5:00 am
in the next two weeks the remaining 4 weeks will give us time to negotiate the contract as well as give the providers 60 days to implement if we have a new provider so i'm sure you're aware of may or may not know we have a special telephone service in the jail there are in the pathologist sniffs never regulated by the fcc and high rates were charged at various facilities to make phone calls and for the first time the fcc contemplated regulation of enter state rates they announced in july an intent to raise the rates but not the direction to at that time we paused our rfp process to make sure our rfp was responsible responsive to federal regulation in october of
5:01 am
2014 the fcc indicated through lob a ceiling at $0.21 for prepaid and 20 important collect calls they'll lloyd like to eliminate the surcharge fees the intent behind this to lower the fees to the inmates can have a lower amount and reduce the recidivism so in that 3 month enter eloquently process that was on hold we issued in december and our rfp district attorney meet the requirements of fcc in light intervening period the sheriff's went to washington, d.c. to mediate meet with the commissioners and talk about his position regarding inmate calling rates as you recall we drastically increased the call rates and reduce the inmate
5:02 am
calling rates by 20 percent under the sheriff's discretion kind of opened by the indication of the fcc they were willing to negotiate the rates we went further it is important for the access to have the telephone and maintain the support so the message to washington, d.c. overall the department supports the fcc action regarding the calling rates but speaking on behalf of the other sheriff's in the state and country to remind the fcc that the commission from inmate calling waiting rate goes to the revenue will prevent to fund programs that reduce recidivism in the jail for example, in san francisco they fund a our prisoner legal services that provide the legal
5:03 am
services to prisoners and fund the services so for 23i7bd like san francisco this is a financial position there's the potential that the funds duo can a backfill but it is not an option other county don't think those revenues for some of the operable costs one of the things the fcc talked about the inmate walter fund is a small part of the fund it's a large part of the funding towards programs that reduce recidivism and also the sheriff's wanted to share with the fcc with the 40 san francisco experience is outlining how our reductions of inmate calling rates has been reduced on the far left our
5:04 am
surcharges well above $2 and into the 3 and go up to $0.60 a minute last fall we drastically reduced our calling rates for about 24 percent on average for 15 minute calls making sure that no surcharge went over a dollar 25 and the local calls that are the most pruvent were at $0.10 and minute and $0.15 a minute and the international is 21 and $0.25 pr then substantial the fcc came out with the new recommendations stating there will be no surcharges so what we've now put in our rfp there are no surcharges local calls will be at $0.79 and minute and
5:05 am
non-will meet the fcc calling requirement so how is it impacted our calling rates if the look at the months prior to the introduction of the lower calling rates and look at the 3 months after the introduction of the lower calling rates as you can see that our call volume increased 21 percent in the actual mints of talk 18 percent we're proud of that result and hoping that inmates stay in closer contact with their friends and families just good to prove what this means for san francisco we're reducing our there will be an overall impact of decrease in the short time to have a fund balance to continue to spend at the existing level was we eat body that fund
5:06 am
balance we're going to be looking for the support of city to back those funds i'll be happy to answer any questions. >> this is really helpful presentation what that means i want to reiterate some of the comments that were brought up before are that i think when other items were before us increasing the rates are one thing i know that some of the supervisors said it is strange to don't think the amount of calls to fund the inmates programs seem a little bit i guess counter i've tuff but seeing what you've laid out i guess one the questions do we have in san francisco charge inmates for the phone calls. >> that's a great question i think the sheriff's certainly agrees with you that's why we've been pushing over time to as
5:07 am
time passes to push rates down in our current rfp in response to the comments we've given preference to my he any vendor that provides the calling any points in the rfp to award to any vendor that provides local calls that's the vast majority of our calls. >> i see there's been significant reductions in enter state but the local calls is the most impactful as your engaging on the new service for the vendors that takes into account the goal to help the meats and again, i know it costs money to run the programs to support them but again seems odd to charge based on the phone call fees.
