and the permit status, of, unit legization, and it is provided for you. and you referred to the rental complaints and how many we have received and can we get a sense

of what is happening and the challenges? you might be and the challenges are i think, is, we have the president and said about pushing the large down hill and we have spent, and i am almost frightened to be able to tell you how much time that it took to take the first five through and hearing to be able to get the notices of decision because, of how different it is to get the investigation, and especially if the complaint has come in, and has not given you a on-line hosting listing, and a lot of individuals who are advertising on various on-line platforms including craig's list and all sorts of those out there now. >> and but, it is that they are getting smarter about not putting the pictures of the front of the building on that listing and since there are no addresses, trying to make sure

that you have identified the listing with the specific property, that currently follows under chapter 41, which is four units or more for us until this legislation actually, if and when it gets amended is very difficult. and sometimes we are laobing at pictures in the sheet and i have had the seven inspectors to the site to try to identify if that is the street. by those pictures. and it is difficult because that is taking away from resources of dealing with main maintenance and other issues that are the coreman date of the housing division and the current structure of chapter 42, does not use the model you have to take a case to a hearing and at that point, make a finding whether or not there is a violation or not, and at the time of the hearing, the

violation.

and to the planning commission and they duplicated the file and so some of it we want forward and some of it did not and because there are so many amendments and almost every superviser had one amendment that was propose and we need some time to be able to analyze this, probably we will tell you that the way that it is proposed is that it comes completely out of dbi and goes to planning, and which is in many ways a very good thing because of the impacts that it was having on our ability to do our mandates and however, having said that, there are ways that we can and we can assist, the planning department, with additional training and so when they are

doing the investigations if they see the things that we can address those are opportunities and until we have a chance to see everything adopted, you know, maybe it may be premature at this particular point and the other thing that i think that you should also consider is that when you have your next joint meeting with the planning commission, some of this goes back to them as well. and so that is just something that you might want to think in your timing. >> and well absolutely, my hope is that in the process of looking at these amendments,

and the enforcement efforts of this ordinance, that our department and planning are actually included in it and instead of, you know, the tail waging the dog. i hope ha we can support the experts of being part of the process of evaluating the amendments and the other thing, commissioner is that the current ordinance, only is with the two buildings and if this is a much, much larger issue to have to deal with. and so, the departments are going to need some time to be able to get the file version of this, and as i said, there are so many, and it was, it was astounding that the clerk of the court and the acting president at the time that follow all of those amendments i can't think back when there are that many pieces on the floor i would say that january might be a bit early, especially since they are going to have to take some of this stuff back to land use and planning but obviously after that and i mean

that we have been very proactive on this legislation, and all along and as part of it forward and so we are continuing to watch that and interact with it and the various supervisors and we will continue to do so and the commission for wanting to vet the concerns that you have but it may be a bit early but you may want to wait until the intent is to effect this before. >> exactly, i don't want what happened to happen again and so i think that sooner rather than later, both commissions should review this, and >> so at this point, we can only give you... >> what you have. >> and even though we might not quite understand it yet, because it is, i guess that we will see it all put together. >> so, thank you.
