8:00 pm
19984 i live locally there have been a lot of changes in the community joining the homeowners association i was a traffic safety person we discussed the ramifications of business on ocean avenue and how it had an impact on the community when we lost the survivor way on ocean avenue a lot of people were upset a lot of the homeowners were concerned and elderly persons where are we're going to go now for shopping so i've seen an evolution since then my wife and i do a lot of the shopping at trader joe's and the
8:01 pm
whole foods it is sad we have a daughter at a major university that has a major - i see a lot of students that come to trader jose and think they would get more bank for their buck at a safe way so even worse that the whole foods that is located near city college i see the same situation obviously there's going to be detriment in the community we talked about the parking has been stated it is primarily for community use the local institutions the neighboring community i don't see much of american people adverse but one thing that bothers me i see a
8:02 pm
lot of marijuana dispensary locations in the immediate area it sure with about noise to level the playing field and have target that has a say is an impact on home value and things like that so thank you very much for your time. >> thank you>> thank you. next speaker, please. >> if ami i've called your name. >> good afternoon, commissioners i'm dan weaver speaking as executive director of the oracle ocean avenue association i've got copies of a letter that i worked on and prepared as part of the formula retail process because in the past in the
8:03 pm
present not target is coming in new target has done nothing wrong i've worked with them well however the history of formula retail on ocean avenue and other neighborhood doesn't go well, no letter of agreement or memorandum of understanding about anything of what role a large chain formula retail business would have in the community in which it chooses to locate and for the existing formula retail businesses they're almost completely nonresponsive to anything deny managers are in place whole foods is uniquely different from all the rest i'm hoping that target will be what we're trying to do is spell out our understanding of what this
8:04 pm
would be unfortunately never the planning department nor target has any built to be involved in the process we've gone ahead and done that i want to basically present this to you as something that should be done with formula retail applications throughout the city again, the ocean avenue association and all the neighborhoods are pleased that target is choosing ocean avenue for the new type of store thank you. >> thank you. >> good afternoon, commissioners i'm david bloomfield i live across from the terrace from the proposed target store my residential context is on top
8:05 pm
of the complex i'm opposed to the project but i have quality of life concerns i want to express their definitely be an increase in the street cleans by the city twice a month it is hopefully inadequate and there are double parking issues there are no yellow zones in the immediate vicinity for the proposed target store deliver trucks for cvs double park and target willes bat the situation my main concern, however, is the time for deliveries to the target store by its suppliers
8:06 pm
they're proposing deliveries between 6:00 a.m. and 9:00 p.m. on week days and two no one specific times on saturday and sunday i'd like to propose and i did propose to the gentleman deliveries be restricted between the hours of 7:00 a.m. and 7:00 p.m. not lout between the hours of 7:00 p.m. and 7:00 a.m. this is a mixed use neighborhood with significant residential use of residents on either side you will jewels up the other side of ocean avenue truck deliveries at 6:00 a.m. in the morning which is part of their proposal is disruptive to the neighborhood it was disruptive when cvs we were delivering at 5:00 a.m. that
8:07 pm
list gates and power jacks and back up lights four trucks it is distressing i think 6:00 a.m. when the community is just maybe staring just waking up i know the ambient noise level is low at a time so i think early morning deliveries ought to be addressed it is a good time to address it before it's a problem and have a fix afterward i don't think if the planning department has any power to limit delivery times as part of the conditional use but i request they do so. >> thank you.
