4:35 am
asked me to speak to a recent news article that enhance with the law times about our in time status in california and decision by the franchise tax board to revoke the exemption from the state next door i'd like to read a couple of bullet points on background and i'll entertain any questions you have or the public has so as is noted the franchise tax board revoked blue shield's exception from state next door that occurred in around august of last year that was broadly recorded on or announced by the franchise tax board and i should note we're appealing that decision but our nonprofit status is not related to whether we pay state
4:36 am
or federal taxes we'll remain a nonprofit consistent with our mission decision of the franchise tax board is not unique, in fact, many plucking and blue shield plans federal and state tax and also others pay state taxes i'd like to remind the board as part of the mission that as a result of our 2 percent pledge in 2012 we've returned to our members and consumers over half a billion dollars, in fact $550 million to our customers and members including work cc sf and as a reminder for all that was a pledge to cap our operating income at 2 percent that means we project at the
4:37 am
given of every year our trends and at the end of every year we look at claims and expenses and if there's money left over we remain 2 percent to reinvestment systems and such and anything above that we return to again, our members and customers and even when we began doing that in nevada we were the only health plan in the united states that made such a exempting commitment in addition the blue shield has donated over $225 million to strength the safety net in 2014 we made over 4 hundred and 80 grants to public services agencies to help support the safety net but after legislated i didn't negotiations the franchise tax board took the action because of the level of the revenues that
4:38 am
stand at $4.2 billion we or less made a acquisition to enter the medal department by care first a nonprofit with about 5 hundred thousand members we do accept the care acquisition to close that significantly reduce our reserves because we're a nonprofit and can't raise money from vefrdz we rely on the receivers such as the care first acquisition after the acquisition blue shield reserves will be at a level that independent actual riders is to maintain a a rating with the agencies and an a rating is required to make sure we can continue to do business with other large employers including calpers and i'll
4:39 am
finally lists my statement we believe p we have 3 foundational as a nonprofit one to be mission driven we're mission driven to make health care affordable for all californians you've heard about that with the ac co patrons that will spill over into our exerts within the health deliver systems number 2 to be a good corp citizen the work we do is far greater than our executors certainly in california and finally it be a good set the record straight of the resources i'm pause and entertain questions about the excise tax board mission.
4:40 am
>> any questions before the commissioners i would ask a broad question regarding the facts filings information on the running the company so you do file a 990 naenl; is that correct. >> i believe so i'm not that close to the tax filings. >> someone going to our website be able to identify the top 5 paid officers in the company. >> i don't believe so but i do believe we're required to file that that the irs. >> that is done through a 990 my understanding are there any descriptions of executive pay or perks or bonuses on our website or other public documents. >> i have not i don't believe it is on the public website and i won place i haven't looked is our annual report which
4:41 am
should include information i'm certain. >> i'm raising those questions you and i both know this is the in the public mind show you guys sweltered away the money and do what you do i want to try to get those issues there is some public documentation your rearview mirror required to speak to 0 factually rather than speculation. >> federal filings. >> yep and that's the point of clarification. >> other comments or questions from the board if you'll stand by we'll be having public comment and maybe questions you might want to respond to. >> yes. director dodd. >> for the record do you have a federal nonprofit status.
