10:30 am
what is the 90 dbes inside or outside. >> this is an llp the 90 decimals is the agreed upon limit between myself and the venue. >> so they were 2, 3, 4 excess of 90 days. >> yes. >> on the facing doors and windows and vents must be closed. >> this is actually something i've started to include 1, 2, 3 4 most find my recommendations in general a lot of the establishment we go to and test has captive vents and fans from kichdz or ventilation systems and it can provide quite a bit of leak. >> do you 0 you e did you
10:31 am
investigate whether the establishment has possibly no air vent because it is san francisco and a they can box the vents but to block them will you check into that. >> i will another question on the permit inspection that sound abatement is that a recommendation or an actual i don't know what to call it is it a recommendation hey here's what we think you should do rather than what we enforce. >> the verbiage a that's been used previously i've updated the form it could be reworked but something that needs to be done before the issuance of the permit. >> whether it's a permit inspection plan or i don't know what the word is.
10:32 am
>> sound abatement. >> sound abatement period and it's been called that as long as i can remember. >> i would not want this to be feeling lighter. >> the word recommendation will work and i have a question about metro dome was that record as a - i know we have one resident say they've noise i didn't so something happened you went out. >> we did a sound test and established when i thought at the time was a good level to make both the venue and the resident happy and sdutsdz it with the venue itself they were in inclines this night and said they will be purchasing a higher quality sound meter so anything i've gone to this
10:33 am
particular venue it's at the request of this resident and it seems like staff is changing pretty rapidly there there's a lack of communication going on. >> is that something you're going to go back to until. >> we go back until he claims again. >> this is on my regular route. >> okay. thank you. >> thank you. >> commissioner lee. >> do they have a limit or is this potential stuff. >> potential each of event has its own it is more difficult they're not abiding by the live entertainment past 10:00 p.m.
10:34 am
the sound issue is at this point some things they're not obey responsible about. >> okay. >> we'll keep watch you'll do that for us any other convicting inspector poly i didn't i have a couple of quick notes did an inspection on the fillmore auditorium we've been getting complaints will the venue about noise and something we've been working on for a while and before i came here cammy worked on i walked around the neighborhood and went into the venue we got a complaint via 3678 sanctioning a neighbor had a noise complaint i was there and witnessed i mean,
10:35 am
i didn't witness a violation any sound like outside i'm not saying that particular person didn't hear f that i - it was in the middle of the show when i have those there we got a complaint from about a venue on 16th street called ac c i went by to see if they had an inspection it's not our issue we received complaint if the supervisors office it is unresolved but not necessarily our issue so we'll fourth who what to do about that going forward a similar issues in nina's cafe about complaint about noise in the venue that's a restaurant but what we found is it is not
10:36 am
entertainment and that a lot of times what the noise that is happening after close of business so we forwarded to the police department to handle the only other issue in regards to the neighborhood around kelly's irish bar it's dark around there this is potentially a safety issue i'm going to talk to the venue about it is not just their issue those are the major things i've worked on in the last several weeks. >> i'll be happy to answer any questions questions. >> commissioners and. >> all right. let's open this up to public comment any public comment on item our staff any chort seeing public comment is closed item 5 police department
10:37 am
questions or comments and the floor is yours when you get here here. >> hello steve from central station relating quiet the last couple of weeks in the central district a couple of things at 546 geary about 220 in the morning after closing time they have extended hours an assault outside i mean out in front looking at the narrative it was a fast alteration regarding someone talking to somebody's girl friend it was smashed over a persons head an ambulance was called i was looking to see
10:38 am
based on the narrative it was not something that security jumped in it was a suddenly act of violence i was happy after assisting with the investigation i have no complaints there important next on the list is notice of violation monroe a 473 broadway this was with our morning life on saturdays and sunday on broadway there are two clubs that open the night club in the morning time this was when the officers responder at 902 in the morning on january 5th the officers saw a violation of gun control with noise going outside and cars double parked in the traffic
10:39 am
lane the officers respond as well as security there was a noise complaint at atmosphere 447 broadway on january 25th the atmosphere right now is not real active but on for special events so there was a noise complaint at 11:45 p.m. and next one a meeting with the people from the very well he will as well as the hotel across the alley we've been working a there's been improvements and we kind of drift back the general manager kanthd us at general station having to - i met with her as well as ore director of security and when i wanted to hear from their point of view what the issues were and we talked about the i can go
