and paid for by the owners there are still will 60 under receive at planning a possibility, of course that we may see more permits issued in the next few weeks for those i think it is safe to say by the time we get to the first anniversary by the medal of may and the next report jointly is due from planning and dbi to the board will probably be in the 10 to 12 or 15 actually issued permits for those legalized unit so for whatever reasons we can speculate quite a bit open what some of the reasons might be a lot of the original units are code compliant where planning is waving the issue those
9:31 pm
applications is not coming in i know we've been talking with planning about it maybe by the end of this report we'll have a better understanding of why this is happening but other than that that's it. >> commissioner walker. >> on the secondary unit legalization the first step is to be advised by some outside people; right? are we seeping e keeping track of how many people are doing that. >> we've had about 15 hundred inquires since the program start; right? and typically they'll come to our council and get informal advise but note an architect or engineer do a
9:32 pm
screening and look at the specification addressed required. >> thank you thank you, bill. >> good afternoon tom director of building inspection one correction i want to make the soft story it is not 7 it is only one non-compliant and also, we send a warning letter to those of the tier one due to complete their work by 2017. >> no other questions on item 5 b move on to item 5 c update on the major projects. >> tom as you can see the slightly increase on the project
9:33 pm
for the major project by 2 percent any other question you had? >> nope thank you. >> thank you. >> item number 5 d update on code enforcement. >> good afternoon, commissioners dan deputy director of building inspection i'm here to give you the code enforcement and the monthly update for the building inspection building inspection was performed for the most month of february 5 thousand 89 complaints were 3 hundred and 29 complaints response between 49 square miles to 20urz 21 and notice of violation complaints without abated were one hundred
9:34 pm
and 62 and complaint of notice of violations were 32 and second with code enforcement for thirty for the housing inspection services performed 9 hundred and 33 complaints received were 3 hundred 89, complaint response fine 49 square miles to r78z and abated complamdz with notice of violations were 3 hundred and 16 the number of cases sent to directors were 39 and routine inspections were one hundred and 10 as far as the routine inspections the chief inspector we'll report to you on the 13 inspects that are what they're currently doing and it's an agenda item she'll address as far as code enforcement the number of cases 33 and number of
9:35 pm
abatements 26 and number of cases 6 and number of kinds abated were one hundred and 12 and code enforcement inspections performed one hundred and 36 thank you. >> thank you deputy director. >> no questions do we have any public comment on any of the items under item 5? >> okay. as previously announced item 6 not being heard we move on to item 7 discussion and update regarding routine inspections performed by the housing division. >> good morning with respect to routine inspections and commissioner walker mentioned we're effected by 5 vacancies we actually had 6 an individual open medical leave that is back the department has
9:36 pm
been pro-active in the acceptance we have within the last few weeks interviewed for new housing inspectors i believe there will be some positions filled with respect to that effort i do want to thank deputy directors teresa teresa madison and others for assisting on the panel to get the positions filled awhile that's happening we continue to be required to respond to all complaints that come in within 1 to 3 business days for the task force and the field inspects, etc. that's not enough we recognize that things happening in various part of the city and the ongoing inspections citywide that the things need to be done we've got a concentrated
9:37 pm
safety concerns that periodically cluster community and building types and yes, i'm talking about the fires in the mission district we've done we've identified one hundred and 28 building longer than third street to amazon and have notified the property owners coming in into a routine inspection ear concerned with the loss of life and serious bold injuries and also looking for reoccurring problems with life hazards related to egress and other fire issues of the one hundred and 28 all of 6 had their nos sent out this is hollow happened with within the last three weeks and 35 of the inspections have occurred and we're moving so fast two cases as a result of this effort went
9:38 pm
to the litigation committee yesterday two property there were 3 but 2 as a result one property owner the history with the building this is the second and third time we've been out through we're seeing add locks and chains on egress let me show you a picture a picture of a cadillac that looets leads to a roof door this is important there's a fire escape that is a building along the moikts corridor we've cited this before i pook took one look at this it is not even through to the directors hearing it didn't have to be we'll go through this pro is it is referred to the city attorney the message we want to send if you're doing something like that you need to stop we understand there are a phenomena
9:39 pm
going on along the mission corridor with unauthorized entry people using fire escapes to going get into the building we can't have that we can't have the central alarm system out of use there's no skews the fire department tagged it we need to get that into the housing code to have broader coverage we're working with the code enforcement outreach program with the mission sro collaborative and housing rights committee and working with them they give out and they get into buildings fire working groups we're continuing to help them our district inspectors is to assist them to grow this not only in the sro's but the apartment buildings and the
9:40 pm
buildings that have a combination of other building we realize we've got limited resources we want to focus them on what we call the code enforcement focused areas we'll actuates them we hope that the needs arises in other parts of city we'll shift gears and focus somewhere else we know with respect to they're being a lack of housing especially with the tree fire and the devastation we are being pro-active with replaced we'll continue and i want to congratulate our new housing inspector under lopez that helped with this without
9:41 pm
