o the city and county. >> i guess i don't understand why it's necessary. >> lisa is looking up the code. >> government code 56381 requires the commission to adopt annually the proposed budget by may 1st. >> by when? >> may 1st. >> that's all you have in terms of --. >> i'm still reading the rest of it. >> so our clerk is still looking at the legislative code so what we can do, take additional comments, i think if commissioner breed still wants to continue , after that mr. lindo and then we'll go to public comment and hope we get an answer. mr. lindo. >> thank you. no, i was thinking, i think the code is going to clarify this. but it seems like there is a legislative requirement that is hovering over your head that
8:31 pm
you need to present something to someone, if i'm not mistaken. but it doesn't have to be an approved budged. is that right? >> we don't approve a final budget until the second of the hearings and this is our first hearing. >> is it possible to approve a budged submitted by our executive director and you need to relay that information to, that we've relayed it and we will be voetding on it at our next meeting? >> are you talking about the proposed budget or the final budget? >> it sounds like you need a vote to say that we saw them, it's under review, and we will vote on it for a final version at a later date. >> from what i understand of the process is we need to knowledge that we've done this and that we're communicating a proposed budget. it is not by
8:32 pm
any stretch of the imagination a final budget. there is still work that needs to be done on t because we have may 1st to do it, you could decide not to do anything, but we would have to have another properly noticed meeting. >> we could also just take action next week and have an official vote next week, next month. correct? >> correct. one of the things to keep in mind. >> you could decide we need to do another properly noticed meeting. there's a special notice that needs to be put out. >> let's not belabor this. if we're not ready to have a vote, let's not do a vote. i'd rather work out the differences over the next month, not just coming to the next lafco meeting but working with our offices and the folks here and
8:33 pm
the clerk in the interim and then we can have a spepbs going on next lafco meeting. i don't want here next lafco meeting unless they change the date. so why don't we open this up for public comment? >> good afternoon again, commissioners, eric brooks, san francisco green party, our city and san francisco clean energy advocates. so on this item i would also, i'm kind of glad you are postponing this. i understand where director fried is coming from, but i think there's a lot that needs to be thought about. one has to do with the budget for the director and staff themselves. we expect that community choice will probably
8:34 pm
go along swimmingly early next year. however, i just want to remind, i know you have heard this ad nauseam, but it's so important that the reason the advocates have pushed this program for so long and worked to get it off the ground for so long is my tenants said the local buildout. that may not be flushed out entirely and we may need commissioner porter and diligence than we might think. so let's be prepared. after cca does get off the ground, i think there are so many things that are so crucial that are coming up. once cca is put to bed, myself and a lot of other advocates community broad band is are groiing to make that our no. 1 priority. we've got the public banking issue that was brought up by
8:35 pm
commissioner avalos that also may need to be explored. we've got issues of getting the mta to expand. i think the role is lafco is to get the city to do a more visionary policy, then we've got some very serious housing issues that we want to take up with study work at lafco. there's a lot of stuff we need to fund and i would urge you to give yourself the latitude to be flexible and able to do this. we've been able to do this. we've been very generous . >> thank you very much. we will close public comment. this item do we want to continue or we can file it. >> i would suggest continuing it to the next april meeting. >> so we'll continue this item to the call of the chair. we can take that, colleagues, without objection? >> first and second?
8:36 pm
>> actually, mr. chair, if you would like to make plans to change the meeting so that you are able to attend in order to participate in the discussion around the budget i am open to that. so i'm not certain that we should specify the date that we are going to hear this item. >> question, can i -- do we have to do a decision here to change the date for next year's meeting or in the interim we can do that? >> we can do a pole and find out which would work, i would have to check with the clerk's office about proper neat ising so we can get that notice done properly. >> if we can have a motion to continue this item to the call of the chair and then we can set the special date. >> so moved.