10:40 am
down through there are basically 6 smoking area on the sidewalk and alley way large cluster of 0 people the noise goes up so the recommendation to see if they can have the smokers move it out to stoelg street so the noise dissipates and not affect the hotel another observation that the hotel made the entrance to the club a large cluster of people and that have's caused the group to get loud so abstinence of the sidewalk so the guests will not be in an area and whatever security outside was checking applications rather than checking the lines so we asked them to check the lines as well
10:41 am
too much vehicular traffic in the alley so the traffic can go through there we talked about trying to courage people at the end of the night to go onto stockton street so the cabs you can pick up the person and go quicker out of the area and there was inadequate lighting on cam ton place this makes it harder for the quality of life area and the recommendation was to increase the lighting so i contacted karen flood of the union square business improvement district to see if we can improve the lighting in that area and the last one was the alleyways as well as being blocked with cardboard boxes and trash we want to clean up that area so
10:42 am
we're talking about when i brought this to the attention of the manager some of those things he's doing i said look it might be a hit-or-miss so he's going to work on that we spoke about maybe the hometown putting an awning that might cut down on the annoying noise up into the hotel rooms the hotel windows have sound proof but interests lineal other incidents there were two thefts at the ruby sky purse and cell and then another theft on monroe a $500 jacket any questions or comments. >> commissioners commissioner lee. >> yeah. on vessel i guess our talking about the lady that's the new manager at the hotel. >> she's been there are inform
10:43 am
years now. >> minimum at least over the last year. >> so i know when i was as vessel they still have the sign saying please respect our neighbors it wasn't there when i - and i know they had it up. >> this is way back. >> oh yeah. >> in our meetings this was not the first time we sat down with the parties there was improvement 1230r the signage up there. >> okay. >> other questions or comments i do appreciate that do not put all those issues an vessel talking about the cars going through the street seems like people are trying their best fingers can be pointed out at the one business but it's anothers city. >> whether the light there's a
10:44 am
couple of avenues we're trying to coma together. >> how did the business improvement district. >> when i spoke to karen flood she was definitely listening and says how we can go onto the next level. >> great, thank you. >> thank you is any public comment on item the police report seeing none, public comment is closed excuse me. >> we're going to move on to item 6 which is our permits. >> and i'm going to hand to deputy city attorney black stone. >> good afternoon commissioners so our first item on this guess a great stars theatre this is continued again because we are still working with the planning department to figure out this one so we took a voted on whether or not you will allow them to continue until our next meeting. >> sure. >> would someone like to make
10:45 am
that motion. >> can we continue to the to the call of the chair 80 since we don't know how point of order i think the applicant sent a request for continuance. >> it wasn't a specific timeframe but it's important to make that clear in the motion whether you move to dpo do exactly what we asked asked for or not i'm sure you're aware of there's a timeframe issue here so if it comes down from the applicant he's asking for a specific timeframe i mean we can honor that but i have to figure out what that means. >> so i move to continue the permit based on the applicants request. >> the applicant requested for the first meeting in march. >> march 3
10:46 am
there is a motion and a second no public comment. >> on that motion same house, same call? >> oh, wait i can't do that yet so commissioner frost. >> commissioner lee commissioner joseph commissioner moshoyannis commissioner perez commissioner tan. >> that motion passes. >> our second one raymond they have a permit 2 allows them to serve food on sunday's through thursday until 3:00 a.m. with the last meal at 2:30 and say on until 32:30 they've requested in our packet is to extend their hours of operation they would to be on weekend and week days and the last meal to be served as 5:00 a.m.
10:47 am
petting lawn station has submitted well submitted a denial for the permit they're requesting it there are a couple of things i'll tell you about their issue is the tax licensed on all our permits 2 will sigh you'll see in our packet the permit is not valid without a current tax license in this issue the situation the tax office had a couple of problems first of all the applicant doesn't pay any license foes for 2012 and 2013 those were delineate they went to the tax office but they didn't add the extend hours they've paid a huge bill in 2014 but our permit was not on there that was not the
10:48 am
fault of applicant that'll they've paid on their extend hours in january, i wanted to get that out of the way for the blame so having said that i want to bring up a critique and great, thank you. >> do you want to come on up. >> you want to speak on the one to our right that one. >> i own the restaurant. >> at 346 o farrell street and i'm here to apply for a permit formal more extended until 5 clock last meal. >> why to 5 you have it to 3 right now.
