item 7 d at one street a mandatory discretionary review is proechtd for continuance until mayor march 19 i have no speaker cards is there any comment on the items proposed for continuance seeing none, public comment is closed. >> item one ab and 3 to the dates indicated and item 17 to march 19. >> second. >> thank you, commissioner on that motion to continue items commissioner antonini commissioner johnson commissioner moore commissioner richards commissioner president wu and commissioner fong so moved, commissioners, that motion passes unanimously and zoning administrator. >> items 1 ab continued to next
8:04 pm
week as well thank you. >> thank you, commissioners that places you under our consent calendar i have one item item 5 c and e at 16310 through 39 oak street and conditional use authorization i understand that commissioner richards you wanted this pulled off content so we'll take this up on the regular calendar that places you under commissioner matters for the definite minutes for january 15th. >> public comment on the draft minutes seeing none, public comment is closed commissioner president wu move to approve draft minutes. >> second a. >> on that motion to adapt the
8:05 pm
minutes for this year. >> commissioner antonini commissioner johnson commissioner moore commissioner richards supervisor wu and wanting commissioner fong snoimentd that passes. >> first of all i noticed in the paper or yesterday what as an article about the chain gang building for the accountant on the buildings on fulsome street and also there's another one interesting designed by randy about two blocks away because those are part of the transbay and were part of the formerly agency now the successor agency it would be nice to have a presentation on those and other buildings that are coming going to be built and being approved for construction and in the
8:06 pm
transbay area so the public is also asking. >> yes. questions we don't know the answers until we see the construction that would be hopefully and i'd like to ask that we have some comments not necessary today on the problem of rincon hill there was a fraudulent situation that developed trying to understand i can understand a little bit about the creation of if i can tush agency that was the depository for fund for the developer but i never heard anything about the improvements so i would think we need to know about the process like who checks those things off and how it works if there are improvements we would think you have to see the improvements before you allow the money to be dispersed i'm not aware of
8:07 pm
improvements that happened to the project i noticed also in the same paper you were was the good news on transbay and in light of the opinion it seems as to the project sponsors who were opposed to the melrose district have decided not to pursue further action against that and that's extremely good news we all need transbay center to be there and downtown extension and in reality all the properties surrounding that value a greatly increased by the downtown extension so it's important we get as much funding as we can for this and feinstein there was an article in today is chronicle about the unat the end consequences of legislation regarding conversion of tics to
8:08 pm
condo that was passed unfortunately started out as a simple legislation and has a lot of things attached if anyone is evicted from a building in the past 10 years were not allowed to condo convert married can r gentlemen and middle-aged i think it's 3 united one of them got a job in australia and decided to rent the thing now unfortunately, the the renter do agree to leave except for a huge amount 6 money if they displace them against there will they'll not been able to take part in the condo conversion unfortunately, sometimes our policies end up having untended consequences this is why we video so many vacant units had
8:09 pm
they been for prudent forgot about it we put renter in there the consequences have come back to haunt them a lot of people are reticent to rent they know those laws are more and more on and on reduce to get to do what you want with our property in the past if you were moving back 0 our property obviously you could occupy it was not considered displacement but that's a little bit troubling and finally what's up with the garage there's hardly any parker i was lucky to get a place commissioner moore had to circle around but only valet it seems like they have a huge amount of parking i don't need an answer
8:10 pm
today with city hall and the courts it seems like we need as many patricia's as we can get thank you. >> commissioner johnson. >> thank you very much i don't have a lot of things but one item you recently asked the district court of cancel to dismiss the home.org and the city and county of san francisco and basically we were alleging that the new legislation for short-term rentals violated i vitals the commerce clause of constitution that i discriminating against non-residential san franciscans so people that come to san francisco don't live here and it is also discriminating against the commerce clause for the occupancy tax it is unlawful to
8:11 pm
say that an out of state company or resident hydrahas to pay occupancy tax in san francisco basically that was dismissed and i didn't think about that a week i was watching alumni beggar west and someone on the program basically agreed he didn't disagree when the host of the program said this rule basically says it is not a platform that is completely not the cased so i thought i would bring it to everything everyone's attention adapted by the board of supervisors to a allow for enforcement and provide a better snapshot of where listing are in san francisco so i thought i would highlight that no action necessarily this is a court
8:12 pm