his experience because this happened as a housing inspector for many years we couldn't have done it without you so the staff held and i had four district inspectors we got everybody together to the clerical staff brought their database together and awhile everything else is happening with additional resources we'll do more commissioner walker then commissioner mar. >> i want to congratulate i and thank you both and the director for supporting this again, i think that our - my personal request is that we actually increase the assets that you need the personnel you need and focus on that over the next year to continue this and make that part of our regular response to making sure that the
9:42 pm
buildings are safe we have tens of thousands if not hundreds of thousands of these kinds of building are old don't have the engineering and this safety requirement that the newer buildings have i think this is a really good response and i encourage you and the director to count on the commission to support this effort ongoingly thank you, commissioner. >>the other thing we're trying to do this in a sensitive way the last thing to displace them but not put in in jeopardy a lot of the inspectors are former individual that worked in outreach they have a sensitivity they have that people skills to be able to deal with that and work in collaboration because we understand the 0 moment we leave that this as american people inspector things can change
9:43 pm
padlocks can go anticipating on and things with respect to fire safety this is a calming of the individuals that occupies the building we're collaborated with our outreach partners too >> as a followup is maybe it's time to look at our outreach program to see if we need to increase that effort i think we've talked about that in terms of the seismic program as well as this secondary unit i mean there are issues very sensitive issues around folks in currently illegal secondary units that our priority is to legalize them we've had that issue it has come up even more in those times so if there recent a need for expanding coverage or shifting things around the commission will be
9:44 pm
willing to listen to that as well and support it. >> we actually commissioner are having that dialog we can get an unanimous complaint an illegal unit we may not have the history with the property owner or the building to see there's an issue one the things we intact administration person will ask a series of questions to get nor information so just not to say there's an illegal part of some type of building if we don't have the information there isn't proximate cause to proceed this is i've been looking at the language to see or is to the property owner if you don't let us in there are hazards you need to address them we want to do this in a sensitive way we've
9:45 pm
reached to our contractors to get feedback before we do that. >> commissioner mar please. so thank you very much for this report one of the reasons i was pushing for the rounded inspectors to come back and down or deny nor often property owners pay for those inspections it is supposed to be a service it's to the punitive so what fires happened in the mission the property owner with others proud i have no - of course not we're - we have the practices of having response to the squeaky who's also or the complaints doesn't mean there was not problems if we did a routine inspection if we did one earlier a lot of times a lot of property owners will say to me it's to the
9:46 pm
punitive the routine six the rupert happens and the problem is 30i89d they'll fix the problem and we did a follow-up and you know it was appointment when i met with her the reinspection there's no charge it's not punitive not only the tenant that want the routine inspections by the property owners feel they should have it, too they're paying for it i want to encourage you to keep doing it and any issues regarding staffing commissioner walker and myself will support you and the director in getting all the staff we're entitled to and we have a line i know there are issues about the lists before but that is something else we should make sure is up to date for i to work
9:47 pm
with that human resources is responsible for i want to go back to the way we used to actually district inspectors all doing routine because the district inspectors know best and know to go back to doing the routine inspects and i'm glad for some of the changes that recently happened but hopefully, we'll go back to that and you know that's you know that's all i have to say oh, one other things i appreciate the report but i was wondering if just like the nov report if we could get routine reports so i know that i support your tell us on the mission right now but
9:48 pm
this itself squeaky wheel i imagine the tenderloin is a close second that's where the orderly property are and problems i want to make sure that if we get a written report just like others novs we could a track it, it's great we move on the mission and the tenderloin let's keep at it so see where the routine are happening not just complaint driven but inspectors are going. >> yes. commissioners we give you monthly records and it seems to me there's a miss comics we're doing rupert inspections on short staffed we can't do inspections because of the amount of complaints that will reoccur when we are fully staffed this is what we're doing in the interim and with respect
9:49 pm
to the service you talked about the property owner gets a detailed package that you know includes the you know 36 items their supposed to look at it before the inspection occurs the affidavit with reporter to smoke detectors and smoke alarms that's in the package and the other thing if we write a notice of violation and do a inspection they're not charged that's part of their annual fee after that point if we have to do it, it's different than a complaint we'll continue to do those and the new inspectors that'll that's one thing to make sure based on a detailed procedural manual all of the materials it is detailed what the property owners get it let's us know they're ready to
9:50 pm
go that's part of the process when we get the new inspectors. >> thank you rots mayor for the update. >> any further commission comments any public comment? seeing none, we can move on to item 9 discussion commissioners questions and matters increased staff. >> seeing none. >> none okay. then item number 9 b future meetings and agendas our next meeting will be april 15th. >> commissioner mar. >> so i'd like back on the agenda for the next meeting a more detailed update on the seller project on the permit tracking because luckily i
9:51 pm
attended a recent meeting and want to thank the director and deputy director screening that kind of got hammered to kind of move this forward i'm happy to say that the moving forward and light at the end of the tunnel not only to the two directors but the staff i know the clerks that really have been cranking open the data and something like that but in april maybe we could get a really more updated discussion on the summer project and maybe the rest of the commissioners and the public can kind of know what the prospects when it goes online. >> commissioner walker. >> yeah. it is not on the agenda i wanted it on the agenda ever meeting until we go live and after.
