1:30 pm
help the southeast sector but when i saw you name some streets after the people in alice griffith, that was not done for alice griffith, that was done for on the hill in the beginning when this redevelopment came to my community. so the lawyer, he needs to let you all know, do you know you all can be sued? i tell people, the people that are sick. we have a 19-month-old baby that has cancer now. 19 months old. you all don't know what's going on in my community. how many people are dying and going to continue to die. if they go where you are trying to send them and okay it, there is going to be more deaths. you know who is going to be responsible for the death of those people?
1:31 pm
you and you and you because you have not listened. you don't know the area, you don't know the toxins that are there and cannot be cleaned because i was told by the navy if they cleaned the area there won't be nothing there but the bay because the whole area was landfill, every inch of it that you vote on. you are going to be voting on something else today that is not a fact and it's just a shame. you can go on the internet. go on the internet and look up toxic city san francisco. then go in there again and look up harrington park, san francisco. you will learn a lot about the area. thank you very much. >> thank you. this is closed
1:32 pm
public comment because there are no other speaker cards. do the commissioners have questions on this item? commissioner mondejar or mr. diego, i have a couple of questions. you indicated that there are trustees, bond trustees, can you tell us who they are and how they are selected? >> what i mentioned was the escrow trustees and the sorrow -- escrow trustees in each case for the bonds to be refunded. in other words all the bonds being refunded the trustees either back of new -- bank of new york and to keep it simple we'll use those same trustees for the escrow agents during the refunding. they will be very short lived escrows.
1:33 pm
we'll be calling the bonds on february 1, 2015. >> no other questions? >> i have no other questions to me. this is a significant item for financing measure and there are savings and i think it's prudent to go forward. do i have a motion? >> i move. >> commissioner bustos has moved, commissioner mondejar has seconded. please call the roll. >> city clerk: commissioners please answer when called your name. commissioner mondejar, commissioner singh, absent, commissioner bustos, madam chair rosales. there votes and one absent.
1:34 pm
>> let's call the next item. >> at this point you will be reassessing recessing as the financing authority. >> at this time the commission on community investment and infrastructure will take a recess and no one needs to leave the room or yes? >> our outside bond council will serve as your council for the financing authority action. >> very good. at that point we switch agendas. at this point we start the meeting for the financing authority. i understand completely. thank you. i open it up.
1:35 pm
>> madam chair, just for the record, the recess you called at 132 p.m..:32 p.m.. >> okay. bear with me for a minute so i understand what i'm doing. this is the meeting of the financing
1:36 pm
redevelopment authority. we are convening the meeting at 134 :34 p.m. on december 2, 2014. please call the roll, madam secretary. >> city clerk: commissioner mondejar, commissioner singh, ab sent, commissioner bustos, chair rosales. there are no reportable actions. the next order of business item 3, item 3 no items, regular agenda, first the consent agenda, there are no items. the next is regular agenda, item 4a, approving subject to approval by the department of finances the refunding of certain bonds of the redevelopment agency of the city and county of san francisco and authorizing the execution and delivery of
1:37 pm
redemption agreement by the city of san francisco county of finance and authority and approving other matters relating to various project areas resolution december 2nd , 2014. >> thank you, madam secretary. you will now consider this refunding transaction which is you know as the state department of finance approves and the chair indicated in a previous capacity certainly saves this commission money given current interest rates. with that, i would like to ask john diego to make a brief presentation on the specifics under the compassey of -- capacity of the financing authority. >> thank you, once again my name is john diego, senior analyst.
