sure if you fill out the cards and say who you are and what our speaking about and thank you to the sfgovtv and 3 to 4 services for broadcasting this out to the public every time we meet thank you very much so we'll move on and start with roman numeral. >> commissioner frost commissioner lee commissioner lee commissioner perez commissioner tan we have a quorum. >> great the first item we don't need to do. >> no. >> it's the selection of the presiding officer we will move on to item 2 public comment, public comment for any issues that pardon to the entertainment commission that is not agenda
12:02 pm
disanyone want to comment seeing none, public comment is closed we'll move own to the approval of minutes of january 6th and january 20th. >> i move to decide indicate the minutes. >> a that's fair since we were not to each the meeting is there a second. >> shall we vote on it commissioner perez commissioner moshoyannis commissioner joseph commissioner lee commissioner tan i so let's start with january 6th happy to entertain a motion. >> move to approve the minutes of january 6th. >> january 6th sorry what do i say february. >> motion the second.
12:03 pm
>> any public comment on item our january 6th minutes don't see any let's take a vote. >> i think i'll run down the list commissioner perez commissioner moshoyannis abstain commissioner joseph commissioner lee commissioner frost commissioner tan abstain but the motion does pass let's move on to january 20th. >> make a motion we accept the minutes. >> is there a second. >> second. >> additions, deletions, or changes or public comment any public comment on this? all right. let's take a vote >> commissioner frost commissioner lee commissioner joseph abstain commissioner moshoyannis commissioner perez commissioner tan. >> that motion passes and the
12:04 pm
minutes are approved great job crystal on to item had the report from the executive director and our staff. >> thank you. good evening i did not write a memo there's not much to update just a few dates important for the most part if you're interested if attending any of the meetings related to legislation you should put those things down the last night early morning hearing date what i'm the hearing of the board of supervisors is february 23rd i'm pretty much i know that benefit is there there it's land use committee and i've sent an e-mail specifically so you guys have an note in our calendar that's not
12:05 pm
likely to change we'll be month to month at a task force for the last time tomorrow and reviewing the final report draft weeping we'll be presenting to the board of supervisors that's what time is that do you know. >> i'm sorry, i think it is a 1 o'clock but i'll send everybody an e-mail when we obviously get an agenda that's the safety bet at this point i'm sure you're aware of things as the board moves around i hope it sticks it hadn't move for a few weeks now i'll send you guys confirmation the other important date the rules committee to fill a vacant commission seat that you have up there and at the moment is february 12th that hearing date is said we could move around and it is not
12:06 pm
necessarily a place for the commissioner to show up night life they want to come on behalf of applicant if you do intend to as many that i know we do worry about quorum issues but just so you're aware february 12th is a date for rules it takes one hearing and leafs committee and needs to leave the board in theory we should if we do a swearing in quicken someone is seated by the next meeting that we're having is march third keep our fingers crossed on that. >> i did write here that we intend to have the publication of the economic study and outdoor event implemented and out by late february but i'm not entirely hopeful that schedule
12:07 pm
will stay on track and again, this is something we rush really you know very hard to help the controller's office complete in terms of data collection and then it went into a black hole i know that commissioner moshoyannis is very eager as i am to get it out of the controller's office so all i can do is say over and over someone help me to fought why it's not coming out and then the last thing is we handed out a blank questionnaire that looks like the questionnaire is in fact a revised version we cammy worked on it this week or really late like i don't want to discuss it
12:08 pm
i want you guys to take it home for homework it is an important piece of what you guys use as a tool especially someone that is not familiar with we we intend to do we use the bare bones we received 12 years ago from do police department we've changed it over the years and i think the most recent attempt to change if based on with the commission is doing but we might have missed it there are no rules you shape it; however you want to obviously it needs to remain a public document so you want to not ask too many really super personal questions question we have to redact but a business model if you guys do me
12:09 pm
a favor and make it up and send it back or hand it back that's the best way for us to figure out how to incorporate our comments and certainly discuss it next time we're together whatever you feel is appropriate. >> this is just the send hours. >> wherever we think fairly useful and robust application again any of the forms can be redone that's the biggest piece of the puzzle unless you have to ask about the relevant things you care about so take it home it's fun homework for you unless there's questions i'm sorry to hand to off to my colleague. >> nope.
