11:30 pm
second street and goes on and on the other night i called the police i said this is a nuisance i'm a taxpayer there's been fidgeting and shouting and career honking going on from twoks in the afternoon i'm giving you the sceney because how could this situation possibly fit into the kind of project you're talking about it didn't work in the big city environment that's what needs to be addressed. >> thanks ma'am our time is up. >> offering that's what the thing was okay. okay can i put a little tiny thing you, you motive think of during the rush
11:31 pm
hour closings the entrance to the freeway there are 3 hunters point other. >> ma'am our time is up you can submit your 09 concerns in writing. >> is there any public comment? >> commissioners i'm john a dissolve on second street the lady is right it starting at 2 o'clock and to 7:30 and 8 o'clock at night would r both directs back up in the morning we get the freight trucks trying to unload and the construction crews are taking the yellow zones now the freight trucks are double packing you have one lane of traffic that takes a half an hour to get from fulsome to second street i'm sorry from fremont to second
11:32 pm
so now that part of the problem can get expanded even more if you cannot lake a left-hand turn if howard to second street now you'll back up traffic further and put and put and put oracle in its shut i've got a problem with traffic control we've got the bryant street entrance into the freeway but that's only for commercial vehicles not commercial by environmentally correct vehicles open that up to the general public comment to try to get into the freeway quicker eliminate the two chapels open harrison street going north i've
11:33 pm
got news it is not 2 channels at night 3 channels there are piecemealing going around the channel to get into the bridge you've got to change that stoplight and start directing the traffic it is the most dangers intersection we get into i want to three or four of the meetings one of the things we agreed on at those meetings why the sidewalks down to harrison now more traffic to the ball park and there's a lot of people are walk that action will not interfere with the traffic problems you've got the food trucks on second street and the
11:34 pm
academy of art buses and ring buses and google buses you've got traffic problems you've got to solve fourth street problem and get that traffic to get to harrison and the bridge you saw some of the things maybe 4r50r7b9 looking second street all right. we've reduced the traffic now the bike lanes i've got more thousand dollars that's my time. >> is there any additional public comment on this item okay public comment is closed. >> commissioner antonini. >> yeah i wagon some of the speakers i think the analysis is low and incomplete i know there is no project option and there are a couple of variants but i didn't side maybe the 1r5i7b9 where you would only have 1 bike lane instead of bike lanes on both sides one of them is 7 feet
11:35 pm
it seems to me if you put a yellow line down the middle the bikes could a travel on one side of the street it is a reality on many nights walking i see the backs up of people will go trying to get along second street and during the day we've heard from the public about the loading zones there's parking on the sides of that street i'm not sure if this is the best street to try to do that on i don't know if theres an analysis over third street it is mostly one paw way maybe more room to put bikes and already the embarcadero is nice to get around so i'm not commenting on
11:36 pm
the actual project but on the report i think we should explore more alternatives than just simply look at the bike lanes going in both directions i'll also mention not 34 houses getting rid of the buses if you're going to do the busses move them to third street the buses have to stop and backs up the traffic so i think we have to try to distribute the traffic over a broader area. >> commissioners any other comments. >> okay. thank you commissioners that places you on item 13 others townsend street an office street authorization. >> yeah. >> good afternoon,
11:37 pm
commissioners rick with the department staff this is a traffic authorization for 2 thousand plus thousand square feet that provides the changing use from pdr to office use for 41 thousand 2 hundred square feet on the first story second-story and third-story to retain gross feet open the ground floor and as opposed it will be leased to an intersect company the department received two corresponds one expressed this ground floor improvements along the public right-of-way and the other expressed concerns over the public right-of-way one the corridorers expressed support due to the change in the ground floor retail use i've
11:38 pm
provided copies for your review the department staff recommends approval with companies with the planning code the project is consistent with the general plan and the project is in a zoning plan that permits office use and courageous the office development and an allocation of 3 hundred 4 percent of office current space available at current rates that pays the impact fees and the project sponsor is present and available for questions that concludes my presentation. thank you. >> project sponsor please. >> good afternoon commissioner president fong director ram and members of the commission i'm jim ruben reuben, junius & rose i'm working with the owners of the building that actually own that this since 1977 he's here today
