. >> you're welcome sir. >> any other comments or questions from the commission? >> commissioner hwang? >> i'm wondering if there's kind of like a way to answer simply what's a day in the life of a jttf officer sounds like they are not out there visiting or participating in active interviews with inform ants with the fbi so is it more of an intelligence gathering -- are they mostly working in the office responding to tips and assessing sort of threats to public events i'm wondering if you could just say what's a day in the life look like? >> it's a it's a compilation of all of the i of the things you mentioned commissioner.

following up on potential tips to determine whether there is in fact some sort of credibility to that information . >> do they act primarily on their own or do they act at your direction? >> we are in constant contact with each other. . we review cases on on a regular basis. i review their cases on a quarterly basises as well to ensure compliance with policies and procedures. pretty much on a on a daily basis. >> thank you very much. >> yeah you know what lies underneath this ordinance is a sense of assurance of the ways

the sfpd officers are comporting themselves and so it's good to hear that constantly reflecting that the fbi is clear on that i appreciate the chief reaching out to the fbi. my sense from your presentation is the scope of information you shared with us is actually beyond what was required by the ordinance but the department is looking at the questions that the community still has; is that accurate? >> that's accurate. >> i'm grateful for that i think it's really important that's there's transparency. there's a lot of detail there but what's what's underneath it is getting questions answered that can be and making sure we're conducting ourselves as we say we are thank you for that. there might be public comment at the end of this item after the chief's report. >> okay thank you. >> finally the presentation of

the 4th quarter 2014 fire arm discharge review board findings and shooting investigative summary. >> good evening sergeant. >> good evening chief. >> has it been a quarter since we saw you last? >> actually that's a that's a great question. >> commissioners director and chief. i'm here to present the quarterly report and officer involved shootings. the reason it seems like it's so recent is

because we delayed the last presentation because of the holidays so there's a delay and i'll get through it in a minute but the next scheduled is march march 31st and the holidays created a little bump in the schedule. >> got it. it's still good to see you thank you. >> met on january 2015 and we released 6 investigations there were 2 oid's id's 00614 and 00714 and 12-001 and 004 as well as 13-001 and 002 and the board was chaired by deputy chief barino of the administrative bureau and deputy chief was sitting in as the acting special operations

bureau chief and our advise er members director hicks captain from the training division and i'll go over the cases that were presented briefly. the first was the discharge. that occurred september september 7th, 2014, at northern station and in this incident an officer accidental discharged his weapon while loading it up for the start of the shift and no one was hit and that was found not in policy. >> the other discharge we reviewed was 00714 occurred on november, 2014 and in 2014 and in that instance two officers approached by a citizen reporting an auto burglary in progress the

officers responded to the location saw a vehicle matched the description 3 suspects there the officers attempted to detain when the officers had the detainees show their hands, a pit bull dog was released charged one of the officers he retreated fired his weapon missed the dog the dog sprinted off and that was found in in policy. >> going onto the officer involved shootings that were reviewed 12-001 occurred may may 10th, 2012, that occurred. officers. attempting to locate a person of interest in a homicide investigation that subject was un expected ly encountered and he opened fire

on the officers. the officers retreated setup a perimeter the suspect released tear gas set fire to the building and continued to fire and all first responding public safety folks including fire. two officers in the course of the encounter it was a standoff that lasted a while 2 different officers fired one round each the second officer fired hit the suspect may the mortal y wounding him that was found in policy. >>. >> on this occasion there was a person armed with a gun the officer saw a person the call was a couple of addresses away they saw somebody match the description coming out they

attempted to detain them the suspect ran from the officers. the officers pursued them. injuring the suspect the suspect taken in custody and the weapon recovered and that was found in policy. >> 2013 there was a report of a stolen vehicle approaching the tenderloin station several officers exited the station and set themselves up on the sidewalk taking cover behind some vehicles there was at that time a choke point right around the station and they expected the vehicle to to become stuck in traffic where they could where it's a very narrow

sidewalk and it was a large vehicle. a recruit officer found himself stuck between on the sidewalk as he retreated found himself stuck between the on the narrow sidewalk between the trees that line the sidewalk and the vehicle he fired at the driver -- at the driver of the vehicle missing him the vehicle continued on and was involved in a collision a few blocks later and the suspect was taken in custody and he was not hit that was found in policy. >> the 4th shooting that was reviewed was on the unit block of george court it occurred on on march on march fifth 20134 officers assigned to bayview's housing unit saw a vehicle that matched a -- on the look out that was reported ly involved

