7:00 am
to require the eminent domain sequa must be completed in order to move forward with a geobond project sequa has to be completed before that bond comes before you in placing the bond on the ballot we have to insure rights to the anticipated property so you see the logical compendium not having sequa or the eminent domain process which is legitimate i didn't so the court process that as availed to a public agency under the threat of eminent domain is the fair market value that is paid for by the city up to a certain amount and the negotiations can
7:01 am
continue if they fail to result in a reasonable supplement by either party the court can rule through a jury action so that's the process it's long it's complicated and it's just not a very good fit for a general obligation bond measure that has a few things in the wrong sequence for us. >> i understand the delays in the eminent domain process i see that thousands us off in the faurment it be. >> john gibner deputy city attorney to provide more detail after the city has it's appraisal and the owner does his appraisal the city has to make
7:02 am
an offer as the first, i think formal eminent domain process if that form offer does not result in a settlement it would be our awe operated value not there are the board of supervisors can precede with the eminent domain will have to adapt a resolution of public necessity by a 2/3rd's vote and that resolution will have to find a public use for the property and that it will serve the greatest public good and cause the least harm the city files a lawsuit and ultimately will decide whether this is an appropriate use of eminent domain and after a trial probably before a jury the jury will decide where our offer is reasonable just compensation in the jury decided we've low bald
7:03 am
and made an inu inappropriate offer we'll loss the eminent domain and have to pay the property owners attorney fees and costs a little bit more by way - in this situation it's a hard to predict how a jury will come out it's relating difficult in the last two years the city has negotiated a price point with the property owner i'm sure that will come into play. >> that's very helpful. >> mr. chairman and members of the committee as a followup to supervisor mar's inquirey regarding a renegotiation that is what the budget analyst office is suggesting option number 2 to continue the
7:04 am
proposed resolution and to create request fufbt negotiations we understand that this city has invested money in the purchase to purchase this property we understand that there is according to mr. updyke no other viable location that's understood but we don't understand the huge difference between the appraised value and the proposed purchase price we believe there is room to get some sort of saifrz as and point out if in our report even if you include the one property from the comparables there will be an $800000 savings and mr. updyke said it was a tough negotiation through was a death in the family we don't think that is relevant we think what was relevant the huge differences
7:05 am
between the appraised value and the purchase price. >> mr. updyke you want to comment? >> so mr. rose mentioned the appraisal happened in august of 2014 when was that appraisal done and inform our work as well. >> so, yes as part of the due diligence process i mentioned the city ordered an. >> a prevail tendered in august 2014 so we get a disparity between the purchase price so how do we reconcile that? this took months of negotiations to get to the number before you now i don't respectfully building that we're turning to ownership
7:06 am
will make a difference in anything it jeopardizes our option rights we have technically have expired due to the negotiations both parties realize is a negotiation to extend the negotiation rights 23i9s that's problematic in and of itself this is a lease with a purchase option lease payments are not recoverable through geobonds it's not a bond expensive that's an expense to get us to the privilege to acquiring which is geobond and the acquisition st. is funded throttle bond if we extend the negotiations and do not acquire and lease the property it is costing us $2,500 a day anti of
7:07 am
general fund and we've got it went crutch >> what did the source refunds out. >> at the end of january we'll have to look for other source of fund in order to continue to lease that. >> okay why not move into public comment anybody wish to comment on item 8? okay public comment is closed. colleagues any further discussion at this point >> let me just i'll make one comment i this is a tough one from high prospective i appreciate mr. roses analyze it is tough to shallow i've seen the recent
7:08 am
real estate and things get out of hand and i astronomical costs while the portfolios or whatever we're doing as a city we're in the market as well as everyone else and the general difference i want to show to our department so i agree with mr. roses analysis but i struggle i know what is market is out there we a run of risk of losing this property and i think that's a tough question i think that the geobond issue is real from my prospective but i'd like to hear my colleagues. >> i appreciate mr. updyke's and mr. rose pointing out that large disparity between the
7:09 am
appraisal and the price we're being asked to approve today, i lean towards option 2 continuing this for a are short time to allow the negotiations so that it gets closer to what mr. rose is suggesting even with about looking at the comparables my suggestion we move towards option two of continuing for a short time and requesting other negotiations. >> i say the word option as well. >> so i can do that as well, my preference is just to move forward so why not take a roll call vote and discuss that. >> make a motion. >> i'll move we continue those
7:10 am
recesses and request further negotiations and continue this to the call of the chair. >> okay motion by supervisor mar madam clerk can you. >> on that motion. >> supervisor mar supervisor avalos supervisor farrell no oar there are 2 i's and one no motion passes. >> okay. thank you colleagues madam clerk call items 9 and 10. >> reauthorized the city attorney to extend an grand parent from the office of traffic safety for the drug and prosecution program and amending to reflect one class 8177 terry position for october through 2015 and item 10 retroactive to
