by the developer both the city attorney's office and the office of public finance have determined this is an allowable use of bond our point when the voters voted on the bonds the clear 27b9 for the seismic improvements to neighborhood fire stations under those circumstances not for the temporary fire station on treasure island so our recommendations supervisors on page 10 we recommend you request the city attorney to report back to the board of supervisors about options to amend the administrative code for purposes of limiting the ability of city departments to allow the bonds for the competitive procedures in this case i stated clearly the department had sufficient time to award those and not just with all due respect those contracts for the sole base on
7:01 am
they're reasonable cost we had no include whether or not $2.5 million to make a temporary fix to the fire station and no one knows for sure excluding the department one way or the other without a competitive bid that shows with the price should have been so we consider the approval the proposed resolution been amended the recessing resolution as i stated raise a competitive bids under the administrative code although those contracts could have been award under the procedures and the construction of the temporary modular fire station will be partially funded by energy response bond that are 2i7d for long term safety improvements to the neighborhood fire stations again, we're not commenting only the who it's
7:02 am
legal we're only commenting on the use of those funds based on the intent in which the voters voted on for those reasons we consider this item to be a policy matter i'll acknowledge certainly the stakes they've awarded the contracted the work was supposed to be completed in april this is a clear case the department should have bit on those contracts. >> maybe we could ask the department or the dpw the time lapse is a clear point first of all any mold in city buildings we want to remedy right away and between the declaring of an action and not doing anything about it maybe we could get a respond. >> sure to be quiet honest the department of public works didn't become involved until
7:03 am
october part of the point in the frerpts realm to determine and make some decisions about relocating it's employees if i like i can ask them to speak to this. >> yes. why not have the fire department. >> thank you, supervisors i'm with the san francisco fire department i have our cfo mark if you have questions for him to truly understand this is not simplify you need to back up this is a unique position for the san francisco fire department we have one firehouse on treasure island and 43 fire stations in the city of san francisco if this would have happened anywhere else than treasure island we'll close those fire stations and move the cops companies to the neighboring fire stations like we have to move out for a certain amount of time we can't
7:04 am
leave treasure island vacant we have to have our company there in march we've been having complaint of mold and sent out a mold company they recommended we vacate the building immediately we remember validating the it building been with twenty-four hours our health and safety of the members comes first one vanltd we moved them to the training facility where we had to relocation the recruits and moved the firefighters into classrooms so to declare an emergency at this point we didn't think necessary we did research and called mold companies turnout they say we don't recommend you redo this and accident architects said by
7:05 am
the time you rebuild this building tear it down we spoke to tida they said we can't do permanent housing we're under redevelopment it kept getting weird and the situation bigger so we're still living in this is classrooms we're there to say it's to be routine by the planning commission, and may be acted upon by a single roll call vote ideal situations is a stretch we thought we could handle this and move back in once decided we can't we can't build a new facility and can't move into the old facility we went to the other fire departments outside of the sit city and talked to them they have modular housing we talked about with the mayor's office and work on our current budget on july one to put money on
7:06 am
there to purchase modular housing and dpw explicit still contract with p them we looked we were going to purchase we looked at it as purchasing on modular that was built and bring it 80 here to relocation it we talked took several modular companies and started to go to the regularly process and went to oca to put this out to regular bid they would hold on it needs to go to dpw and that's when dpw got involved that's the timeline we were thinking we were in a temporary not even close to an ideal situations in classrooms we were going to last for less than a year once we realized the magnitude this is well over a year we have a problem here we have ether $2 million of vehicles sitting
7:07 am
outside it is not that it's uncomfortable far stretch but operationally wise to the fire department if you u when you say something temporary for a month or two the magnitude when you say something over a year to a year and a half close to relocating it creates for issues that's when the mayor come out and supervisor kim came out to look at 9 deputy director of public works and 20id said we have a bigger problem we need to move faster than the rig process. >> mr. rose. >> mr. chairman beyond one comment that the chief made that is relevant why those contracts can't go out to bid not one statement the emergency was discovered i acknowledge it was
7:08 am
an emergency it was mold not safe a firefighters discovered in march of 2014 i don't hear one statement as a why within a year those contracts could not have been rebid we're not stating this is a terrible situations we agree if something had been done the contract shouldn't have been awarded many under the administrative code through a psychologically process wul without bidding. >> before i ask my question i'll give the fire department a congressman to respond. >> we were going to go to comprehensive bid we were told we couldn't. >> what was the timeframe we first of all we had no money
7:09 am
you can't sign without money our cfo i talked to the mayor's office and we have allocated one $.5 million in our budget in july and as soon as we were ready to go and obviously i'm not on the money side but apparently, it was july 1st but as soon as those fund cleared it stopped and become a dpw project. >> mr. chair we're hearing the fire department is stating the reason it was not comprehensively extensively bit they didn't get involved because the fire department originally discovered this it is either according to the two departments we're not trying to pass blame every one fault or another that's what the testimony from