1:38 pm
basically resolution no. 2, 2014, approved the execution of the redemption agreement which allowed the bonds that are being refunded allows the refunding to complete. those are three party agreements among the ocii, the financing authority which are the issuer of the bonds that we are refunding and the escrow trustees. so this is really without this, the deal could not complete. the resolution authorizes other critical actions that maybe necessary to the completion of the transaction. in fact, that concludes my presentation. >> thank you. madam secretary, do we have any speaker cards on
1:39 pm
this item. >> one speaker card. dr. spin ola jackson. >> thank you very much. dr. jackson. i'm glad i came here today to hear the report. now i want to see whether or not you commissioners will make sure that my church and the church name is grace tabernacle community church. the address is 1121 oak dale street, san francisco, 94124. redevelopment bill the hill going straight up oak dale put my church in a hole. it rains. water comes straight down into church. it's been coming and coming for years. this is not my
1:40 pm
first time coming. i have been here before some of you got here talking about my church. in any other area this body would not have allowed this to occur. this has been since 1970, since the 70s. when are you all going to do something about raising my church, put it on the level where it was supposed to be gone. my pastor came here and francisco decosta came to testify. at least we were able to get you the redevelopment committee to set aside must -- monies so when people would get off the bus to the church that they wouldn't be tumbling
1:41 pm
down the hill. there is no sidewalk, nothing. this is a disgrace how this department have allowed my community to suffer and still suffer. i just want to make sure that the agreement that was made back in the 70s be taken care of now. we are in 2014, almost 2015 and you have done nothing for my church. that was my church. if it was somebody's church, i wouldn't be here. but that's where i have to go. that's where i have to sit and smell. you all do something here today about this church. you know it was other people from the community ask you to do the same thing. thank you. >> let me make this situation
1:42 pm
very clear. so, you represent the former san francisco redevelopment agency and your director here, she knows very well what dr. jackson said. $187,000 were given so that we could fix what needed to be fixed. i was a project manager. because at one time i ran the presidio of san francisco and i did it for free for the church. now, you have an obligation to fix that church especially the foundation of the church. it needs a french trench so the basement does not get flooded. this is what i'm saying and members like you are appointed by the
1:43 pm
mayor and they have no history and what happens, this becomes a comedy. by you all taking over, you need the foundation of our fathers. you do that in one way. so your director needs to sit down with you all and give you all an orientation. you all need to call bishop ernest jackson to see whether he has a valid case. you need to call the director of dpw muhammad because i sent him over 1,000 photographs. so he can testify. you need to call blackwell
1:44 pm
to see whether decosta is saying is true. what i'm saying is the office of the successor agency is like a joke rubber stamping. you all have obligations, but how can you all fulfill your obligations if your heart is not in the right place. your heart is in the right place when it comes to transactions, behind closed doors. your heart is not in the right place when promises were made that monies were expended so you know there is a link. now you want to drop this church there in that hole. so i'm asking the director, the mayor, muhammad, to come out wherever you are and speak to the truth. this city is going to
1:45 pm
the dogs because people are not speaking the truth. thank you very much. >> thank you. do we have any other speaker cards? >> i have no further request to speak. >> public comment is closed. commissioners, any questions on item 4a of the regular agenda of the redevelopment financing authority? >> madam chair, eye -- i have a question. the issue of the church when i was on redevelopment, the question came up, how does that affect the decision before us now, is that a separate discussion that we then look at having? >> it doesn't affect the refunding action today. certainly commissioner you can bring it up under questions and matters and we can genre --
1:46 pm
again, rereview the matter. >> i remember when dr. jackson came before us with the pastor with issues. i would love if we can move this item the way it is but then have another conversation with dr. jackson and her pastor. if we made a commitment we should fulfill our commitment and do it. i know it's an issue that the church has been dealing with for a long long time. so if there was money set aside, then maybe we should figure out, have a separate discussion about that. i would ask that, but i would like to move this item since it's a separate item from the church. let's move this item and if we can have a separate discussion from that. >> when the ccii reconvenes we can get back to that topic and that question. there has been a motion by commissioner bustos on item
1:47 pm
4a and a second by commissioner mondejar. city clerk: commissioner mondejar, singh absence, commissioner bust os, commissioner rosales. next agenda item. no speaker cards. >> the next order of business is item 6. public comment on non-agenda items. >> we have confirmed there
1:48 pm
are no speaker cards for financing authority. >> the next order of business is item 7, the financing authority adjournment. >> hearing no objection, the redevelopment financing authority is adjourned. thank you for your service. we are now going to change lawyers or call back mr. brian. i was
1:49 pm
just given the courtesy of mr. singh to return. i think he is going to return. we'll wait a few minutes. we are now reconvening. at the commission. >> the next order of business
1:50 pm