4:42 am
>> yes. we maintain we are at our corporate filing both state and federal. >> your 990 filings okay stand but there's no future questions any public comment on this item. >> yeah. the question of reserves came up for blue shield now i'm wondering how does that related to compensation for choses do the executive compensation go up or the letters while they went adopt this is something i want to know and a lot of other people want to know. >> thank you for your comment. >> other public comment? >> thank you members sitting next to me had a
4:43 am
letter noifs her many of her efficiency might not be eligible there's a contract negotiation there is a lot of treatment and with specialists and very concerned i want to know which health plan will they receive a letter and which health plan is the negotiations going on and is that for members offering them specialities or physicians will be available. >> thank you that was not directed at blue shield i'll ask director dodd. >> our members are required to summit what they have sending out i have no knowledge of that letter i can follow-up. >> okay. so if you care to make any final comments. >> no, just thank you for
4:44 am
allowing us the time to address there is a lot of misinformation in the public about the articles that have been written in the media i think the probability the one i think is most accurate is one written by the sacramento business times that lays out other health plans and other organizations that have not-for-profit status and he fine line that lays between the nonprofits like kaiser or sutter or other heartache plans not-for-profit and features identified in that article. >> thank you very much for your time i hope this edifies the conversation getting into the weeds. >> item 17. >> discussion item opportunity to place items on future
4:45 am
agendas. >> any items from the board or public comment on this item >> hearing none item 18. >> item 18 discussion item opportunity for the public comment to comment on any matters within the board's jurisdiction. >> any public comment? on this item? >> a question of clarification i hope it isn't awkward i don't attend these as i eyed to do in the past i noticed by the rates for my drug prirpgsdz went up for blue shield i go to walgreens drug store and suddenly much higher was this vote on by the board to increase the rates what exactly is going on i want information on that. >> i was ask you to raise that
4:46 am
question we've indeed improved the rates for this year there were increased. >> yes. >> maybe in our particular plan like i said, i don't want you to disclosure all our information. >> if you could consultant with the director after the meeting. >> i found out the hard way. >> thank you. any other public comments? on item 18? hearing none i'm ready to teenager a closed session on the appeal >> i make the motion on closed session for the member appeal. >> we have a motion all opposed by the same sign
4:47 am
4:48 am
. >> all right, good morning, everyone, welcome it our rules committee meeting of april 9, 2015. my name is katy tang, i'm vice chair of the committee. i know our chair, john avalos, will join us shortly and to my left is supervisor maria cohen.
4:49 am
>> please silence cell phones and all electronic devices. items acted upon today will be on the april 21 board of supervisors agenda unless otherwise stated. >> thank you, madam clerk, please call item 1, please. >> item no. 1 is a hearing to consider appointing one member to the bicycle advisory committee term ending november 19, 2016 or the tenure of the nominating supervisor, whichever is shorter in duration. there is one seat and one applicant. >> thank you, since we have one applicant for the seat we can call up miss magy up and give us a presentation. >> hello, supervisors, my name is ilyse magy and i am interested in seat 9 on the bicycle advisory commit ee. i work as an artist and organizor and focus on pedestrian advocacy and alternative transportation in both my
4:50 am
professional and personal life. i currently work as an organizer with sf advocacy riders, we work to improve public transportation in san francisco. i also volunteer with walk sf, creating projects to bring forth project vision zero. i have lived in san francisco since 2008. i first moved here looking for a city that had a robust public transportation system, since i came from metro detroit, where we really don't be have one, so for a year i relid on muni because i was terrified of even riding a bike in a parking lot, but slowly i realized biking is a great way to get around in san francisco. i had some good allies that taught me how to ride in the streets and now it's half of my main mode of transportation. so i feel that on the bac i could really serve as an advocate for multi modal transportation.
4:51 am
i first heard about the seat opening on the bac through the bicycle coalition news letter and it piqued my interest but when i talked to someone on the committee who informed me there are only men currently on the committee i knew i had to change that by applying. so not only do i feel i could advocate for multi modal transportation users, people who are maybe otherwise afraid to get on their bikes but could do so with the right encouragement but also women who have specific challenges with biking, i think i could be a good representative for all of those. >> great thank you. and if you can just speak a little bit about are there any specific goals that you'd like to achieve if you are able to be appointed to this committee or like to see the committee take on that they currently have not? >> yeah, i think the bac is really taking on a lot right now. i admire their work. vision zero is something i'm very passionate about. i think that with the bac, too, i think
4:52 am
there is a way that they could take more steps in encouraging people to get on their bikes or to use different modes of transportation and i think that it's a little bit easy ier for men to get on their bikes and go into traffic because sometimes it can be a harrowing activity and i think there are issues they are not seeing, specific challenges where biking is just terrifying. having someone on the committee who can keep an eye out for not just current riding issues but future riding issues, keeping an eye on future problem spots in the city that are not working. >> yes, it is challenging biking in a skirt. okay, great, do we have any other questions or comments from committee members? seeing none, i think we will open this item up to public comment. any members of the public who wish to speak on item 1? please