7:10 am
two separate departments the contract should r.n. have been extensively bid. >> does dpw or the fire department wish to comment that is a problem. >> committee members i don't think either department is here to cast blame the chief is talking about the timeline by october we were in an emergency situation our department and the donor made the dignities to declare an emergency. >> supervisor tang. >> my question if we approve the amount of funding for the temporary sites what's the implicates for the future when the permanent site is built. >> it's sort of the development
7:11 am
agreement it didn't have that implications for the timeline it will mean we have $4.5 million less but the total of the amount that was allocated to neighborhood fire stations so it's a very, very maul amount and we don't see it as having a big impact on the ability to improve neighborhood fire stations. >> okay okay. we'll open up for public comment there's no opening statements being able to approve that this is about declaring emergencies how we approach this mr. rose made valid points no one is here to blame we want to make sure we're doing the right thing but we're also policymakers going forward this type of this is the budget and
7:12 am
finance we want to make sure that the departments understand the process that is expected of them in times like this okay. >> colleagues why not move to public comment any public comment on item 4 okay seeing none, public comment is closed colleagues, i would highly suggest we have no choice but to move this forward at this point we need to approve the technical amendments if we could have the dialog as mr. rose suggested policies around emergency contracted. >> john gibner, deputy city attorney i'm happy happy to do that i'll recommend you not add that report back to my office into the reds here but we're happy to work with the committee or my member of the board for
7:13 am
the policy discussions. >> that's part of the reds and thanks for that and thanks mr. rose and colleagues at this point, i'll suggest we have a motion to take the technical amendments and continue for a week. >> so moved. >> second. >> we'll take that without objection. >> all right. madam clerk call item 5. >> approving the change lease between travel quality services and the city with a minimum guarantee of $1.5 million for the lease and 3, 4 year option for the airport commission. >> okay. thank you ms. one-size-fits-all in her is here from the airport. >> good morning supervisor farrell and others kathy with the san francisco international airport the item seeks for an approval of the currency
7:14 am
exchange lease this proposed lease is a result of a competitive lace with the travel company the lease has a 5 year term to 2004 with 3 4 year options to extend travel x operates 3 locations throughout but airport 8 in the international and one location in each of our domestic terminals to provide the exchange of sale oath outline world currencies and debit cards and offer check carvings services the trend associated is the greater $5.4 million per year in the form of an annual guarantee or a percentage of gross revenues adjustments will be adjusted annually based on the consumer permits index he'd
7:15 am
the staff recommended approval i'll be happy to answer any questions. >> thank you, colleagues my questions okay mr. rose. >> yes. mr. chairman and members we report based on the minimum annual guarantee rent for the first year of the lease which will be $5 million plus as shown in table 3 the initial 5 year term of lease based on on that minimum guarantee will pay the airport at least $27 million plus we recommend you, you approve that resolution. >> thank you, mr. rose any question public comment seeing none, public comment is closed. >> supervisor tang. >> that's correct i'd like to make a motion to forward item 5 with a positive recommendation to the full board.
7:16 am
>> can we take that without objection? >> madam clerk call item 6. >> appropriately $3.4 million to the city responsibility for the class of business allocation for in time agencies to contract with the city and county of san francisco. >> thank you madam clerk this item was support by supervisor mar i'm going to turn it over to. >> thank you supervisor farrell this is co-sponsored by supervisor campos and jane kim this is to be routine by the planning commission, and may be acted upon by a single roll call vote important piece of unfinished business from our last budget an ordinance that will creativity par it's for our community so-called nonprofits in the city that are 14 that receive city contract they make up a huge critical part of san francisco's human safety net of our city this services the most vulnerable and needy people in our city in august of last year saurm the full board passed a resolution that had an unanimous
7:17 am
u amount to fund the cost of nonprofit agencies that contract with the city and the funding was con 2i7b9 on the above prejudged or projected stimulates of the 2014-2015 to be funded like the local tax and real estate transfer tackles city's recently comprehensive report caper we call it for the fiscal year mentions a year-end inappropriate surcharge of $21.6 million but the caper showed the city has a 134ur as mentioned in the resolution that was passes? august that came from again the unanticipated end revenue the board of supervisors made the commitment according to the resolution because many of the 45ird working organization provide in some of the critical serviced and that they've been chronically under contemplated
7:18 am
over the year from 2008 to 9 the nonprofit organization received the funding from the san francisco budget & finance committee despite absorbing the high costs and in many cases not on there since 2007 or 8 for the city's nonprofits organizations because the funding amazed to a reduction for those nonprofits negatively impacting our city's safety net and the finance that don't think them and the workers that serve those organizations for the nonprofit for profit contractors in the city they receive annually increases i could to the cip or increases of 3 percent of more this is about parity for the nonprofits compared to the for profit
7:19 am
contractors with the city that receive those annual increases until 2013, the nonprofit contractors had not received a cost of doing business since 2007 or 8 it's about parity and entity for our nonprofit organizations in the fiscal year 2014-2015 our budget included fund revenues for the generosity responsible to promote 1.5 percent increase for the nonprofit organizations that was much needed but as people came to the board meetings to saying they can't survive on that and the slogan by many i totally agree having been a nonprofit worker over thirty years ago running agencies if the city as well the 2014-2015 budget
