een the community and agencies. they're are a number of agencies that do projects within the area and it is. >> >> it's a big project, so they're currently overseeing over 28 projects in the area, and they all vary in timeline so it's -- they have been meeting -- the 13th meeting is going to be held this month and meeting every other month at city college, the ocean campus and we currently have five voting members out of nine and all members have been present since 2013 so they're very committed and pretty much they provide input to the community and oversight and helping prioritize the implementation of transportation and other public improvements and some of the projects include the balboa park station area and plaza improvements, muni forward
4:01 am
which is the transit line changes, the ocean avenue corridor design and the i280 off ramp realignment so if you have any further questions i am available. thank you. >> thank you. did you want to say anything? >> [inaudible] >> okay. any questions? well thank you for bringing this forward. even though the balboa station isn't in my district it's just close enough to the district where it has a lot of impact and i am certainly supportive of the extension. any public comments on this item? seeing none public is now closed. [gavel] supervisor campos. >> thank you. i would like to move this item forward with a positive recommendation. and by the way what an incredible voice. thank you for the
4:02 am
presentation. >> deputy city attorney john gibner. >> just one suggestion to the committee. on page three of the resolution the resolution refers to the rules committee makes appointments to the body. i think this was probably in the original 2012 resolution also, and what has happened with this body as all advisory bodies that the board makes the appointments. the rules committee considers the applications and nominations so i would just suggest and we can work with the m ta on massaging the language and clarify it's the board making the appointments and not the rules committee and then we will submit a copy to the board. >> i make a motion to clarify that's it's the board and not the rules committee that appoints. >> okay. so there's a motion to pass this with positive recommendation for amendments. no objection. then this item is
4:03 am
passed. [gavel] thank you. madam clerk item number 5. >> item number 5 is a hearing to consider appointing six members for a two-year term ending december 16, 2016 to the market and ovtavia community advisory committee. there are six seats and eight applicants. >> okay. if you're here i will call in the order on the agenda. krute singa. >> hello and thanks for the opportunity to speak to you today. i am krute singa and i am wanting to be reappointed to the market and ovtavia seat. i have been on in the seat for the last two years and served as the vice chair. i found the role to be interesting and enjoyed the opportunity to strengthen the neighborhood structure which i plan and work. what i bring to
4:04 am
the community is over 13 years of experience in urban planning and specifically in multi-modal transportation planning establishing projects that improve pedestrian, bicycle transit, ride sharing access, and closely tied to land use and economic and social development. i am currently working for the san francisco department of the environment where i manage sustainable transportation programs and outreach and education programs. but my experience and interest is not only in transportation. i am also interested in understanding the factors that contribute to making a complete and vibrant neighborhood for residents and visitors including access to basic services, amenities, schools and open spaces. and on a personal level i grew up in san francisco and have lived in the mission delores area for the last 11 years. i don't own a
4:05 am
car and rely on the pedestrian, transit and car share amenities in the neighborhood and i also work in the plan area which i mentioned and familiar with the multi-model access issues that currently exist and we need be mitigated with all of the new development coming on board now and over the next few years so to conclude i am interested in continuing to be a part of the cac and contribute to the improvements in the plan area. thank you. >> thank you very much. thank you for wanting to serve. the next person on the agenda is joshua marker and i believe that he's not going to be here today but he did -- he was recently appointed and support the by supervisor kim's office. next person is raymond gary mccoy. gary.