decision and legislation stands as well so we'll see how things play out in the future i thought that was an interesting take the homeowners of bloomberg would take away that decision. >> commissioner richards. >> i have 4 things here excuse me. i'm fighting a cold last week in the examiner talking about stopping things i read he talks tongue in check brings up palo alto providing office space and san francisco has to have those workers housed and i understand from this article that someone sued the city for doing the same thing and it the something i know it's tongue in check when we have a review of
8:13 pm
meeting our housing mandate i'd love to see how the rest of the state is doing more serious i was in portland last weekend and read the paper in the mail it was talking about san francisco a paying money for housing they don't want and something it looks like we've been approving in fdr the people building the house 6 thousands square feet their rational why they want to build that they could have built a bigger envelope this is more tongue in check but of all places portland and third supervisor wiener it is going to introduce interim controls i want to make a comment that is coming and signal to folks on staff they'll
8:14 pm
need the assistance i know that mr. star is working on that so things behind the scenes the most important is the airbnb laws it's great but when i understand people have gone through the process or scheduled to go through the process is the number of rentals in the high thousand dollars we shall starting from a big deficit point of view on enforcement so how with are we're going to make the 8 or 7 or 6 thousand folks to register with it is staff we'll have a bunch of discussions thank you. >> commissioner moore. >> on the lighter note for the airbnbers who are looking for airbnb there iso a new port called can i stay with you while
8:15 pm
i rent my places on airbnb in the not a joke he read it in the foreign paper it is already used in jamming and florida and new york i thought was a good joke. >> any additional comments okay. next item please. commissioners item 8 commissioners rules and regulations this is a consideration of amendments and possible adapt on your meeting of january 8th you initiated a confidence about amending our rules and regulations to continue to this date commissioner richards made a great suggestion of adapting the executive summary noted the way it is and it would be
8:16 pm
and so the proposed modifications essentially would not change when submittal deadlines for commission packets are required but they modification required the submittals to be provided to the office of commission affairs and the planner it makes a distinction between the packets we're not outsourcing the restriction of our case reports that required advance submittals for the sponsor and opposition is a case of the report, however, we continue to hold the same deadline as we currently have 8 days in advance to be port part of the commission packet and created online a new link to be packets for those submittals that are not included in the case report and links or hyper links for our electronic agenda to be provided to you the commissioners and the members of
8:17 pm
the public for those pdrs submittals we receive after case reports have been finalized only other modifications commissioners we'll proposing at this point for you're hearing procedures to basically accurately reflect the practices of the commission taking public comment smith their cards and taking the opponents and proponents seconds the procedures call for now to eliminate any type of review that's my short presentation. >> commissioner moore. >> i believe that you're sending back and making the clarity is really good, i. wondering to direct my question to president fong i think this commission was going to form a
8:18 pm
subcommittee to discuss the commission in a broader context i hope excludes the told them of a article 1, etc. and there are things i disagree with and if we only ask to speak about the first 3 pages in our document i'm comfortable with the changes you've made. >> commissioner antonini. >> yeah. i would have to know specifically what commissioner moore's talking about regarding that particular part but i think the changes that are being made in the existing are very clear and fairly simple as was pointed out by mr. ion it basically doesn't change the rules except when our taking advantage of the retro to mail an outside service
8:19 pm
requires to be submittals earlier for all parties the second part obviously is on the second page page bringing into conformity in the order of the submittals in the case of except drs and people in favor of drs and people in favor and ceo's and outlet projects bring into conformity i'd like to get those approved today but i'm not against further consideration of those part of them commissioner moore has brought up as some that future date we can come back with the possible restriction in the latter year. >> only the last 2 pages commissioner antonini if i may only 8 dot submittals the last
8:20 pm
few pages eye i have issues as the departments flaking itself >> commissioner richards i'm going to turn in my clarity i think page 13 are well done i appreciate what you've done and hope the other changes we're proposing wrap around i move to approve pages 1, 2, 3 of those rules congressman's. >> second. >> >> second. >> okay. so just to be clear and i appreciate mr. ions work in getting this portion am i hearing a desire for the subcommittee to go further and i appreciate those who are interested and i think
8:21 pm
commissioner moore has volunteered to chair that commissioner richards has agreed and commissioner johnson has agreed as well, of course all the other commissioners will have the finally say but welcome our recommendations. >> great. >> the city attorney wants to say something. >> i also wanted clarity on the motion you said for pages 1, 2, 3 the changes are old in our exclusive summary. >> commissioner moore did i hear a second. >> yes. second and commissioner antonini and we're booifk the first 3 pages today and the others will retain and we're work with the existing changes and the appendix section. >> mined it excludes all the amendments today only the