12:10 pm
>> no questions. >> thank you, director cane and good evening, commissioners keeping with our new tradition of pga on the documents we create during the week and weekend i've included a certification form object the second page the packet gives a run down of the violations that occurred and time associated finances for an incident this past weekend and then the document i've promised you the past couple of meetings a recommendation for the sound abatement on the third page an example of one of the recent ones it's approved or disapproved and any recommendations for the people to abide by as far as sound goes as far as general notes we had
12:11 pm
one new complaint on hawthorne i went and spoke with the management there and did a little bit of investigation ongoing as far as i witness there was no violation but i'm going to stay on top 6 that and make sure we have direct communication between the residents of the nearby hotel and the venue itself. >> commissioner joseph. >> hi you can call me audrey on the administration certification did you mean 12:00 a.m. it's 12 noon. >> this was issued today. >> at noon. >> after the fact yes and what is the 90 dbes inside or outside. >> this is an llp the 90
12:12 pm
decimals is the agreed upon limit between myself and the venue. >> so they were 2, 3, 4 excess of 90 days. >> yes. >> on the facing doors and windows and vents must be closed. >> this is actually something i've started to include 1, 2, 3 4 most find my recommendations in general a lot of the establishment we go to and test has captive vents and fans from kichdz or ventilation systems and it can provide quite a bit of leak. >> do you 0 you e did you investigate whether the establishment has possibly no air vent because it is san
12:13 pm
francisco and a they can box the vents but to block them will you check into that. >> i will another question on the permit inspection that sound abatement is that a recommendation or an actual i don't know what to call it is it a recommendation hey here's what we think you should do rather than what we enforce. >> the verbiage a that's been used previously i've updated the form it could be reworked but something that needs to be done before the issuance of the permit. >> whether it's a permit inspection plan or i don't know what the word is. >> sound abatement. >> sound abatement period and it's been called that as long as i can remember. >> i would not want this to be
12:14 pm
feeling lighter. >> the word recommendation will work and i have a question about metro dome was that record as a - i know we have one resident say they've noise i didn't so something happened you went out. >> we did a sound test and established when i thought at the time was a good level to make both the venue and the resident happy and sdutsdz it with the venue itself they were in inclines this night and said they will be purchasing a higher quality sound meter so anything i've gone to this particular venue it's at the request of this resident and it
12:15 pm
seems like staff is changing pretty rapidly there there's a lack of communication going on. >> is that something you're going to go back to until. >> we go back until he claims again. >> this is on my regular route. >> okay. thank you. >> thank you. >> commissioner lee. >> do they have a limit or is this potential stuff. >> potential each of event has its own it is more difficult they're not abiding by the live entertainment past 10:00 p.m. the sound issue is at this point some things they're not obey
12:16 pm
responsible about. >> okay. >> we'll keep watch you'll do that for us any other convicting inspector poly i didn't i have a couple of quick notes did an inspection on the fillmore auditorium we've been getting complaints will the venue about noise and something we've been working on for a while and before i came here cammy worked on i walked around the neighborhood and went into the venue we got a complaint via 3678 sanctioning a neighbor had a noise complaint i was there and witnessed i mean, i didn't witness a violation any sound like outside i'm not saying that particular person
12:17 pm
didn't hear f that i - it was in the middle of the show when i have those there we got a complaint from about a venue on 16th street called ac c i went by to see if they had an inspection it's not our issue we received complaint if the supervisors office it is unresolved but not necessarily our issue so we'll fourth who what to do about that going forward a similar issues in nina's cafe about complaint about noise in the venue that's a restaurant but what we found is it is not entertainment and that a lot of times what the noise that is happening after close of
12:18 pm
business so we forwarded to the police department to handle the only other issue in regards to the neighborhood around kelly's irish bar it's dark around there this is potentially a safety issue i'm going to talk to the venue about it is not just their issue those are the major things i've worked on in the last several weeks. >> i'll be happy to answer any questions questions. >> commissioners and. >> all right. let's open this up to public comment any public comment on item our staff any chort seeing public comment is closed item 5 police department questions or comments and the floor is yours when you get here
12:19 pm
here. >> hello steve from central station relating quiet the last couple of weeks in the central district a couple of things at 546 geary about 220 in the morning after closing time they have extended hours an assault outside i mean out in front looking at the narrative it was a fast alteration regarding someone talking to somebody's girl friend it was smashed over a persons head an ambulance was called i was looking to see based on the narrative it was not something that security jumped in it was a suddenly act
12:20 pm
of violence i was happy after assisting with the investigation i have no complaints there important next on the list is notice of violation monroe a 473 broadway this was with our morning life on saturdays and sunday on broadway there are two clubs that open the night club in the morning time this was when the officers responder at 902 in the morning on january 5th the officers saw a violation of gun control with noise going outside and cars double parked in the traffic lane the officers respond as well as security there was a noise complaint at