5:08 am
>> the sheriff's on the grounds with you. >> okay seeing no other questions any public comment on this item? seeing none, public comment is closed. >> supervisor tang with that given this is really just an amendment to be able to have a bridge contract while they for negotiate the future one i'll move this forward with r with a positive recommendation to the full board. >> we'll take that without objection. >> item 4 a resolution to move for an emergency case inc. and albert electric to expedite the human installation of a structure that compromises fire station 48 to help fund it on treasure island with the amount of all 4 to not to exceed
5:09 am
$54 million. >> i'm the depending upon of finance administration and puc we respectfully requesting our approval of the contract under the sects of the administrative code for the construction of a temporary fire station on treasure island right now have entered into contracts with 3 vendors designed space module building and electric for a total contract value of 1.25633 million dollars we're respectfully requesting an amendment for technical corrections we have brought those documentation and can submit them to the clerk i want to run through them for the bin of the committee we're asking for the totally agree gait of 4 contract f to be changed to $2.7 million and requesting to add a line that reflect an agreed upon change order with
5:10 am
the electric $103,000 plus to stricken a clause in the original reds the first further result clause in the resolution that discuses actions to secure emergency contracts. >> okay that's correct very much supervisor tang. >> if you could just i guess run down why it is that we're at that point in an emergency contract the timeline for things discovered and why we have to got rid of go forward. >> if you have additional more facilities with questions i have my colleagues from the fire department here back in the fall or actually in the spring of last year the facility on treasure island was unhabitual at that time the fire
5:11 am
department took steps to relocation the firefighters into their training quarters to have a healthy environment and needs to spend time to see their next course of action it wasn't until october they realized this was a construction contract then keeping them in the treasure island training facility or installing something at treasure island so the fire department took a few months to secure the funding and identify the direction and eventually requested a plan of action by that time it was october and the firefighters have in the training facility at treasure island which is why we declared an emergency to relocation those firefighters given ata it's a 24/7 facility and an emergency
5:12 am
provision to the island commissioner chan. >> so thank you and so then from my understanding bans the resolution this temporary site will last 15 years; is that correct. >> that's the stated useful life the structures but reasonably we expect it could lasted longer and has the potential for longer use treasure island is under discussion so we are procuring something that has the potential to last longer than and potentially be used been site by another occupants should the fire station be ready. >> in terms of the funding i know that portion is from the army bond by voters i want to commercialism that this is something we're able to do. >> i have discuss the eligibility of those bond funded
5:13 am
with the controller's office of finance and the city attorney's office and we're comfortable that is a legitimate use of bond. >> all right. thank you. >> thank you for those questions supervisor tang for clarification mr. rose to your report please. mr. chairman i would appreciate if the department would advise us of the amendment my report is based on what was submitted wisp not aware of this amendment it didn't change the conclusions of our report but much appreciated for us to get that information so we can report that to say the budget & finance committee on page 7 of the report the total project koftdz the fire department on treasure island $3 million of which $2.5 million is for floor contract 3 contractors but 40 contract and
5:14 am
5 hundred thousand for the project management and the fire department 2015 budget the balance will come from the earthquake safety or general obligation bonds for the neighborhood fights improvements think outside the box on page 8 of the report we report that to date dpw has extended money and have 8 hundred the total estimated cost of $3 million is shown in table 2 on page 9 of our report supervisors to put this in context when we think about an emergency for example a sewer a main sewer bursts the did not immediately fixes this sewer
5:15 am
repairs that so they can't get to the board of supervisors they have to do the work and then in accordance with the administrative code oh, the board of supervisors this is is the legislative body that creates the section they then report back to the board of supervisors on an oath oath the budget and legislative analysis did not consider the treasure island if a facility to be an emergency as defined deby the code mold was discovered in friegs almost a year ago during the planning process important the tear facility over last year there were several points that
5:16 am
the city departments quo could have moved but they require the competitive bid progress for the temporary fire station on treasure island as a matter of fact to put this in context the emergency was discovered in march of 2014 and yet on emergency was not declared by the department until october of 2014 this is ridiculous that is not what emergency is under the section of the administrative code on page 10 of our report regarding the bond issue financing we point out that dpw tend to use one million dollars plus in emergency responses for earthquakes to partially fund this for the temporary fire station the initial part didn't
5:17 am
exclude the fire station only treasure island that will be constructed by the developer in 2023 as part of the redevelopment of treasure island and those are intend for the seismic and safety improvement for the fire stations but dpw is now recommending the use of the yours bond of the temporary fire station on treasure island by the developer both the city attorney's office and the office of public finance have determined this is an allowable use of bond our point when the voters voted on the bonds the clear 27b9 for the seismic improvements to neighborhood fire stations under those circumstances not for the temporary fire station on treasure island so our recommendations supervisors on page 10 we recommend you request the city attorney to report back to the board of supervisors about options to amend the administrative code for purposes
5:18 am
of limiting the ability of city departments to allow the bonds for the competitive procedures in this case i stated clearly the department had sufficient time to award those and not just with all due respect those contracts for the sole base on they're reasonable cost we had no include whether or not $2.5 million to make a temporary fix to the fire station and no one knows for sure excluding the department one way or the other without a competitive bid that shows with the price should have been so we consider the approval the proposed resolution been amended the recessing resolution as i stated raise a competitive bids under the administrative code although those contracts
5:19 am
