clerk. colleagues it is part of the broader regional implementation effort led by the association of government staff. they are working with local jurisdiction squz the sogez of bay area government. the administrative committee and regional planning committee i sit on with the transportation chair. we are develop agpriority consurivation throughout the region thrmpt are different kinds of pca or priority conservation areas throughout the region that promote the space and human health. last december in 2014 we passed a resolution authorizing a process nullifying the 4 priority connoisseursation areas and the planning

department was directed to study and select new areas to be brought before the board before may 30, 2015. following that process the planning department led a working group to study the topic that consisted of the department of the environment and the reck and park department as well as non profit agencies. but also the california native plant society and [inaudible] alliance to work to determine new areas for nomination and this is really important in maximizing and expanding open space. the agency developed a new group of 4 pca's while incorporating the original idea to more clously represent urban city policies ewe adopted over weent years and we selected these different areas using a more focused scientific aroach

to determine which areas are in the greatest need. for pca selected include pulow fellms natural area, bay view-it is south east neighborhoods of the city. also green connections in mu claren park, pivot and number 4 is a trail connecting twin peeks. i think these new areas represent a collective program that will improve the city open space, city lands and parks and look forward to your support. thank you to the transportation chair chilly chang and the planning committee i work on for promoting urban areas as a key place sfr conservation. i also introduce with my colleagues about language equality and multilingualism in the future of the city to make the city as

great as it can be for the diverse language groups. nearly 40 years ago the u.s. supreme court in low versus nickels established language rights and equality as a key goal of equality and equity in school systems and cities. the chinese for affirmative action with a coalition of immigrants rights group advocateed in the late 90's for equalrectomies of servess. nearly one half 06 of the population of san francisco speak a language other than english and 40 percent are born outside of the u.s. so this is about equal access, equality of language and equity for services in the community. i want to thank you the cosponsor supervisor squz also [inaudible] helped to update the language access ordinance in 2009. my office continues to work with theophorous of

civic engagement and immigrant affairs and the community coalition. the language access network to insure adequate translation interpretation services are provided to the limited grsh speaking communities. i want to thank [inaudible] and merby others who worked on language equality and kenny low the kid from 1974 that went to gene parker school like supervisor yee and they united with other immigrant [inaudible] multilingualism as a key volue. i think the hearing request will look at the language access report by the office of civic engagement and also look at the ordinance supervisor yee is working on with translation services like the school district to bring it within the city or the ordinance that i and supervisor

yang and others pass today eliminate the teared system so all deparmtz are held accountable to the needs of the immigrant and limited english speaking communities as well. since the implementation of the 2009 ordinance, the cities expanded not only to chinese and spanish speaking, but last year the community advocateed the filipino and immigrants communities to at [inaudible] as a required language that must be provided to the community. [inaudible] office of sieving and immigrant relation affairs also provides russian translation. pleny of them live in the richmond district and spread throughout the city as well. i look forward to the laering with the colleagues to review language access and language equality and multilingualism within the

city within the departments and aenshs. we are working with imgrnlt community organizations to insure the departmenterize living tupe the sometimes lofty but important language equality policy in the city. the rest i'll submit >> thank you supervisor mar. supervisor compose >> i have 2 items today and 1st want to begin with a resolution and want to thank supervisor wiener for cosponsoring, authorizing the plaiment of a side walk plaque in front of the lexington club located at 3464 lexington street which will be closing shortly. the lexington opened in 1997 as a neighborhood space for the dike, queers, artist musicians and neighborhood folk that surround it and they

succeeded in priding that community a space. for 16 -18 years it is vibrant community and left the mark in the neighborhoods. we want to commemorate of the contribution of the space by having a plaque placed by the side walk so we look forward to wurging with dpw department to make that happen. the next item is a item that i think all of us here at the board had something to say about it and that is the issue of the regulation of [inaudible] short term rentals, whatever you want to call it. today i'm proud to be