12:21 pm
atmosphere 447 broadway on january 25th the atmosphere right now is not real active but on for special events so there was a noise complaint at 11:45 p.m. and next one a meeting with the people from the very well he will as well as the hotel across the alley we've been working a there's been improvements and we kind of drift back the general manager kanthd us at general station having to - i met with her as well as ore director of security and when i wanted to hear from their point of view what the issues were and we talked about the i can go down through there are basically 6 smoking area on the sidewalk
12:22 pm
and alley way large cluster of 0 people the noise goes up so the recommendation to see if they can have the smokers move it out to stoelg street so the noise dissipates and not affect the hotel another observation that the hotel made the entrance to the club a large cluster of people and that have's caused the group to get loud so abstinence of the sidewalk so the guests will not be in an area and whatever security outside was checking applications rather than checking the lines so we asked them to check the lines as well too much vehicular traffic in the alley so the traffic can go
12:23 pm
through there we talked about trying to courage people at the end of the night to go onto stockton street so the cabs you can pick up the person a quicker out of the area and there was inadequate lighting on cam ton place this makes it harder for the quality of life area and the recommendation was to increase the lighting so i contacted karen flood of the union square business improvement district to see if we can improve the lighting in that area and the last one was the alleyways as well as being blocked with cardboard boxes and trash we want to clean up that area so we're talking about when i brought this to the attention of the manager some of
12:24 pm
those things he's doing i said look it might be a hit-or-miss so he's going to work on that we spoke about maybe the hometown putting an awning that might cut down on the annoying noise up into the hotel rooms the hotel windows have sound proof but interests lineal other incidents there were two thefts at the ruby sky purse and cell and then another theft on monroe a $500 jacket any questions or comments. >> commissioners commissioner lee. >> yeah. on vessel i guess our talking about the lady that's the new manager at the hotel. >> she's been there are inform years now. >> minimum at least over the last year. >> so i know when i was as
12:25 pm
vessel they still have the sign saying please respect our neighbors it wasn't there when i - and i know they had it up. >> this is way back. >> oh yeah. >> in our meetings this was not the first time we sat down with the parties there was improvement 1230r the signage up there. >> okay. >> other questions or comments i do appreciate that do not put all those issues an vessel talking about the cars going through the street seems like people are trying their best fingers can be pointed out at the one business but it's anothers city. >> whether the light there's a couple of avenues we're trying to coma together. >> how did the business improvement district. >> when i spoke to karen flood
12:26 pm
she was definitely listening and says how we can go onto the next level. >> great, thank you. >> thank you is any public comment on item the police report seeing none, public comment is closed excuse me. >> we're going to moveem 6 which is our permits. >> and i'm going to hand to deputy city attorney black stone. >> good afternoon commissioners so our first item on this guess a great stars theatre this is continued again because we are still working with the planning department to figure out this one so we took a voted on whether or not you will allow them to continue until our next meeting. >> sure. >> would someone like to make that motion. >> can we continue to the to the call of the chair 80 since we don't know how point of order
12:27 pm
i think the applicant sent a request for continuance. >> it wasn't a specific timeframe but it's important to make that clear in the motion whether you move to dpo do exactly what we asked asked for or not i'm sure you're aware of there's a timeframe issue here so if it comes down from the applicant he's asking for a specific timeframe i mean we can honor that but i have to figure out what that means. >> so i move to continue the permit based on the applicants request. >> the applicant requested for the first meeting in march. >> march 3 there is a motion and a second no public comment. >> on that motion same house, same call? >> oh, wait i can't do that yet
12:28 pm
so commissioner frost. >> commissioner lee commissioner joseph commissioner moshoyannis commissioner perez commissioner tan. >> that motion passes. >> our second one raymond they have a permit 2 allows them to serve food on sunday's through thursday until 3:00 a.m. with the last meal at 2:30 and say on until 32:30 they've requested in our packet is to extend their hours of operation they would to be on weekend and week days and the last meal to be served as 5:00 a.m. petting lawn station has submitted well submitted a denial for the permit they're requesting it there are a couple of things i'll tell you about
12:29 pm
their issue is the tax licensed on all our permits 2 will sigh you'll see in our packet the permit is not valid without a current tax license in this issue the situation the tax office had a couple of problems first of all the applicant doesn't pay any license foes for 2012 and 2013 those were delineate they went to the tax office but they didn't add the extend hours they've paid a huge bill in 2014 but our permit was not on there that was not the fault of applicant that'll they've paid on their extend hours in january, i wanted to get that out of the way for the
12:30 pm
blame so having said that i want to bring up a critique and great, thank you. >> do you want to come on up. >> you want to speak on the one to our right that one. >> i own the restaurant. >> at 346 o farrell street and i'm here to apply for a permit formal more extended until 5 clock last meal. >> why to 5 you have it to 3 right now. >> we have - okay go going back in a furious we recently
