>> so i am jason henderson and currently the chair of the market and ovtavia community advisory committee and i have known paul for over a decade. paul is a pillar in the community. he has back to the very beginning of the drafting of the market and ovtavia plan and he has a long record of advocacy within the neighborhood especially for families and for the public school system and keeping public schools -- like john muir in the neighborhood to accommodate future growth. i know you have his application in front of you, and he sends his regards that he had to be away today. he thought that the hearing was actually going to be before the thanksgiving holiday and he apologizes he couldn't make it today and i am happy to answer questions and support paul's candidacy for the cac.

thank you. >> okay. thank you. and then next one is jason henderson. >> all right. so good afternoon supervisors. thank you. it's with great pleasure i am reapplying for the committee on the market and ovtavia plan. i am applying for the at large position again. as some of you might know i'm a professor at san francisco state university so i look at planning from a city wide perspective and not just air wide perspective and i teach planning and it's important to our faculty that we're involved and give back to our communities in our areas of expertise so that's one of the reasons i'm here. i bring 20 years of experience in transportation planing to the

valley neighborhood association and i gravitated towards paul because he got people to work together on ideas and issues that affected not only hayes valley but the community at large. when my role changed i watched paul from the study side and worked with the city and community and the design and implementation in the land use in the market and ovtavia area including patricia's green and has been involved in the corridor and the surrounding community. it's so important to have someone that understands the impacts of the areas of rapid growth especially with the new developments that will bring thousands of new residents to the neighborhoods and has been the go to office when we need a reasonable, thinks out of the box but sensitive person that works well with the diverse community and supervisor breed gives full support to paul olsen for this. >> thank you. any other

public comments? seeing none public comment is now closed. thank you for coming today and applying for this, most of you reapplying. i have to say i have concern with one of the candidates in terms of attend attendance, kenneth wingard and he missed meetings recently and he reached out to our office and the question was asked how much time do you actually have to come to the meetings and it was evident he is committed to this body however his profession or job takes him away during the week, and i believe what he said that the meeting day of the week of the meeting has changed to a monday. is that correct? and so he said that wouldn't be a problem because he doesn't leave for travel on mondays, so i

think with that explanation i'm willing to -- many of us on this committee are concerned with people showing up for meetings when they want to be on bodies and in the past we have chosen not seat people with bad attendance but the commitment but seems this person is okay and i wanted to mention that. supervisor tang. >> thank you supervisor yee and i don't think we didn't ask this many questions because we saw everyone recently and i want to thank you for your interest serving and i had concerns about mr. wingard and i spoke with him and changed his schedule and prior to 2012 made 80% of the meetings so he was part of the cac from the very beginning and

i am currently serving on the shelter monitoring committee. i was appointed in april of this year to fill a temporary vacancy and i am seeking reappointment because from my experience as a direct service provider in san francisco working with homeless clients i see that there is a need for advocacy and ensuring that the shelter system is serving san francisco residents as it's intended to so i really enjoyed the experience i had thus far. i want to continue learning and working with other service providers and shelters to improve the system, and so i would hopefully be reappointed this term. >> just a quick question. >> sure. >> so as i understand it you're applying for seats four, five and six and right now what seat are you serving? >> i believe it was either four or six. i was serving -- or am

concerns that need to be changed on this agreement and i'm reaching out to him but he hasn't been able to address it, so i am here today to try to facilitate getting this done. number 3 on page four of the release, the effective date needs to be changed from when -- the effective date needs to be changed when the board approves it to when the funds are received by the plaintiff. the reason for that -- >> can i ask a question? which item are you talking about? >> item 9. >> item 10. >> it's paul haynes. >> this is wells fargo. >> no. >> so this is the settlement the laugh with paul haynes.

>> yes. >> okay. >> yeah you're saying there is no agreement. >> well, what happened they submitted an agreement and there were some changes made and the changes were not noticed by the plaintiff until after he signed it. he signed it on the tenth and then looked at it real cloasesly and there is a provision in the settlement agreement where you can revoke it. okay. so what i did i reached out to the city attorney after the tenth. i said "listen we need to look at this. this is simple term terminology. i think it can be fixed. instead of saying the effective date is when the board of supervisors approves it it should be when the settlement funds are received. the reason for that

if the effective date is the board of supervisors -- i am working right now. if the effective date is the board of supervisors i have to resign. i won't have a job and it will be waiting so it puts them in a tough position and make that clear. >> so you're the plaintiff's counsel? >> no. >> you're the plaintiff? >> yes. >> okay. >> so that puts a burden on the plaintiff if the effective date again is when the board of supervisors approves it because then according to the city attorney he has to go, but our proposing the effective date is when settlement funds are received. that ways when the plaintiff gets what he wants the city gets what they want. >> okay. so thank you for your input. we will take that

signed into law about a year and a half ago and the whole idea behind it was to help homeowners strengthen buildings so that they would not collapse. >> did you the soft story program apply to all buildings or building that were built in a certain time frame? >> it only applies to buildings built in the time frame of 1978 and earlier. it's aimed at wood framed buildings that are three or more stories and five or more units. but the openings at the garage level and the street level aren't supported in many buildings. and without the support during a major earthquake, they are expected to pancake and flatten ~. many of the buildings in this program are under rent control so it's to everybody's advantage to do the work and make sure they protect their investment