10:49 am
>> we have - okay go going back in a furious we recently basically trying to extend it for the reason when we started this extension of the business we were somewhat - we were mislead we had a loud place we were scheduled to the customers that were drunk like 1 o'clock they were coming in we catered it in a manner that was not sufficient to be honest with you it took a while to realize when i got myself into i took 3 steps back this year i've discontinued the music that is called the loud music distancing and this and that that's continued about 6 weeks
10:50 am
now i took that discussion because i'm trying to cater to the audience that comes if the xyz clubs but i was doing something wrong i was catering to the customer worship not spending anything at my restaurant i was getting a bad reputation it took me quite some years to years i executed the line at 12 we have a cue if somebody times to come into our place we serve only food they will pay and get seated otherwise you're not going to get into my restaurant we have two security guards it help us wonderful now we've
10:51 am
build a cue and people are very nice in san francisco i've had come across zero can't say 99 of the club has changed very nice people they come drunk and in a cue i've seen them go back to the corner and wait in the cue that's definitely a good choice because i want to carry out to someone that is at least stand goobl they need to come back in a half hour and if that half an hour 45 miles per hour a their sobered up now they can have a meal if a person is intoxicated they need help i want to be that facility that gives him something that was not necessarily we're a food place
10:52 am
and going to serve food and if there's a place called for microscopic we don't do that no longer we strictly serves food if someone needs help that's also part of my job once our in my store i take that serious so we have calmed the music one hundred and 45 people i'm telling my examiners look if you guys want to come to my restaurant you're going to get your order taken and if someone want to make froubl in my place that's not happening no free in my place we've having had zero cultural of trouble in my place to the cultural as changed along with me and if you guys permit it that will be nice and if, if you
10:53 am
would i would feel very, very happy. >> we have a few more questions commissioner joseph. >> so just staff this application this is his current application 2015. >> that's an amendment he always has the previous application i didn't put the whole thing. >> okay. i guess i have to ask you this is the one that was submitted in 2012. >> yeah. >> i get it in 2012 under item none 10 it says describes our plan to control the crowds on the sidewalk of streets he says there's no lines we're a restaurant we don't endorse the noise a that's 2, 3, 42012 and now i am assuming you enforce no
10:54 am
smoking on your line; is that correct. >> i request endorse no smoking we're endorsing 20 feet of our area we're 20. >> i don't know last time i received from the city is 20 so we do enforcement. >> can i sky a question you're a business owner and know what licenses you need to run our business how come you didn't pay tax. >> i've been very bad at reading the lawyer said please start reading so every time i went out to pay a fee i don't know until what kinds of things are listed into the business permit i've been only operating
10:55 am
the business licenses and some taxes are paid i don't know first of all i'm not involved in the permit process so i have no way to know until the city contacted me i took an action and i'm so sorry if i if but moving forward i found out i take care of and in some being attendant to the city i had started my business in 1997 on third and jones. >> i need you to answer the question you didn't pay our fees because you didn't know. >> my correct language would be i wasn't aware of such fees that i had to pull the permits because i've been in business for the last 9 years i didn't
10:56 am
have no one to tell me. >> when they sent you a renewal in the mail you don't read your mail. >> at this point, i think that ms. she had - and e lashed. >> he was built in 2010 and 2011 and he paid and then 2012 2013 he was billed and display pay any of the licenses and can be and paid those are licenses the extended licenses. >> i understood that he was receiving a renewal in the mail like all the people like we are for all our licenses and paid nothing you didn't pay it because you didn't read our mail or you didn't read well enough is that it. >> i didn't know it was supposed to be effective on this
10:57 am
form. >> they sent i something and i didn't understand it. >> so the two years you received it and paid for it how did you not do that the next two years. >> some point the officer i can't remember his name's an officer's came out to check if we have an avenue, however, permit i said we have permit and i - sins e.r. since i've not received what happened along the way that when those officers approached me for the hours the job part so i said okay. so i came to see ms. cammy i'm trying to remember. >> okay. i think we understand that the stipend hours permit you're here for doesn't show up on your original billow you went
10:58 am
to cammy we understand that but other builds for the tax collector you didn't pay we're trying to understand how well, you run your business whether there are an annual fees to pay to the city you haven't. >> in addition when you got our extended hours permit to 3:00 o'clock you were given a permit and paid a fee and had that permit correct and when the officers came to ask you to see your permit did i refuse to show them the permit? >> no, i didn't. >> you didn't so the officer that submitted this to us didn't he will tell the truth. >> in my point of view. >> not our point of view you did it or didn't you refused to show him. >> i have - >> when the city official asked
10:59 am
for your permit and i've not said that mime answer is i'm going to assist you because i'm going to get into the process of understanding why we're here - okay eject go if you were to go back a year back there was a person of the badge come twice and part of the files i made those myself once upon a time, there was an officer's with a badge said i is to check our employees i kind of doubted the guy i kind of doubted the guy if you can show me your badge and he took it back and put it into his pocket over here so i said okay. if i want to have a seat i'm busy right now right now right now i left the counter and
11:00 am
estimated outside. >> i'm sorry to truth of the matter you but my question simply was did the refuse to show the officer your permit. >> my answer is i did not say no. >> i didn't say no, but did you say yes and show him our permit. >> i was going to walk him he didn't want to walk. >> he thought asked to be seated and when i came back he was gone. >> he's talking about last year. >> i'm talking about recently. >> he's trying to get us over here. >> i have one more question and let you go you have security at our door and you have another security inside. >> one at the door