8:37 pm
>> motion from commissioner breed, seconded by commissioner cruz and we'll cake that without objection. >> okay, let's go on with our next item. abl there's a lot to add. >> can i call the item first? item no. 5, executive officer's report. a, status update regarding the study on the implementation and opportunities for undergrounding wires and expansion of fiber networks in san francisco and, b, status update regarding the study on open source elections. >> we're moving forward through the two items mentioned. we should have a report next week on the undergrounding expansion report. we should have something next week and i will put it out on the web site, submitted to all the folks who i know are submitted on our side and then give a presentation the next meeting about that report and we are
8:38 pm
continuing to work on the open source one as well. we might have both reports ready to go for the next meeting since we have our amazing intern working on that one. finally, just a reminder, that april 1st is when your sunshine ethics and form 700 forms are due. if you are a member of the board of supervisors and you filled it out there, you are covered. please get your forms and stuff in so we have 100 percent participation. thank you. >> great. this item is now open up for public comment. public comment is open to the executive officer's report. >> good afternoon, iep steven edwards from the san francisco coalition to underground utilities. first i'd like to thank director fried for his assistance in trying to get the undergrounding of electrical and communications telecommunications utilities
8:39 pm
undergrounded. this is a perfect use for lafco and i would agree with previous speaker who said that the budget for lafco is exactly to study this kind of thing and for you to continue to have an adequate budget means that an infrastructure project that cannot be researched by individuals or the general public can still be funded and studied by lafco. so thank you very much, director fried. >> thank you, any other member of the public who would like to comment? seeing none we will close public comment and go on to our next item. >> item no. 6, public comment. >> public comment again. any member of the public who would like to comment? seeing no one come forward we will close public comment and our next item. >> item no. 7, future agenda items. >> okay, colleagues, any future issues to bring forward? okay, we will have public comment on future agenda items

8:41 pm
as a society we've basically failed big portion of our population if you think about the basics of food, shelter safety a lot of people don't have any of those i'm mr. cookie can't speak for all the things but i know say, i have ideas how we can address the food issue. >> open the door and walk through that don't just stand looking out. >> as they grew up in in a how would that had access to good food and our parent cooked this is how you feed yours this is not happening in our country this is a huge pleasure i'm david one of the co-founder
8:42 pm
so about four year ago we worked with the serviced and got to know the kid one of the things we figured out was that they didn't know how to cook. >> i heard about the cooking school through the larkin academy a. >> their noting no way to feed themselves so they're eating a lot of fast food and i usually eat whatever safeway is near my home a lot of hot food i was excited that i was eating lunch enough instead of what and eat. >> as i was inviting them over teaching them basic ways to fix good food they were so existed. >> particle learning the skills and the food they were really go
8:43 pm
it it turned into the is charity foundation i ran into my friend we were talking about this this do you want to run this charity foundations and she said, yes. >> i'm a co-found and executive director for the cooking project our best classes participation for 10 students are monday they're really fun their chief driven classes we have a different guest around the city they're our stand alone cola's we had a series or series still city of attorney's office style of classes our final are night life diners. >> santa barbara shall comes in and helps us show us things and this is one the owners they help
8:44 pm
us to socialize and i've been here about a year. >> we want to be sure to serve as many as we can. >> the san francisco cooking school is an amazing amazing partner. >> it is doing that in that space really elevates the space for the kids special for the chief that make it easy for them to come and it really makes the experience pretty special. >> i'm sutro sue set i'm a chief 2, 3, 4 san francisco. >> that's what those classes afford me the opportunity it breakdown the barriers and is this is not scary this is our choice about you many times this is a feel good what it is that you give them is an opportunity you have to make it seem like it's there for them for the taking show them it is their and
8:45 pm
they can do that. >> hi, i'm antonio the chief in san francisco. >> the majority of kids at that age in order to get them into food they need to see something simple and the evidence will show and easy to produce i want to make sure that people can do it with a bowl and spoon and burner and one pan. >> i like is the receipts that are simple and not feel like it's a burden to make foods the cohesives show something eased. >> i go for vera toilet so someone can't do it or its way out of their range we only use 6 ingredients i can
8:46 pm
afford 6 ingredient what good is showing you them something they can't use but the sovereignties what are you going to do more me you're not successful. >> we made a vegetable stir-fry indicators he'd ginger and onion that is really affordable how to balance it was easy to make the food we present i loved it if i having had access to a kitchen i'd cook more. >> some of us have never had a kitchen not taught how to cookie wasn't taught how to cook. >> i have a great appreciation for programs that teach kids food and cooking it is one of the healthiest positive things
8:47 pm
you can communicate to people that are very young. >> the more programs like the cooking project in general that can have a positive impact how our kids eat is really, really important i believe that everybody should venting to utilize the kitchen and meet other kids their age to identify they're not alone and their ways in which to pick yours up and move forward that. >> it is really important to me the opportunity exists and so i do everything in my power to keep it that. >> we'll have our new headquarters in the heart of the tenderloin at taylor and kushlg at the end of this summer 2014 we're really excited. >> a lot of the of the
8:48 pm
conditions in san francisco they have in the rest of the country so our goal to 257bd or expand out of the san francisco in los angeles and then after that who know. >> we'd never want to tell people want to do or eat only provide the skills and the tools in case that's something people are 2rrd in doing. >> you can't buy a box of psyche you have to put them in the right vein and direction with the right kids with a right place address time those kids don't have this you have to instill they can do it they're good enough now to finding out figure out and find the future for .
