it explicitly outlines guideline principles and practices. open house supports the lgbt long term facility rights and together with california bill 663 requires [inaudible] this bill would strengthen the importance of the training. open house is the forfront of training since 2006 and here to support other advocates and implementation of best practices. 3:31 pm
senior houses. thank you >> thank you very much >> eliz beth gill and a senior staff attorney of aclu of northern california. i want to say thank you for introducing this measure. we support it, it is a important civil rights measure for a vulnerable part of the population. thank you >> thank you very much for being here. >> hello, my name is daniel [inaudible] and i'm a attorney with transgender law center and i'm here on behalf of the organization to, press or support for this orbd nns. i will be short and sweet. i want to say this ordinance will improve access to necessary long term care facilities for lgbt community members in
3:32 pm
particular our transgender community members and in doing so it will insure the seniors receive the necessary care that they need. thank you. >> thank you very much. is there any additional public comment on item 1? seeing none mr. chairman may we close public comment? >> sure public comment is now closed. colleagues do you have closing remarks? >> mr. chairman thank you for hearing this today and colleagues for all your words of support and encouragement and [inaudible] thank you for your moving remarks. i think it is one of these reoccurring issues in the community about when people talk about for example, marriage about why does the word matter and part tof is the broader issue about recognition of relationships of
3:33 pm
all shapes and forms and the nightmarish situations that all too many peep have gone through for many decades whether it is in the long term care facility or in a hospital or when-if a partner dies and their spouse isn't on the morjage and the family comes in and takes the home back and kicks them out. this legislation will be a step in trying to avoid those type of situations, so colleagues i would request that the committee forward this item to the full board with positive recommendation >> thank you supervisor wiener for your legislation in this. any other thoughts on this from the colleagues? seeing none. supervisor christensen >> that is a reminder for everyone to get legal. as someone that speent my muddle
3:34 pm
adultd years as a single person in a relationship, love is a good reason but legal clarity another. i hope you will take the opportunity where appropriate >> can we vamotion to forward this item to full board? any objections? motion passes >> thank you colleagues >> madam clerk item 2 >> ordinance [inaudible] prohibit drivers of tour buses [inaudible] >> so as people are leaving quitely we'll proceed. colleagues as you know i introduced this legislation following the tragic accident which took place last year in front of city haul. a tour bus driver was driving and acting
3:35 pm
as a tour guide when he fately struck [inaudible] crossing polk street cross walk. [inaudible] from the san francisco police department stated on that day there appeared to be an occasion here where the driver were more focused on the land mark to the right in this case, city hall as oppose today the road way. after research i discovered existing laws do not impose restrictions on their ability of tour bus drivers to narrate a tour while drivering. this legislation will amend the transs portation code to prohibit drivers of tour buses to narrate while drivering. i coauthored the vision zero policy adopted last year. the policy that makeatize the goal
3:36 pm
to end all [inaudible] by 2024. and this is only to me another effort to get to those goals. according to california traffic safety survey in 2013, 36 percent of california surveyors thought talking while driving posed the biggest safety problem on california road ways. nearly 70 percent of the california driver surveys said they have been hit or nearly hit by a driver who was talking or texting on their cells. stats show drivers and cell phones even hand free arefore times more likely to crash and hurt themselves or someone else within 5 minutes of make agcall. texters are 23 times
3:37 pm
more likely to crash. more thran 3 thousand people are killed this way each year and 300 thousand to 500 thousand are injured. this legislation is a step in the right direction as it relates to distracted driver and believe it will make our streets safer for pedestrians. one more stateagy is for san francisco to reach the zero goals. i understand the legislation will have limited impact as many of the tour buses may be going in and out of san francisco and will be under the jurisdiction of the california. in the mean time while we are waiting for this to pass i have been in discussion with the state legislators asking them to
3:38 pm
carry it at the state level so we can strevlen or efforts here. so, i would like to ask my colleagues at this point for any comment that they may have. supervisor christensen >> district 3 obviously has a lot oftoryism and support thetoryism and all portions of it however we have had residence struck by tour buses. i think compicating the fact that we have a lot of london style tour buses on the road with the driver on the opposite side. a 98 year old neighbor was struck a couple years ago and i was all most mowed down by a narrating wrong side driver about 2 months ago so i
3:39 pm
know as we increase pedestrian safety this is a big issue for us and hope the tour bus driver by including taped spiels or let's up the job market and bring on another person, i hope they could provide a safer experience without hurting the baultm line too intensely. i would like to say troothe extebt this ordinance may have a impact on making district 3 saerf i support it >> supervisor bree >> i want to add a couple comment. i appreciate this legislation because i think is needed. there are a lot of challenges in my district as well with tour buses. specifically when the tour buserize driving through nairblds they are loud. i know
3:40 pm
this legislation won't change that and we are looking into that because that is a issue as well, but this is definitely a step in the right direction and think it is important that when we are driving or when tour bus operateers are driving in the city that are operating the buses safely and there is someone senerately who is communicating and talking about what they are saying. when i visit other countries that is how it was done. there was a bus operator and a tour guide, so i think it is time we start moving in the right direction to make sure that we place whatever regulations we can because ultimately this is about public safety and glad we are looking at moving in this direction. thank you supervisor u >> thank you supervisor bree. are there public comment at this point? if there are line up to the sign on your right and i see that there are some
