12:01 pm
commissioner frost commissioner lee commissioner joseph commissioner moshoyannis commissioner cavanes commissioner tan and we have quorum and it is seems commissioner perez. >> commissioner perez is yeah, still out of the country so we haven't heard specifically for how long that will be. >> great well, we have quorum that's all that matters the first item is public comment any items related to the entertainment commission you don't see agendized any public comment oh there's one. >> good evening, commissioners i'm steve even i would like to say that the limited live pirates are popular that is a great sign and a lot of the cv dices want to stimulate the
12:02 pm
businesses as accessory use some of the businesses that want to participate the second sunday they may not serve food or beverages so they may not meet the criteria or the distinction eyed so it didn't fall under your jurisdiction i'm hoping that may be one the supervisors can look at the definition and see we we can add so those venues are allowed to participate and have music can fall under the jurisdiction of entertainment commission. >> can i clarify whiechdz and are - >> i specifically have in mind england side their driving some of the businesses to connect one a a cycling they don't have food or beverage but want to
12:03 pm
participate and currently don't meet the definition but maybe something applicable. >> great, thank you. >> all right. is there is there any additional public comment seeing none, public comment is closed item number 2 is revenue and approve the minutes from march and february 3rdrd. >> i want to move to approve under is a motion is there a second. >> are we approving both or one unless you want to split them. >> i remove my motion and to bifurcate the minutes. >> any public comment? >> take a vote. >> commissioner chief administrative officer no way a vote to bifurcate the minutes.
12:04 pm
>> commissioner moshoyannis commissioner joseph commissioner lee commissioner frost commissioner tan. >> the motion passes so let's. >> that case i'd like to move to approve the minutes of february 3rdrd. >> is there a motion and a second any further discussion or changes any public comment? >> same house, same call? >> all right. with that the motion passes like to entertain. >> no, it can't be. >> can't be the same call we have a new commissioner that was not here on february. >> not on the february 3rd minutes i'll call the question of the first motion commissioner cavanes you need to abstain. >> say abstain so commissioner moshoyannis commissioner joseph commissioner lee
12:05 pm
commissioner frost commissioner tan. >> all right. >> perfect. >> let's entertain the motion for march third minutes any anyone want to - >> one expression. >> all right. >> adding commissioner cavanes to the roll call. >> all right. any other changes or - edits no so let's take a motion with that one change >> i make a motion to accept the minutes of march third and second i know this is exciting all right. so >> commissioner frost commissioner lee commissioner joseph abstain commissioner moshoyannis commissioner cavanes and commissioner tan and our minutes are passed all
12:06 pm
right. so the next item is election of the vice president we're missing a vice president for the last several meetings with commissioner hyde absent so i'm happy to entertain a motion. >> i'd like to nominate commissioner moshoyannis. >> there's a motion and nomination for a nomination is there a second we can discuss it and take a vote if anyone is moved to do outcomes you'll have to get 4 votes for a new vice chair a second to the motion so we can at least discuss it. >> i'll make a second. >> is there a motion and a second. >> can the president not second the motion when there's a second like this only curious. >> i don't know. >> i don't know the answer.
12:07 pm
>> i think he can make and check the motion actually i'm not sure. >> i'll have to get the answer that's not how we've been returning this for sometime. >> also commissioner moshoyannis i don't care if you like to make a statement on your candidacy. >> i was asked by you i know that with the absence there's a need to fill the position so certainlyable and willing for support the commission in had that role there is a lot of great work that needs to be done i'm happy to help in that role. >> just to clarify is this just until july. >> yes. >> so not for a year out just to complete the term all right.