8:08 pm
>> thank you. next speaker, please. >> hello, i'm daniel brown i'm a former college professor from city college i'm just retired range okay i agree with what the last man said i live on the terrace it is very noisy and going to be worse with all the cars double parking and loading and unloading and my biggest concern a at the scene inside the park structure before you come out into the street i walk down there everyday and people come out without looking both ways someone is going to get killed other thing their break ins on deferring r0d terrace i see it
8:09 pm
every single day or every other day put up video cameras someone go out at night but for their own safety and the safety for the people using the streets they should investigate that it there was criminal behavior after school a few blocks down kids are harry's people and they're going just going to move down the street and go into the store there is shoplifting at cvs so for targets own business purposes they need to do something to anticipate the behavior of the kids that are nationally nasty and vicious
8:10 pm
they're all kinds of break-ins and theft in the neighborhood i've lived there for 27 years please whatever target can do to stop that thank you. >> is there any additional public comment okay public comment is closed. >> let me start off with a couple of questions one that maybe staff can ask is there alcohol sales proposed here. >> yes. >> wine and beer. >> all of the above type 21. >> okay. and what is the criteria here about signage and exterior signage. >> they need to comply with article of so no more than a third of the area in the windows
8:11 pm
and other provisions as indicated in article 76. >> one of the requests we've talked about the transparent windows is that part of the criteria. >> yes there are existing windows that will comply with that provision. >> okay. and then as we said what are the delivery hours proposed. >> proposed between 6 and 9:00 p.m. >> okay. and then there's other things i'm curious about maybe they'll come up a larger question for target is well, i know that the typical as far as the local is ours and local buying i realize the size and complexity of target has there been dialog or discussion within
8:12 pm
target stores to standardize. >> that's a good question i did not go into detail but we call localization is not only the store within the neighborhood but products within the local area one of them is method holder products is based in san francisco and target was the major retailer to bring them on board ear conscious of that. >> okay. thank you i'll open up to commissioners and maybe some are shared commissioner antonini. >> thank you yeah. i live in lakeside village about a mile away from ocean avenue i frequently along that street on my way to 280 most of the time what's been said is accurate there's not a
8:13 pm
lot of neighborhood served from establishments there is a whole foods and was gentleman pointed out but a higher priced point and trader jose is past where i live so for the kinds of things that neighbors need there's a lot of small businesses specialists and go ethnic residents it looks at nice but as far as neighborhood services there's not much tdr there so i think it will be a big success and might be a startup to begin some improvement in the neighborhood and may get a designation restaurant or some other things starting to come into the ear that make that street because you've got nice residential areas on one day and
8:14 pm
montgomery height and we had ward parks they deserve things in their neighborhood instead of going into their cars i'm in support and i'll mention has nothing to do with but the architect an deferring rod terrace leafs things to be deserved it didn't come on my watch but there has not been too good deferring rod terrace i remember the safeway it didn't take off and the gentleman that spoke about crime problems they're there and i don't think any one rierlt can solve the problem when we have better 0 endorsement and stricker penalties maybe a little less crime but what we can do to have
8:15 pm
eyeing on the street that people are using the area you'll have less crime because activity discourages crime. >> can i respond in terms of our security features we will have a dictated security within the store and having cameras inside the store and inside the parking garage that is associated with that and as you said the eyes on the street the whole idea with the windows in the existing store actually were o packed out from the last tenant we'd like be opening those up fully so one hundred percent transparency navigation we're enlarge the two existing windows that are out there so their being be more window space
8:16 pm
and the idea of having the activity between the store is an important function not only for us but for the neighborhood in terms of the trucks and deliveries i had had some e-mail discussions bart with the mr. booming field the trucks we're using again, this is a much smaller so for much smaller trucks not the 18 who he recalls 28 trucks that will make deliveries one in the morning and one in the evening right now with the ocean avenue area there is no truck restrictions whole foods and the others doesn't have any what i mentioned to mr. bloomfield we'll try to work within 7:00 a.m. to 7:00 p.m.
8:17 pm
but those trucks are going to be serving our other stores and given local patterns if we could have flexibility we'll be willing to accept certain conditions like 6:00 a.m. to 6:00 p.m. but again, the cvs and whole foods have no restrictions whatsoever we feel that we can work within that we would do our best to work between the 7:00 a.m. to 7:00 p.m. we'd be willing in the commission choose the hours will be workingable for us. >> thank you for your remarks and also there maybe other commissions there was mentioned a stop sign coming out which sound like a good idea but this is a good addition to the neighborhood i'm feasible but
8:18 pm
i'll see whatever conditions on the approval. >> commissioner richards. >> i'm generally favorable for the project i actively visited did site in 1960 ocean was literally across the street project no december i have a couple of questions for the project sponsor having lived at the upper market i'm aware of the delivery issues and supportive of cvs on 28 market we had restrictions only the delivery time we talked about the size of the trucks and their 28 feet they have the ocean bias or prejudice sound and incredibly annoying you have the trash pickup so a couple of questions first one for the deliveries and the traffic issue
8:19 pm
have you so you get to get a yellow curve with an operate delivery time. >> we'll have discussions and will continue to work on the process. >> i guess the second question i'll be you know we worked with and i guess it's hard coming when we will condition our project when our competitor across the street didn't have restrictions we work with cvs on a 7:00 a.m. on 0 minimum i think this is appropriate here given the proximity of the residents living on behalf of where the deliveries radio happening so on a 7:00 a.m. to 7:00 p.m. delivery time i support the project not only a stop sign but