could have been award under the procedures and the construction of the temporary modular fire station will be partially funded by energy response bond that are 2i7d for long term safety improvements to the neighborhood fire stations again, we're not commenting only the who it's legal we're only commenting on the use of those funds based on the intent in which the voters voted on for those reasons we consider this item to be a policy matter i'll acknowledge certainly the stakes they've awarded the contracted the work was supposed to be completed in april this is a clear case the department should have bit on those contracts. >> maybe we could ask the department or the dpw the time lapse is a clear point first of
5:20 am
all any mold in city buildings we want to remedy right away and between the declaring of an action and not doing anything about it maybe we could get a respond. >> sure to be quiet honest the department of public works didn't become involved until october part of the point in the frerpts realm to determine and make some decisions about relocating it's employees if i like i can ask them to speak to this. >> yes. why not have the fire department. >> thank you, supervisors i'm with the san francisco fire department i have our cfo mark if you have questions for him to truly understand this is not simplify you need to back up this is a unique position for the san francisco fire department we have one firehouse
5:21 am
on treasure island and 43 fire stations in the city of san francisco if this would have happened anywhere else than treasure island we'll close those fire stations and move the cops companies to the neighboring fire stations like we have to move out for a certain amount of time we can't leave treasure island vacant we have to have our company there in march we've been having complaint of mold and sent out a mold company they recommended we vacate the building immediately we remember validating the it building been with twenty-four hours our health and safety of the members comes first one vanltd we moved them to the training facility where we had to relocation the recruits and
5:22 am
moved the firefighters into classrooms so to declare an emergency at this point we didn't think necessary we did research and called mold companies turnout they say we don't recommend you redo this and accident architects said by the time you rebuild this building tear it down we spoke to tida they said we can't do permanent housing we're under redevelopment it kept getting weird and the situation bigger so we're still living in this is classrooms we're there to say it's to be routine by the planning commission, and may be acted upon by a single roll call vote ideal situations is a stretch we thought we could handle this and move back in once decided we can't we can't build a new facility and can't
5:23 am
move into the old facility we went to the other fire departments outside of the sit city and talked to them they have modular housing we talked about with the mayor's office and work on our current budget on july one to put money on there to purchase modular housing and dpw explicit still contract with p them we looked we were going to purchase we looked at it as purchasing on modular that was built and bring it 80 here to relocation it we talked took several modular companies and started to go to the regularly process and went to oca to put this out to regular bid they would hold on it needs to go to dpw and that's
5:24 am
when dpw got involved that's the timeline we were thinking we were in a temporary not even close to an ideal situations in classrooms we were going to last for less than a year once we realized the magnitude this is well over a year we have a problem here we have ether $2 million of vehicles sitting outside it is not that it's uncomfortable far stretch but operationally wise to the fire department if you u when you say something temporary for a month or two the magnitude when you say something over a year to a year and a half close to relocating it creates for issues that's when the mayor come out and supervisor kim came out to look at 9 deputy director of public works and 20id said we
5:25 am
have a bigger problem we need to move faster than the rig process. >> mr. rose. >> mr. chairman beyond one comment that the chief made that is relevant why those contracts can't go out to bid not one statement the emergency was discovered i acknowledge it was an emergency it was mold not safe a firefighters discovered in march of 2014 i don't hear one statement as a why within a year those contracts could not have been rebid we're not stating this is a terrible situations we agree if something had been done the contract shouldn't have been awarded many under the administrative code through a psychologically process wul without bidding. >> before i ask my question
5:26 am
i'll give the fire department a congressman to respond. >> we were going to go to comprehensive bid we were told we couldn't. >> what was the timeframe we first of all we had no money you can't sign without money our cfo i talked to the mayor's office and we have allocated one $.5 million in our budget in july and as soon as we were ready to go and obviously i'm not on the money side but apparently, it was july 1st but as soon as those fund cleared it stopped and become a dpw project. >> mr. chair we're hearing the fire department is stating the
5:27 am
reason it was not comprehensively extensively bit they didn't get involved because the fire department originally discovered this it is either according to the two departments we're not trying to pass blame every one fault or another that's what the testimony from two separate departments the contract should r.n. have been extensively bid. >> does dpw or the fire department wish to comment that is a problem. >> committee members i don't think either department is here to cast blame the chief is talking about the timeline by october we were in an emergency situation our department and the
5:28 am
donor made the dignities to declare an emergency. >> supervisor tang. >> my question if we approve the amount of funding for the temporary sites what's the implicates for the future when the permanent site is built. >> it's sort of the development agreement it didn't have that implications for the timeline it will mean we have $4.5 million less but the total of the amount that was allocated to neighborhood fire stations so it's a very, very maul amount and we don't see it as having a big impact on the ability to improve neighborhood fire stations. >> okay okay. we'll open up for public
5:29 am
comment there's no opening statements being able to approve that this is about declaring emergencies how we approach this mr. rose made valid points no one is here to blame we want to make sure we're doing the right thing but we're also policymakers going forward this type of this is the budget and finance we want to make sure that the departments understand the process that is expected of them in times like this okay. >> colleagues why not move to public comment any public comment on item 4 okay seeing none, public comment is closed colleagues, i would highly suggest we have no choice but to move this forward at this point we need to approve the technical
5:30 am
amendments if we could have the dialog as mr. rose suggested policies around emergency contracted. >> john gibner, deputy city attorney i'm happy happy to do that i'll recommend you not add that report back to my office into the reds here but we're happy to work with the committee or my member of the board for the policy discussions. >> that's part of the reds and thanks for that and thanks mr. rose and colleagues at this point, i'll suggest we have a motion to take the technical amendments and continue for a week. >> so moved. >> second. >> we'll take that without objection. >> all right. madam clerk call item 5. >> approving the change lease between travel quality services and the city with a minimum guarantee of $1.5 million