introducing legislation that will greatly increase the cities abilities to enforce our short term rental law. this [inaudible] law. this legislation essentially responds to what we have heard from our planning department staff. the staff that is charged with the enforcement of the legislation has in no uncertain terms in very clear language indicated that the law as it currently is written is simply unenforceable. my legislation, this amendment has a number of key component and i want to begin by thanking supervisorarve lose and mar for cosponsoring the legislation and i know that there are a number of colleagues who have been working on this issue including supervisor kim and look forward continuing to work with her as this item moves

forward. the first thing the set of amendments dus and let me be clear that all of us who talks about this may disagree how to regulate the industry, but all support short term rentals. weknow short term rentals are a part of san francisco and here to stay and i know many people in my district and throughout the city who are involved in short term rentals who are making contributions to our community. that said, i think that those of us who have been talking about this believe that there should be reasonable, fair regulation of this industry and i respectfully submit the law passed last year does not constitute what i thipg we would like to see, which is

fair, reasonable regulation of this industry. the fact is, unless we are able to enforce the laws we cast, the laws become meaningless and that is exactly what has happened to the air b and b law. the regulations and requirements that it establishes are essentially a paper tiger because it has no teeth. the components of my amendmenterize the following, first it sets a limit of 90 days for short term rental-short term residential rental regardless if hosted or unhosted. unhosted to 90 days and allows hosted rental with limitation year rounds. the planic department clearly told us it is virtually impossible for them to enforce the 90 day

limit for unhosted units because it is impossible for thim to know for sure whether a unit is hosted or unhosted. they have said it would greatly improve enforcement if sthra clear guideline for both types of rentals thmpt 90 day limit will help protect the supply of permanent housing available to san francisco because it limits the total number of days in a year a home or apartment can be offered for tourist rentals. we want those units to be offered for housing in san francisco. the second item that this amendment does is it requires hosting plat forms to provide data to the planning department regarding the number of noits a unit or room is rented. the planning department stated repeatedly that they need more data to

enforce the law. the asked to provide that data and the response from [inaudible] has been we will not provide itinous you subpoena the information and then they would fight a subpoena as they have done in other jurisdictions like new york. my law will create a provision that requires hosting plat forms like air b and b who have access to data to provide monthly data to the planning department on the number of nights each unit is listed by the individuals who are registered. this way the planning department has evidence of whether the 90 day limit has in fact been fallowed without being to get that information there is no way to verify compliance thmpt third item established fines for hosting plat forms that list unregistered short term limits.

it allows a fine of up to 1 thousand dollars a day against plat forms if they offer tourist rentals on their sites for units that registered with the sit a. we know all are thousandoffs units that are being rented, but when the hearing was held only a few dozen units were registered with city. a requirement is meaningless unless we impose penalties when unitss are listed without registration. the 4ths item preserved neighborhood by prohibiting short term rentals in rh 1 d neighborhood, which are zoned for no commercial actirfbty. we don't want to introduce commercial activity in the quite neighborhoods. for 50

yours the city zoned for certain activity of neighborhoods for preserve that those neighborhoods and we want to include this requirement. finally, we expand the right of action so that people effected by a nearby tourist rental can go to court to enforce the law. this provision allows those effected the right to go to court to enforce city law on short term rental. people effecteded could include and there are a number of people that can be impacted by this, next door neighbors and tenets or owners who live in a buildsing where a short term rental is offered. this provision includes damages, attorney fees and civil penalty up to 1 thousand dollars. we believe and look forward to discussing this that this provision is critical in termoffs insureing enforcement because we need a meaningful

prescribet right of acaction tosupplement the enforcement done by city staff. to date the city attorneys office because of the work that-there is no violations we only received 2 claims. we know there is a lot more activity taking place. a neighbor as the law stanlds has it hire a private investigation to proov the violation took place, something that is very difficult and costly and basically impossible for most residence. if we do not create a meaningful private right of action with adequate damages, only the wealthy can afford to bring claim tooz court and see enforcement happen. this provision empois all san
