get that to at the beginning but i know you been going to a lot of stuff so it's good to have you there. item number three report from the doctor and the staff. should have good evening again. i can use this one. i am super happy to report to you about a piece of legislation that i put the press release on your paper there from supervisor read that was introduced today. it basically what they're calling the first and the nose patient to birds are like the new legislations. it's a piece of legislation we been working on for a few months now. if something certainly that's been on our thoughts here for a very long time. it's finally something that turn from fear to action. i'm really pleased about it. something that again i didn't give you all the actual legislation. if you wanted am happy to e-mail you a copy. i do have some here but essentially what it does, it

requires like notification when folks move into residential properties. it requires more accurate sound testing a developer's who are building your [inaudible] entertainment. it enlarged heart creates a way in which this commission can get involved in a process of working and getting developers with permit holders together. so it's an interesting as we go through this we will learn a lot and will need your expertise especially as it relates to your neighbors and sounds when a developer comes to you and this what we envision and presents an early outline of a plan for residential within 300 feet of a place of entertainment that's been operating for 12 consecutive months, they will be presenting to you the plan and then how obviously is going to impact the entertainment

business that's there and how they intend to hopefully, we will have the venue here work with that then you might just like they work with other potential folks in and around the radius to make sure those two users can maintain and state vibrant and happy together. so, it's going to be really interesting and something that we, again worked on for a long time and i think will find surprisingly positive outcomes. i'm hopeful about. we have to be planning for our fund. this is a big part of that good we have to be getting in front of and not just being reactive to all of this crazy change that's happening here. so i think this is a really cool experiment and i'll put it that way. it literally -- and i know about probably every city that has the issues we do in this country

the work that i did hardly anything. it's gorgeous. take it home frame it. whatever you want. we did make any very many copies because we have been directed obviously to have this be a digital document, so we'll put it on our website. you can admire it that way as well. i see the last thing i want to mention to you was something they may have read about in the paper and didn't have a lot of information but it's a brick and mortar. so, between this meeting and the last one we were able to sit down with operators of brick-and-mortar after an incident that ended up with six people being shot after one of those shows outside of the venue. along with sf pd at mission station we had a long conversation directed by the commander, cmdr. redman and at this point i think there is an agreement between the operator and entertainment commission and

police to be much more mindful of looking certain kinds of shows definitely have longer-term communication around those shows with sf pd to ensure if they have concerns it's time to do something that booking in particular. and we did mention the need for cameras and i believe because the operator is also purchasing the building next door which is called woodward gardens. that he intends to put up [inaudible] from the end of that block all the way past brick-and-mortar. so, there was no request on the part of sf pd on the conditions at the moment, so we're hopeful that this is something that happened out of the ordinary and not a

pattern or anything. with that, i don't know. questions all candor over to my inspector with her sort of party being converted that night there was a local hip-hop artist performing from different neighborhoods. is the venue owner speaking to the promoter just about how >> yes absolutely. was an additional show scheduled in december that was similar and it has since been canceled on their own decision. that was their decision, not hours and didn't come from anyone but him. do i think process going forward how to more mindfully book that kind of show. >> but other than this one incident there hasn't been any previous incidences of violence, >> know there hasn't. there were few instances in the past where the police were informed and/or ended up finding out

about shows before they took place and again they're much more conscious of neighborhood disputes and things that might cause problems and were able to get in touch with the venue operator and then make some changes in or counsel shows in advance of. so maybe if they had some stuff off in the past but no there has not been anything like that >> thank you >> was the show particularly managed by the doe holder or was it another operator or promoter involved >> no. i mean i think what you're asking the operator was doing the same thing he was posted to. it was a promoter involved what was in a handoff could security was there. they just created a situation that should have been avoided by mixing, cutting, some folks that shouldn't have come together. i don't allow us to say that.