8:20 pm
as at signages i think as well target is trying to be a good neighbor not a reason to not work with the community i guess if i could debate on some of the things to integrate with the neighborhood besides the which i shouldn't giving can you tell us what things you have in mind to be part of the neighborhood. >> yeah. if i may back up briefly to the sign and the car coming in like that we will work towards that i want to make it clear target in this case is not the owner we're leasing the space all of this n is in conjunction with the owner so in terms of conditioning i want to be clear that are things we can
8:21 pm
and can't do >> i understand the awareness the importance we'll certainly put that on the map in terms of the charitable giving our community giving we focus on 3 main areas educations particularly preschool reading programs the art and then on certain domestic social policies that are important and they're a number of as i said nonprofit groups in the city we will continue to reach out to and have had dialogues with the similar nonprofits that have organization or reaches into those neighborhoods. >> i guess one question following on the car i'll be
8:22 pm
more inclined to look at that to have you come back and say we can't do this instead of saying we can do this may be the city attorney oh okay. i'll support the project with the sienldz for the pedestrians. >> thank you. i'm again curious how that works again since we don't have the final say in that we - we don't. >> if i were the landowner and came to granted any 17 thousand secret it would be in my best interest to vw's have signage when a car comes that shouldn't be an issue given the size of this project that was tech toxic
8:23 pm
i can't imagine that the owner wouldn't say okay. >> i have a question if i may through the president it is unclear for me when was stated and maybe the project sponsor has any control over and over the garage or the garage is part of the project because if it's not part of the scope of the project than the commission didn't have jurisdiction over the garage and it's not part of the leased area that we have we have rights to used the parking garage and under recent specified spaces for target but they have spate security within the garage that is owned and maintained and operated by the landlord not by target. >> deputy city attorney my advice to the commission if the
8:24 pm
commission were k4r50i7bd to have conditions they continue the matter so my office can research with whether the commission has jurisdiction over the garage space. >> may i suggest that instead of continuing it we might want to if the conditional use is for the formula retail itself not for the parking so my suggestion we work with the target on safety matter and work with the property owner and you can indirect i direct us to work with that as a condition of approval. >> okay. thank you commissioner johnson. >> thank you my comment might help not only was there some comment about safety from coming in and out of the garage but pedestrian safety
8:25 pm
and those issues are not the planning department but the dph so i think it might be helpful to just condition that the project sponsor work with dph and sfmta to an pedestrian circulation so yellow zones and things like that that's not the planning commission part of that can be the project sponsor contacting the landlord and seeing if we want to discuss any changes to the garage spates i mean, i can make that language clear i think that things like that would help. >> okay. >> commissioner hillis. >> sorry a question on loading so you plan to do loading from ocean avenue. >> yes. >> that's kind of to the west side. >> it is the existing building and loading has been done from
8:26 pm
ocean avenue there's a ref port or door on ocean avenue. >> okay. you'll get a yellow zone or whatever. >> p w. >> the 67 a.m. to 9:00 p.m. is reasonable i'll support that and i agree with commissioner richards self-we put a stop sign no one is going to stop this from happening i intended e at the end not to like the blinking signs not walking it depended on - on the windows you know going from the east to west there's two days there were windows or windows should be designed to be in the space were there never windows in those spaces. >> no. >> and your signage the signage
8:27 pm
was jarring to me at first i don't know obviously you've got a logo it people know when you want to put it out there maybe this is a question for staff are the red you know when you circulate the signage are those architecture or included. >> it's part of the signage calculations but it is responsible for submitting the permit they've not done it it. >> i will be supportive of working with staff to have the signage on that corner is overwhelming the color it is red so it clashes with the rust color above it looks at jarring especially with cvs next door
8:28 pm
corporate looking signs i don't know if you've seen pete's their formula retail and taking the signage and making that seem more neighborhood commercial feeling and less of a design important a plaza commercial so put a condition you'll work better with staff on that design of the signage and kind of where it is and the size. >> commissioner richards. >> i have two additional follow-up on the transparent of the windows you'll look in and see the commissioners, on that motion and going of the store and you're absolutely right. >> to commissioner hillis point and not calling a colonel period of time but when we the working of the sign you might want to take into account what we negotiated with cvs it was more
8:29 pm
of a neighborhood feel so. >> when i say that's a halo. >> yes. >> i would like oh. >> i'd like to make a motion to approve the project with the condition that the scliefrz be 7:00 a.m. to 7:00 p.m. and the project sponsor works with the staff open thaib their signage plan as well as oh yes. >> a traffic pedestrian sign for the pedestrians crossing the path of the entrance route. >> second. >> commissioner there is a motion and a second i might paraphrase that last one the conditions as amended to include
8:30 pm
a restriction of 7:00 a.m. to 7:00 p.m. to work with the staff on signage and work with the sfmta and devon traffic calming and safety manufacturer very good commissioner antonini commissioner hillis commissioner johnson commissioner moore commissioner richards and commissioner president fong so moved, commissioners, that motion passes unanimously 7 to zero. >> we've got one more item okay or commissioners that places you under our discretionary review calendar for the case at 27 hodge's additionally this is a discretionary review. >> good afternoon, commissioners mark i'm presenting that dr for planner kate conner before you a a discretionary review for a building application to