12:08 pm
>> any questions or commissioner lee. >> so is it okay i mean do without commissioner perez. >> we only need 4 votes. >> we have quorum so we don't have to wait any other thoughts from commissioners any public comment? on who should be you're next vice president? all right. >> steven i'll say and show up and commissioner moshoyannis has a deeper understanding on a lot of the issues and he's able to provide a lot of clarity that was a good selection if we wanted to be vice president the commission will be better for
12:09 pm
it. >> thank you. any other members of the public who would like to speak so let's take a vote. >> okay. on the motion and second. >> commissioner frost commissioner lee commissioner joseph commissioner moshoyannis i vote on myself. >> okay. i. >> commissioner cavanes and commissioner tan. >> congratulations we have a new vice chair i'm going to leave this meeting now (clapping.) all right. thank you for stepping up for that so the next business item is a report from the staff and our sound inspectors. >> just to clarify i was out on vacation last week and there wasn't a whole lots of things not on the agenda so the director's report seems redundant i'm going to go ahead
12:10 pm
and have the sound effectors do a brief overview of what's been going on in the last couple of weeks. >> thank you, director cane and commissioners we have a street food park so it's at 428, 11th street filing a little bit less than one a month permits they do beer festivals and occasional live music and they filed a fairly late application for the past saturday and in speaking with the mission district police we learned that there has been calls for a complaint regarding sound coming from that area i approached from howard and their was automobile
12:11 pm
so i located two individuals with a permit on hand i introduced them to the condition that a permit event (laughter) wrap up. >> the condition that outdoor event can't be 5ub9 past 2 hundred feet i advised them how they might measure that moving forward so to encourage them to apply much further for events we have a couple of new classrooms 298 right around the same area newly opened 0 was i'll be going by and making sure that everything
12:12 pm
is closed up making sure there's no leak during my sound inspection there was a couple of suggestions about the roof so i'll talk with them so see if the work was done and it seems as though another agencies around the city have been taking an active roll in coming to me with some after hours events like the bayview station and the city attorney there's a lot of communication that is not something we're directly involved in but like to work with the police and city attorney's to make sure that if things are being a nuisance to but surrounding neighbors so that wraps up my report any questions?
12:13 pm
>> just 2 quick street food park you mentioned it was missions pd wouldn't that be mission on the border you mentioned a late permit we mentioned cut off we need to revisit that and give the staff authority to deny late permits within a certain timeframe where can we put that up for a vote soon. >> it was discussed at the end of last meeting i wasn't here i had to leave early i'll agenda kids that but good point. >> that didn't relate to the after parties. >> now just comments on the food park. >> i think that it maybe two separate things but i think that putting a deadline on a request
12:14 pm
was more for special nights; right? not 8 nights lining like halloween or new years eve that wasn't - >> yeah. >> 11 or something like that i forget. >> commissioner joseph. >> so it is incredibly difficult to limit sound to two hundred and 50 feet sound tracks if there's nothing to stop it like a building or if you know street food is it traveled sound down the street down van ness or howard that is hard to stop it left lanes unless there are short speakers like go 12 or 15 feet but from me if they iran ran a sound system it is hard to enforce that so i'm not sure you
12:15 pm
know how we beale deal with that did you just ask them to turn it down. >> i did they were not responsive in case like the dj was very interested in turning it back up almost immediately but it sound system in particular they used for the event was overkill i also noticed that was a large structure in between the main strip on 11 before howard before howard and the food street. it seemed like a good barrier for sound not to travel past the structure but it sound like it took vibration and passed that along
12:16 pm
any questions about the illegal after-hour event i know the time stamp are in the average is that when the reports came in >> correct. >> do you know what time those parties were. >> they were not on view yet those are just when the reports came in our office. >> i haven't found necessarily any of the pirates are starting bra one a.m. maybe between 1 and 2 and sometimes as late as 3. >> okay. >> thank you. >> thank you. >> inspector poly. >> a couple of issues we an illegal party on brandon basically seemed like it was under control and sunday night i got a call anothers 1025 payrolling approximately they jammed a band into a spates and had a party so i think what's
12:17 pm
going to end up happening if we liaison with the southern police department we're going to play a cat and mouse game the next findings to write them a letter and maybe involve the city attorney compliance issue the box sf at the do a lot of events different types of events this is not a permit this was 55 a complaint not a po e and in an area that's not zoned for entertainment so i talked with the owner and basically told him that he needed to get into contact with the planning department and figure you know that situation out before we can talk about permitting he agreed i should be hearing from him taken place
12:18 pm
soon and we're going to pick up and go from there we'll keep you abreast several permit updates the contact information and figuring out if people need permits for expired permits stuff like this but i imagine to walking wait to discuss the square they're up on the agenda we'll deal with that issue if you have any questions i'll be happy to field them. >> commissioner lee. >> 77th brand is that in a commercial or office spates or apartment. >> it is so 787 is like a garage with you like a it was like redeveloped from maybe being an industrial kind of use
12:19 pm
building into half condos so say is basically condominiums and space that is turned into. >> do they have music there. >> i'm not sure. >> i think south of harrison but it is a residential not like they have a - >> yeah. a lot of things they have to do. >> right. right i mean, i'll definitely look at that and go through the zoning maps and try to fought but right now they call it a community gathering the last time i went by i hung out they explicit know what it was offering it was just a little gathering i'm not sure about that but i'm going to go by and make contact with the people and talk with accident complainant i'll probably get
12:20 pm
the names. >> so is 77 brandon a residential house. >> yes. >> are they charging to get in. >> from what i've seen they have not been charging but i gathered sometimes, it depends on the gathering. >> so at the serve alcohol. >> yes. >> thank you for the report. >> so the commission knows so the commission can understand as the director and just based on the history of what we hear and do hear i'm inclined to look at the places but as far as digging in and figuring out was their zoned that's not our job we're not here to honor the underground and shut it down we're here to make sure that people provide responsible
12:21 pm
hospitality and there's a looefd that's why you heard shawn describe his work with the police department our work is not to go after unpermitted underground events we care about them but it is not our job to run around and play cat and mouse. >> but the compliments come into him. >> they certainly do we work with other agencies that have more to do do with this to try to bring them into compliances or make them clear about the rules that's where i feel like our resources need to end. >> why is it you're using the city attorney rather than issuing the citation. >> those are code compliance problems. >> we have to get a cu or.