11:39 pm
i think that is notable i need to not we thought it was an office building there are a lot of reasons back in 1990 when the department created the south end historic district there themselves a survey done that showed an office building since 1997 when the building was purchased a subsequent maim of work has been done all good work with building brit i permitting i don't know why those building permits were released and caused us to be here was not here's sort of a before and after show the second street front and the frontage after is all glazing
11:40 pm
and that's exactly what i think the urban design guidelines wants you to do with pedestrian window line along second street as i say most of the work is already done building itself has been operated for thirty years or so the zoning and this is what dlaevents this building from the other ones with the square 660 third street were office was not allowed this building was m-2 which allowed everything frankly and ss association allows the office principally permitted that use why are we here the tenant who you note to be cloud fair submitted their tenant
11:41 pm
predicament mroogs application and got to the planning department and the planning department held it up looking for what you note to be the case that i call it a uniform but the permit that converts something to office and covers the beyond the scope of work and has a sign off from the planning department we couldn't find that permit the planning department couldn't find the permit i disagreed with the planning commission but over the years that's a time looser so (laughter) you end up arguing for a few months and then do it anyway so we decided to take the path of at least resistance and send out the notice and pay the fees and come here today and seek on office allocation that's what we're here for
11:42 pm
i don't know of any opposition of the merits to this project we did workout the retail there's an mou with the neighborhood about the retail we went further to retail and offering community space to meet at the building we weren't aware but we responded to the lighting on the deblg and sent them something i assume their saved they haven't shown up i hope the absence of john is noticeable it is meaningful i talked to him yesterday and didn't need to be here if you have questions we're all available and the owner is the architect and the architect is here as well thank you. >> okay opening it up for public comment michael as alice
11:43 pm
rogers. >> good afternoon. my name is michael ann though i'm on the board of directors of the neighborhood association and also a member of its retail working group we've been working with the building under the tenant on this project and so i'm here to speak in favor of it you have in your position our letter of support on the 101 townsend i'd like to reiterate this endorsement both the building owner and tenant have worked to diligently accommodate the wishes to make the ground floor assessable we greatly appreciated that
11:44 pm
effort and strongly urge you to support the project more a adjoin comment whether or not a their governed by the second street interim control we hope you'll take into account the needs of the resident in that area our area is becoming tremendously more residential than a lot of folks in the city realize i know there's a lot of pulth and, of course, the giant by the residents are really coming to the forefront. >> the business and the neighborhood associations are attempting to build a vibrant neighborhood that fixed up everyday of the week we appreciate your help in making that happen thank you. >> good afternoon commissioners i'm alice rogers with the same
11:45 pm
south beach mission bay neighborhood association retail working group and i won't take much of your time it's been a long day for you, we support this project our focus the ground floor retail all indications and our discussions with the tenants they have shown an admirable degree of interest in being anti ward facing and enacting with the community as opposed to what is a blight with the windows and window shades that is the first of the interim controls the tenant and the building opener have been cooperative in our letter we asked for 4 particular
11:46 pm
conditions they seem to be complying we hope they do the interim controls for a large building really represent a give back to the building opener by being able to convert the ground floor space to office and hope that transfers into a more affordable rent for the retail space and making the retail space most visible along the pedestrian corridors that's the win-win for everyone and hope our gooths agreement precedes in good faith thank you. >> thank you. >> good evening commissioners
11:47 pm

11:49 pm
electricians abide by the laws i sent an e-mail he directed me to the manager construction cloud fair i'm meeting today i found out the job has not quote been awarded i frthd this is a great chance to send them a letter of intent to possibly work together and they can help strengthen our san francisco community by giving our shops and electricians a chance to work on the job i ask for a continuance we have limited access to the decisions maker and none of your contractor were allowed to bid we only want more time to work out a way to work together open this project thank you. >> is there any additional public comment on this item?