4:06 am
>> hi supervisors. i am gary mccoy and currently on seat three. i feel like i was just here. i saw you all at the end of the july actually so i am just asking for your recommendation to continue on the commission another two years. it's been great for the last couple of months and just working towards continuing pedestrian safety improvements and open space projects. thank you. >> it's always good to see you here. >> thank you. >> thank you very much. next person is madam bring ham who i believe has withdrawn her application. is that correct? and the next one is kenneth wingard. are you here? there
4:07 am
was a statement submitted and then us russell pritchard has withdrawn also. paul olsen, are you here? come on up. >> supervisors i am not paul but paul did ask if it was possible for someone to speak on his behalf. >> go ahead. >> so i am jason henderson and currently the chair of the market and ovtavia community advisory committee and i have known paul for over a decade. paul is a pillar in the community. he has back to the very beginning of the drafting of the market and ovtavia plan and he has a long record of advocacy within the neighborhood especially for families and for the public school system and keeping public schools -- like
4:08 am
john muir in the neighborhood to accommodate future growth. i know you have his application in front of you, and he sends his regards that he had to be away today. he thought that the hearing was actually going to be before the thanksgiving holiday and he apologizes he couldn't make it today and i am happy to answer questions and support paul's candidacy for the cac. thank you. >> okay. thank you. and then next one is jason henderson. >> all right. so good afternoon supervisors. thank you. it's with great pleasure i am reapplying for the committee on the market and ovtavia plan. i am applying for the at large position again. as some of you might know i'm a professor at
4:09 am
san francisco state university so i look at planning from a city wide perspective and not just air wide perspective and i teach planning and it's important to our faculty that we're involved and give back to our communities in our areas of expertise so that's one of the reasons i'm here. i bring 20 years of experience in transportation planing to the cac and involved with the drafting of the plan and i'm also a renter and concerned about affordable housing in the market and ovtavia area and we press for creative ways to make sure that the new development brings with it affordable housing and i am happy to answer any questions if you need any further materials please let me know. >> are you speaking for anybody else? >> no. i don't think so. >> okay. thank you. any public comments on this item? come on up. you have two
4:10 am
minutes. >> hi supervisors, i am valerie brown with supervisor breed and here in support of paul and an active member of the neighborhood and part of the office as long as i can remember. paul has a long resume as a activists and i met him and president of the hayes valley neighborhood association and i gravitated towards paul because he got people to work together on ideas and issues that affected not only hayes valley but the community at large. when my role changed i watched paul from the study side and worked with the city and community and the design and implementation in the land use in the market and ovtavia area including patricia's green and has been involved in the corridor and the surrounding community. it's so important to
4:11 am
have someone that understands the impacts of the areas of rapid growth especially with the new developments that will bring thousands of new residents to the neighborhoods and has been the go to office when we need a reasonable thinks out of the box but sensitive person that works well with the diverse community and supervisor breed gives full support to paul olsen for this. >> thank you. any other public comments? seeing none public comment is now closed. thank you for coming today and applying for this, most of you reapplying. i have to say i have concern with one of the candidates in terms of attend attendance, kenneth wingard and he missed meetings recently and he reached out to our office and the question was asked how much time do you actually have to
4:12 am
come to the meetings and it was evident he is committed to this body however his profession or job takes him away during the week, and i believe what he said that the meeting day of the week of the meeting has changed to a monday. is that correct? and so he said that wouldn't be a problem because he doesn't leave for travel on mondays, so i think with that explanation i'm willing to -- many of us on this committee are concerned with people showing up for meetings when they want to be on bodies and in the past we have chosen not seat people with bad attendance but the commitment but seems this person is okay and i wanted to mention that.
4:13 am
supervisor tang. >> thank you supervisor yee and i don't think we didn't ask this many questions because we saw everyone recently and i want to thank you for your interest serving and i had concerns about mr. wingard and i spoke with him and changed his schedule and prior to 2012 made 80% of the meetings so he was part of the cac from the very beginning and interested in continuing so i am evident he will make this work with the schedule. as for the rest i think the only person we didn't appoint recently who is up today is mr. paul elolsen and pressed interest in him in this role and for everyone repointed thank you for your service and happy to have you continue. >> okay. so is there a recommendation? >> yes, sorry through the
4:14 am