had been taken in a carjacking and possibly linked to some armed robberies. a pursuit ensued led the officers to george court the vehicle stopped the officers exited their vehicle. the suspect vehicle backed up at that point struck one of the officers two officers fired in defense of that officer and struck the driver. he was injured and taken in custody and his weapon was recovered and that was determined to be in policy. >> and as i said the next firearm discharge review board is tentative ly scheduled for march 21, 2015, and we'll go over the open ois investigations at this time. i believe you got the reports that i distributed. right now

there's 21 open ois cases that includes the 4 that were presented so that that includes those. so the the 4 cases presented to the presented are being finalized now and summary letters you will be receiving. there was one criminal investigation was completed. we received the da's charging decision letter and that will be presented to the next firearm discharge review board and excuse me -- homicide criminal investigation report was completeded and 2 charging decision letters have been received recently. >> can you attach numbers to those? >> one criminal investigation. >> which one is it? >> i'm sorry. i have it on the next slide i'm just trying to give you the overview sorry. >> 2 charging decision letters

we have 8 cases currently under review with the district attorney and since the last time i talked to you 6 new cases have been opened. in in reviewing these cases of the 3 remaining from those 2012 two were reviewed and one is -- that's the one that we have the homicide report for so that will be that will be at the next fdrb and 2013 cases there were one is already closed. you will recall that one, so that's not on this list of the remaining two have been were reviewed and of the remaining we have charging decision letters for for two of them and we're waiting for charging

decisions on the rest of those cases from from the district attorney. >> of the cases from 2014, there are 8 and 1, 2 and 3 are also in review with the district the district attorney's office and the remaining cases and on your report in the overhead here you have the specific dates and the pieces that happened those have been opened and presentations occurred and a number of steps are listed on each specific slide that is the same case for 15-1 and 15-2 the most recent that you actually heard so -- >> that's a lot of information so. >> i know with the commission

our intention are the cases that have not been presented to the da and upon presentation to the da there to the da there will be a preliminary convening and then once the decision from the da is final, we'll have a final fdrb convening. >> i think there's a couple of things that have come up a few times which is you know we're looking at the cases by year that were presented to the review board which is the final step in the process to determine whether something was in policy and we're talking about 2012 2 cases from from 2012 and two from 2013 so i'm glad this issue is being addressed we shouldn't wait to learn the policy lessons from these cases and also shouldn't wait to make a preliminary policy determination would that be a part of this review, chief? >> and training

recommendations. >> and training recommendations because i think there's obviously closer in time being able to address these issues certainly makes a lot of sense what i hear you also saying even on cases where the firearm discharge review board has made a finding there's still reasons why some of these cases remain open and that's become an issue, too. when is it open and when is it closed? >> i have them listed because the final stage as as far as internal affairs is concerned is that summary letter to the commission and i i i know commissioner will recall there was a period sometime back where those letters were years behind and we're troig to we're trying to have that be basically i've submitted a

couple that you will be seeing so the time frames have been just collapsed on that. >> okay commissioner dejesus. >> i did sit on this last one. i do want to point out to the public we don't have a vote we do do get asked questions. if it's in policy was there a review of the policy or training issue, should we change is this the best practice but only the commissioner that's there gets to hear what's going on and i'm glad you are going to do a review. it's important to know if we've learned from that or something that needs to be revisited or other things and i'm glad if we're doing a review there's a way to get all of the commissioners on board

attorney with the asian law caucus. thank you for the report on the safe san francisco civil rights ordinance. as you may remember civil rights groups worked for the passage of this ordinance. as as to the process we're thankful to the san francisco police department for giving us advance notice and we're also thankful to have received the report 5 days before it was presented giving us time time

to analyze our concerns. yesterday we sent the chief some of our questions and you already provided answers to many of them we really appreciate that and thank commissioner thank wang for their engagement with us. i have 3 follow up requests if i may. we were wondering if it's possible to update this report with this additional information in writing? >> yes. >> thank you. i know you asked the fbi to join these conversations in the past. we really hope they will be able to come in the future if possible. i think it's important for the fbi to have an understanding of how the community experiences this and see what this process looks like so if we could encourage them to come in the future that

for short and in our look out we allege -- the national sars program uses a vague standard even lower than reasonable suspicion of criminal activity and at high risk of racial profiling. that's not an abstract fear but a fact. i'll read a couple of these out to demonstrate some some of some of the problematic ones we came

across. two middle eastern males taking photographs. buying several large pallets of water and a middle eastern male adult who is very un friendly. one of them was reported because he was appeared to be middle eastern and attempted to buy quote a large amount of computers he turned out to be a purchasing manager for a computer center. another plaintiff was reported because of his quote full conversion to islam and so the clear