3:41 pm
people that filled out cards so i should call them up first. rudey [inaudible] ordel [inaudible] aenthany [inaudible] eric [inaudible] tour bus number 2 and john [inaudible] >> [inaudible] my name is rudey [inaudible] director of operations for the national filipino organizations called [inaudible] i'm here to take supervisor yee for sponsoring the legislation. thank you supervisor. what we do today is send a strong message to tour bus operators and drivers. what happened to our 68 year
3:42 pm
old senior was a tragic and i'm hoping that having this legislation will prevent serious injury. more importantly i'm happy you will also take this up to the cpuc in sacramento because we have other areas where we can prevent this tragied from happening. i fully support this legislation and thank you again supervisor >> thank you >> good morning supervisors >> don't forget to acknowledge that [inaudible] former commissioner for city college >> thank you. [inaudible] general counsel of the national federation of filipino american association. i would like to
3:43 pm
thank supervisor yee for this necessary legislation t. is unfortunate it had to take the death of a beloved community worker and bring this type of legislation. we pass rules prohibiting people from using their cell phones, texting, doing anything that will distract people from driving because we put a great premium on the safety of the people and pedestrians and this is worse than any of those because a bus driver who is busy and forming the passagejures about the city hall and other attractions will be distracted from looking right in front is what happened with mrs. prusilla [inaudible] while i understand that this is limited, it starts the process where important state legislation can begin to
3:44 pm
correct what is obviously very needed. i cu-mind the supervisor and hope this will be approved as soon as possible and be brought up to the state and get it enacted where it should be. thank you >> good morning supervisors, my name is aenthany [inaudible] i'm a attorney and also a [inaudible] i echo everything [inaudible] i also cu-mind yoi and your comment earlier. it sounds like this legislation is supported as a member of the legal community whos clientele suffers from severe injury i'm supportive of this legislation to protect the members of the community, not only ourselves, but the constituents of the great city and visitors and guests. thank you and keep up the good work.
3:45 pm
>> good morning supervisor [inaudible] san francisco travel association. as you know in 2013, 16.9 million visitors came to san francisco and contributed 9.4 billion to the economy and many enjoy using moter vehicle tours. it provides with a number of option tooz learn about the city. this includes lanchlg and small operators [inaudible] we are appreciative and encouraged by your efforts to address the safety of not only the residence but the visitors who use these options. [inaudible] requires all tour drivers to use hands free communication technology. we caution the board to make sure
3:46 pm
any regulatedtory approach developed will not have the unintented consequences of limitingtory options by making the [inaudible] small and less popular options cannot apply. we are aware the supervisor has engaged in discussion with thetory operator industry and encourage the city to be open to continue that dialogue as this meser moves forward and also as it is imlmented in order to insure and address any unintended consequences. thank you again for looking out for the safety of our visitors >> thank you >> good morning supervisors. my name is [inaudible] san francisco bicycle coalition. i want to thank you for holding thishering on this issue and legislation. we think this is a pornts peess of legislation [inaudible] a reminder to the operation rerate of large
3:47 pm
vehicles of the responsibility they have when they get behind the wheel. we thank supervisor yee of taking the initiative of this issue and look forward [inaudible] as a member of the nob nub feel this is important legislation. the san francisco bike coalition is working on the large vehicle driver training program and hope that many of these tour companies will buy into the free trainic program that will launch this year training on bike safety >> following the next speaker is [inaudible] no, come on. following you >> thank you. good morning members of the government and audit oversight committee. [inaudible] on behalf of [inaudible] we are here to fully support the proposed
3:48 pm
ordinance amending the transportation code to prevent tour bus drivers while narrating while driving. [inaudible] in response to the death of prusilla [inaudible] that morening just outside city hall in broad dilight following the law across a clearly marked cross walk pursy was not prevented from being struck and killed by a bus driver who didn't see her as he was narrating. poses a risk for all users rsh but most of all those that walk and bike. while california law currently bans texting and hand held cell
3:49 pm
phone use, a recent study by the national safety counsel comparing 30 studies found when comparing dreeurfb performance between hand held and non hand held free phone there is no safety benefit for those using hands free. whether you think hand held or hand free phone, all drivers experience cognitive distraction during conversation. this leads to risk such as attention blindness where drivers fail to see 50 percent of that in their window [inaudible] insureing tour bus drivers are focused on their vehicle is critical and due to the large size of the vehicles is key and will save lives >> thank you [inaudible] >> thank you for inviting me
3:50 pm
chairman yee and maybes of the committee. i teach the adult bike safety program for the city. i also teach [inaudible] operateers under the program safety and [inaudible] i produced 2 videos in san francisco on safety both dealt with distracted driving for bus drivers and also [inaudible] i just want to say-i myself have been nearly a victim on market street when a bus got 1 inch from my handle bars. [inaudible] he could see coming up to me and still all most managed to hit me and that would have been a bad accident. distracted drivering is not the use of your hands or extrimties or talking, it is just distraction when your mind