chair and i would like to make a motion to appoint krute singa to seat one. joshua marker to seat two. raymond gary mccoy to seat three. kenneth wingard to seat four. paul olsen seat five and jason henderson for seat six with positive recommendation to the full board. >> any objection? seeing none the motion passes. congratulations. thank you for coming. . item 6. >> item 6 is appointments for the shelter monitoring committee and there are four seats and four applicants. >> great. i will call them in order of the agenda. nicholas kimura. >> hi. good afternoon. i am nicholas kimura. i am seeking reappointment. i am currently chair of the shelter monitoring committee. i work as a shelter
4:15 am
client advocate for the collaborative and volunteer for the coalition on homelessness. i am well aware of the situation, the homeless community faces, and have i have good rapport with the shelter management as well and seeking reappointment. >> okay. any questions? seeing none. kendra amick. >> hello and good afternoon. i am currently serving on the shelter monitoring committee. i was appointed in april of this year to fill a temporary vacancy and i am seeking reappointment because from my experience as a direct service provider in san francisco working with homeless clients i see that there is a need for advocacy and ensuring that the shelter system is serving san francisco residents as it's intended to so i really
4:16 am
enjoyed the experience i had thus far. i want to continue learning and working with other service providers and shelters to improve the system, and so i would hopefully be reappointed this term. >> just a quick question. >> sure. >> so as i understand it you're applying for seats four, five and six and right now what seat are you serving? >> i believe it was either four or six. i was serving -- or am serving on lhcb position for seat one or the appointed seat one position. >> okay. >> and it was just an idea to move to the bos position. >> okay. i understand. thank you. >> thanks. >> okay. next person would be michael kirkland and he's not able to attend but he did send
4:17 am
a statement. >> can i say something on his behalf or later? >> sure. >> i can do public comment. >> why don't you do it now. it doesn't matter. >> i guess i am speaking in my voice though. i want to voice my support for michael kirkland reappointment. honesty there were issues in the beginning with attendance however that has been remedied and attending orientation and the meetings. >> thank you and the last person is kim armbruster and i believe they are withdrawn so that's the end of that. any public comments on this item? seeing none the public comment is now closed. [gavel] supervisor campos. >> thank you. again i want to thank the applicants and all of the people seeking to continue to serve. this is a very important committee that plays a very important role serving a
4:18 am
very vulnerable population so grateful that people are willing to serve in this capacity so i make a motion to approve nicholas kimura for seat three once again. kendra amick for seat number 4, mike mike for seat number 5. >> okay. no objection then motion passes. congratulations. [gavel] >> thank you. >> so there are some litigation items, but no closed session is that -- okay good. >> can i have the opportunity to make a public comment on that before or after? >> i'm sorry? >> for settlement. we will call it up in a second. >> okay. >> okay. madam clerk item
4:19 am
number 7. >> item number 7 through 10 are ordinances and resolutions thrsessing and approving tolling and standstill agreements and settlements for lawsuits and unmitigated claims. >> okay. any questions? supervisor campos. >> just a motion to go into closed session, but i know there is public comment before that. >> are we going into closed session? >> yes but you need to take public comment before you go into closed session. >> okay. for some reason it wasn't listed here. public comments on this item? >> [inaudible] plaintiff -- good afternoon to the chair,
4:20 am
committee members. i feel compelled to come here because there is a perception that the plaintiff is holding the progress of the settlement up and i just wanted to make clear that is not the case. i have reached out to the city attorney and explained what concerns there are, and in fact this boils down to two basic concerns that need to be changed on this agreement and i'm reaching out to him but he hasn't been able to address it, so i am here today to try to facilitate getting this done. number 3 on page four of the release, the effective date needs to be changed from when -- the effective date needs to be
4:21 am
changed when the board approves it to when the funds are received by the plaintiff. the reason for that -- >> can i ask a question? which item are you talking about? >> item 9. >> item 10. >> it's paul haynes. >> this is wells fargo. >> no. >> so this is the settlement the laugh with paul haynes. >> yes. >> okay. >> yeah you're saying there is no agreement. >> well, what happened they submitted an agreement and there were some changes made and the changes were not noticed by the plaintiff until after he signed it. he signed it on the tenth and then looked at it real cloasesly and there is a provision in the settlement
4:22 am
agreement where you can revoke it. okay. so what i did i reached out to the city attorney after the tenth. i said "listen we need to look at this. this is simple term terminology. i think it can be fixed. instead of saying the effective date is when the board of supervisors approves it it should be when the settlement funds are received. the reason for that if the effective date is the board of supervisors -- i am working right now. if the effective date is the board of supervisors i have to resign. i won't have a job and it will be waiting so it puts them in a tough position and make that clear. >> so you're the plaintiff's counsel? >> no. >> you're the plaintiff? >> yes. >> okay. >> so that puts a burden on the plaintiff if the effective date again is when the board of