>> very careful. >> let's move on to the sound inspector reports which are [inaudible] >> good evening commissioners. i'm sorry i'm everywhere right now. i'll go over my report is only a few things that are important to mention. other than that all field questions on things i don't [inaudible] if you need to ask me about anything. the inspections about [inaudible] 685 setter. there was an incident that happened where there was just a lot of people in the street just general chaos. it became a point of contention. i happen to be there that night observing the security how they were managing their security and what i saw was basically revocable security guards but could have done a better job. the parking lot, we were able to resolve whether they had a

security guard or not and they don't have a security guard. not having a security guard which is not the venues as possibility it's the parking lot management responsibility -- is a very important thing that's causing a problem. because there's only so much that they can do on their side of the street running up and down the avenue. you know, there's nothing they can do without adding a lot more security guards so i think that's an issue. the parking needs a security guard. to to to hide dirt a minor security session some issues we went over with the basement, whatever. so, they do have a security guard. he was able and -- i mean i can [inaudible] with the police department they probably would be security plan may be another security guard. everything else looked fine. it

was fine. citation that i wrote a citation for mad dog [inaudible] i've been buying about five times i wrote him a notice, that violation for not having a billiards table permit and it's been about five months that i've been working on it. i got to a point where it's like well i should cite them. so i cited them. they did call in. they should be coming in to come into compliance. >> [inaudible] >> okay so there you have it. one minor thing, to address, the all-star café i wrote in my report that the venue is in compliance but after talking to kenny, they're not in compliance. there is a new ownership in the shop the donut shop café. they need to --

extended hours on it so they're not in combines and they need to come into combines and were working on having that happen. so that's basically the most important parts of our reports if you have any questions i'll answer them >> heavy talk to the permit officer about the parking lot situation because i cannot legislation, they let the operators go for a while so it's actually up to the sf pd to recommend that they should have security after a certain amount of incidents. >> i did talk to the permit officer. that's basically what we went over. if you feel like there's an issue and they need to add security then he'll work on it. i think at this point because the issues that are going on and what i'm saying to mike i think they need a security guard. >> talk to them again >> any other questions, thank you. >> good evening commissioners.

a few things to address. club malibu at 3395 mission, i been working with them on their sound issues and recently received another communication from a neighbor of theirs. i went by this past two fridays ago and had a long talk with them about ensuring they understand the limited [inaudible] permit most recently the [inaudible] permit and then followed up again on saturday. they are still struggling to keep things at 90. so i wrote them a citation for exceeding. the metronome ballroom on 1830 17th street, i went by there this past weekend to establish ambient sound levels. i like to work with

them pending approval of their permit to ensure that the neighborhood is not negatively impacted with event that they are hosting. last but not least, atmosphere at 447 broadway to mike this past weekend there was a fight inside the venue that their security team ejected those patrons. then the fight was broken up by sf pd. shortly after another fight occurred in the parking lot just down columbus from the venue and then i heard some gunshots. the following night saturday atmosphere was a multiagency presence. i don't have a whole lot of details about what happened that night but the agencies that were there did force the closure of the club for the evening. i'm sure if

out weekly read the narrative on 12 seven approximately 1:32 pm [inaudible] u i saw a large group of people in the physical altercation. on the sidewalk directly in front of the seller. i'm eagerly contacted dispatch dmi radio and asked for other units to come. i count i counted there by 11 responding units that came to help out with that. multiple physical files continue to break out [inaudible] exited the car [inaudible] estimated crowd to be about 500 people. the crowd was actually loud and rowdy upon exiting. [inaudible] overly intoxicated they could be seen followed him unable to walk on their own power. and even vomiting on the street and sidewalk. officers struggled to keep the crowd on the streets using verbal commands at approximately 1:57 am we were still present officers viewed a large physical fight in front of 650 which is just down the street with six pin eight males at approximate to 19 in the

morning officers were finally able to clear the streets all subjects. so, a little bit after 1:30 am from 1:32 am to 2:19 am it took quite a long time and a large allocation of officers. the sergeant that responded to the scene, he didn't notice of violation for the seller and a copy was sent to the seller and we are in correspondence as far as what they can do to improve at their club. i've been getting more and more calls and conversations with officers that have to respond every weekend to the club and so we're working with security as well as the club to see what we can do to stop having the [inaudible] to curb the violence. >> is something escalating their? because i know you've reported before and they're just kind of [inaudible] not