3:51 pm
is taken away from driving. taking away from it in other ways isn't a remarkable benefit. unfortunately stats on distracted driving show low because you are not charged on a citation unless there is a witness who corroborates it and where it goes is unsafe speed so when you see the stats of unsafe speed i say a high proportion is due to distracted driving [inaudible] i urge you to go ahead with the legislation you are considering >> any other public comments on this item? seeing none, no closed. colleagues any comment? seeing none. i don't think. my closing comment on this is that i grew up-i'm a
3:52 pm
native san franciscan so i understand tourism is very important in the city. i don't necessarily go on a lot of tour buses when i travel on vaiication, but once in a while i do and all most everywhere i have gone there is a driver and narrator separate. i don't believe this will hurt tourism business here. i want to make sure that not only are the residence in san francisco are safe, but also the tourest themselves. with that is there a motion? without objection this passes. thank you very much for coming. madam clerk, item number 3 >> hearing on the
3:53 pm
implementation of participatory budget projects [inaudible] requesting various departments to report. >> thank you. last year my office organized the first ever budget for district 7. the residence were involved in every step of the program. they submitted applications for fundsing, spoke with city staff to finalize their projects and voted to select the project that receive funding. district 7 has the highest number of votes, more than 1 thousand people voted both on line and in person. 9 projects were funded under the pedestrian safety and a total of 160 thousand and 6 projects were funded in the general project
3:54 pm
category [inaudible] including funding for park improvement, interactive are dar, [inaudible] and scholarship for teens. i want to insure we keep our promise to the renz dns. we spent hours and hours preparing their projects, speaking to the neighbors and getting people to vote. 6 months after the vote only a handful of projects have been completed and i want to insure that we keep or commitment and deliver these projects as soon as possible. now we'll hear from a number of departments on the status of the project awarded in 2014 and it is important to sigh this as a learning experience. it was the first time district 7, but district 3 had 2 years of this and district 10 i believe is
3:55 pm
going through the second year just like we are. one of the things that i want to insure is that we learn from this experience to make it even better in terms of the process and efficiency. i'll call the speakers and we'll come up from different departments. so, could i have from sfmta, miriam surel? >> good morning chairman uand member thofz committee. thank you for having me today. [inaudible] team of planners and engineers in the [inaudible] sfmta. ile rrb run through the 9 projects that
3:56 pm
were from this budget project and i'll go through them quickly and focus on some of the broader issues and ideas that we have for future rounds. we had 4 applications for speed raid arsigns and happy to report we have been going through a process that we started about a year ago to obtain 35 new raider signs and we are switching to solar powered sign and those should come in the next few weeks so once we get thos we can make the final design details and should be in by thends of july. we had 2 applications for-4 different locations for [inaudible] such as speed humps and just got the speed survey results back and found 2 location qualify. the next step for those is send ballots to residence of the streets to
3:57 pm
insure there is support for those measures and if they are approved we'll add them to our queue for public work to implement the speed bumps that should happen later the summer. there are 2 locations where there is stop [inaudible] one is at [inaudible] as you can see on the pickler on the left we installed [inaudible] on tuesday we are excited to be implementing our flashing beacon parole. at [inaudible] we have the elements in the work. we'll add continental markings. you can see the cross walk is fade squd we'll exthend signal timing. we had 2 locations where there is more study required. one is also at [inaudible] where we we'll look into what it will cost to open
3:58 pm
a cross walk there and improve access ablt. we had a study on melrose avenue leading to sunny side park where we are wrapping up the memo that we will share in the next couple weeks for what we can do in the location. there is a lot of the information we need today move forward so the muneication we am with residence is more like a e-mail or phone call to let them know we are looking at those locations and some general information about the process or time line for some of those. now i want to switch and talk about the broader issues. i want to start by saying we recognize that there is a opportunity for us in the future to be clearer about what time lines are for these things. i won't go throw every step, but generally speaking we do need oo go through each step to implement the basic measures
3:59 pm
like stop signs or speed humps and each can take 1-3 months so it adds up. there is something of a back log of work we are trying to get to. when we receive funding it can take 8 months to [inaudible] we are work ing on hiring. [inaudible] insert into other processes and get to them earlier. i also want to highlight there are options we can do much faster than others. particularly things that don't require brand new engineering designs. epigrading marked cross walks, refreshing street markings rkts adding green paint to bike lanes, those are great projects to implement quickly. i also want to talk about some of the existing processes we have. one thing we found is a lot of the
4:00 pm
applications receiveder said we do have processes where people can apply at any time through submitting a application for speed humps or island or get a new cross walk or stop sign. people can apply for those at any time and on the last slide we have nrfckz about how to apply for that stuff. we need it make sure residence know thereat is available year rounds [inaudible] i want to wrap up by describing something we saw. some of the best applications described the issues rather than the solution that gives the engineers to [inaudible] having a face approach for the projects where we have funding in one year to do a kudy and recommend a few different alternatives and then cost. this is what we did with sunnyside safe