4:23 am
supervisors approves it because then according to the city attorney he has to go, but our proposing the effective date is when settlement funds are received. that ways when the plaintiff gets what he wants the city gets what they want. >> okay. so thank you for your input. we will take that into consideration when we go into closed session. >> okay. >> thank you very much. >> there is one other item and number 9 on page five -- >> your time is up. >> okay. >> so there is a motion to go into closed session. no objection. so moved. we going into closed session. >> deputy city attorney gone
4:24 am
john gibner. during the closed session the committee recommended to forward items to the full council. >> can i have a motion? >> so moved. >> madam clerk is there anything else on the agenda? >> no. that concludes our business for today. >> okay. if there is nothing further that concludes this meeting. thank you very much. [gavel] >> my name is robert baca, i'm the development manager for block 49. i'm excited to be here and start construction as we've been starting construction for the last three weeks. the biggest thing for me
4:25 am
today is we're a year-and-a-half for 60 families for having brand new affordable hopes. something about that really excites me. i can't 'em , emphasize how much collaboration won't into this. we have a great group of speakers today, but i want to make a quick story about why this project is so special to me. i lived in san francisco for a long time, i went to school at san francisco state so i've been involved in this community for a very long time. being part of this project means a lot to me. i'd like to thank the mayor, his office, oci, the commissioners, the citizens, advisory committee, bank of america, david baker architects, kale contractors and every single consultant
4:26 am
in my development team. i want to thank bridgette for putting this event together on such short notice. this is a really good event. the one thing that fascinates me about real estate development is that it's one of the few industries that requires such a large amount of collaboration and team work. you can't find the industries that require this level of collaboration and i like to compare real estate development to team sports. i know you're probably tired of this comparison, but instead of doing a 45 minute lecture on how real estate development is a team sport, i want to compare my team to 2012 49ers. you could call me collin kapernick. i want to give a special thanks to pam simms.
4:27 am
[applause] i want to give a special thanks to shaman waldon. these are the people i've worked with the most and i'm sure they are very happy they don't have to hear from me every single day like they were for a long time. so i'm grateful for everybody. there's not enough time for me to thank everybody individually. i'm excited to get this completed and the families moved in. now we're to the good part of the program. i want to introduce a special guest. this man was my mayor for several years so i've had the opportunity to learn a lot about hip. he's a great mayor and dedicated to affordability housing in san francisco. i want to introduce mayor edwin lee. [applause]
4:28 am
thank you very much for that -- i like these construction hats. it means we're getting things done. morning! >> morning. >> welcome to the bay view, as always. this is a good time for the still. it's a good time to get together with friends. it's a good time to get together with community, to celebrate, but also, as always, to get road work done for our residents. i'm out here again, as i've said over and over again, i hate making new promises. phase one's about ole promises. i want to thank the commissioner for helping me keep that promise. this is the promise to build 60 units of 100% affording housing for this community. this is a great holiday story and -- [applause] yes, be proud of ourselves and of the city working together getting that done, and while
4:29 am
we're doing i want we're doing it the right way with good companies, good sub contractors, good people that utilize the talent of this community already. 30% of the work force is from bay view and 50% san francisco residents to help build this housing. not only is it a good goal that we look forward to opening in 2016, we're doing it in a fashion in which local residents get these jobs. it is all about the jobs. i can see that in the eyes of the gentlemen standing back there. you're not going barbecuing, you're working. this community is invaluable to our city and now as people get down here more and more often to take a look at the homes opening up here, the communities that we're building, the partnerships we have with entities like am
4:30 am
cal and ycd and the people working are going to feel more and more where has bay view been? where have i been to not recognize bay view and i think you'll see a huge surge of people who want to live here so those of you who own and rent here, hold on to your properties. make sure your do the right investments and take care of yourselves. when we do expand more and more attention to this area you'll find more and more people naturally inclined to live here. there was a promise you'd never been isolated from our city. residents do deserve to be hooked up, connected up, being part of the city and this has always been about one of the major reasons why i took up the challenge to become the mayor of this city and i will continue doing that for all our communities because this is what not only makes me feel good this is the right thing to do, carry out promises that have been made over many, many years and be