8:51 pm
the roll call sxhaerp commissioner hayon all members obey present first is public comment on the appearing or not appearing on the agenda with the simplification. >> i came to talk about a need for responding to complaint both filed with you as well as those referred to the suspect ordinance task force because i'm involved in would both aspects of complainant an incident in december of 2013 when i complained about nearly a year ago i've never heard a response nothing not to say we're looking at it it self-come within our jurisdiction silence that's a
8:52 pm
problem because what i was on the commission about mike dparz we talked about whether complaints what about stale so the fact i've not heard makes me wonder maybe i h had a valid point but want to talk about the complaints referred to the shoerns task force i've had complaint where i got a unanimous or overwhelming vote sometimes i'd get a response you don't think this would hundred thousand dollar hold up in court i spent time on the task force envelope was there a draft of minutes or instruction to the shoerns on those saying there has to be a court lawsuit case
8:53 pm
present to ethics that's not been communicated to the task force or communicated to complainants when we make a complaint i have several overwhelming unanimous decisions get figuratively gotten away what is your criteria and not just as board statement it didn't meet evidence for a court kinds why not made known to the larger public nor the task force that's the timelyness of preponderance response to compliment those foiled directly to you and sunset in another matter i saw minutes from 2008 people talked about the need have a priority may not but
8:54 pm
dismissing complaint will have overwhelming support seems like you're not paying attention to the task force maybe they need education but you can't say no and walk away. >> can i get the overhead there you go members of the administration ryan heart from open government i'd like to read this quote from kennedy in the citizens unit case the government may comment a constitutional wrong that identities preferred speakers by taking the right to speak if some and give it to others the government denies the person the
8:55 pm
right to establish work and respect for the speakers voice the government may not deparagraph the public to determine for itself what speech and speakers are worthy ever consideration the first amendment protects speaker and speech and the jed idea from each i'd like to agree with our timeliness and here's why i agree i have 19 orders of determination every one has failed to be enforced by you the last one was the city larger than and held a hearing to announce it the day i left the city to go out of the state i was not given notice by e-mail or postal mail a hearing was held when it gets to point you can't dismiss them like in the past are go do an enron i think
8:56 pm
that some real questions need to be answered when you look at 19 times are you going to say their all faulty this is a pattern of behavior of city government because i speak about things they don't want spoken of or access to records they decide they're not going to follow the law if you look at those cases each is a first amendment case in the official record and the right to access public records i need to effectively experience by first amendment you're going to tell me 19 cases none was worth our consideration in fairness i've come to you before and is a the good government guy says you have to give the
8:57 pm
appearance of fairness you can't look at those 19 cases many have not had a hearing and saying in any way, shape, or form you're in anyway being fair to me, i'm not paranoid under of other members that try to get public records i have the perseverance to take it to the whole crap deal to get those orders when are you going do get off our backside and enforce the law this sunset says this body is responsible for endorsing the law. >> i guess i would be one of the people that are having an enormous amount of problems unfortunately, i'm an all over the i have a simple permit it's a mess they have a communication
8:58 pm
officer who didn't communicate it she decided to give documents they're completely irrelevant this has been spending the last 5 years the majority of my time is getting simple documents simple questions asked regarding permit reluctance a little bit information here and there i can't get it i'm not going to take you through what it is like to work in a situation like that but in 2013 they held a hearing to revoke my permit without importing and exporting me and denied me my due process rights i was in the hospital when the hearing took place i was slander they did not know how to run public meetings at all mr. hearts was there defended that
8:59 pm
he that was on by doing a public record search by my name they filed a case at the same time i had to wait for that to close out 3 medias later and filed on appeal and one and since that time i'm afraid that work in the streets it's not a fear of retaliation only lies in venting incidents that haven't happened and trying to get bits and pieces of information point me to the code point me to the ordinance or the section that would be regarding bottle caps as stupid as it may sound at the can't get it today and everyday i go through that i am am afraid to go to their office last month
9:00 pm
you ring a buzzer to get to the door i rang the buzzer to get a money order it takes a few minutes instead, they denied me assess a woman manager went to the guards desk and claimed to call 9-1-1 a restraining order against me i've endured this for 10 years. >> mr. chair what sort of permit are you talking about. >> it's called a street ordinance permit i have it many my bag my health is at stake it is urban bearable for me through the street artist