11:50 pm
>> good afternoon, commissioners sue hester i wished to directing your attention to pages two and three of the staff report way the current legislation is drafted on housing you are creating a disincentive for people to be honest and b subsidizing conversion from pdr to office on page 2 it says since 2010 the building has been primarily occupied by office tech's that's an illegal occupation it was without permit without payment of fees since the intent there's been the eastern neighborhoods plan in effect and since 200986 it has been pop-in in effect
11:51 pm
it's been occupied by office tenants by 4 years and you say in the next sentence a chance of use for 41 thousand from pdr to office and you look at page 3 the chart of fees what is the office conversion fee for jobs housing link it is $7.37 alienates it's offset by pdr according to the staff report they've been illegal occupying since 2010 so you have a combination of non-enforcement of the law which should be a very big hefty fine per day for illegal use you have a subsidy from the fee
11:52 pm
because they claim preexisting use of the pdr it's offset by office, i know enough about foes to know the housing fee is 25 there's a square foot they're paying $2 plus i've listened to the entire hearing you had a very long hearing on housing it ises krusht to meet for housing at the same time one of 8 i think it was 81 and this building is coming through and they're being paid to convert illegal to office and they did a conversion to office you need to tell me the board of supervisors you need to initiate legislation if you're cheating if the pdr
11:53 pm
today and going to office next week you've got an argument 5 years ago you don't thank you. >> is there any additional public comment? okay seeing none, public comment is closed commissioner richards to mr. hester's can you comment >> the department staff out of the development impact fees we'll provide used credits based the last illegal use that is the pdr use unless we see a building permit that the building has been commemorated that's how we dealt the impact foes and the pdf has the credit
11:54 pm
so. >> so if it is truly office the report does say guarantee go based on the record. >> we can only rely on the records we've had it as a pdr space to the quakes are the differential and that's the way the state law works we can only charge the differential. >> so if its enforcement if someone recorded and size it's office and now pdr. >> i don't believe it changes it will still be an illegal pdr use originally. >> i think on the project itself you know it is neighborhood support and got mr. anthony and rogers i spoke with
11:55 pm
the gentleman mr. john was absent i want to say cloud force working with the community and offers community space a couple of things i met with someone from cloud fair yesterday and asked on the retail space if they're willing to work with the mayor's office of economic workforce development to look at a small business going in there i'm seeing a needing head i remind we continue to do that with our integrity and i've heard from the gentleman to have a melting i'm sure you'll be open to a meeting potentially are the local trades and the dr as well so i like the project and i move to approve. >> second. >> commissioner antonini. >> yeah. i do have questions
11:56 pm
well, first of all, i want to say wrardz with regard to comments m-2 lout office as a permit use no real reason during the period of time so it was differently to have to change it from pdr to office it explicit make sense so, now an mou for very long m u o allows office mr. ruben i'd like to ask you a question i wanted to know if you have response there were questions earlier raised by the public i see you're interested. >> i'm okay now i may have wanted to comment but what i'm hearing and looks like from what i'm seeing i've heard
11:57 pm
from the sponsor willingness to work with the neighborhood on the mayor's office with a possible retail and also with mr. cop he will and other trades so making sure that as well as possible we employ locally and so i'm supportive of the project it is certainly a busy area down there i'm conforming confirm that being down there i noticed so much more traffic this year than previous years foot traffic and people in the restaurant and times previously we always go to select our giants twikts a group never had so many people as in this case this year. >> commissioner hillis. >> just i think i'm supportive also of the project a question
11:58 pm
for staff the project sponsor talked about how do you make a determination kind of when there there's permits how do you make the determination of the office. >> we'll be looking at for permits pulled and establish an office use in a disrespect location when the record shows for example, a history of pdr uses and then at some point office uses starting to be approved not with a conversion but the planning department signed off. >> in the 80s it was converting did you need approval what form a regular permit pulled. >> yes. typed it's a chance of use with the planning department
11:59 pm
although it is not kicked in prior to 1985 but a day of active permitted for a change of use. >> thank you commissioners is there a motion and a second to approve that with conditions. >> commissioner antonini commissioner hillis o'connor commissioner richards commissioner wu commissioner president fong so moved, commissioners, that motion passes unanimously 6 to zero and places you on item 14 c u a at 3657 terry very well street conditional use authorization. >> commissioners, i wanted to introduce you to andrew pera