orderly but now you're talking no fights. >> we have been working with them but i've just seen were more lately where were having things. it's not just during the weekends. sometimes it's during the week. so we are trying to see where they are in their practices so how they can tweak it so we don't get this but yet there has been an increase in calls for service and fights at the club. >> do know if they change their management or their programming? >> their management, that's all the same. >> officers change order i'm just wondering what has changed because >> most or not most -- a lot of resources are allocated on broadway on the weekends. so we have those officers that are there. obviously he sought to patrol the rest of the district so we have the midnight officer that works in that zone there. he usually after 1:00 am he does a lot of passing calls. he's consistently been there a lot i would say the last few

months. so there's not really been a change there as well. as we said, we do see a lot of activity coming out of there and we would like it to be reduced. >> it was an aggravated assault >> i'm another? the seller fight. so, i thought we had discussed that there had been sort of programming change at the seller about a year or so ago. is that not -- >> on different nights they cater to different groups. sometimes it's college nights. it just depends on where it is as far as what groups they are bringing in. so, i've not seen really much of a difference as far as -- i just look at calls for service. i don't necessarily know tonight is this her night for this specific crowd. i just know when i read the port the next morning were the officers come up to me and say the mac it went out last night. we're

doing a lot of officers out there >> see you're not getting an advance notice of what nights they're doing or anything like that >> i don't think like -- it's not like it's a club that, okay, tonight would have his band come in or this dj that scored to bring in a large crowd. it's not really like that as far as some clubs that are going have a special bend the natives out of the ordinary is unabashed or resources. we are not seen the same things just sort of random. >> was an aggravated assault at kennedy's public which is a 1040 columbus. those on december 14 at about 9:30 pm. summary was [inaudible] outside the bathroom and was cold cock in the back of the head and knocked unconscious. a summary from the friday from december 12, this is the broadway summary that the sgt. wrote at

the end of the night. shortly after 1 am units in the area broadway began broadcasting on view physical fight. two people were kicked out of monroe because of the milk punch a bartender in the face goodwin security responded her boyfriend i tied them the staff did not wish to press charges. the male was arrested for drunk in public. when the fema was contained sheep don't abound is that i can't write she was yelling and screaming and crying and rolling around them enablers was called and she was released to the medics. the worst area was in front about his fear. as far as his people were exiting the club numbers fights were breaking out. it was far too many for security or police to handle. we were unable to detain anyone because there are so many fights. we just kept trying to break them up. when atmosphere let out there were hundreds of people who exited the club. this is really important. . there was an mta supervisor was inside the club that night

and he approached the sgt. and stated he was inside atmosphere when the fight broke out. he said, that there were numerous black males brandishing weapons inside the club. so, i went to her narrative and her statement to get a better explanation of that. this is in the narrative: on 12-13 1418 120 [inaudible] 500 block of broadway" in front of club atmosphere with numerous physical fights broke out at people were exiting the club. amir puccini identified himself as mta supervisor. he stated that he didn't is i the club when physical fights broke out. he told me a girl in a white dress was causing problems. weird numbers people saying they got arms but he saw a group of black males brandishing guns. at that point he turned and ran out of the club. that was placing them it was either club [inaudible]

when we have rumors we have a city employee that's able to say i saw this exactly gives us more credibility as to what happened. based on that, on the go to azores back to the summary: officers arrested an individual was fighting other pageants and kicked out of atmosphere. the subject resisted arrest and follow the police. officers went to the round with a suspect and finally able to place him in handcuffs. one officer's wrist left wrist was broken during the incident. the subject was extremely intoxicated. it was later learned the subject had a warrant and was on probation. so now we've had two officers injured that are on disability from incidents coming out of atmosphere. another one this a couple minutes later: within minutes of shots were fired on a 300 block of broadway. numerous officers were in the immediate area and a broadcast of vehicle suspect description had [inaudible] brochure. that was lost in