12:22 pm
>> it's not a permit violation. >> okay. great. >> any other questions for our inspectors if not opening it up for public comment any public comment on the crazy things happening in the city all right. in public comment we'll move on to item 5 we have a guest to discuss that i'm going to turn it over to director cane a to introduce this to the commissioners. >> good evening i've been talking about this in a vague terms for that sometime now and i'm happy connor is here to present this legislation that we hope will not only protect places of entertainment from the potential of complaints by the
12:23 pm
incredible number of new resident coming up but allowing the entertainment commission to get into the communication without explaining firefighter i'll have connor explain and walk though how this came about and this is in terms of the legislation i gave you guys a copy you can walk through with him you can drill him with questions. >> please good evening connor legislation aid to london breed we had so much fun working with jocelyn and cammy we thought how can we spend more time with them as the entertainment commission i want to congratulate newest commissioner commissioner cavanes am i saying that right. i saw her at the rules committee you faced two other strong
12:24 pm
candidates so congratulations and i'm butter you up more before we go on to the legislation you know it was a tough one the truth is we starting looking at want relationship between new residential development and night time vupdz because of the rad major building the independent as well as supervisor breed were concerned this could say put immunizations on elements in the community an they might the the sound like work or shutting do you think that's concerning that got us thinking about citywide as jocelyn mentioned as the city it
12:25 pm
creating more and more housing in neighborhoods that were commercial or light industrial we're seeing the housing in conflicts with a long time scrawny and seen a lot of venues go out of business club come back month and accident sound like factory the leksz ton club and the bottom of the hill facing pressure and lucky 18 maybe displaced entirely by housing those face different circumstances that are unique no director heinecke denying that housing is transmitting to the pressures on night time so we have to make sure they both co-exist just to emphasize that if you look at the controllers report a couple ever years ago bars and venues asia that's right bring $800 million in spending and 43 percent of the
12:26 pm
bay area resident from outside the city that visit san francisco do so primarily to visit one of the establishment their incredibly important culturally and social your dedicating our time to serving the industry we sat down with cammy and jocelyn and residential venues and police department and planning the department of building inspection and benadryl van how have the legislation is a product of the communications and the many many city attorney hours i wanted to walk you through i'll give a high-level for the most part the entertainment commission and the planning department will create and maintain a map of all the to e in the city when a residential
12:27 pm
plan is presented the developer will be notified the entertainment commission will go be notified as well and have the opportunity to hold a hearing on the relationship too the probation officer e we tweaked with the planning to mull if i and make sure the planning commission has enough time to submit their represents to planning and deploying on how to make sure those two constitution o exist the second major aspect of the legislation if the probation officer e is operating within the terms of the permit the terms the city has asked them to comply with the city is asking a venue and it is doing so we have a responsibility to allow them to continue this is an important aspect and thirdly before a resident an owner or
12:28 pm
leaser moves into a new residential unit they'll be notified by the landlord or seller so there's a disclosure please be advised there's a music venue that may impact you there that maybe noise and people on the sidewalks know that and jocelyn made good comments that she interactions with people that come to the commission because they toured a residence on tuesday afternoon they move in and friday night is a different story ultimately we want people to be happy as well as allow the venues to continue to operate and the fourth component is your commission actually have has the authority of the police code to modify the
12:29 pm
increase of the amount of sound we want to say if there's conflicts between a new venue the entertainment commission can exercise that authority and here's criteria to evaluate lounge has the probation officer been there so we can clarify the process so there are options rather than the restrictions on the venue that's been in the neighborhood for a long time this is ultimately about starting the communication and bringing the venue and aprons to the table how can we preempt problems that are commissioner pating's and we want to protect the venues but at the same time as i said we want to make sure that people are happy in their homes as the city is rushing to build housing in the new neighborhoods and existing neighborhoods like visa did care we want to protect the reason people are living here in the
12:30 pm