9:52 pm
>> i took liabilities there because i pulled it saying okay we'll give henry a bit of a break and so i of the kind of saying the next time we see him you'll have the golden state but if we need to bring it back and update. >> every month. >> that's why i wanted to thank the staff it is going better and light at the end of the tunnel so lowest the commissioners and public know. >> dual noted. >> along with the new reports we receive every month from the executive teem e team we're going to dr. the phillip project back on and an action item regarding candle stick park project. >> will that be an action item. >> we need to. >> we discuss it as an action item is that under our
9:53 pm
jurisdiction. >> what's a that's what the city attorney is telling me. >> not under our jurisdiction not an action item. >> not. >> can't we take - >> commissioner walker. >> can't we take a recommendation. >> commissioner walker and commissioner mccray. >> john from the city attorney's office the process for issuing and carrying out permit and plan check and inspection are administrative services under the control of the director so those typically are items that the commission can urge a certain type of action there can be a coincidence opinion that forms amongst the commission but they can't they don't have the ability to change how the
9:54 pm
department administers a permit process. >> commissioner walker. >> what's the reality for the administration. >> we're not changing the administration we're asking for it to be administered. >> maybe so we - if an action item if it's put on as an action item the action to suggest something or like a resolution but not binding is that what you're saying and correct the building inspection can make a recommendation to the director the dismay would the department of public health. >> that would be - >> that's not binding. >> that's taco an action through right if we vote on it. >> it's discussion possible recommendation and he possibly action if we can't take an
9:55 pm
action not within our jurisdiction anyway but can't vote on anything analysis its agendized that way correct. >> i'll suggest i could work with the commission secretary on the language of the agenda items so it is clear that to the extent the commission is making a recommendation it is not trooed over into administration. >> great. >> of a permit process. >> we'll work on the language hopefully reflection of what you're saying. >> any other items that anyone can think of and not now. >> items for the agenda be submitted to the commission office by the 8th of april it is just two hectic with the things coming in at the last minute like things today it would be helpful if we get
9:56 pm
them ahead of time it will be helpful for sonya i'm speaking on her behalf it is too crazy when things come in at the last minute. >> so i'll ask. >> sorry mr. secretary commissioner walker. >> i'd like to thank secretary ann for filling in for sonya it's nice having you here. >> it's been nice and sonya is very, very well, i speak with her she'll be back on april 6th. >> do we have any public comment on item 9 item 10 adjournment. >> have a motion. >> so moved second. >> in favor. >> we're adjourned it is 1228. >> thank you mr. secretary you let
9:57 pm
9:58 pm
melgar commissioner mar committee is excused commissioner walker and we're expecting president clinch we have quorum at this time i'd like item b the oath for anyone who is going to be giving testimony will you please stand and raise your right hand. >> do you solemnly swear or affirm the testimony you're about to give will be the whole truth and nothing but the truth? to the best of your acknowledge thank you you may be seated we're on item c approval of the minutes discussion and possible action to adapt the minutes for january 21st, 2015. >> move to approve. >> second. >> any opposed? in favor >> i.
9:59 pm
>> okay. the minutes are approved is there any public comment on item those minutes? seeing none, we may move on to item d a continued appeal case no. 6791921 central avenue we have rosemary the chef housing inspector to give the presentation >> good morning members of the board this was before you in november and december it was continued from january to february to today to give ms. lobe time to work with the mayor's office of housing so with you have at the back of our revised staff report an e-mail from the mayor's office of housing dated march 9 of this year indicated they've can't go forward without proper