8:22 pm
formation of a committee to discuss the rules and regulations. >> that's fine to me. >> we're not approving the red in outline changes and submittal and procedures in submittal a as under b details this is not in here. >> that is part of the reason why i'm holding this latin last part of our approval today and that's the motion as i understand it the red outlines are or not included in the exclusive summary. >> they are. >> i'll support that. >> commissioner president wu. >> i think there's an an agreement some of the changes outlined in the summary is acceptable but i'm not convinced we have to send them off today to approve them we can go into
8:23 pm
the committee with the understanding there are changes that the committee is acceptable with and package it or there or are there other changes that need to be made new now. >> to be honest commissioner no one are you are talking about their clarity for the public on when and how to summit things and the comments to be taken. >> that being the case maybe withdraw but to be clear for the public the rules that are in effect are working and have been working to withdraw that motion today for the subcommittee spends quality time and come back with the total - >> commissioner johnson. >> i'll make a motion to not approve the changes to our
8:24 pm
currently rules and not continue on with our rules always currently written can we make a motion. >> commissioner it sound likes there's a desire to form the committee maybe we can form the committee today and set a future meeting at our prior regular hearing and then have the committee members start discussing. >> so i'll withdraw. >> do you need formation. >> today, you'll appoint committee members and they'll meet and the first action to elect the chair. >> so commissioner moore i believe is showing an interest in leading that and commissioner johnson and commissioner richards. >> okay commissioners it would you like to propose a date and i would to get an genocide from the subcommittee the members
8:25 pm
what a month or two months how long to resolve this? >> commissioner johnson. >> i think to our question do you mean the first date let's do it next thursday. >> it will have to be noticed. >> by 72 hours so potential hold a hearing next february 12th if i guys are ready to go. >> one second. >> while she's checking they are calendar commissioner antonini. >> yeah. i wanted to see this is an item on the agenda we should continue to a date i mean, if it's not ready by the date we can continue it further. >> i agree. >> i'll suggest sometime in mid to late march or early april do you have a date and march 18 is
8:26 pm
light. >> move to continue the approval of the rules and regulations as revised to march 19 you'd like to meet sooner. >> i think our group can start meeting next week and we can then give absolutely absolute definite actions to the issues they could be easily resolve work but to the respect of the subcommittee that hadn't talked to each other of each other to do is as quickly as possible 2 to 6 weeks at the max. >> commissioner wu. >> the first question when is the meeting of subcommittee and the second question when we should continue to the date that is enforced we could do a
8:27 pm
continuance today knowing we'll calendar it again or we can set a date 6 weeks awe out and if it needs to be set again we. >> commissioner johnson. >> yeah. thank you very much i would because commissioner mendoza-mcdonnell motion was not seconded can i make another motion and put another date out there and committee will meet starting next thursday. >> so so i make a motion to continue this item to april. >> 16. >> 16. >> second. >> second. >> commissioner moore. >> that's fine. >> okay. >> investigated commissioners on that motion to continue recognition to april 16th and to hold the first committee meeting on february 12th arrest commissioner antonini. >> commissioner johnson commissioner moore
8:28 pm
commissioner richards commissioner rue u wu and commissioner fong so moved, commissioners, that motion passes unanimously that places you under commissioners announcement. >> a couple of meetings on our public realm on ocean avenue 6:30 next wednesday the february 11th from 6:30 to 8:00 p.m. at the high school on the ocean avenue realm improvement plan and the also the final on house on argument that is february 5th at the park rather than library on hate street secondly i wanted to in response to commissioner antonini's response to a hearing on the transbay projects that
8:29 pm
came up in mission bay so i've been talking to ocii the successor agency about the organization of a hearing on each the project areas and give you an update in both transbay and mission bay perhaps different dates but a lot of things happening this is a good time to get an update and get that on the calendar as quickly as possible. >> thank you commissioners item 10 review of past events with the board of supervisors and the reservation commission. >> good afternoon aaron starr that is a report for january 26th to the 30th and february 2nd to the six-hundred at last week's land use meeting we had the shelter and this was the interim controls for the housing this commission heard
8:30 pm
this item on december 18th and voted unanimously to recommend approval the ludicrously was unanimously recommended to the full board and the article 2 as you recall on definitions creates interim control for the rfp districts it is a phase one at the land use commission supervisor wiener spoke to the consistency and making it easier for use for everyone there was minor technical amount of time and one person from the audience voted in favor and next on the agenda the ushlth accumulation for the dr zoning administrator to accommodate the needs of person with disability it was heard and voted unanimously for approval at the land use hearing