7:20 am
included a raids increase that was 2.3 percent for the city and county and the public employees got a 2.25 increase on october of last year regretting the increase for the fiscal year so such a low increase for nonprofit xldz a cut in the agencies that they chose between cutting programs or layoffing folks the estimated cost is 97 that costs of increases 3 buyout $4 million enough to bring the nonprofits both parity with the city employees i want to be clear we need long term strategies so it we address this pay equities gap for the hard working nonprofits and the parts
7:21 am
of critical safety net complugd including the city employees this long-term solution i hope people b are looking at with this budget committee we're not achieving our long term goals this supplemental is providing much needed trousers the community basis organizations whatever we're able to accomplish through the process we have to be forwarded looking and look for the structures in the future as a city we need to help our nonprofit and the community based on organizations they survived a financial environment and fulfilling the commitment in august of last year this will sure a long term of survival all of organizations and maintain our community with that i want to ask if any of
7:22 am
the colleagues want to speak. >> supervisor john avalos's. >> yes. i co-sponsored this supplemental as well so we can add my name from today i thank you for bringing this forward i've been involved in the budget process for i don't know since 1997 and the issue about the cost of.org as before us the board and the mayor's office every year will see people that have are city employees wage increases this and that to meet the rising cost of living in san francisco the bay area there are a lot of employees that work in the bay area now we're seeing our affordability crisis is beyond the control of any policy at the board of supervisors or city hall so we have our facing how we're
7:23 am
going to deal with the gap that exists for nonprofits to stay in san francisco and continue to work in san francisco so they can stay alive but others people that work for nonprofits they continue to stay in the city as well the cost of insurance the cost of rent is skooith and so many nonprofits that have to close their doors to meet those issues and last year, we the voters approved increased to a minimum wage so looking at the cost of doing business and paying workers more is consistent with all the work and effort that every single elected official got behind in raising the minimum wage they should be consisted with and not changing policy because we feel
7:24 am
federal and state this is not appropriate that is the most appropriate thing we're to responded to the affordability crisis we have to look at our nonprofit sector to expend the research of government services to support people who are struggling in the city that's a huge effort the nonprofits are involved in we have so make sure we put our money where our mouth it is for the crisis i hope we move forward 24 item and the different levels of nonprofits who are here today it is critical to making sure we continue to have a city that supports people that are struggling here that's what we do by pca this today moving forward to the full board we can continue that work
7:25 am
(clapping.) >> okay. colleagues if not 0 questions or comments mr. rose why not to our report on report on item 6 please. yes mr. chairman and members of the committee supervisor avalos on page 1-800 of our report we report the 4.5 percent as supervisor mar has staeltd $6 million plus was previously bid in the fiscal year 2014-2015 budget and together will provide the approximate total of 2.255 percent or $10 million plus in the fiscal year 2014-2015 and mirandize in the table of page 17 we consider this to be a policy matter for the board of supervisors. >> thank you, mr. rose all right. if no other comments
7:26 am
why not open up for public comment as supervisor mar i know thank you for those who submitted the speaker cards if you want to submit more speaker cards brings them up here. >> can i add another comment we seeing the biggest generation of wealth in san francisco in all-time i don't think there's ever been the kind of wealth generated and the budget is improving improving we have to increase our general retired we have $25 million and more money coming in than that expected we have that decision we had unfinished business we had to deal with in looking at the cola every budget they do not believe that we support the budget
7:27 am
knowing we'd have to come back and fixtures this thank you. >> i just wanted to add to that despite the tremendous economic boom as a wealth generations the different reports show that 28 percent of the population are living at $22,000 a year largely seniors and families from low income communities of color and gunpoint community the safety net we're talking about for a tiny autumn amount of 7.5 percent are addressing the issues despite the wealth i'm going to call a number of named about 20 cards and people i believe have two minutes one and a half minutes the soft buzzer goufz and thees off and the
7:28 am
first is peter. (calling names) good morning supervisors my name is a peter i'm with s c i 10 to one there goes the chair of the committee the fact we're here we have to fight and august today to k078 peel the budget & finance committee to make good on a a promise in agree a ridiculous the increase if the city saw a surcharge well, the city saw a surcharge anyone that lived and works here sees the
7:29 am
wealth and airbnb to may they're back tacks thanks to the supervisors it is a decent surcharge too so the question becomes what a our local government if they refuse to honor a vote why should the workers or others trust any what the board of supervisors say the nonprofit workers are broke and san francisco is not what's the rational and the argument against the egregious supplemental we haven't is that heard when we have heard from supervisor avalos and supervisor mar about their support if there are doubt or opposition i'd love pubically for those supervisors to state why they don't that this is a good idea or why the full board should have a chance to voted on something they've
7:30 am
agreed to in august the silence is very troubling and concerning physical evidence i mean i was a nonprofit working now a union representative for 10 to one it is difficult we see the city change and we see our jobs stay the same it is very important we get this money and something you all ready agreed to. >> hi gm supervisors i'm natalie marital i'm the elected leader of e pi you local 2 thank you for time and support supervisor mar and supervisor avalos i want to talk about the forgets in the nonprofit community being that k346b9 left out in the cold at the city grows fin