4:53 am
come forward. >> good morning, supervisors, i am peter strauss, i'm on the board of san francisco transit riders. when one is in the position you are in i know you can get leery when faced with a solo kapbld daes. ilyse should be appointed to this position not only because she is the only one applying but because she is an outstanding candidate. i have known her for about a year, she said she's been working for the transit riders as a consultant and i found her to be extremely energetic, creative, intelligent. she is perfect for this. as she said, she is a multi modalist, i have never seen her in a car but she is very assertive as a bike rider, she is a transit rider and a pedestrian and i think that
4:54 am
combined perspective is something that would serve you and serve the bicycle committee very well and i urge you to support her candidacy. thank you. >> any other member s of the public who wish to speak on item 1? seeing none, then, public comment on item 1 is now closed. we are now joined by our chair, supervisor john avalos. welcome. would you like to take over now? >> let's take over. i thought we all took over already. thank you, sorry i'm late, i had some medical stuff with my family but everything is good so thank you for your patience and thank you, my colleagues, for getting started. so we are on item no. 1? >> through the chair, we just concluded public comment on item 1. i would be happy to make a motion to appoint and move forward ilyse iris magy
4:55 am
for seat 9 for the bicycle committee. >> although i wasn't here for public comment, i have reviewed the file and i am fine with that motion. we will take it without objection. i believe we're actually going to be pausing on item no. 2, hearing that last, is that correct? they are still working on amendments for that legislation so let's go to item no. 3, please. >> item no. 3 is a hearing to consider appointing 7 members for one year terms to be determined by the energy efficiency coordinating committee. there are 7 seats and 7 applicants. >> i believe all the applicants are here, it's an issue of some folks not having all the right letters to back them so we won't be able to move everyone forward who perhaps qualifies today, but we'll get started. why don't we go on to the first applicant, who have been
4:56 am
avni jamdar. >> good morning, supervisors, i am avni jamdar, director of emerald cities, san francisco bay area. i'd like to thank supervisor mar and the staff for supervising this staff and getting us to this point. emerald city has been involved in efforts to get to this point. we believe this committee will have great value in creating a more navigable and concerted platform for energy efficiency platforms and resources in san francisco county. emerald cities is a national organization, we work together to advance a sustainable environment by creating greater economic opportunities for all. we are transforming the energy efficiency sector in a high road way by retrofiting building stock, creating jobs and revitalizing the local
4:57 am
economies of our region. so i am applying for seat 3 but i could qualify for 1 or 2 as well. in san francisco we have successfully demonstrated a project for energy efficiency retrofit with a community work force agreement that we negotiated with the building trades and community at the table that ensured high road labor, community on ramps through career track jobs. we work closely with the building trades, work force training programs like the conservation corps, city built academy, housing developers like mission housing and others, investors, community-based organizations like bright line, sf organizing project, city agencies so we have valuable experience in the energy efficiency sector and we know (inaudible) i also serve on the citizens advisory committee of the sfpuc, specifically on the power subcommittee so i am familiar with the energy efficiency programs and policies at the
4:58 am
sfpuc so our experience would help inform policy and programs and resources of the city and county. we'll have moving forward, especially with the cap in trade dollars and have a strong community driven perspective so i hope to serve on the committee. >> thank you very much. in terms of your work with emerald cities, (inaudible) we appreciate your stepping up. thank you. we can go on to our next applicant. i don't have all the names of who is here but i think sam moss is next. mr. moss. >> good morning, supervisors, thank you for this opportunity. i really appreciate being able to come forward and put my name and mission housing in general on to this application. mission housing development corporation, of which i serve as the executive director currently is a 44-year-old
4:59 am
affordable housing developer that currently houses and serves over 3,000 tenants in the san francisco area, mainly in the mission district. we focus on energy efficiency and sustainability in all things that we do. most currently in the 10 year program of which we're in the third year is a preservation project. we're going through approximately 1,000 of our units to rehab them with a focus on energy efficiency, sustainability, and the long-term preservation of affordable housing. i believe that my role as executive director of mission housing and before that the director of asaid management over the portfolio will provide valuable insight to the committee, mainly on using funds as efficiently and intelligently as possible in order to make sure that any upgrades or efficiency standards that are completed
5:00 am
also last for decades to come. >> great, thank you. mr. moss, it's been a number of years that mission housing has been actively in the role of developing housing. i think the last project was the valencia gardens that had been started in a previous man manifestation of mission housing and you are new as executive director, what do you see for the coming years for mission housing in terms of where it's going to put its energy towards maintenance or we're actually looking at mission housing playing a larger role in the development process and, if so, what are the projects that you see moving forward? >> well, certainly as far as maintenance goes, like i said, we do have approximately 32 buildings. and so first and foremost the 1700 units