item 5b authorizing an agreement not to exceed $2 million with the affordable housing units at mission bay south block east to the environmental and quality act mission bay south redevelopment area resolution no. 902014. >> thank you. commissioners we are very pleased to bring before you the next affordable housing project in mission bay the items includes not only the selection of the proposed developer of 1300 fourth street. this is their first second project
1:51 pm
with us now tndc they have a project in mission bay but they have come forward with a very experienced development team as a companions item to the exclusive negotiations agreement and you also consider the allocation of the predevelopment dollars to allow the development team moving forward the design process and financing process to bring back before you shortly. time does go by fast, the schematic design in the agreement. with that, our specialist in the housing division and she will be joined by others on the team. >> good afternoon, i'm pam simms, a development specialist at ocii. i'm
1:52 pm
representing item 5d, a request to enter into exclusive negotiations with the agreement and a predevelopment loan agreement for $2.5 million both with 1300, 4th street. both of these items are associated with the development of the 1300, fourth street. on september 17, 1998, the sfra commission approved the north development plans or opa aechltz . requires that 1400 housing
1:53 pm
developments are done. the balance of 1445 units are being developed by non-housing developers. also the mission bay policy established the affordability levels and they can go up to 60 percent of area median income or $250 for a family of four. to address this affordable housing requirement, earlier in may, the staff released a request for proposal for the mission bay south block 60. a significant outreach effort was made to community groups, developers and other community stakeholders. the rfp requested submit tals from a team from a service provider, architect and property manager. they
1:54 pm
helped prepare the rfp to fund contracts associated with the formally homeless families. the development program outlined in the rfp included rental housing and affordable income to homeless families, 80 percent of the units be affordable to households of 50 percent of area median income with the remaining 27 be set aside for formally homeless families and equal share plan of 1-2 bedroom units. 8800 square feet of ground floor retail space and interesting design, financial feasibility, green and sustainable building strategies and use of the entire site for 135 units and no more than one to one parking. four proposal packets were received.
1:55 pm
during the completeness renew view one was not completed. the remaining applicants. the housing development corporation and tenderloin neighborhood development corporation tndc were interviewed by a selection panel who included representative from ocii, the mayor's office of housing and community development and the mission bay citizens advisory committee. the panel unanimously selected the tndc stoo team which includes sooner lomon and bar an and tndc valencia as the service providers. the tndc
1:56 pm
is committed to pursuing additional finances in order to reduce subsidy, compelling design, a service provider in addition to services from 28th valencia in after school literacy and writing school program and the fourth street side with retail. the proposing development is adjacent to 588 mission bay blvd north is known as mission bay southwest which you approved for financing earlier this year. it addresses the need for affordable housing by targeting households of 50 percent of median income an equal distribution of 1-2 bedroom units, 103 apartment units in 3-5 buildings in 23 various
1:57 pm
homes and flats and 45 off street parking spaces which includes 5 retail spaces in two carshare spaces. so why we are here today is for your authorization to enter into a $2.5 million predevelopment loan agreement. this funding will pay for architectural design, two construction designs, legal cost and development fee. the rates are very simple which will convert to a permanent loan at construction closing. the staff will work to implement procedures and present a balanced budget and the developer will meet with staff at 50 percent construction drawings to help cost containment. the exclusive negotiations agreement requires the
1:58 pm
developer to provide a $10,000 performance deposit to take us to the anticipated construction start. in case we slip, there will be two potential six 6 months extension milestone of design concept, as well as schematic design drawings and a general estimation and cost estimates. as was previously stated, the mission bay citizens advisory committee was represented on the selection panel. the tndc team presented this project to the cac at it's august 14th meeting and the cac supported this project. so the schedule from here on is this is what wii we anticipate. april 15th back with schematic design for
1:59 pm
your approval, august 15th, return to commission for financing in order to apply for tax credits in october 2015. march 2016, we'll come back to the commission for authorization to enter into a long term ground lease. anticipate 2016, financing will close, construction will begin and finally december 2017, construction should be complete. that come completes staff presentation. dr. paul and foil, and representing architects, abernathy. thank you. >> thank you. do we have any speaker cards? >> yes. we have three
2:00 pm
speakers. >> my name is donna dellara, italian. i'm a member of the cac. i want to support this here today because the project is a very nice project. i looked at it very carefully. it meets all the requirements that we seem to require and i personally am very fond of the thought of the 826 valencia after school program. i would like to see something for kids in advanced ages and the ability to read and write stories is just wonderful. the other thing i thought very highly about is they did include five parking spots for the retail tenants. it's the only building i see earmarked