7:11 am
extend a grant from the u.s. department of justice for the prosecution strategies that effectively address and prevent prime and san francisco amendment ordinance to reflect the grant for the class 2015 budget analyst position to 2016. >> okay. thank you we have the city attorney's office here and i'm the policy and grants manager for the san francisco city attorney's office in records regarding to one we received the office of traffic save for colorful prosecution program the grant will have a team to prosecute driving impaired cases it is collaborative work with the
7:12 am
personnel throughout the city and county of san francisco not to exceed our did you want prosecution department under the influence remain the highest cases this will reduce the alcohol and drug injury and safety for residents and visitors in regards to item 10 smart prosecution was awarded and we received the federal bureau of justice grant this with two year grant that enhance the driven prosecution and strategies that prevent crime in san francisco this grant will garage or be able our officer for an outreach to place san francisco at the forefront of evidence a based prosecution and crime analyst as well technology support for our
7:13 am
efforts headings i'm happy to answer any questions you may have. that the supervisors may have. >> supervisors no budget analyst report anyone wish to comment on items 9 or 10 seeing none, public comment is closed thanks for being here colleagues, can i have a motion to move those forward we'll take that without objection. >> madam clerk call item 12 and back to 6. >> item 11 the resolution approving the lease amendments between the restaurant groups for the sxhoegs s f p america and the city and county of san francisco. >> okay. the lady is here from our airport. >> good morning members of the committee kathy with the san francisco international airport this was continued in order for
7:14 am
the airport tenants and fair employees to resolve the labor questions as well as for the airport to come back and explain our 10 year extension so i'll briefing recap that the airport a seeking our approval for the concession leases those are 10 year lease extensions for our terminal 3 that is cvs have been close the current lease language requires the airport offer replacement space as those loeshgsz locations were closed at our requests this space will be available is what's before you as part of the resolution the 10 year extensions were a replacement business deal identical to the original agreements that have now been
7:15 am
modified the tenants when we originally proposed in 2005 planned for 10 years to a.m.ries their costs for the existing spaces so the revenue staff went back that's how we came up with our 10 year extension today that will help a.m.ries the costs as well to cover the new costs they'll occupy once the project is over it's my understanding from airport staff that historically it's been the airports practice to try to keep construction and audition costs around 45 percent of our profit and loss statements this 10 year extension will allow them that the terminal to the student beverage and food modification were entered into and approved
7:16 am
by the board in 2011 that having had base terms so that is what i was able to find out to answer the question of how the airport came up with the 10 year lease extension i'm happy to answer any questions you may have. supervisor mar. >> i wanted to thank you for explaining that that process and also for working hard with john martin and our staff for negotiating with the 5 tenants but also for better treatment of the workers that are at the airport i appreciate during the difficult time of december as well thank you for everything ms. literally in her. >> colleagues other questions or comments mr. rose go to our report on item 11. >> yes. mr. chairman on page 5
7:17 am
the existing concessions will expire one-on-one with on term to - to each the 5 lazy we've extended for that 10 years to november 2015 when construction in terminal east is extend to 2025 8 years longer than the extensions no 2017 and ms. light in her said we've extended those for the amortization period for the airports practice to provide for the costs that equal no more than 4 percent of the annual sales which the airport requires in the amortization period of at
7:18 am
least 10 years our recommendations are on page 36 of our report first, we recommend the reason for retro activity for 2015 and amend the title on lines to delete the reference to plus one, two option and recommend the proposed resolution on pages two and three to change the urban advertised construction costs with the 0335 and 63395 and 21 through 667 with one hundred and 7898 for 23 thousand and 60 thousand with 52 thousand and 7 that dollars we consider approval the proposed resolution with the policy matter with the board it extends the lace terms
7:19 am
for 8 years without a plea of process, however, i'll state i believe that the airport exploration is not reasonable. >> thank you, mr. rose any questions for the the budget analyst report anyone wish to comment on this item. >> all right. seeing none, public comment is closed. >> colleagues, we have our budget analyst recommends can i have a motion to accept you'll the recommendations and the nicaragua item as amended we have a motion we'll take that without objection. and okay. thank you madam clerk can you go, to item 67. >> item 6 a hearing on the results the tenderloin public toilet program. >> okay. colleagues can we through hear this item i'm going to turn it over to you. >> thank you supervisor farrell
7:20 am
colleagues and members of the public i introduced you on this tenderloin pit stop an innovative totality program monitored by the public works in order to address the clear need for roommate facilities throughout the district i represent over the years i've been representing the tenderloin and the south of market it is one of the top concerns i here consistently about from our visitors and as a matter of law small business workers and workers the human feces and dog feces on the street it's been in the public eye with one e quote/unquote the human waste land that jennifer wang created we've benefit working with the department of public works since 2012 to come up with a pilot program that will offer a triple combination of portable sings
7:21 am
and receptacles i want to appreciate the work of the department of public works director mohammed nuru who has been really committed to this program and shepard it through the last couple of years there's a number of challenges we saw with public toilets and particularly in the downtown area and insuring the monitoring of its use as a bathroom the innovative program that has been implemented in the last 6 months as a pilot with 3, toilets in the tenderloin has been the subject of the hearing and the outcomes we want to hear from the department of public works the locations were selected based on the highest concentration of fooegz e feces in the right-of-way what makes
7:22 am
this successful that the tenderloin pit stops are staffed so to make sure the bathrooms are kept safe and clean and secure we already know based on the pilot the average use of the locations average average double the eye when the program started the feedback our office has received from residents and tourist and workers there is a real need for clean and safe public restrooms this has provided people with a dig if i did place this is significant the cleaning requests are from the report from the feces in the right-of-way prior to the pit stop the public works averaged 27 requests today down to 16
7:23 am
normal half the 15 gallons of water the city saved water today 2 thousand 6 hundred since accident program since the 14 weeks 2 hundred and 75 siernlz or syringes were left behind the original $150,000 there's was we near the end of the six months trial given the significant benefits we want to make sure we extend our expedition today the public works is here to present they're finding regard the pit stops and continuing and expanding a clean and safe toilet program across the city i want to thank everyone again at
7:24 am
public works for working so hard on the project especially sam dodge who is here and the project manager of the deputy director and salmon jack's and our public policy director and our colleague who made this possible and all the community groups for their advocacy and support making sure this is successful for all who were involved over the last two years i want to bring up sam dodge and rachel for the presentation thank you. >> all right. trying to get this thing going here all right. >> supervisors thank you very much for having us today
7:25 am
can you - i don't know? a great project it is rare we get to be involved when i was first signed to count the fees in the tenderloin and go block by block my first response was what did i do wrong but the good thing the community is focused on the issue of safe toilet assess for quite some. after 10 years of different it rationed and the geocodes had a was the issue for safe clean assess that would be moved in and out everyday the tenderloin pit stop - there you go
7:26 am
great this toilet assess program is called the tenderloin pit stop i don't know if i'm doing this right - making like the supervisor said it's monitored toilet with waste and needle disposal and dog waste packs the benefits of the program we found to be more than just - oh, okay. we found to be more than just the judge a safe place to use the toilet it's great for extended on the other hand, expended public safety and the sidewalks are more sanitary and our requests are down and provided a place for syringe disposal and doggy bags the amount of requests if the neighborhood were tremendous you
7:27 am
know disease and feces on the sidewalk there's been an outbreak of diseases and intervention is effective why? because we were looking at the data at the department of public works and the most previous we saw escalating place where it's accounting for 55 percent of the city's requests as we started to see it rising up we tried to hold overnight staff and bring in early daytime staff so see if we started out with a clean sidewalks that would reduce the need for service but we had more need so we started to do analysis of the street outreach to the community and talking
7:28 am
abouty visiting old plan and talking to the benefit district and the clean city people at st. anthony's have been thinking about this issue for a longshoreman we found ultimately the portable toilets one that had a little bit of water you can wash our hands and look like an airport bathroom but that's not the factor it was on site choices those are based on the analysis of what we are getting calls from and nosing feces and urine on the street people can see them tuesday through fridays and alice street and golden gate
7:29 am
at jones and hide street and turk this is as you can see the backside of the unit here as you can see there's also you know composing and rerecycling i can't emphasis in view of what it means to have strong community partners and sanitation storage is a tremendous partner they move the units in and out and get them into a topnotch condition and, of course, the city which is been staffing the locations and dog training program they take a lot of pride and create a sense of safety there are uniform persons out on the streets not a punishing presence you know some
7:30 am
of our initial fears were that drug dealers are going to somehow deal behind there there was a lot of concern from the police department how are we going to keep this safe will someone go crazy if the bathroom and lock themselves in and create a big disturbance none of that has come to pass if someone crazy happens we're going to press forward but nothing like that has happened it's between accident police and the staff as well so getting to the statistics as you can see rising usage each month breaking down by week and we have the needle
